The Department received your application for Transfer of permit along with supporting information on December 18,2007 regarding the subject facility. As indicated by the submitted additional information, the merger of Chariotte Landscaping and Sanitation Services, Inc. GENERAL CONDITIONS:

approved drawings, exhibits, specifications, or conditions of this Permit may constitute grounds for revocation and enforcement action by the Department.

3. As provided in Subsections 403.037(6) and 403.722(5) F.S., the issuance of this Permit does not convey any vested rights or any exclusive privileges. Neither does it authorize any injury to public or private property or any invasion of personal rights, nor any infringement of federal, state or local laws or regulations. This Permit is not a waiver of or approval of any other Department permit that may be required for other aspects of the total project which are not addressed in the Permit.

4. This Permit conveys no title to land or water, does not constitute State recognition or acknowledgement of title, and does not constitute authority for the use of submerged lands unless herein provided and the necessary title or leasehold interests have been obtained from the State. Only the Trustees of the Intemal Improvement Trust Fund may express State opinion as to title.

5. This Permit does not relieve the Permittee from liability for harm or injury to human health or welfare, animal or plant life, or property caused by the construction or operation of this permitted source or from penalties therefore; nor does it allow the Permittee to cause pollution in contravention of Florida Statutes and Department rules, unless specifically authorized by any order from the Department.

6. Permittee shall properly operate and maintain the facility and systems of treatment and control (and related appurtenances) that are installed and used by the Permittee to achieve compliance with the conditions of this Permit, as required by Department rules. This provision includes the operation of backup or auxiliary facilities or similar systems when necessary to achieve compliance with the conditions of the Permit and when required by Department rules.

7. The Permittee, by accepting this Permit, specifically agrees to allow authorized Department personnel, upon presentation of credential or other documents as may be required by law, and at reasonable times, access to the premises where the permitted activity is located or conducted to:

GENERAL CONDITIONS:

(c) Sample or monitor any substances or parameters at any location reasonably ecessary to assure compliance with this Permit or Department rules.

Reasonable time may depend on the nature of the concern being investigated.

8. If, for any reason the Permittee does not comply with or will be unable to comply with any condition or limitation specified in this Permit, the Permittee shall immediately provide the Department with the following information:

(a) A description of and cause of noncompliance; and

(b) The period of noncompliance, including dates and times; or, if not corrected, the anticipated time the noncompliance is expected to continue, and steps being taken to reduce, eliminate, and prevent recurrence of the noncompliance. The Permittee shall be responsible for any and all damages which may result and may be subject to enforcement action by the Department for penalties or revocation of this Permit.

9. In accepting this Permit, the Permittee understands and agrees that all records, notes, monitoring data and other information relating to the construction or operation of this permitted source, which are submitted to the Department, may be used by the Department as evidence in any enforcement case involving the permitted source arising under the Florida Statutes or Department rules, except where such use is prescribed by Sections 403.1 1 | and 40i.73, F.S. Such evidence shall only be used to the extent it is consistent with the Florida Rules of Civil Procedure and appropriate evidentiary rules.

10. The Permittee agrees to comply with changes in Department rules and Florida Statutes after a reasonable time for compliance, provided, however, the Permittee does not waive any other rights granted by Florida Statutes or Department rules. A reasonable time for compliance with a new or amended surface water quality standard, other than those standards addressed in Rule 62-302.500, F.A.C, shall include a reasonable time to obtain or be denied a mixing zone for the new or amended standard.

11. This Permit is transferable only upon Department approval in accordance with Rules 62-4.120 and 62-730.300, F.A.C, as applicable. The Permittee shall be liable for any noncompliance of the permitted activity until the transfer is approved by the Department. GENERAL CONDITIONS:

12. This Permit or a copy thereof shall be kept at the work site of the permitted activity.

13. This Permit also constitutes:

(a) Determination of Best Available Control Technology (BACT) (b) Determination of Prevention of Significant Deterioration (PSD) (c) Certification of compliance with State Water Quality Standards (Section 401, PL 92-s00) (d) Compliance with New Source Performance Standards

14. The Permittee shall comply with the following:

(a) Upon request, the Permittee shall furnish all records and plans required under Department rules. During enforcement actions, the retention period for all records will be extended automatically, unless otherwise stipulated by the Department.

(b) The Permittee shall hold at the facility or other location designated by this Permit, records of all monitoring information (including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation) required by this Permit, copies of all reports required by this Permit, and records of all data used to complete the application for this Permit.

(c) Records of monitoring information shall include:

1. the date, exact place, and time of sampling or measurements; 2. the person responsible for performing the sampling or measurements; 3. the dates analyses were performed; 4. the person responsible for performing the analyses; 5. the analytical techniques or methods used; 6. the results of such analyses.

