SEPARATE OPINION of JUDGE DE CASTRO 1 Have Voted in Favour of the Advisory Opinion Because It States That There Are No Ties of S
SEPARATE OPINION OF JUDGE DE CASTRO [Translation] 1 have voted in favour of the Advisory Opinion because it states that there are no ties of sovereignty between the territory of Western Sahara and the Kingdom of Morocco and the Mauritanian entity, and that the principle of self-determination should be applied to the said territory, thereby giving a correct, clear and conclusive reply to the real questions put to the Court. On the other hand, 1 cannot go along with the Advisory Opinion either in its statement regarding the existence of other legal ties between the territory and the Kingdom of Morocco and the Mauritanian entity, nor in al1 its reasoning. In order to justify my vote, 1feel obliged to set out my separate opinion below. 1. Origins of the Case For the sake of clarity and to avoid repetitions, 1 think it as well to refer to the more important features of the background to the case before the Court. The ultimate origins of resolution 3292 (XXIX) of the United Nations General Assembly can be traced back to the determined activity of a most extraordinary personality, Si Allal El Fassi, to whom must be attributed Morocco's interest in the expansion of its frontiers. It would seem that, around 1956, Moroccans firmly believed that the Sherifian Kingdom did not extend beyond the Wad Dra'a. Government ministers were unaware even of the existence of the southern region of the Spanish Protectorate '. El Fassi, on the other hand, even before Morocco's independence, was advocating the reconstitution of Greater Morocco, by claiming, on the basis of Morocco's historic rights, Mauritania, Rio de Oro, the Sakiet El Hamra, part of Algeria - Tindouf and Colomb-Béchar- and part of Mali. -

A significant number of well-established human rights obligations apply in the three quarters of the territory that is under Moroccan occupation. International law contains clear prescriptions for the protection, political independence and advancement of the Saharawi people, who were the original inhabitants of Western Sahara, then Spanish Sahara, until they were abandoned by Spain in 1975. Foremost is the right of self-determination of non-self-governing peoples. The norms prescribed by the International Covenant on Economic, Social and Cultural Rights have been consistently violated in occupied Western Sahara. This submission for the Committee on Economic, Social and Cultural Rights has been prepared by Western Sahara Resource Watch, an international non-governmental organization, based in Brussels. It is intended to highlight the significant failure of Morocco as the occupying power or State with responsibility for the territory of Western Sahara and the Saharawi people to ensure even the most basic compliance with the International Covenant on Economic, Social and Cultural Rights. -

More than 50 7o of moroccan population lives in these areas.Nevertheless, these regionsface severewater shortageswith limited and highly erraticrainfall. High risk of drought occufrence over and within years is common. Temperature regimes,shallow erodedsoils and croppingof marginallands aggravate moisture deticits. Farming systemsare complex and heterogeneouscombining crops and livestock. Traditional cultural practices are often inappropriate. The lack of adequateand appropriateinfrastructure to make agriculturalinputs availableand to store excessproduction limits progressof technology.The potential of increasedagricultural production and farm income does exist and it is far from being realized. The case of the United Nations’ efforts to mediate an end to the seemingly intractable conflict in the Western Sahara is particularly instructive. Several mediators have been The United Nations and employed over the duration of this effort, with the most important being former U.S. Secretary of State James Baker from 1997 to 2004. His efforts as the UN’s mediator are Western Sahara highlighted in this report. During this mediation Baker was the secretary-general’s personal envoy on Western Sahara. The author of this Special Report, Anna Theofilopoulou, was A Never-ending Affair ideally placed within the UN system to both observe and participate in this mediation effort. She covered Western Sahara and the Maghreb region in the UN’s Department of Political Affairs from 1994 to 2004. Abstract The oases of the Draa are part of the biosphere reserve recognized by UNESCO, 2000. These oases are agro systems located in the Saharan region of southern Morocco. They are the main sources of livelihood of the indigenous population. The sustainability of the oasean system for centuries has made him a rich and resilient ecosystem. Despite its aridity and isolation, the population had always been able to adapt and optimize natural resources, which are scarce.
