WHEREASil is expedient to reconslitule the Jadavpur University lo enable ir to function more efficiently as n University encouraging and providing for inslrucuon, leaching, mining and research in various branches of learning and courses of study, promoting advancement and dissemination of knowledge and learning, and ex tending higher education, to meet he growing needs of society and to make he consritution of various auhorities or bodies oflhe University more democratic consislent with the objectives of the Na~ionalCouncil of Education, Bengat and fie Dawn Society; 11 is hereby enacted in he Thirty-second Year of the RepubIic of , by the Legislature of West Bengal, as follows:-

CHAPTER I Preliminary

1. (1) This Acl may be called he Jadavpur Universi~yAct, 198 1. shon tirlc and , ...... ( 14) "prescribed" mcans prescribed by S talutes, Ordinances, Regulations or Rules made under lhis Act:

(1 5) "Principal" means the head of an Institution, by wharever name called;

(1 6) "regislered graduale" means a graduate registered under this Act, at least lhree months prior to the date of eleclion of mcmbers to the COUFI,on application in the prescribed form and on payment of a fee of one rupee:

Provided chat no person shall be eIigible to bc registered under this Act unless he has graduared himself horn the University at least lhree years prior to the date of election of members to the Coun;

(17) "Sb~ures","Ordinances", "RegulaLions" and "Rules" mean. respectively, the S~nlutes,Ordinances, Regulauons and Rules of he Unjversiry made undcr this Act:-

(18) "Students' Union" means,-

(a) in rehiion to the University, the S~udcnls' Union consti~u~edin the manner prescribed; and

(b) in relation to an affiliated college, [he Studenls' Union constituted in the manncr prescribed;

(19) "Teacher" mcans a Professor, Reader, Principal, kcturer, Demonstrator, Tutor or any orher person, appointed or recognised as such by the Univesily, either whole-Lime or par[-time, Tor he purpose of imparting ins~ructionor conducting research in heUniversity or in an lnsli~uuon;

(20) "Universi~y" means the Jadavpur Universily as cons~ituted under lhis Act;

(2 1) "University Labaralory", "University Library", "University Museum" or "Universi~yInslitution" means a laboratory, n library, a museum or an instilution, as the case may be, and managed by the Universi~y,whehcr established by il or not. T~IEJaduvprrr Uttiversirjl Act, 1981.

CHAPTER n

The Univcrsily and ils omcers

Thc 3. (1) The firs1 Chancellor and he firs1 Vice-Chnnccllor of he Univcrsi~y. Universily and the firs1 members ofthe Courl and the Execulive Council, and all persons who may hereafrer become heChancellor or [he Vice- ChancelIor '[or the Pro-Vice-Chancellor] of llie University or [hemembers of rhc Court or rhc Execurivc Council, so long as they continue lo hold such office or membership. shall consti wte a body corporate by the name of [he Jadwpur University. (2) The University shall have perpetual successon and a cammon seal and shall sue and be sued by Ihc name of thc Jdavpur University.

Powcrs ot 4. The Universiry shaIl have (he rollowing powers, namely:- rhc Univmiiy. (1) Lo encourage and providc for ins~ruction,teaching. training and research in all branches of enginedng, technology, humanities and science '[and in such olher branches of learning and courses oisrudy as it may think lit. and generally to promore] ~hcadvanccment and dissemination of knowledge and Icarning and he exlension ol higher educarion;

5. '(1) Save as hereinafter othcnvise provided, ~hclocal limits of ','Eyi:iclion ,., jurisdiction of the Universily (hcreinafrer referred lo as the terrilorial Univcrsiry. lirni~sof the University) shall cxlend to an area lvilhin n radius of rhrcc and a halFkiIometers from Ihc place where [he Universily has its orficcs. '(2) Norwilhslanding anything conlnincd in sub-seclion (l), any college or Institurion sirualed beyond the tcmtorial limits of lhc Universily may, wirh [he sanction of lhe State Govcmmenl, apply lo the University for affiliarion or recognition or any course or courscs of s~udy(leading to any degree, diploma or ccrlilicnre of [he Univcrsity) coaducted by the college or Instilution, u rhc case may be, and the Univeaily may, subjccl lo such condilio~lsand resrriclions as it may with lhe approval of Ihc Slate Governrnenr rhink lic LO impose, affiliate co ilself, or recognize the coursc or courses of study conducled by, such collcge or Insti tution and admit the college or ~hcInstilu~ion, as thc case may be, lo 311 Ihc privileges of thc Univerisly.

