House Bill 1050 Introduced by: Representatives Reed, Anderson, Barthel, Blare, Chase, Hoffman, Keintz, Perry, Tidemann, and York and Senators Otten (Herman), Duhamel, and Zikmund Todd Vik 367-7909 An Act to modify certain publishing requirements in official newspapers. This bill modifies certain publishing requirements in official newspapers. For larger newspapers (circulation over 9,000), this bill increases the current allowed fee per column inch from $5.93 to $6.00 ($493 or 0.9%), sets in statue an annual increase of the lesser of 2% or inflation, increases the font size from 6pt to 9pt ($24,350 or 48.7% -- not exactly 50% as part of the District cost is a flat $10.00 fee for the newspaper filing the required affidavit for proof the minutes were printed), requires public entities to pay for a message indicating the minutes can also be found on line at a central depository (estimated increase with the additional pt size for this new required language is $884 or 1.8% b), and allows newspapers to print their required number of issues to be eligible to be a legal newspaper online instead of in print.

Position: The District opposes this bill. The Sioux Falls School District currently spends almost $50,000 per year on legal notices. This bill will increase that amount to approximately $75,725 or 51.4%. Since the internet became ubiquitous years ago and many local governments have been posting minutes

on their internet sites, those governments have been petitioning the Legislature to drop the requirement that they continue to pay to print them in local newspapers with declining circulation. The primary arguments against these bills were twofold: 1) not everybody has access to the internet, and 2) if the minutes are only stored on the local government’s website the local government can nefariously change them without the public having access to the original copy. Ironically, this bill flies in the face of both those arguments as follows: 1) it allows legal newspapers to establish their required number of “printings” by posting them online, and 2) establishes a centralized online clearinghouse where local government minutes are stored. Therefore, this bill should be hoghoused to eliminate the requirement for local governments to “print” their minutes in a local newspaper and instead require that they be posted on Open SD or some other 3rd party governmental site. The notice stating the minutes are available at each local government’s website and on Open SD can still be printed in the newspaper.

This bill would place into law the rules for schools to be designated a Purple Star school. The Purple Star school program is designed to help schools respond to the educational and social- emotional challenges military-connected children face during their transition to a new school. The school would be required to have a military staff liaison designated along with duties this person would need to complete to assist the students referenced. . Position: The District takes no position on this bill. The Sioux Falls School District assists all students and families in the process of acclimating to a new school by having established transition practices in place to address the unique needs of student mobility.

This bill prohibits the transfer of any wind energy tax revenue to the capital outlay fund, bond redemption fund or the capital projects fund of a district. . Senate Bill 49 Introduced by: The Committee on Appropriations at the request of the Bureau of Finance and Management Todd Vik 367-7909 An Act to revise property tax levies for school districts and to revise the state aid to general and special education formulas. This bill increases both State Aid formulas by 2.4 percent per the Governor’s budget address. This is 0.9 percent above the formula’s stated index factor of 3 percent or inflation whichever is less. Also adjusts both formula’s maximum property taxes to maintain the state0wide share between property taxes and state aid in both formulas. Position: The District supports this bill. The 2.4 percent increase will allow school districts to increase teacher (and other employee) compensation by an amount that somewhat keeps up with State Employee increases and provider increases. The additional 0.9 percent, if passed, would mean that, over the ensuing five years, the per student allocation will have increased 0.4 percent more than the statutory index factor increase since the ½ cent sales tax increase. This is a positive trend as 3 percent or inflation, whichever is less, does not keep up with private sector or state employee compensation increases over an extended period of time.

Senate Bill 68 Introduced by: Senators Heinert, Foster, and Smith (VJ) and Representatives Pourier, Bordeaux, Haugaard, Jensen (Phil), Randolph, and St. John at the request of the Committee on State-Tribal Relations Brett Arenz 367-4670 An Act to provide for the creation and funding of Oceti Sakowin community-based schools. This bill would allow an Oceti Sakowin charter school to apply for sponsorship from any school district or the state Department of Education. If approved, the charter school would receive a pro rata share of all funding received by the district in which it resides. The bill allows for noncertified teachers to provide instruction in a Native American language if they hold a Lakota, Dakota, or Nakota language permit. Position: The District opposes this bill. A school district already has the ability to operate a school in accordance with Oceti Sakowin Essential Understandings and Standards if they wish. Section 5 requires a contractual agreement between the sponsoring district and the charter school setting forth the legal requirements of the charter school. If the legislature desires to place legal requirements on a private nonprofit corporation operating a charter school with public funds, it should do so by passing laws, not by abdicating its responsibility to school districts. This contract would provide insufficient accountability for the private nonprofit corporation operating the charter school. The bill requires a school district send pro rata share of all funds, but still requires the school district to provide special education services. This conflicts with Section 18, which prohibits discrimination in the admission of students based on a student’s special needs. If the bill is not attempting to exempt the charter schools from any state laws or accountability, what is the purpose of the bill?
