PREFACE

This brochure attempts to present in concise form information about the activities of

Parliamentary Committees, other than the Financial and Departmentally Related Standing

Committees, for the period from 1st June 2014 to 31st May, 2015.

2. The material has been arranged in two parts. Part-I contains two sections. Sections I &

II present resume of the work done by the Standing Parliamentary Committees and the ad-hoc

Committees respectively. Part-II of the brochure contains Appendices which give details of composition of the Committees/Sub-Committees, their sittings, subjects discussed and the composition of the various groups which undertook study visits, places and dates of visits.

CHAPTER ONE

BUSINESS ADVISORY COMMITTEE

I. Constitution of Committee

1.1 The Business Advisory Committee was constituted on 13 June, 2014 for the first time in the and continued in Office during the period under review.

1.2 The Committee consists of not more than fifteen members including the Speaker who is the ex officio Chairperson of the Committee. The Composition of the Committee is given in Appendix-I.

II. Review of Work Done

(a) Sittings of the Committee

1.3 During the period under report, the Committee held 20 sittings spread over 9 hrs 08 Mts. Statement showing the dates of sitting of the Committee held, the duration of the sittings, the number of Members present is given in Appendix – XXIV.

1.4 Statement showing the number of sittings of the Committee attended by each member is given in Appendix – XLIV.

1.7 The Minutes of sittings of the Business Advisory Committee were prepared and presented to the House.

IV. Secretariat

1.8 Business Advisory Committee (Table Office) constitutes the Secretariat of the Committee. The sanctioned staff Strength (in 2001) of the Branch was 18 whereas the actual strength is 13. A Joint Secretary, a Director, two Additional Directors and one Under Secretary remained in charge of the Branch. ------

CHAPTER TWO

COMMITTEE OF PRIVILEGES

II. Constitution of Committee

2.1 The Committee of Privileges, which was constituted on 01.09.2014 continued in Office during the period under review.

2.2 The Committee consists of 15 Members of Lok Sabha. The Speaker appointed Shri S. S. Ahluwalia, Member of the Committee, as the Chairperson of the Committee. The Composition of the Committee is given in Appendix – II.

II. Subject Selected for Examination

2.3 The Committee does not take up matters for examination on their own. Matters are referred to the Committee either by the House under Rule 226 or by the Speaker under Rule 227 of the Rules of Procedure and Conduct of Business in Lok Sabha. The Committee examined/is examining the following matters during the period:-

Shanavas, MPs against a correspondent of „Times of India‟ newspaper for allegedly humiliating them and tarnishing their image by publishing a false and defamatory news item wherein they were reported to have been allegedly absent without prior sanction for leave from the House. 4. Notices of question of privilege dated 17 and 20 April, 2015 20.04. 2015 given by Shri Vinod Kumar Sonkar, MP and also signed by thirty-four other Members against the District/Police Administration of for allegedly misbehaving with him while he wanted to raise a matter of public interest. 5. Notice of question of privilege dated 27 April, 2015 given by 20.04. 2015 Shri , MP against the District/Police Administration of Allahabad for allegedly issuing a notice to him in connection with setting up of a Magisterial Inquiry inter alia on the incident of demonstration/dharna led by him and Shri Vinod Kumar Sonkar, MP at the DM Residence Gate, Allahabad.

6. Notice of question of privilege dated 12 March, 2015 given by 07.05. 2015 Shri R. K. Singh and 32 other MPs against Shri Sudhir Kumar, an officer in the Ministry of Road Transport & Highways (National Highway Authority of India) for allegedly misleading the Members by making false statements in a meeting and also by making insulting remarks.

III.Constitution of Sub-Committees/Study Groups

2.4 No Sub-Committee/Study Groups were constituted by the Committee.

IV. Review of work done

(a) Sittings of the Committee

2.5 During the period under report, the Committee held 4 sittings lasting for 04 hours and 05 minutes. Statement showing the dates of sittings of the Committee held, the duration of the sittings, the number of Members present and the subjects discussed is given in Appendix – XXV.

