1. INTRODUCTION

A. Background

∑ The State of Uttarakhand suffered from major cloud bursts, incessant rains and major floods in the upper valleys during 15-17 June 2013 that resulted in severe damages in several parts of Uttarakhand. The districts of Chamoli, Rudraprayag and Pauri were directly affected by this disaster. These regions are among the country’s most important pilgrimage centers and the calamity occurred during the peak pilgrimage season. Several roads and bridges have been washed away by the unprecedented flash floods and landslides. A large number of houses, public buildings, roads and bridges, urban and rural infrastructure has been damaged. To restore and rebuild the damaged infrastructures, especially the road connectivity network in the state, the Uttarakhand Emergency Assistance Project (UEAP) has been taken up which envisages rehabilitation and reconstruction of state roads and bridges, tourism infrastructure (including construction of helipads and trekking routes), urban roads and buildings.

∑ Through the implementation of the UEAP the expected outcome will be economic and social recovery from the disaster in Uttarakhand State.

∑ Broadly, the works in Garhwal region comprise restoration of the road to its original shape with the clearance of slip and construction of retaining and breast walls, drains, crash barriers and improvement of riding surface by resurfacing through cement concrete and BM / SDBC. These will be constructed as per MORD / MoRT&H Specifications and as per the IRC guidelines. The Program will improve road connectivity and will improve the quality of life of the poor in the project influenced areas. The strengthening and rehabilitation of road will be restricted to affected lengths and alignments of proposed subprojects.

B. Need for the Subproject

∑ The subprojects under consideration have been taken up for restoring the damaged road networks spread over different parts of Chamoli District including the towns of Joshimath and Karnprayag. These subprojects provide connectivity to urban as well as rural areas of Chamoli District and after restoration both local people and pilgrimage and sports tourists from outside will be well connected with all-weather road networks in the region.

∑ Chamoli District road networks provide key connectivity to a number of famous Hindu pilgrimage centers including two revered shrines of and of the Char Dhams. These roads provide connectivity to Badrinath shrine and also many other revered temples like Narsingh Temple, (Gopinath) Temple, Tunganath Temple, etc. Restoration of these roads will help reviving the connectivity to these pilgrimage centers. Moreover, Auli, a winter sports destination is also connected through the subprojects.

∑ The details of the proposed subprojects have been provided below.

∑ There are altogether 10 roads of Chamoli District which were considered under UEAP funded by ADB. The affected stretches of these 10 roads have been taken up as Contract Packages C-7, C-8, C-20, C-21A, C-21B, C-32, C-33, C-49, C-50 and C-51 for rehabilitation and upgradation.

∑ Initially, Resettlement Plans (RP) has been prepared for the subprojects C-20, C-21A and C-21B.TheseRPs mentioned that there were no Involuntary Resettlement (IR) impacts. Later during implementation stage, field visits and public consultations have been carried out in these subprojects between December 2015 and March 2016which reconfirmed no IR impact in these subprojects.

∑ Contract Packages C-7 comprises of two parts, Nandprayag-Ghat Road and Rudraprayag-Pokhri-Karnprayag Road. The total length of the Nandprayag-Ghat road is 18.490 km and affected road length covered in this project is 14.000 km. This road connects Chamoli and Ghat. The total length of the Rudraprayag-Pokhri-Karnprayag road is 75.510 Km and affected road length covered in this project is 14.510 Km.

∑ Subproject C-8, known as Chamoli-Kund Road, is an important road off-shoot from NH 58 near Chamoli Town and traverses through hilly terrain up to Kund Colony bypassing Gopeshwar Town. The total affected length considered under this subproject is 22.600 km.

∑ The proposed subproject C-20 is an urban road passing through Joshimath Town till Auli, a famous location for winter sports that attracts domestic and international sports lovers. The details of the subproject have been provided as follows.

∑ Package C-21 has two parts of which one comes under Karnprayag Town (Nagar Panchayat) and the other under Joshimath Town (Nagar Palika).

∑ The proposed subproject component of Karnprayag Town is formed of four small stretches of roads mentioned in the following table.

∑ The other component of C-21 is an urban road passing through Joshimath Town as presented in the table below.

