NFL Commissioner’s Authority Study Guide Ray Rice The Incident On Feburary 15, 2014, Ray Rice and his fiancée Janay Palmer were arrested on assault charges following an incident at an Atlantic City casino. 1 At the time, Rice’s attorney described the event as a “minor physical altercation.” Later that week, footage was released showing Rice drag Palmer’s unconscious body by her hair.2 Over the following months: • Ravens’ personnel publicly declared they would stand by Rice throughout the process;3 • Rice was indicted on aggravated assault charges;4 • Rice married Palmer prior to his trial date;5 • Rice rejected an offered plea deal and applied for a pretrial intervention program;6 • Prosecutors accepted Rice’s application into the program, and the altercation will not appear on his record assuming completion of the program and that Rice has no further legal issues – applications to the program were accepted in only 1% of domestic violence cases over the previous four years, according to Outside the Lines;7 • The Ravens held a press conference for Rice and Palmer, where Rice apologized for the situation and Palmer apologized for her “role” in the situation too – this resulted in significant media backlash for Rice and the Ravens;8 and • Rice and the Ravens met with Commissioner Goodell for the discipline hearing The Disciplinary Hearing and Suspension In the hearing, Rice’s wife pled for Commissioner Goodell to not overtly punish Rice for his actions, while Rice’s portrayal of the event has been a point of contention between Ravens’ personnel and Goodell since.9 1 “Everything You Need To Know About the Ray Rice Case,” Rebecca Elliot (http://time.com/3329351/ray-rice- timeline/). 2 “Ray Rice Dragging Unconscious Fiancee After Alleged Mutual Attack,” TMZ Sports. 3 Steve Bisciotti Show Compassion for Ray Rice, Ryan Mink (http://www.baltimoreravens.com/news/article- 1/Steve-Bisciotti-Shows-Compassion-For-Ray-Rice/7ae432d7-bebb-4d41-981d-3166b525981c). 4 “Ray Rice indicted for aggravated assault in domestic violence incident with fiancée,” Louis Bien (http://www.sbnation.com/nfl/2014/3/27/5555054/ray-rice-arrest-assault-domestic-violence-fiancee/in/5191279). 5 “Ray Rice marries Janay Palmer amid assault case,” Jeff Zrebiec and Justin Fenton (http://articles.baltimoresun.com/2014-03-29/sports/bal-20140329_1_ray-rice-rice-and-palmer-janay-palmer). 6 “Ray Rice offered plea deal in aggravated assault case,” Louis Bien (http://www.sbnation.com/nfl/2014/5/1/5672288/ray-rice-plea-deal-aggravated-assault-janay-palmer/in/5191279). 7 “Program Ray Rice in is rarely granted,” John Barr and Don Van Natta Jr. (http://espn.go.com/espn/otl/story/_/id/11514871/judicial-figures-show-ray-rice-deal-offered-rarely). 8 “Ray Rice is an a****** and the Ravens couldn’t care less,” Ryan Van Bibber (http://www.sbnation.com/nfl/2014/5/23/5745888/ray-rice-wife-apology-assault-domestic-violence-ravens). 9 “The Ray Rice Fallout,” Peter King (http://mmqb.si.com/2014/07/25/ray-rice-nfl-suspension-ravens/). Approximately five weeks later, Goodell announced that Rice would be suspended for 2 games and fined $58,000 for conduct detrimental to the league, a similar punishment given to those for previous related incidents – though none of the previous incidents had video footage.10 NFL Releases New Domestic Violence Policy As a result of pressure from fans, league sponsors and the media, the NFL released a new policy to determine suspensions for those involved with domestic violence. The policy, which applies to all NFL personnel, stated that first-time offenders would serve a 6-game suspension without pay, while second-time offenders would receive a lifetime ban.11 TMZ Releases Full Elevator Footage, Goodell Reconsiders Suspension On September 8, 2014, TMZ released the full elevator footage, showing Rice brutally hitting Palmer before dragging her out of the elevator back to their room. The release brought about a wave of outrage from most, and immediately questions were asked regarding whether Goodell had seen the footage prior to making the 2-game suspension.12 Later that day, the Ravens released Rice, stating that he had not been honest regarding what actually occurred in the elevator.13 The Ravens, the NFL and Commissioner Goodell all denied having seen that footage prior to its release.[14][15] The Associated Press reported that the NFL had received the footage in April, but could not confirm that Goodell himself had seen the footage. Goodell received a great deal of criticism for his handling of the situation, with some calling for his resignation, particularly after Outside the Lines reported that Rice was very graphic and entirely honest during the disciplinary hearing in June.16 Goodell announced, after reviewing the full footage, that Rice would be suspended indefinitely.17 Two days later, the NFL announced they would conduct an independent investigation into the 10 “Ray Rice suspended 2 games by NFL after assault arrest,” Louis Bien (http://www.sbnation.com/nfl/2014/7/24/5824682/ray-rice-suspension-assault-ravens). 11 “NFL announces new domestic violence policy,” Katie Sharp (http://www.sbnation.com/nfl/2014/8/28/6079465/nfl-announces-new-domestic-violence-policy). 12 Ray Rice assault video makes NFL’s punishment look even weaker,” Ryan Van Bibber (http://www.sbnation.com/nfl/2014/9/8/6120881/ray-rice-video-tmz-nfl-ravens). 13 “Ray Rice’s contract terminated by Ravens,” Jason B. Ray Rice situation, with a focus on the NFL’s handling of evidence – in particular, the video footage inside the elevator.18 Rice Appeals the Suspension Rice appealed the indefinite suspension, likening the situation to double jeopardy, since he was essentially punished twice for the same incident.19 Judge Barbara Jones was announced as the presiding arbitrator over the appeal, since the NFLPA asked Goodell to withdraw himself because of his role in the suspension and as a witness to the case.20 Goodell testified for over two hours, but further information is not available due to the gag order on the proceedings.21 Judge Jones overturned Rice’s suspension and forced the NFL to immediately reinstate him because it was shown that Rice did not misrepresent the facts to the Commissioner and, without the 6-game standard suspension already in place, an indefinite suspension was excessive and without cause.22 For more information on the situation, visit the SB Nation Timeline. Adrian Peterson The Incident Following a routine doctor’s visit, signs of child abuse were discovered on the son of Adrian Peterson.23 A police report was filed, and in August, Peterson was called to testify before a grand jury – Peterson was not indicted. A week later, Peterson was indicted for reckless or negligent 18 “Ex-FBI director will head independent investigation into Ray Rice situation,” Matt Conner (http://www.sbnation.com/2014/9/10/6134377/ray-rice-evidence-nfl-independent-investigation-fbi-robert- mueller/in/5191279). 19 “Ray Rice appeals indefinite suspension,” Marc Sessler (http://www.nfl.com/news/story/0ap3000000396009/article/ray-rice-appeals-indefinite-suspension). 20 “Former U.S. District Judge Barbara S.