2.6 Statements showing the number of sittings of the Committee attended by each member is given in Appendix – XLV.

(b) Proceedings

2.7 No evidence was taken in the meeting during the period under review.

(c) Visits for on-the-spots studies

2.8 Not applicable to the Committee

V. Reports Presented

2.9 During the period under review, no Report was presented by the Committee of Privileges to the House. (b) Action Taken Reports

2.10 No Action Taken reports were presented to the House during the period under review.

(c) Laying of Minutes

2.11 Minutes of Sitting of the Committee relating to various Reports presented to the House were prepared and presented to the House alongwith the relevant Report.

VI. Secretariat

2.12 Privileges Committee (Privileges & Ethics Branch) constitutes the Secretariat of the Committee of Privileges. Staff Strength of the Branch sanctioned was 11 for Committee of Privileges & Committee on Ethics. However, the Branch is now providing secretarial assistance to a new Committee on Violation of Protocol Norms etc., the sanctioned strength as assessed by the Work Study needs to be revised accordingly. At present, the actual strength of the Branch is 13. A Joint Secretary, a Director, One Deputy Secretary, One Under Secretary and One Legislative Officer remained in charge of the Branch.

CHAPTER THREE

COMMITTEE ON ABSENCE OF MEMBERS FROM THE SITTINGS OF THE HOUSE

I. Constitution Of Committee

3.1 The Committee on Absence of Members from the Sittings of the House for the year 2014-15 was constituted on 01.09.2014 and continued in Office during the period under review

3.2 The Committee consisted of 15 Members of Lok Sabha and Nil Members of . The Speaker appointed Shri P. Karunakaran Member of the Committee, as the Chairperson of the Committee. The composition of the Committee is given in Appendix-III.

II. Review of work done

(a) Sittings of the Committee

3.3 During the period under review, the Committee held 02 Sittings lasting for 00 hours. and 56 minutes. Statement showing the dates of sitting of the Committee held, the duration of the sittings, the number of Members present and the subjects discussed is given in Appendix –XXVI.

3.4 Statement showing the number of sittings of the Committee attended by each Member is given in Appendix-XLVI III. Reports Presented (a) Original Reports

IV. Secretariat

3.7 Committee on Absence of Members from the Sittings of the House (Table Office (B)) renders secretarial assistance to the Committee on Absence of Members from the Sittings of the House. Staff Strength of the Branch sanctioned was three whereas the actual strength is Nil. A Joint Secretary, a Director, Additional Director, Deputy Secretary and Legislative Officer remained in charge of the Branch.

CHAPTER FOUR

COMMITTEE ON GOVERNMENT ASSURANCES

I. Constitution of Committee

4.1 The Committee on Government Assurances for the year 2014-15 was constituted on 01 September 2014 w.e.f. 02 September, 2014 and continued in office during the period under review.

4.2 The Committee consisted of 15 Members of Lok Sabha. The Speaker appointed Dr. "Nishank", Member of the Committee, as the Chairperson of the Committee. The composition of the Committee is given in Appendix-IV.

II. Subject Selected for Examination

4.3 Subjects are not selected by this Committee. 4.4 Petitions referred – Not applicable to this Committee. 4.5 No representation received by the Committee for examination.

III. Bills referred 4.6 Bills are not referred to this Committee

IV. Constitution of Sub-Committees/Study Groups 4.7 No Sub-Committees/Study Groups have been formed.

V. Review of work done

(a) Sittings of the Committee

4.8 During the period under report, the Committee held 10 sittings lasting for 21.30 hrs. Statement showing the dates of sitting of the Committee held, the duration of the sittings, the number of Members present and the subjects discussed is given in Appendix –XXVII

4.9 Nil in view of Para 4.7 above.

4.11 Verbatim record of Proceedings of the sittings of the Committee, at which evidence was taken, was maintained. These comprised 480 pages (approx.).

