CHAPTER 11

R.S.B.C. 1960, c. 71 An Act to Amend the Constitution Act 1961, c. 10; 1962, c. 13 1963, c. 9; 1965, c. 6. [Assented to 1st April, 1966.]

ER MAJESTY, by and with the advice and consent of the H Legislative Assembly of the Province of , enacts as follows:—

Short title. 1. This Act may be cited as the Constitution Act Amendment Act, 1966.

Amend»». M. 2. Section 14 of the Constitution Act, being chapter 71 of the Revised Statutes of British Columbia, 1960, is amended by striking out the word " fifty-two " from the first line and substituting the word " fifty-five ", so that the section shall read as follows:— " 14. The Legislative Assembly shall consist of fifty-five members, to be elected in the manner provided by the Provincial Elections Act, and to represent the electoral districts constituted and defined by and in this Act."

Rc-enacts Schedule C. 3. Schedule C is repealed and the following substituted:—

ATLIN ELECTORAL DISTRICT

All that portion of the Province of British Columbia which is contained within the following boundaries:— Atlin Mining Division; Stikine Mining Divsion, except that part which lies to the cast of the one hundred and twenty-eighth meridian of west longitude; together with Portland Canal Mining Division, as denned in the Gazette of April 22nd, 1937, shall constitute one electoral district, to be designated as "Atlin Elec­ toral District," and return one member

All that portion of the Province of British Columbia which is contained within the following boundaries:— Commencing at the intersection of the south-westerly prolongalion of the centre line of Byrne Road with the high-water mark of the North Arm of the on the right bank thereof, Group 1, New Westminster District; thence north-easterly along the said south-westerly prolongation of the centre line of Byrne Road and continuing north-easterly along the said centre line and the north­ easterly prolongation thereof to the centre line of South-east Marine Drive; thence in a general north-westerly direction along the said centre line of South-east Marine Drive to the centre line of Royal Oak Avenue; thence northtilj along the centre line of Royal Oak Avenue to the centre line of Imperial Sircet: thence easterly along the «aid centre line of Imperial Street to the centre line of Sperling Avenue; thence northeily along the said centre line of Sperling Avenue to the centre line of the Grandview-Douglas Highway; thence in a general north-westerly direction along the said centre line of the Grandview Douglas Highway and con­ tinuing north-westerly along the centre lino of Douglas Road to the centre line of the Great Northern Railway right of-way: thence easterly along the .said centre line of the Great Northern Railway right-of-way to the northerly boundary of District Lot 77: thence easterly along the said northerly boundary of District Lot 77 to the centre line of the Loughecd Highway; thence in a general south­ easterly direction along the said centre line of the Loughced Highway to the centre line of North Road; thence southerly along the said centre line of North Road to the easterly prolongation of the centre line of Holmes Street; thence westerly along the said easterly prolongation of the centre line of Holmes Street and t.on- tinuing westerly along the said centre line to the centre line of Tenth Avenue; thence fouth-wcsterly along the said centre line of Tenth Avenue and the ..outh- wcstcrly prolongation thereof to the centre line of South-east Marine Drive; thence in a general south-easterly direction along the said centre line of South-east Marine CONSTITUTION (AMENDMENT) CHAP. 11

BURNABY NORTH ELECTORAL DISTRICT All that portion of the Province of British Columbia which is contained within the following boundaries:— Commencing at the intersection of the centre line of Boundary Road with the high-water mark of Second Narrows, , on the southerly shore thereof, Group 1, New Westminster District; thence due north to the middle line of said Second Narrows; thence in a general easterly direction along the middle lines of Second Narrows, Burrard Inlet and Port Moody to the northerly prolongation of the centre line of North Road; thence southerly along the said northerly prolonga­ tion of the centre line of North Road and continuing southerly along the said centre line to the centre line of the Lougheed Highway; thence north-westerly along the said centre line of the Lougheed Highway to the northerly boundary of District Lot 77; thence westerly along the said northerly boundary of District Lot 77 to the centre line of the Great Northern Railway right-of-way; thence westerly along the said centre line of the Great Northern Railway right-of-way to the centre line of Boundary Road; thence northerly along the said centre line of Boundary Road to the point of commencement, shall constitute one electoral district, to be designated as " Burnaby North Electoral District," and return one member.

