Allagan Faculty of Law, University of Groningen, The Netherlands Correspondence: [email protected] Abstract Indonesian Private International Law (PIL) until now is based on Algemene Bepalingen van Wetgeving (AB) described in the State Gazette No.23 of 1847. The latest development of Indonesian PIL was the issuance of Academic Bill of PIL in 2014. Between the time span of more than 150 years, what is the development of Indonesian PIL? Whether the principles of PIL as stipulated in Article 16 AB (Principle of Nationality), 17 AB (Lex Re Sitae) and 18 AB (Locus Rigit Actum) remains in the Bill of Indonesian PIL? Is there any alteration? Is there any PIL regulation in any other Indonesian prevailing regulation besides AB? This writing would like to answer such questions and reviewing the Bill of Indonesian PIL. The comparison research method will be made to the PIL regulation in the Netherlands to see the development of AB in its original country, particularly the three PIL’s Principles. The debate goes back to the 1960's and 1970's, when distinguished scholars such as F .A. THE DOCTRINE OF THE RENVOI At this point,,before the discussion passes from the topic of succession on death to that of transfer inter vivos, it seems appropriate to mention the doctrine of the renvoi, which has been invoked most frequently, though not exclusively, in Con- nection with succession. The problem arises from the fact that in a given situation connected with two or. more countries, the laws of those countries may be different not only as regards their. domestic rules,; but 'Also -as regards their conflict rules. If a. court in X, in accordance with a conflict rule' -of the forum, has selected the law of some other country, Y, as . the proper law with regard to a particular juridical question arising from the factual situation, and arrives at the stage of applying the law of Y,2 the court might do any one of three things. Firstly, it might reject or ignore the doctrine of the renvoi and apply simply the domestic rulee3 of the law of Y, without regard to the conflict rules of that law, that is, without regard to any possible reference back (renvoi) from the law of Y to the law of X or forward to the law of a third country, .Z. Secondly, it might adopt a theory of partial renvoi, that is, it might apply the conflict rules of the law, of Y to the extent of accepting a reference back from .the law of Y, and consequently apply the domestic rules of the law of X, without considering what, if any, theory of the renvoi prevails in the law of Y. -

The Classical View: “Conflicts Justice” The classical, traditional view of the law of conflict of laws, going at least as far back as Savigny and Story,1 is grounded on the basic premise that the function of conflicts law is to ensure that each multistate legal dispute is resolved according to the law of the state that has the closest or otherwise most ―appropriate‖ relationship with that dispute. Opinions on defining and especially measuring the ―propriety‖ of such a relationship have differed over the years from one legal system to another and from one subject to the next. Despite such differences, however, all versions of the classical school have remained preoccupied with choosing the proper state to supply the applicable law, rather than directly searching for the proper law, much less the proper result. Indeed, the implicit—if not explicit—assumption of the classical school is that, in the great majority of cases, the law of the proper state is the proper law. The law which would ordinarily be applicable under choice of law rules may, for example, be denied application where it is “manifestly incompatible with the public policy (‘ordre public’) of the forum”1, and a foreign judgment may be refused recognition on the grounds that, for example, “such recognition is manifestly contrary to public policy in the [state] in which recognition is sought”2. The existence of such a discretion is recognised in common law rules, embodied in statutory codifications of private international law3, including those operating between European states otherwise bound by principles of mutual trust, and is a standard feature of international conventions on private international law4. It has even been suggested that it is a general principle of law which can thus be implied in private international law treaties which are silent on the issue5. The public policy exception is not only ubiquitous6, but also a fundamentally important element of modern private international law. As a ‘safety net’ to choice of law rules and rules governing the recognition and enforcement of foreign judgments, it is a doctrine which crucially defines the outer limits of the ‘tolerance of difference’ implicit in those rules7. -