(d) Visits for on-the-spots studies

4.12 No visit for on-the-spot studies has been undertaken by the Committee during the period 1st June, 2014 to 31st May, 2015 (16th Lok Sabha). VI. Reports Presented

4.14 Conventionally no Action Taken Reports are drafted, since onus to fulfill a given assurance squarely lies with the concerned Department/Ministry.

(c) Laying of Minutes

4.15 Minutes of sittings of the Committee relating to various Reports presented to the House were prepared and presented to the House alongwith the relevant Reports.

VII. Secretariat

4.16 The Committee on Government Assurances Branch constitutes the Secretariat of the Committee. No separate staff is sanctioned to the branch. However, the number of the officers/staff deployed in the branch is 08 including one Attendant. One Director and one Additional Director have also been deployed to look after the work of the Committee on Government Assurances Branch. The Branch functions under the overall supervision of the Joint Secretary.

CHAPTER FIVE

COMMITTEE ON PAPERS LAID ON THE TABLE

I. Constitution of Committee

5.1 The Committee on Papers Laid on the Table for the year 2014-2015 was constituted on 01.09.2014 and continued in Office during the period under review.

5.2 The Committee consist of 15 Members of Lok Sabha. Out of 15 Members, 14 Members were nominated vide Bulletin Part – II dated 02.09.2014 and one Member was nominated vide Bulletin Part – II dated 05.03.2015. The Hon‟ble Speaker had appointed Shri , M.P., as the Chairperson of the Committee. The composition of the Committee is given in Appendix-V.

II. Cases taken up for examination

5.3 During the period under review, the Committee examined 1156 papers pertaining to laying of the Annual Reports and Audited Accounts of various Organisation/Institutions and following cases, where there were inordinate and repeated delays, were taken up for detailed examination with the concerned Administrative Ministries –

(i) Delay in laying of the Annual Reports and Audited Accounts of Banaras Hindu University, Varanasi;

(ii) Delay in laying of the Annual Reports and Audited Accounts of Muslim University, Aligarh;

(iii) Delay in laying of the Annual Reports and Audited Accounts of Navodaya Vidyalaya, Noida;

5.11 Committee on Papers Laid on the Table (Committee Branch-II) deals with three Committees i.e. (i) Joint Committee on Offices of Profit; (ii) Committee on Papers Laid on the Table; and (ii) Joint/Select Committee on Bills. After separation of the Committee on Subordinate Legislation (COSL) in the year 2006 from CB-II, the actual Sanctioned Strength of Committee Branch-II provided by AN-I Branch as per the available record is as under:-

6.1 The Committee on Petitions for the year 2014-2015 was constituted on 01 September, 2014 and it continued in office during the period under review.

6.2 The Committee consist of 15 Members of Lok Sabha. The Speaker appointed Shri , Member of the Committee, as the Chairperson of the Committee. The composition of the Committee is given at Appendix-VI.

II. Petitions/Representations examined

6.3 The Committee consider the petitions presented to the House. During the aforesaid period, one petition was presented to the House on 29.11.2014. The Committee also considered the representations received by the Speaker/the Chairperson of the Committee. During the period under review, the Committee received about approximately 2354 representations from individuals/groups/associations etc. out of which 71 representations were forwarded to the concerned Ministries/Departments for furnishing their comments.