BURNABY-WtLLiNGDON ELECTORAL DISTRICT All that portion of the Province of British Columbia which is contained within the following boundari's:— Commencing at the intersection of centre line of Boundary Road with the high- water mark of the North Arm of ihe Fraser River on the right bank thereof, Groi'p 1, New Westminster District; thence northerly along the said centre line of Boundary Road to the centre line of the Great Northern Railway right-of-way; thence easterly along the said centre line of the Great Northern Railway right-of- way to the centre line of Douglas Road; thence in a general south-easterly direc­ tion along the said centre line of Douglas Road and continuing south-easterly along the centre line of Grandview-Douglas Highway to the centre line of Sperling Avenue; thence southerly along the said centre line of Sperling Avenue to the centre line of Imperial Street; thence westerly along the said centre line of Imperial Street to the centre line of Royal Oak Avenue; thence southerly along the said centre line of Royal Oak Avenue to the centre line of South-east Marine Drive; thence in a general south-easterly direction along the said centre line of South-cast Marine Drive to the north-easterly prolongation of the centre line of Byrne Road: thence south-westerly along ihe said north-easterly prolongation of the centre line of Byrne Road and continuing south-westerly along the said centre line and the south-westerly prolongation thereof to the middle line of the North Arm of the Fraser River; thence in a general north-westerly direction along the said middle iine of the North Arm of the Fiaser River to the southerly prolonga­ tion of the centre line of Boundary Road; thence northerly along the said southerly prolongation of the centre line of Bounclaty Road to the point of commencement, 57 CONSTITUTION (AMENDMENT) 14-15 ELIZ. 2 shall constitute one electoral district, to be designated as " Burnaby-Willingdon Electoral District," and return one member.

CARIBOO ELECTORAL DISTRICT All that portion of the Province of British Columbia which is contained within the following boundaries:— Commencing at the point of intersection of the 53rd parallel of north latitude with the 124th meridian of west longitude; thence west along the 53rd parallel of north latitude to the northerly boundary of the watershed of Dean River: thence southerly along said boundary and that of the watershed of Bernhardt Creek to the southerly boundary of the watershed of the sti earns flowing into Sigutlat Lake; thence easterly along said southerly boundary to the point thereon which lies due north of the confluence of Takia and Dean Rivers; thence south to said junction point; thence southerly along the westerly boundary of the watershed of Takia River to the headwaters of the main stream of the west fork of Burnt Bridge Creek; thence in a general southerly direction to and along the northerly boundary of the watershed of the main stream of the west fork of Burnt Bridge Creek to the middle line of the main stream of Burnt Bridge Creek; thence southerly along said middle line to the middle line of Bella Coola PJver; thence southerly along said middle line to and along the middle line of Talchako River to a point due north of the mouth of an unnamed creek which flows northerly into the said Tal­ chako River, from Talchako Glacier; Notwithstanding anything contained in the Constitution Act or **»»*»• the Provincial Elections Act, where a vacancy in the Legislative Assembly has happened or happens before the thirty-first day of October, 1966, and before dissolution of the twenty-seventh Legislative Assembly, the vacancy shall be filled either, (a) if a writ for a general election is issued on or before the thirty- first day of October, 1966, and the return day mentioned in the writ is not later than the thirty-first day of December, 1966, at that general election, or (b) at a by-election the writ for which shall be issued not later than (i) six months after the happening of the vacancy, or (ii) the first day of November, 1966, whichever is later, and this section shall be deemed to have come into force and effect on the day prior to that upon which the first of those vacancies occurred and is retroactive to the extent necessary to give full force and effect to the provisions thereof on and after that date.
