Redding* The issue of the case and the crimes it includes repeat what happened in the time of the Sodomites and the wrath that fell upon them. INTRODUCTION ¶1 In April 2003, at the 59th Session of the United Nations Commission for Human Rights (UNCHR) in Geneva, Brazil unexpectedly introduced a resolution for consideration that called upon both the United Nations and state governments to incorporate protection from persecution and discrimination on the basis of “sexual orientation” into their human rights practices and procedures.3 While this was not the first time that the relationship between human rights and protection from persecution and discrimination on the basis of “sexual orientation” had been discussed at the UNCHR, it was indeed the first time that a resolution had been proposed with such wide ramifications for member states vis-à-vis the protection of (non-normative) sexual orientations.4 Earlier, while still controversial, the UNCHR had only considered, and passed, resolutions that worked to protect people from being extra-judicially, arbitrarily, and summarily executed based on their sexual orientation. 5 This time, however, far more than the right to kill people based on their sexual orientation was at stake for UN member states. ¶2 Not surprisingly, the Brazilian resolution did not pass and, indeed, an international coalition of states worked strenuously to either delay consideration of the proposal or to kill it outright. Prominent in this somewhat-motley coalition were Pakistan (on behalf of the Organization of the Islamic Conference), the Vatican, and Zimbabwe.6 While these states did not succeed in getting the resolution voted down, their opposition was instrumental in tabling full consideration of the Brazilian resolution until the UNCHR’s 60th session in 2004.7 At this 2004 session, the Brazilian resolution was again 3 The text of the U.N. Comm’n on Human Rights, Postponement of Draft Resolution E/CN.4/2003/L.92 and the Proposed Amendments 437 NORTHWESTERN JOURNAL OF INTERNATIONAL HUMAN RIGHTS [ 2006 confronted with vocal opposition and a vote on the resolution’s substantive terms was put off for yet another year.8 At the 61st session in April 2005, the UNCHR again failed to discuss the resolution, and it has now completely fallen off of the UNCHR’s agenda, unless some state is brave enough in the future to affirmatively re-introduce the resolution for discussion. 9 ¶3 In consideration of the formidable opposition to the Brazilian resolution, and the very real possibility that it will not be revived in the foreseeable future, some important and urgent questions about future strategy and aims must now be posed. Considerable resources and effort have been invested in the struggle for the Brazilian resolution by some of the leading international gay and lesbian human rights organizations, including the International Gay and Lesbian Human Rights Commission, Amnesty International’s Outfront project, and Human Rights Watch’s Lesbian and Gay Rights project. While these resources and efforts have surely raised a great deal of international awareness of and collaboration on the problems that people with persecuted sexual orientations suffer, one must wonder if another course of action might generate these same benefits without the problems that come with the Brazilian resolution. Accordingly, now is the time to ask whether the Brazilian resolution (or any efforts like it) is the best way forward, and whether international human rights norms and practices (and resources) could be used more effectively to help protect the large numbers of those persons whose persecution is the ostensible target of the Brazilian resolution.

Conflicts among religious and ethnic groups have scored American cultural and political history. Some of these conflicts have involved campaigns of suppression against deviant religious and minority ethnic groups by the mainstream. Although the law has most often been deployed as an instrument of suppression, there is now a public law consensus to preserve and protect the autonomy of religious and ethnic subcultures, as well as the ability of their members to self-identify without penalty. One thesis of this Essay is that this vaunted public law consensus should be extended to sexual orientation minorities as well. Like religion, sexual orientation marks both personal identity and social divisions.' In this century, in fact, sexual orientation has steadily been replacing religion as the identity characteristic that is both physically invisible and morally polarizing. In 1900, one's group identity was largely defined by one's ethnicity, social class, sex, and religion. The norm was Anglo-Saxon, middle-class, male, and Protestant. The Jew, Roman Catholic, or Jehovah's Witness was considered deviant and was subject to social, economic, and political discrimination. In 2000, one's group identity will be largely defined by one's race, income, sex, and sexual orientation. The norm will be white, middle-income, male, and heterosexual. To be sure, today’s most fervent political and cultural debates such as abortion, contraception, same-sex marriage, transgender rights, pedophilia, and, most recently, sexual victimization lie within the perimeters of perhaps the ultimate taboo: religion and sexuality. Interestingly, whether the sacredness of religion is appropriated to approach sexuality in a beneficial or detrimental way, these two topics will forever intersect –sometimes in palpable ways, but also in ambiguous and unexpected manners. The interest of this course is to provide a safe and broad platform to critically discuss the complex and fluid intersections between sexuality and religion. We will address urgent and perennial questions from different religious perspectives, such as what is the spiritual meaning of sexuality? Is sexuality an obstacle or a vehicle for spiritual fulfillment? Who are the voices of authority who set the sacred rules on sexuality and who gets to enforce them? In this ambitious and interdisciplinary overview, we will analyze the intricate ways in which religion and sexuality have influenced each other over the last half century; and the variety of challenges that contemporary sexual practice and research pose to traditional religions.

  • Opening Global Spaces for Sexual and Gender Minorities
    Raising our Voices: Opening Global Spaces for Sexual and Gender Minorities By Kimberley Vance 1 I. Introduction This chapter will examine how movements of sexual and gender minorities have struggled (and succeeded) in raising their voices and issues within important spaces of global politics and civil society mobilization. Advancing discussions on issues related to sexual rights, and more specifically, sexual orientation and gender identity, has been challenging for these movements and their allies. Organizations have been actively excluded from regional and UN fora, and procedural obstacles have been used to prevent both them and their specific issues from receiving consideration on their merits. Despite the obstacles, and perhaps because of them, there has been remarkable development of regional and global networks and organizations. They have demanded a voice in global governance at least as far back as the 1975 International Women‘s Year Conference in Mexico City. In 1978, the only worldwide federation of LGBT (lesbian, gay, bisexual and transgender) groups was founded, and currently, there are many groups of sexual and gender minorities consistently raising their voices in key spaces of global politics. These groups have also worked diligently to build alliances with other human rights organizations to ensure that their issues are mainstreamed throughout a human rights discourse and agenda. This chapter outlines the participation (and exclusion) of sexual and gender minorities in international and regional processes. These regional and global movements have been at the forefront of documenting human rights abuses and violations, advocating for the development of normative tools, such as the Yogyakarta Principles2, and raising their voices in spaces of regional and global governance.

Bonomo* Abstract This Comment discusses the influence of internationallegal norm development on the advancementof sexual orientation rights. Case studies of Argentina and Brazil demonstrate thatprogressin this area of human rights law has been "outward-looking":the countries that are mostprogressive in terms of sexual orientationrights are at once substantiallyinfluenced by and seeking to actively influence the development of internationallegal norms. To demonstrate this "outward-looking" character, this Comment analyzes nongovernmental organization activiy, legislative enactmentsjudicialopinions,andproposed resolutions in internationaland regional governmental bodies in both Argentina and Brazil. It then argues that sexual orientationrights development in these two countriesis a manifestation of the sign ficant impact that internationallaw has had upon this areaof human rights law.