IV. Summary of Recommendations

7.7 The Committee examined thirty-eight Constitution (Amendment) Bills and recommended that the members sponsoring thirty-three Bills be permitted to move for leave to introduce their Bills. In the case of five Bills, namely,- (a) the Constitution (Amendment) , 2014 (Insertion of new article 370A) by Shri , M.P.; (b) the Constitution (Amendment) Bill, 2015 (Insertion of new article 370A) by Shri Nishikant Dubey, M.P.; (c) the Constitution (Amendment) Bill, 2015 (Amendment of article 124) by Shri P.P. Chaudhary, M.P.; (d) the Constitution (Amendment) Bill, 2015 (Amendment of the articles 217 and 224) by Shri P.P. Chaudhary, M.P.; (e) the Constitution (Amendment) Bill, 2015 (Substitution of new article for article 331) by Shrimati , M.P.; the Committee recommended that the members might not be permitted to move for leave to introduce their Bills. (i) The Committee recommended classification and allocation of time to two hundred and twenty- two Bills. Out of these, the Committee classified one hundred and eighty Bills in category `A‟ and the remaining forty-two Bills in category `B‟.

(ii) The Committee also re-considered the classification of the following five Bills on the request of Dr. Ramesh Pokhriyal `Nishank', Shri Nishikant Dubey and Maj Gen B C Khanduri AVSM (Retd.), M.Ps., namely,-

7.8 Committee on Private Members Bills and Resolutions (Legislative Branch-II) constitutes the Secretariat of the Committee. A Joint Secretary, a Director and a Deputy Secretary supervise the work of the Branch. Sanctioned staff strength of the Branch is 7 whereas the actual strength is 10.

CHAPTER EIGHT

COMMITTEE ON SUBORDINATE LEGISLATION

I. Constitution of Committee

8.1 The Committee on Subordinate Legislation for the year 2014-2015 was constituted with effect from 1 September, 2014 vide Bulletin Para No 636 dated 2 September, 2014 and continued in Office during the period under review.

8.2 The Committee consists of 15 Members of Lok Sabha. The Speaker appointed Shri Dilipkumar Mansukhlal Gandhi, member of the Committee, as the Chairperson of the Committee. The composition of the Committee (2014-2015) is given at Appendix-VIII.

II. Subjects selected for examination/discussed

8.3 During the period under review 500 Orders‟ were examined. The Committee considered 15 Memoranda based on the infirmities/points arising out of examination of these statutory orders and the replies of the concerned Ministries/ Departments received thereon. The Committee adopted and presented 5 Reports (3 Original Reports and 2 Action Taken Reports) during the period under review.

The Committee also decided that in addition to examination of „Statutory Orders‟ published in the Gazette of India, they may also take up for examination the rules/regulations/bye-laws etc framed under the relevant Acts of Parliament pertaining to important areas like – Banking and Insurance, Environmental Protection, Shipping, Transport and Highways, Aviation, Labour and Industrial Disputes, Coal, Energy, Steel, Mines, Health, Commodities Boards like Coffee Board, Tea Board, Rubber Board, Jute Board, Central Silk Board, Coconut Board etc.

III. Bills examined

8.4 8 Bills laid on the Table of the Lok Sabha were examined to see whether the Bill seeks to delegate rule-making powers or seeks to amend an earlier Act delegating such powers.

I. Constitution of the Committee

11.1 The General Purposes Committee has no fixed term. During the 16th Lok Sabha, the General Purposes Committee was constituted on 29th January 2015 and continued in office during the period under review.

11.2. The Committee consists of the Hon‟ble Speaker, Deputy Speaker, Panel of Chairpersons and the Chairpersons of all Standing Parliamentary Committee of Lok Sabha, Leaders of recognized parties/groups in Lok Sabha. The Speaker is the ex-officio Chairperson of the Committee. The composition of the Committee is given in the Appendix-XI.

II. Subjects selected for examination

11.3 The General Purposes Committee is constituted to consider the advice on such matters concerning the affairs of the House as may be referred to it by the Speaker from time to time.

11.5 General Purpose Committee (Committee Branch-I) constitutes the Secretariat of the Committee. The sanctioned staff strength of the Branch is 10, however, presently the actual strength of the Branch is 08. 1 Joint Secretary, 1 Director, 1 Additional Director/1 Deputy Secretary and 1 Under Secretary remained in-charge of the Branch.