15. When requested by the Department, the Permittee shall, within a reasonable time, furnish any information required by law, which is needed to determine compliance with the Permit. If the Permittee becomes aware the relevant facts were not submitted or were incorrect in the Permit application or in any report to the Department, such facts or information shall be corrected promptly. SPECIFIC CONDITIONS: l. This Permit is valid for construction/operation of the facility with all applicable requirements of Florida Administrative Code (F.A.C.) Rule 62-71l.

2. Appropriate signs indicating rurme of the facility, operating hours, cost of disposal, site rules and other pertinent information shall be posted at the entrance to the site.

3. An attendant shall be present on the site when the facility is open for business.

4. Only waste tires, not other solid or hazardous waste shall be accepted at the site.

5. The Permittee shall ,tri.iiy abide by the storage limit of 1,500 waste tires at any one time on the site and comply with all the applicable storage requirements in F.A.C. Rule 62-711.540.

6. The Permittee, at least once a year, shall remove all waste tires which are not used tires from the site for recycling, processing, or disposal.

7. The Permittee shall maintain records of the quantity of waste tires received at the site, stored at the site, and shipped from the site, in compliance with F.A.C. Rule 62- 7l 1.540(1)(g), which shall be available for inspection by Department personnel during normal business hours.

8. Pesticides used to control rodents, flies, mosquitoes, and other insects shall be as specified by the Florida Department of Agriculture and Consumer Services (Chapter 5E-2, Florida Administrative Code), and be available on site for use as necessary.

9. Adequate fire control provisions shall be available at all times.

10. The Permittee shall keep a copy of the Emergency Manual at the site at all times.

11. In the event the Permittee is temporarily unable to comply with any of the conditions of this Permit, heishe shall notify the DEP District office immediately. Notification shall include pertinent information as to the cause of the problem and what corrective measures are being taken to prevent its reoccurrence.

12. The Permittee shall notify the Department and the County about the facility's closure at least ninety (90) days prior to the date when waste tires will no longer be accepted. 13. The Permittee shall post a notice at the entrance to notiff public haulers about closure, starting at least thirty (30) days prior to the date when waste tires will no longer be ' accepted.

14. This Permit is issued for five (5) years and will expire on April 29,2004. If a renewal of the Permit is desired, the Permittee shall apply on forms and in a manner prescribed by the Department along with the appropriate fee, sixty (60) days prior to the expiration date.

15. The conditions do not exgmpt the Permittee from complying with requirements of other federal, state, county, municipal or regional pollution control rules, regulations, ordinance, or codes.

Pursuant to Section 403.815, Florida Statutes (F.S.), you are required to publish at your own expense the enclosed Notice of Proposed Agency Action. The notice shall be published one time only within thirty (30) days in the legal ad section of a newspaper of general circulation in the area affected. For the purpose of this rule, "publication in a newspaper of general circulation in the area affected" means publication in a newspaper meeting the requirements of Sections 50.001 and 40.031, F.S., in the county where the activity is to take place. 3. As provided in Subsections 403.037(6) and 403.722(5) F.S., the issuance of this Permit does not convey any vested rights or any exclusive privileges. 6. Permittee shall properly operate and maintain the facility and systems of treatment and control (and related appurtenances) that are installed and used by the Permittee to achieve compliance with the conditions of this Permit, as required by Department nrles. This provision includes the operation of backup or auxiliary facilities or similar systems when necessary to achieve compliance with the conditions of the Permit and when required by Department rules.

7. The Permittee, by accepting this Permit, specifically agrees to allow authorized Department personnel, upon presentation of credential or other documents as may be required by law, and at reasonable times, access to the premises where the permitted activity is located or conducted to:

(c) Sample or monitor any substances or parameters at any location reasonably necessary to assure compliance with this Permit or Department rules.

Reasonable time may depend on the nature of the concern being investigated.

8. If, for any reason the Permittee does not comply with or will be unable to comply with any condition or limitation specified in this Permit, the Permittee shall immediately provide the Department with the following information:

(a) A description of and cause of noncompliance; and

O) The period of noncompliance, including dates and times; or, if not corrected, the anticipated time the noncompliance is expected to continue, and steps being taken to reduce, eliminate, and prevent recurrence of the noncompliance. The Permittee shall be responsible for any and all damages which may result and may be subject to enforcement action by the Department for penalties or revocation of this Permit.

9. In accepting this Permit, the Permittee understands and agrees that all records, notes, monitoring data and other information relating to the construction or operation of this permitted source, which are submitted to the Department, may be used by the Department as evidence in any enforcement case involving the permitted source arising under the Florida Statutes or Department rules, except where such use is prescribed by Sections 403. I 1 1 and 403.73, F.S. Such evidence shall only be used to the extent it is consistent with the Florida Rules of Civil Procedure and appropriate evidentiary rules. r0. The Permittee agrees to comply with changes in Department rules and Florida Statutes after a reasonable time for compliance, provided, however, the Permittee does not waive any other rights granted by Florida Statutes or Department rules. A reasonable time for compliance with a new or amended surface water quality standard, other than those standards addressed in Rule 62-3l2.5ffi, F.A.C, shall include a reasonable time to obtain or be denied a mixing zone for the new or amended standard.