6. The University may detegare such of its powers as it )nay deem D~I~~~,~~,, expedient lo any of the authorities referred [o in scclion 15 or to any Of ~\~crb- of its officers, and may, at any lime, withdraw any power so delegated.

7. The following shall bc the orficers of [he Universi1y:- orficcr~of Lhc (1) the Vice-Chancellor; Univcsity. ?(1A) the Pro-Vice-Chancellor; (2) the Registrar; (3) the Finance Officer: (4) persons holding such other posts as may be declared by Slatules to be posts of officers of Ihe Univcrsi~y.

8. (I) The Governor shall, by virlue of his orficc, be [he Chaocellor nc of the Universily. He shall be the head of the Univcrsily and [he President Ch"cccOr. of the Coun and shall, when present, preside ovcr Ihe meelings of lhe Coun. (2) The Chancellor shall exercisc such powers as may bc conlerred on him by or under the provisions or [his Act. (3) Where power is conrerred upon the Chancellor lo make nominations to any authority or body of [he Univcrsity, the Chancellor shall, lo the exrent ncccssary, nominale persons Lo represen1 i~~tereslsnot otherwise adcquateIy represenled.

(3) The Vice-Chancellor shall be a whole-lime oiricer of the University md shall be paid fram chc Universi~yFund such salary and allorvances as lhc Cltancellor may decide in consul~ationwith the S~atc Government. (3) The Vicc-Chancellor ]nay resign his office by wiring under his hand addressed lo the Chancellor.

Provided rhal if the aclio11 taken by rhe Vice-Chancellor is not approved by the authority or body concerned. the matrershnll immediately be relerrcd to lhe Chancellor whose decision thereon shall bc final. (3) If, at any rime during [he period of probation, the probarioner's work is no1 considered saiisfaclory, [he probationer shall be discharged by the aulhoriry concerned.

Tribunal. 31. (3) The Tribunal may call lor any record, repon or other information rrom the Universily if, in its opinion, such record, reporl or athcr inrorrnution is necessary for efficient discharge of -i ts iunclions, and thc Univcrsi~yshall furnish such record, report or other infonnation to he Tribunal. CHAPTER IV

General provisions governing all authorities or othcr bodies or the Univcrsity.

32. (1) No person shall be qualified for cleclio~~or nominulion as Disqualilica- a mcmber of any authority or body of the University or shall mnlinuc lions* as such member if hc- -(i) is of unsound mind or a dcar-mute, or (ji) js an undischarged insolvent, or (iii) hus been convicted by a cowl or law far an ~rrenccinvolving rnorar lurpi~udc. Ccssaiion of 34. (1) When a person is qualified to be a member of any aulhoriry mcrnbcrship in ccnain or body of the University by virtue OF his membership or any other cxsc-5. auihority or body, he shall cease robe a mcmber 01thc aulhorily or body of [he University when he ceases to be s member of the other. (2) When n pcrson is elected or nominated as n member of any aulhoriry or body of rhe University from any constiruency, he shall cease to be such a member when he ceases lo belong lo that conslituency.

