Comments: I object to Application Number 15/12363/OUT for the following reasons:

This application should be rejected as it is not deliverable.

A major reason for the suspension of the Site Allocations Plan on 11th November 2015 was the deliverability of identified development sites.

This site is totally dependent on the delivery of a link road. Therefore the proposal is not sustainable development since it fails to address the phasing and delivery of the North Chippenham Consortium site, especially the link road therein.

The ELR is necessary for the development to avoid an unacceptable impact upon surrounding road junctions and traffic movements across Chippenham as a whole.

Such impacts would be contrary to policies CP3, CP10, CP61 and CP62 of the Core Strategy (2015).

This application should be rejected as it has an unacceptable impact on the tranquil nature and landscape of this area.

The proposal would have an unacceptable impact upon the tranquil nature of this part of the countryside, the setting of listed buildings at and Tytherton Lucas as well as its relationship to the nearby villages of Langley Burrell and Tytherton Lucas. The proposal is therefore contrary to the provisions of policies CP10, CP51, CP52 and CP58 of the Wiltshire Core Strategy 2015, the NPPF as well as section 16(2) and 72(1) of the Planning (Listed Building and Conservation Area) Act 1990.

The application should be rejected as it brings about coalescence between Chippenham and the surrounding villages, contrary to NPPF Policy.

The farmland within which the application site lies serves to physically separate the settlements of Chippenham with Langley Burrell and Tytherton Lucas. The issue of settlement coalescence and recognising the intrinsic character and beauty of the countryside is an important planning consideration (NPPF Para 17, bullet 5), in addition to the grade and quality of agricultural land lost to development (NPPF Policy 11, para 112). This issue of coalescence has been raised as concerns by local residents as well as the local Parish Councils.

The application should be rejected as it is premature to be determined before a full Ecology Report can be produced by

The application relies on an ecology report provided by the developer, as Wiltshire Council has not produced a detailed ecology report of the area.

With respect to the areas of the River Avon within the Chippenham Site Allocations Plan, Evidence Paper 5: Biodiversity July 2015 admits that further work is needed to assess the areas of the Rivers Avon for protected species and priority habitats.

It is surely premature for any masterplan to be approved before a full independent ecological survey is carried out, looking at the areas both east and west of the Avon, by Wiltshire Council.

The application should be rejected as it maximises damage to the environment of the River Avon and River Marden

The Rivers Avon and Marden are identified as a Priority Habitat (Running Water) in the Wiltshire and Swindon Biodiversity Action Plan.

The River Avon has a designated SSSI in the Neighbourhood Plan area just north of the confluence with the River Marden . – Tytherton Lucas, River Avon SSSI (grid reference ST945750) is a 4.1 hectare geological Site of Special Scientific Interest, notified in 1998. Located 3 miles north east of Chippenham, this SSSI is of geological interest as the banks of the River Avon expose Callovian highly-fossiliferous sandstone which contains well-preserved bivalves, gastropods, brachiopods, belemnites and ammonites.

The Bristol Avon Catchment Plan – January 2016 shows the waterbodies within the Neighbourhood Plan Area as “moderate” under the EU Water Framework Directive. Any waterbody not reaching “good” ecological status has to have plans to address this by 2027. This applies both to the River Avon and River Marden within this development.

This application is therefore contrary to the provisions of Policy CP50, CP51 and CP68, as well as saved Policy H4 of the North Wiltshire Local Plan 2011. In addition NPPF paragraphs 109,117 and 123. And finally EU Water Framework Directive - Directive 2000/60/EC of the European Parliament and of the Council.

The application should be rejected as it is premature to be determined before improvements are made to J17 of the M4

The application fails to set out a scheme that would ensure the delivery, at the appropriate time, of the necessary improvements to J17 of the M4 so as to render the Strategic Road Network safe. As such, the application would not meet the requirements of policies CP10, CP62 and CP66 of the Wiltshire Core Strategy (2015).

In light of the above and with reference to all relevant planning applications at Chippenham (including this one), Highways have requested that a “Grampian” type planning condition be imposed that expressly prohibits development taking place until a detailed scheme for the improvement of J17 has been agreed and completed.