11. This Permit is transferable only upon Department approval in accordance with Rules 62-4.L20 and62-730.300, F.A.C, as applicable. 12. This Permit or a copy thereof shall be kept at the work site of the permitted activity.

13. This Permit also constitutes:

(a) Determination of Best Available Control Technology (BACT) (b) Determination of Prevention of Significant Deterioration (PSD) (c) Certification of compliance with State Water Quality Standards (Section 401, PL 92-s00) (d) Compliance with New Source Performance Standards

14. The Permittee shall comply with the following:

(a) Upon request, the Permittee shall furnish all records and plans required under Department rules. During enforcement actions, the retention period for all records will be extended automatically, unless otherwise stipulated by the Department.

(b) The Permittee shall hold at the facility or other location designated by this Permit, records of all monitoring information (including all calibration and maintenance records and all original strip chart recordings for continuous monitoring instrumentation) required by this Permit, copies of all reports required by this Permit, and records of all data used to complete the application for this Permit.

(c) Records of monitoring information shall include:

1. the date, exact place, and time of sampling or measurements; 2. the person responsible for performing the sampling or measurements; 3. the dates analyses were performed; 4. the person responsible for performing the analyses; 5. the analytical techniques or methods used; 6. the results of such analyses.

15. When requested by the Department, the Permittee shall, within a reasonable time, furnish any information required by law, which is needed to determine compliance with the Permit. If the Permittee becomes aware the relevant facts were not submitted

or were incorrect in the Permit application or in any report to the Department, such facts or information shall be corrected promptly.

SPECIFIC CONDITIONS:

1. This Permit is valid for construction/operation of the facility with dl applicable requirements of Florida Administrative Code (F.A.C.) Rule 62-711.

2. Appropriate signs indicating name of the facility, operating hours, cost of disposal, site rules and other pertinent information shall be posted at the entrance to the site.

3. An attendant shall be present on the site when the facility is open for business.

4. Only waste tires, not other solid or hazardous waste shall be accepted at the site.

5. The Permittee shall strictly abide by the storage limit of 15,000 waste tires at any one time on the site and comply with all the applicable storage requirements in F.A.C. Rule 62-711.540.

6. The Permittee, at least once a year, shall remove all waste tires which are not used tires from the site for recycling, processing, or disposal.

7. The Permittee shall maintain records of the quantity of waste tires received at the site, stored at the site, and shipped from the site, in compliance with F.A.C. Rule 62- 711.540(1)(9), which shall be available for inspection by Department personnel during normal business hours.

8. Pesticides used to control rodents, flies, and other insects shall be as specified by the Florida Department of Agriculture and Consumer Services (Chapter 5E-2, Florida Administrative Code), and be available on site for use as necessary.

9. Adequate fire control provisions shall be available at all times.

10. The Permittee shall keep a copy of the Emergency Manual at the site at all times.

11. In the event the Permittee is temporarily unable to comply with any of the conditions of this Permit, he/she shall notify the DEP District office immediately. 14. This Permit is issued for five (5) years and will expire on DRAFT. If a renewal of the Permit is desired, the Permittee shall apply on forms and in a manner prescribed by the Department along with the appropriate fee, sixty (60) days prior to the expiration date.

15. The conditions do not exempt the Permittee from complying with requirements of other federal, state, county, municipal or regional pollution control rules, regulations, ordinance, or codes.

The following information is provided to meet the requirements of 62-711.540(1XeX1-3). The operator of the site (WM) shall prepare and keep at this site emergency preparedness information. A copy shall be kept at an off-site location as previously designated by the operator. The manual shall be updated at least once a year and upon changes in operations at the site. The manual shall contain the following elements:

Section 1. A list of names and numbers of persons to be contacted in the event of a fire, flood, or other emergency;

Section 2. A list of the emergency response equipment at the site, its location, and how it should be used in the event of a fire or other emergency; and

Section 3. A description of the procedures that should be followed in the event of a fire, including procedures to contain and dispose of the oily material generated by the combustion of large numbers of waste tires."

Section 2. Emerqency response equipment

Emergency equipment at the site is comprised of numerous hand-held fire extinguishers of varying sizes. Fire extinguishers are located in various marked locations in each building and in most vehicles operating from the site. The three fire extinguishers identified on the attached Waste Tire Storage Location site drawing are the closest to the proposed waste tire storage location.

