To Whom It May Concern:
As a result of the unforeseeable, dramatic changes caused by COVID-19 and the resulting state of emergency in California and the impact it is having on our business operations, as of close of business Friday May 15, 2020, the employees on the attached list will be furloughed from the Clubs and Theaters division of Live Nation Entertainment, Inc (*Clubs and Theaters" or "Company").
In an abundance of caution, the Company is providing you with this notice to the extent this is considered a "termination,* 'mass layoff' or "site closing," and applicable laws require it, under the California's Worker Adjustment and Retraining Act, found at Labor Code sections 1400-1408. Assuming that business conditions improve and that govemment officials permit the live concert industry to reopen those events to proceed, however, Live Nation is hopefui that the actions it is taking are temporary and that these employees will be able to return to work in the near future
The decision to furlough the employees in this division was a direct result of COVID-19, which has rapidly spread throughout California necessitating updated and more stringent public health measures. This includes Governor Newsom's Executive Order N-33-20 issued on March 17, 2020, which instructed all Californians to stay at home or at their place of residence unless they work within certain limited sectors of the economy. Because of Executive Order N-33-20, and orders issued by local authorities, the Company's ability to operate was impeded. The fact that the live concert business would need to remain closed as long as it has was not reasonably foreseeable until recently when the ongoing impact of COVID-19 on the concert industry became more clear. For that reason, we were unable to provide 60 days' notice that we would otherwise provide regarding these furloughs, and we are providing as much notice as is practicable given the rapid pace at which this situation has developed.
All affected employees have been notified of their furlough from employment and that it is expected to be temporary Those employees in the positions described below have been informed in writing that they may be eligible for Unemployment Insurance, per Governor Newsom's Executive Order N-31-20 (dated March 17, 2020). Attached is the list of the job positions and number of individuals who will be furloughed from Clubs and Theaters effective close of business May 15, 2020.
There will not be any bumping rights for affected employees—that is, employees will not be able to displace more junior employees out of their job positions as a result of this venue closure. While there is no union representation at these locations and for these employees.