∑ The Rudraprayag-Pokhri-Karnprayag Motor Road (SH), considered as subproject C-32, is one of the most important roads in district Chamoli and Rudraprayag which was also badly damaged during this natural disaster. The total length of the motor road is 75.510 Km and affected road length covered in this project is 10.000 km (includes km 43, km 44, km 46, km 47 and km 59 to km 76). The entire area is known for producing fruits & vegetables and the affected motor road is used as bye pass during blockage of NH 107 & NH 58.

∑ The Tharali-Dewal-Mundoli Road (C-33) is one of the most important roads in Chamoli District which was also severely damaged during this natural disaster. The total length of the road is 37.700 km and affected road length covered in this project is 20.870 km. It connects Tharali and Dewal Blocks. This road is also en route for Raj Ghat Yatra.

∑ Subproject C-49 is one of the most important roads in Chamoli District badly damaged during the natural disaster of 2013. It has two road stretches comprising the Karnprayag- Nauti-Paithani Road and Gauchar-Sidholi Road. The total length of the Karnprayag- Nauti-Paithani road is 80.300 km and affected road length covered in this project is 11.000 km. The total length of the Gauchar-Sidholi road is 23.500 km. Karnprayag- Nauti-Paithani road is used as en route for NH 58 during road blockage due to land slips and pilgrimage seasons when the traffic is high.

∑ The Karnprayag-Nainisen Road (C-50) is an important road in Chamoli District which was badly damaged during the natural disaster of 2013. The total length of the motor road is 26.000. This road connects Karnprayag with Nainisen.

∑ The Pokhri-Gopeshwar Road (C-51) is one of the most important roads in the district of Chamoli which was severely damaged during the 2013 natural disaster. The total length of the road is 30.000 km and affected road length covered in this project is 24.400 km. This road is also en route for NH - 58. This road is designated as a State Highway.

2. LOCATION OF THE SUBPROJECT

7. The subproject roads pass majorly through rural areas and some through urban human settlements like Karnprayag and Joshimath Towns with a varying formation width (see Figure 1). At places, the roads pass through hilly terrains where landslide and slip occurs especially during monsoon season

3. OBJECTIVES OF THE SUBPROJECTS

8. The main objectives of these subprojects are to reinstate the road networks of Chamoli District and also to revive the regional road network damaged due to the natural calamity of 2013.

4. SCOPE OF THIS SUBPROJECTS

9. The ADB funded UEAP project covers the scope of reconstruction of the subprojects C-7 (Nandprayag-Ghat Road and Rudraprayag-Pokhri-Karnprayag Motor Road (SH)), C-8 (Chamoli-Kund Road), C-20 (Joshimath-Auli Road), C-21A (Internal Roads under Karnprayag Nagar Panchayat), C-21B (Approach Road to Narsingh Temple under Joshimath Nagar Palika), C-32 (Rudraprayag-Pokhri-Karnprayag Road), C-33 (Tharali- Dewal-Mundoli Road), C-49 (Gauchar-Sidholi Road), C-50 (Karnprayag-Nainisen Road) and C-51 (Pokhri-Gopeshwar Road). The restoration of the total affected roads of is 51.130 km which is to be done within the existing road carriageway.

The scope of this subproject includes restoration of the roads with WBM (G3), profile correction by BM, resurfacing by SDBC in heavily damaged blacktop portion of the roads, restoration of traffic signs, markings and appurtenances. All these need to be carried out under MORT&H/MORD specifications.

11. A photographic documentation of the subprojects has been presented in Annexure 1.

5. REQUIREMENT OF DUE DILIGENCE REPORT

12. The subprojects have been taken up for reconstruction of the Chamoli roads. In line with the scope of UEAP, the subproject is envisaged as fast track and has been planned to provide easement to the existing but severely damaged portions of the road network within the current ROW. There is no scope for widening any stretch but to restore and reconstruct the roads within the road carriageway. Thus, these subprojects do neither require land acquisition nor do these impact any structure along their courses. Moreover, all the roads pass mainly through rural areas where there is no major settlement only except the towns of Karnprayag and Joshimath along the roads. All along these stretches no commercial establishment / shop has been affected due to implementation of the subprojects. Thus, there is no impact on livelihoods of the people living along these subprojects.