Thc 39. The Universily shall have n fund ro be known as heUniversi~y Univcsiry Fund. Fund to which shall be credited all its income rrom fees, lines, contriburions, '[granrs,] donnlions, loans and advances and from any othcr sourcc wharsocvcr. 1. (1) This Act may becalled theJadavpur University (Amendment) rilk and Act, 2000. commcncc- mcnt. (2) It shall come into force on such date as the State Govemmcni may, by notificadon in heOflcial Gazene, nppoint. 2. In sub-section (I) of section 3 of the Jadavpuf University ACI, Alncndrnen~ of scclion 3 1981 (hercinafler referred to as the principal Acl), after the words "or ,r we;, Ben, Lhe Vice-ChancelIorl', the words "or hePro-Vice-Chancellor" shall be AcL XXLV 01 1981. inserted.

3. In sec~ion7 of the principal Act, after clause (I), Ihe follo~ing Arnendrncnl clause shall bc inserted:- orsection 7.

(I) The pro-vice-chancellor shall be appointed Chmccl'or- by the Chancellor in cpnsullalion with heMinister and the Vicc-ChmcelIor. The term of his office shall be for four years and he shall be eligible Tor rc-appointment for a period not exceeding four years but shall not hold oflice beyond he age of 65 years. (2) The Pro-Vice-Chancellor shall be a whole-lime officer of he Universily and shall be paid from the Universiry Fund such salary and allowances as the Chancellor may decide in consultation with the State Government. (3) The Pro-Vice-Chancellor may resign his office by writing under his hand addressed to the Chancellor. (4) If- (a) [he Pro-Vicc-Chanccllor is, by reason of leave, illness or olher cause, lemporarily unable 10 exercise hepowers and perform Ihe duries of his office, or (b) a vacancy occurs in the office of the Pro-Vice-Chancellor by reason of deah, resignation or expiry of heterm of his office, removal or orherwise, then, during thc period of such temporary inability or pending the appoinlment of a Pro-Vice-Chancellor, as the case may be, the Chancellor, in consultation with the Minister and the Vice-Chancellor, shall auhorise Ihe Dean of the Faculty Council for post-graduate and undergraduate studies in Engineering and Technology to exercise he powers and perform the duks of he Pro-Vice-Chancellor. (3) The Pro-Vice-Chancellor shall, by vime of his office, be a " member of the Court, the Executive Council, and ihe Faculty Council for post-graduate and undergraduate studies in Engineering and Technology and such other committees of the University as may be required under the provisions of rhis Act or the Statutes. He shall also attend the meetings of the Faculty Council for post-graduate and undcrgraduale studies in Science, if he Vice-Chancellor considers il necessary. He shall preside over he rneeling of the Faculty Council for pox-graduate and undergraduate studies in Science, if the Vice- Chancellor is absent in such meeting. (4) The Pro-Vice-Chancellorshall exercise such other powers and perform such other duties for the development and improvement of all adminisrauvc and academic matters conducled in the campus of the University as may be delegaled lo him by he Vice-Chancellor or as may be prescribed or as may be delegaled lo him by or under any provisions of this Act.".

6. In sub-secuon (1) of seclion I6 of Ihe principal Act, after clause (ii), he following clause shall be insened:-

"(iia) he Pro-Vice-Chancellor, ex oflcio;". I 7. In sub-section (I) of section 19 of heprincipal Act, under the Amendment orsection 19. heading "(a) ex oflcio menrbers", after clause (i). the following clause shall be inserted:-

"(j a) hePro-Vice-Chancellor;".

8. In sub-seclion (3) of section 21 of the principal Act, after Amendment clause (i), he following clause shall be inserted:- of section 21.

"(ia) the Pro-Vicc-ChancelIor-Vice-Chairman;".

9. For sub-section(2) of section23 of heprincipal Acl, the following Arncndmcnl sub-section shall be substituted:- or section 23. "(2) The Dean shall be elecled by the members of Ihe Faculty Cauncil from amongst ~hernselves.The Dean of Ihe Faculcy Council far post-graduate and undergraduate studies in Arts and the Dean of the Faculty Council for post-graduale and underpduale sludies in Science shall be the Vicc-Chairman of the respeclive Faculty Councils.".
