Dear Ms Chuntso,

I write further to your Freedom of Information Request in relation to the Operational Control at Preston New Road Cuadrilla Protests. As you are aware, you wrote to the Police and Crime Commissioner on the 5 March enquiring as to 'who has the operational control for the policing of the protests at Cuadrilla's Preston New Road Site'. On the 6 March 2017, Mrs P Ashcroft, on behalf of the Police and Crime Commissioner, advised you that the person responsible for the operational control for the policing of the protests at Cuadrilla's Preston New Road Site was the . On the 10 March 2017 you wrote further advising this office that you were aware that the Chief Constable is in charge of the policing. However, the question asked was

"Please advise who has operational control" You also asked:- 1) The name of the operation 2) The date of the handover of the control 3) Correspondence between Lancashire and Greater Manchester Police detailing the management of the operational control at Preston New Road. You wrote further on the 4 April 2017, seeking an internal review of Lancashire Police and Crime Commissioner's handling of your FOI request 'Operational Control at Preston New Road Cuadrilla Protests' I can confirm that the response provided by Mrs Ashcroft on the 6 March 2017 was correct in that the Policing Protocol Order 2011 makes it clear that the Chief Constable is responsible for decisions concerning the configuration and organisation of policing resources (or) the decision whether, or whether not, to deploy police officers and staff and therefore has operational control at Preston New Road Cuadrilla Protests. This concludes the internal review. Should you not be satisfied with this review you are entitled to make a complaint to the Information Commissioner. The Information Commissioner can be

contacted at the Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow, Cheshire, SK9 5AF. In relation to the three additional questions you asked on the 10 March 2017, this constitutes a new request. This information is held by the Chief Constable and not this office as it is an operational policing matter, it is Lancashire Constabulary that may be able to assist you and if you wish, I can transfer your request to them.