13. Keeping the above information in view and the subproject requirements there is a need to go for a due diligence to check all compliances according to the guidelines and norms set for the implementation of this subproject.

6. SCOPE OF LAND ACQUISITION AND RESETTLEMENT

14. In these subprojects there is no land acquisition. Since the reconstruction and restoration works are being carried out only within the carriageway width of the existing roads, there is no land acquisition in implementing the subproject. Thus, these road subprojects (C-7, C-8, C-20, C-21A, C-21B, C-32, C-33, C-49, C-50 and C-51) have no P a g e | 14 Due Diligence Report (Social): All ‘C’ Category Roads of Chamoli District SMEC India Private Limited

adverse social impact related to land acquisition or impact on privately / publicly owned structures.

15. In the event of any unforeseen adverse impacts on traffic flow or day-time business of roadside shops or vendors, road reconstruction works will be taken up in night shifts following two instructions from the EA between 5.00 p.m. to 10.00 p.m. The first letter (Letter No. 1343/02/UEAP/PWD/2015 dated 18/09/2015 issued by the CE, ADB UEAP (R&B) (Annexure 2)) stated that daytime road resurfacing and related construction activities in urban roads, densely populated / market areas would hamper traffic flow which would affect the running of schools and offices along the roads as there would be no alternative route for them, restrict access to shops and mobile vendors carrying out business along the road and would thereby result in loss of livelihoods for the commercial establishments. Hence, it was decided to carry out construction activities in urban areas after 5.00 pm and during night. In another letter (Letter No. 15702/UEAP/PWD/2015-2016 dated 27/01/2016 issued by CE, ADB UEAP (R&B) Dehradun appended as Annexure 3) specific guidelines have been recommended to continue works only till 10.00 p.m. from the time the shops are closed. These restrictions have also been advised in road construction activities especially near residential areas, schools and hospitals.

7. PROJECT IMPACT AND OUTCOME

16. The outcome of the subproject will be mainly restoring the road network which is vital for the movement of the local people with a wider objective of restoring social and economic life in the region. Better infrastructure of roads would encourage reviving the pilgrimage and winter sports tourism in this part of Uttarakhand State which in turn would boost the income earning opportunities for the local people in tourist business.

8. INDIGENOUS PEOPLE

17. Compared to national average of above 8%, only around 3% of scheduled tribes (STs) are present in Uttarakhand state. They are mostly concentrated in Dehradun and Udham Singh Nagar Districts that are less affected due to the disaster of June 2013. Chamoli District has insignificant concentration of ST groups or indigenous peoples (IP). No IP population is impacted in Chamoli District due to implementation of these subprojects.

18. However, in case any unforeseen, direct or indirect impact on tribal communities being identified during any stage of the project implementation, all the measures will be taken as per Indigenous Peoples’ Policy Framework to minimize impacts on them. This subproject will definitely support economic growth of local communities including Tribes (in case they are).

9. GENDER ISSUE

19. There is no affected woman headed households (WHH) since there is no IR impact. However, Gender Action Plan (GAP) provisions will be taken care of to bring women of the subproject areas in the mainstream in due course of the project implementation.

10. GRIEVANCE REDRESS MECHANISM

20. The EA has established a mechanism to receive and facilitate the resolution of APs concerns and grievances about physical and economic displacement and other project impacts, paying particular attention to the impacts on vulnerable groups.

21. The grievance redress mechanism intends to address concerns and complaints of APs promptly, using an understandable and transparent process that is gender responsive, culturally appropriate, and readily accessible to the displaced persons at no costs and without any retribution.

22. A Grievance Redress Committee (GRC) has been formed at the PMU Level of UEAP. The GRC is a voluntary body and will continue to function, for the benefit of the APs, during the entire project cycle. The contact information of GRC are:

11. PUBLIC CONSULTATION

23. At the initial stage, during end of 2014, public consultation was carried out by the concerned Department (PIU) and DSC-2 consultants to disseminate project information and awareness creation about the project among the road users and local communities. Roadside shopkeepers and residents have been consulted. The public consultation revealed that the majority expressed happiness that the subprojects have been taken up to restore / rehabilitate the affected road networks in Chamoli District.

24. At a later stage during December 2015 to March 2016, public consultations have been conducted in all C Category roads in the district Chamoli. Package-wise the brief outcomes of these consultations have been provided below.