12.1. The House Committee for the year 2014-2015 was constituted on 12.6.2014 and continued in office during the period under review.

12.2. The Committee consisted of 12 members of Lok Sabha. The Hon‟ble Speaker appointed Dr., member of the Committee, as the Chairperson of House Committee w.e.f 12.6.2014 upto 26.11.2014 and the Hon‟ble Speaker appointed Shri as the Chairperson of the Committee w.e.f 27.11.2014. JOINT COMMITTEE ON OFFICES OF PROFIT

I. Constitution of the Committee

13.1 The Joint Committee on Offices of Profit was constituted on 11th December, 2014 for the duration of Sixteenth Lok Sabha on a motion adopted by Lok Sabha on 01st August, 2014 and concurred to by Rajya Sabha on 14th August, 2014.

13.2 The Committee consists of 15 Members (10 Members of Lok Sabha and 5 Members of Rajya Sabha). The Speaker had appointed Shri P.P. Chaudhary, as the Chairperson of the Committee. The composition of the Committee is given at Appendix-XIII.

II. Review of Work done

13.7 In addition, the Committee examined several cases for which further information from the concerned Ministries/Departments and State Governments/UTs was sought for. After detailed examination, the opinion of the Committee was sent in 35 cases to the respective bodies/Government/Rajya Sabha Secretariat, M.Ps., etc. Remaining cases are at different stages of consideration by the Committee.

IV. Secretariat

13.8 Joint Committee on Office of Profit (Committee Branch-II) deals with three Committees i.e. (i) Joint Committee on Offices of Profit; (ii) Committee on Papers Laid on the Table; and (iii) Joint/Select Committee on Bills. After separation of the Committee on Subordinate Legislation (COSL) in the year 2006 from CB-II, the actual Sanctioned Staff Strength of Committee Branch-II as per the AN-I Branch is as follows:-

CHAPTER FOURTEEN

JOINT COMMITTEE ON SALARIES AND ALLOWANCES OF MEMBERS OF PARLIAMENT

I. Constitution of the Committee

14.1 The Joint Committee on Salaries and Allowances of Members of Parliament is constituted on 02.09.2014 and continued in Office during the period under review.

14.2 The Committee consists of five members of Rajya Sabha nominated by the Chairman, Rajya Sabha and 10 Members of Lok Sabha appointed by the Speaker, Lok Sabha. The members of the Joint Committee hold office for a period of one year from the date of election of Chairperson. The composition of the Joint Committee is given in Appendix-XIV.

This Branch deals with Salaries and Allowances of Members of Parliament apart from this, the Branch also deals with the work relating to JCMSA and the work of JCMSA is dealt by only one Assistant.

CHAPTER FIFTEEN

RULES COMMITTEE

I. Constitution of the Committee

15.1 The Rules Committee has no fixed term and it remains in office till reconstituted. During the 16th Lok Sabha, the Rules Committee was constituted w.e.f.1 September, 2014 and continued in office during the period under review.

15.2 The Committee consists of 15 Members of Lok Sabha. The Speaker is the ex-officio Chairperson of the Rules Committee. The composition of the Committee is given in Appendix-XV(A).

II. Subjects selected for examination*

15.3 The Committee does not select subject for examination. The functions of the Committee are to consider matters of procedure and conduct of business in the House and to recommend any amendments or additions to the rules that may be deemed necessary. Suggestions for amendments or additions to the rules can be made by any member of the House, including a Minister, or by the Committee themselves.

17.1 The Committee on Members of Parliament Local Area Development Scheme (MPLADS), Lok Sabha for the year 2014-15 was constituted w.e.f. 15 September, 2014 and continued in office during the period under review.

