  • IN RE: SOCIETY INSURANCE COMPANY COVID-19 BUSINESS INTERRUPTION PROTECTION INSURANCE LITIGATION MDL No
Case MDL No. 2964 Document 88 Filed 10/02/20 Page 1 of 6 UNITED STATES JUDICIAL PANEL on MULTIDISTRICT LITIGATION IN RE: SOCIETY INSURANCE COMPANY COVID-19 BUSINESS INTERRUPTION PROTECTION INSURANCE LITIGATION MDL No. 2964 TRANSFER ORDER Before the Panel: At its July 2020 hearing session, the Panel considered two motions seeking centralization of an industry-wide litigation involving insurance claims for coverage of business interruption losses caused by the COVID-19 pandemic and the related government orders suspending, or severely curtailing, operations of non-essential businesses. We denied the motions, concluding that the differences among the many insurers would overwhelm any common factual questions and hinder the transferee court’s ability to efficiently manage the litigation. See In re COVID-19 Bus. Interruption Prot. Ins. Litig., MDL No. 2942, 2020 WL 4670700, __ F. Supp. 3d __ (J.P.M.L. Aug. 12, 2020). In the briefing on those motions, several parties proposed that insurer- specific MDLs be created. We concluded that we needed “a better understanding of the factual commonalities and differences among these actions, as well as the efficiencies that may or may not be gained through centralization, before creating an insurer-specific MDL.” Id. at *3. So we ordered the Panel Clerk to issue orders directing the parties to certain actions involving a common insurer or group of insurers to show cause why those actions should not be centralized. One of those orders encompassed the 21 actions listed on Schedule A, which involve claims against Society Insurance Company (Society). Since we issued this show cause order, the parties have notified us of thirteen related actions filed in seven districts.1 Plaintiffs in ten of the 34 actions support the creation of a Society MDL in the Northern District of Illinois.

  • Annual Report 2019 Honoring Our Promise
Honoring our promise. Growing with purpose. TOGether Annual Report 2019 Honoring Our Promise Insurance is a unique product. We sell a promise, and it’s a promise that customers hope they never have to use. Yet as a mutual insurance company, honoring that promise when the need arises is the core of what we do. In 2019 the employees and agents of Society Insurance were presented with many opportunities to honor the promise, and met that challenge admirably. Society saw a record number of losses in many lines of business this past year and a total dollar amount of direct losses that was also, unfortunately, a record. Winter weather losses resulting from last year’s polar vortex were followed by summer storms that affected thousands of policyholders. There was also an unusual frequency of large fire losses and catastrophic Workers Compensation injuries. Our employees and agents stepped up to honor the promise with distinction. Following severe summer storms in central Wisconsin involving hundreds of policyholders, over 90% of claims were paid and settled within 12 weeks. After a large fire affecting a medical clinic, payments of over $2 million were in the policyholder’s hands in less than a week. That policyholder included Society Insurance in a full-page thank-you ad in the local newspaper for our role in helping them continue their business. The treatment plan developed for a worker who suffered a catastrophic spinal cord injury ensured he would be transported to the top facility in the country to begin his recovery. Another worker who suffered a traumatic brain injury achieved a degree of recovery few anticipated at the time of his accident.

  • 2020 Annual Report
resiliencE Annual Report 2020 Finding Opportunity in Adversity Winston Churchill once said that “A pessimist sees the difficulty in every opportunity; an optimist sees the opportunity in every difficulty.” The global pandemic of 2020 set difficulties in front of us that could not have been imagined as we began the year. But I’ve been humbled to see how our employees, agents and policyholders have found the opportunities in those difficulties to keep moving forward. It’s also been inspiring to see how we have supported each other to manage these difficult times. The small business owners that Society insures have never seen a more challenging environment. In many cases, the way they had to do business was completely upended. While some unfortunately were not able to survive, most did, and it was due to innovation, creativity and a deep desire to serve their customers. It has been so very impressive. Independent agents had to address their own challenges as business owners, but they also needed to be there for our common customer, the policyholder. Their role as a risk consultant expanded at times to include providing advice on how best to access government aid programs, and sometimes to simply be an empathetic listener for customers. The value they provided won’t be soon forgotten. Society’s employees rose to the occasion to support policyholders and agents, in most cases from a new work-from-home environment. The regular tasks of running an insurance company continued uninterrupted and we adapted as needed. Payment forgiveness was provided to policyholders struggling with cash flow, and then customized payment plans were developed to make catching up easier.