∑ On 6th March 2016 public consultation was held at Mohan Khal (Ch. 43+500 km) on C-7 (Rudraprayag-Pokhri-Karnprayag Road). The local people welcomed the project and were satisfied with the works done. 5 men participated. They requested for a speed breaker at their location and it was noted by the field engineer.

∑ Public consultation was held at Thirpak (Ch. 6+750 km) on C-7 (Nandprayag-Ghat Road) on 7th March 2016 where people praised the quality of road works. 3 persons participated all of whom were men. However, they requested for drains to be constructed along the village area and a speed breaker for the safety of the school going children. This was noted by the field engineer.

∑ In the public consultation held on 7th March 2016 at Kotiyal Ser (Ch. 2+300 km) on C-8 (Chamoli-Kund Road), all the 4 men attendees mentioned that the recently constructed underground sewer lines were of no use and they requested for roadside drains for passage of rain water during monsoon. They requested to have speed breakers made properly with better materials rather than a concrete one. This was noted by the field engineer.

∑ On 20th December 2015 public consultation was intended to be carried out on C-20 (Joshimath-Auli Road) but could not be held residences or shops were found along the stretch. Moreover, commuters were also absent due to snow fall during the winter months.

∑ Public consultation was held at Karnprayag Town Upper Market on C-21A (Internal Roads under Nagar Panchayat Karnprayag) on 19th December 2015 where individual roadside shopkeepers have been consulted. These people appreciated the road works which have been already completed.

∑ Similarly, in public consultation held on 20th December 2015 at Joshimath on C-21B (Approach Road to Narsingh Mandir under Nagar Palika Joshimath) with individual shopkeepers, all of them expressed satisfaction about the road reconstruction works.

∑ On 6th March 2016 public consultation was held at Semiguad (Ch. 74+600 km) on C-32 (Rudraprayag-Pokhri-Karnprayag Road) where people raised issues of longitudinal roadside drainage and a causeway which is partially constructed. 5 men attended the meeting. The field engineer informed the public that both the drains and the causeway were under construction and would be completed before the rainy season.

∑ Public consultation was held on 8th March 2016 at Kedar Bagar (Ch. 1+820 km) on C-33 (Tharali-Dewal-Mundoli Road) along the . People were concerned about the works to be completed and the lower road to be functional before the rainy season. 4 men participated. The points were noted and explained by the field engineer that satisfied the attendees.

∑ Public consultation was held on 6th March 2016 with 5 local youth at Baunla (Ch. 6+500 km) on C-49 (Gauchar-Sidholi Road) who appreciated the road reconstruction works.

∑ On 8th March 2016 Public consultation held at Bishouna (Ch. 40+400 km) on C-49 (Nauti-Paithani Road) with the villagers. 4 men participated and were appreciative about the work as they look forward to bus services to reach their village with the road under construction.

∑ In the public consultation held at Bidoli (Ch. 10+525 km) on C-50 (Karnprayag-Nainisain Road) on 6th March 2016, 3 senior village men expressed their concern about usage of local low grade stones. Moreover, the villagers wanted causeways and drains to be constructed for fast passing of rain water. All these have been noted by the field engineer.

∑ Public consultation was held on at Sonelal Bachher (Ch. 48+100 km) on C-51 (Pokhri- Gopeshwar Road) at a village tea stall where 4 men participated. They have suggested for hill cutting to provide a proper and visible bend at the Temple location and an area on the road where water drops in multiple strands and keeps the area wet which needed to be considered for water channelizing in the road project. All these points have been noted by the field engineer who ensured addressing these issues from technical point of view.

12. CONCLUSIONS

7. In the subprojects C-7, C-8, C-20, C-21A, C-21B, C-32, C-33, C-49, C-50 and C-51 there is no scope of land acquisition. Since the reconstruction and restoration works are to be carried out only within the carriageway of the existing roads, there is no impact due to land acquisition in implementing the subprojects.

8. There is no adverse impact on income earning for roadside shopkeepers as these subprojects pass through scantily populated areas with no major settlements along their courses.

9. These subprojects do not have any adverse social impact on Indigenous Peoples or Tribal Communities.

10. There is no impact on any WHH.