17.2 The Committee consisted of 24 Members of Lok Sabha. The Hon‟ble Speaker appointed Dr. M. Thambi Durai, Hon‟ble Deputy Speaker as the Chairperson of the Committee. The composition of the Committee is given in Appendix- XVII

II. Subjects Selected for Examination

17.3 As per its mandate, (i) The Committee reviews the performance and problems in implementation of the Members of Parliament Local Area Development Scheme; (ii) Considers complaints of Members of Lok Sabha in regard to the Scheme; and (iii) Considers Memoranda prepared on the proposals received from the Ministry of Statistics and Programme Implementation and the Members of Parliament for amendments in the provisions of the MPLAD Scheme Guidelines.

VI. Work relating to MPLADS funds for natural calamities

17.13 Paras were issued in Bulletin Part-II with regard to the natural calamities of flood in Jammu and Kashmir and the earthquake in North India. 30 consent letters of Lok Sabha MPs for allocation of MPLADS funds for rehabilitation of areas affected by these calamities were forwarded to the Ministry of Statistics and Programme Implementation for necessary action at their end.

19.3 The functions and procedure to be followed by the Committees has been laid out in the Bulletin - II No. 660 dated 15.10.2014. The Committee may take up any matters referred to them either by the Speaker or by the House in regard to unethical conduct of member or complaint connected with parliamentary conduct of a member. The Committee may also suo motu take up for consideration and investigation matters relating to unethical conduct by Members wherever felt necessary and make such recommendations as it may deem fit. However, the Branch is now providing secretarial assistance to a new Committee on Violation of Protocol Norms etc., the sanctioned strength as assessed by the Work Study (vide para 2.22 of Report) needs to be revised accordingly. At present, the actual strength of the Branch is 13. A Joint Secretary, a Director, One Deputy Secretary, One Under Secretary and One Legislative Officer remained in charge of the Branch.

CHAPTER TWENTY

22.1 The Committee on Violation of Protocol Norms etc., which was constituted on 15.09.2014 continued in Office during the period under review.

Complaint dated 28.04.2015 from Shri Devendra Singh Bhole, MP 29.04.2015 regarding alleged disregard, non-cooperation and creation of hindrance in the discharge of duties by the Member in his constituency by the District Magistrate, Kanpur Nagar, U.P.

6. Issue of instances of violation of protocol norms of Members of 06.05.2015 Parliament and breach of guidelines issued by the Government of India on Official Dealings between Administration and Members of Parliament by Government officials. 7. Complaint dated 26 October, 2014 from Shri , MP 09.05.2015 alleging discourteous behavior on the part of Station House Officer (SHO), Hariyawan, District Hardoi, Uttar Pradesh 8. Complaint dated 29 December, 2014 from Shri Y.V. Subba Reddy, 09.05.2015 MP alleged misbehavior by the District Collector and Chief Planning Officer, Prakasam District, Andhra Pradesh when he sought information regarding a review meeting under the „Saansad Adarsh Gram Yojana‟ (SAGY).

Staff Strength of the Branch sanctioned was 11 for Committee of Privileges & Committee on Ethics. However, the Branch is now providing secretarial assistance to a new Committee on Violation of Protocol Norms etc., the sanctioned strength as assessed by the Work Study (vide para 2.22 of Report) needs to be revised accordingly. At present, the actual strength of the Branch is 13. A Joint Secretary, a Director, One Deputy Secretary, One Under Secretary and One Legislative Officer remained in charge of the Branch. I. Constitution of Committee

23.1 The Committee on Welfare of Other Backward Classes (OBCs) for the year 2014-15 was constituted on 12.09.2014 and continued in Office during the period under review.

23.2 The Committee consists of 20 Members of Lok Sabha and 10 members of Rajya Sabha. The Speaker appointed Shri Bandaru Dattatraya, MP as the Chairperson of the Committee. Consequent upon the appointment of Shri Bandaru Dattatraya, MP as Union Minister on 09.11.2014 Shri , MP was appointed and the Chairperson of the Committee w.e.f 12.12.2014. The composition of the Committee is given in Appendix-XXIII.