Masters in Civil Law and Private International Law from the University of Tübingen, and Specialization in European Integration at the Europa-Institute, Saarbrücken, Germany Introduction Having had the honor of giving classes on “Consumer Protection: Aspects of Regional and General Private Law,”2 during the Course on International Law at the Organization of American States (OAS) in August 2000, where I concluded that it was both necessary and timely for us to develop in the region a new Inter-American Convention on Private International Law (CIDIP) to protect the tourist consumer and the consumer who buys at a distance, particularly with increasing levels of electronic commerce, I would now like to summarize this course, share the conclusions I reached, and submit them for critical review by my Brazilian colleagues. The approach in the 2000 course was necessarily regional as were the solutions proposed, such as the CIDIP planned at the end of the course, but the problems we identified are also reflected in the Brazilian system, as we seek to emphasize in this article. In effect, the Brazilian rules of Private International Law now in force date back to 1942 and existing drafts—such as the draft of the New Civil Code, the OAB-SP [Brazilian Bar Association/São Paulo] draft on electronic commerce, or Jacob Dolinger’s draft of the new LICC [Introductory Law to the Civil Code]—either seek only to update the material aspects of the new form of international commerce or were withdrawn from Parliament and are now longer under discussion, leaving no special regulations relating to the problem of the law applicable to these increasingly more common international consumer contracts.3/ 1. -

The only condition more appalling, less practical than world government is the lack of it in this atomic age."74 Little courage is needed to be a prophet of evil.75 We dare not take the risk of not taking a risk in the use of reason when confronted with destructive uses of unreason. There is real evil in the world-fascism, for instance. Americans generally believe that, with courage and intelligence, we may be able to overcome many evils. But that belief does not commit us to the dogma that victory is certified. Our belief, hardy and athletic, inspires us to take reasonable chances. "The future of human society," as Mr. Justice Douglas puts it, "depends on whether this generation will be successful pioneers of adventure."76 As Tocqueville's Democracy in America is highly esteemed by Morgenthau, it is too bad that he does not take to heart these words from the last paragraph of that book: "Providence has not created mankind entirely independent or entirely free. It is true that around every man a fatal circle is traced beyond which he cannot pass; but, within the wide verge of that circle he is powerful and free; as it is with man, so with commu- nities."77 Within that circle, we must rest our hope for the future, not on a philosophy of drifting, but on a faith in imaginative, inventive intelligence coupled with integrity and good will. 8 1My answer to such pessimism as Morgenthau's I have expressed thus: "Man's conscious and deliberate purposes have to some extent affected the past, and they can also to some extent affect the shape of the future. -

PHILIPPINE CIVIL PROCEDURE IN TRANSBOUNDARY DISPUTES Antonio R. Bautista' 1. GENERAL CONTEXT 1.1. The Philippine Judicial System in Brief The Philippine judicial system consists of one Supreme Court and such lower courts as are established by law. These courts were given judicial power, defined as "the authority to settle justiciable controversies or disputes involving rights that are enforceable and demandable before the courts of justice or redress of wrongs for violation of such rights".1 This includes the power "to determine whether or not there has been a grave abuse of discretion amounting to lack or excess of jurisdiction on the part of any branch or instrumentality of the government". 2 One gathers, therefore, that the Philippine judiciary is unitary. Unlike the American system, after which that of the Philippines was patterned, there are no state and federal systems in the Philippines. Instead, there is just one Supreme Court. The Philippine judicial system is tiered: below the Supreme Court are such lower courts as are established by Congress and which exercise such jurisdiction as is conferred upon them by law. 3 The Supreme Court is a collegial body composed of a Chief Justice and fourteen Associate Justices. 4 It sits en banc when hearing cases involvin~ the constitutionality of a treaty, international or executive agreement, or law; and the constitutionality, application or operation of presidential decrees, proclamations, orders, instructions, ordinances and other regulations;6 in which the required majority was not obtained when heard by division; 7 where the Supreme Court modifies or reverses a doctrine or principle of law previously laid down either en banc or in division;8 of administrative nature involving • Bautista Picazo Buyco Tan & Fider; Professor of Law, University of the Philippines. -

HOLTZMANN* Arbitration in East-West Trade t Acceptability of Arbitration Arbitration clauses are now standard practice in virtually all contracts between Western corporations and Eastern European foreign trade organizations. Parties on both sides routinely express a strong preference to submit future disputes to final decision by arbitrators rather than resorting to litigation in national courts of law. I Arbitration, as used in this discussion, may be defined as a voluntary agreement by both parties to a contract that any controversies or claims arising out of the contract, or in connection or relating to the contract, or any breach of it, will be settled by one or more arbitrators, rather than by litigation in the courts. Each party to such an agreement typically expects that the other party will comply with the decision of the abritrator, and that, if it does not, the arbitration decision will be enforced in national courts having jurisdiction. Western businessmen and lawyers have traditionally preferred arbitration in international trade disputes in order to avoid the uncertainties and complications associated with appearance in foreign courts. In the Western countries long-established institutions exist which have extensive experience in conducting arbitrations arising out of international trade.