First aid supplies are located in the building identified as the container repair bldg. on the Waste Tire Storage Location drawing. Should injuries occur, first aid supplies can be obtained at that location. $tHfr{:$y*tr}

When possible, and safe to do so, trained on site personnel will utilize fire extinguishers to extinguish any fire. Personnel will remain clear of the thick black smoke generated by a waste tire fire. Evacuation from the area should be done using the Access and Appioach road shown on the Waste Tire Storage Location site drawing. Keep personnel and vehicles away from a waste tire fire.

lf the fire produces oily residue, the residue should be contained within the metal storage container. lf this material is released it will be contained using shovels, dirt or gravel is when safe to do so. The material will be properly removed and disposed of when cooled.

The Department of Environmental Protection will be contacted in the event of a fire or other emergency which poses an unanticipated threat to public health or the environment. A written report will be submitted to the Department within twp weeks of any emergency. The report shall describe the origins of the emergency, the actions that were taken to deal with the emergency, the results of the actions that were taken, and an analysis of the success or failure of the actions.

A copy of the application package, along with a copy of Florida Administrative Code (F.A.C.) CHAPTER 62-7Il WASTE TIRE RULE is enclosed for your review, specifically of the drawing, "Waste Tire Storage Location" and of F.A.C. Rule 62-711.540(7Xb) on Page 1105 regarding consultation with the local fire authority. The site was inspected by you on October 2, 2003 and the Fire Survey Report is included in the enclosed copy of the application package. The applicant states on Page 8 of the application, "Please note that the storage area will remain substantially clear (>25 feet) and will maintain clear access. WM will comply with the requirements below for this exemption to be approved." Please note that F.A.C. Rule 62- 7T1.540(3)(c) states, "A 50-foot-wide fire lane shall be placed around the perimeter of each outdoor waste tire pile." As part of its provision of waste hauling and disposal services, Charlotte Landscaping and Sanitation Seryices, a Division of Waste Management Inc. of Florida (WM) may accept waste tires from third party customers and other sources. To properly accumulate and store these waste tires, this permit application is being submitted to permit the facility as a Waste Tire Collection Center (WTCC) with the Florida Department of Environmental Protection (FDEp). As such, this permit application narrative provides information addressing the requirements of 62-711.540 and 62-711.550, F.A.C. To assist FDEP in their review of this application, we have listed below each section and subsection of the code referenced above in botd italic font and provided a specific response addressing the code requirements.

As described by 62-711.550, F.A.C., the owner or operator of a waste tire collection center shall meet the following requirements:

Sfore no more than 1,500 waste tires at the coltection center at any one time (62-7 1 1 . 550(1 )(a)) ;

' WM will limit the number of waste tires accumulated at the collection center to 1,500 tires or less at any one time.

Note - lt is expected that between 500-1000 waste tires will be received monthly.

At least once a year, remove all waste tires which are not used tires from the site for recycling, processing, or dr.sposa/ (62-711.ss0(1)(b));

. WM will remove all waste tires from the site at least once per calendar month. This exceeds the above requirement.

Applications for collection center permits shalt be submitted to the Departmeht on Form 62-701.900(25). The application shatt contain the fol lowi ng i nfo rmatio n : (a) The namg address, FEID number, and tetephone numher of the owner and operator of the facility, and the name, address, and telephone numher of the facility; (b) A description of the general operation of the facitity including quantities of waste tires received per month; (c) A description o_f ylangements made to acquire fire protection servrces for the facility; (d) The township, range, and secfion numbers and tatitude and longitude of the facility; and (e) A description of how and where the waste tires will be disposed of (62-7 1 1 . 5 50 (2) (a-e)).

The permit for a collection center shatl he vatid for five years, unless revoked, suspende d, or surrendered (62-71 j.SSO(3)).

o ff sign meeting these requirements will be prepared and maintained at the site.

No operations involving the use of open flames shatt be conducted within 25 feet of a waste tire pite (62-711.i40(1)(b)).

o Site activities involving an open flame are limited to periodic welding and torch work for equipment maintenance activities. Such activities will not be conducted within 25 feet of a waste tire pile.

An attendant shall be present when the site is open for husiness if fhe sjfe receiyes waste tires from the pubtic (62-711.540(t)(c)).

o WM staff occupies the facility during business hours. A WM employee fulfilling the role of attendant will supervise and coordinate the acceptance of waste tires from the public during business hours at the WTCC facility. Fire protection selrces for the sife sha// be assure d through notification to the localfire protection authorities. A fire safety suruey sialt he conducted at least annually and the survey repori shati be mide part of the next quarterly report (62-7 1 I . 540(1 )(d)).

' The Fire Department has conducted a fire safety survey at this site. This survey is provided as an attachment to the permit application. Subsequent surveys will be done annually and provided with the following quarterly report as required.

The operator of the site shatl prepare and keep at the site an emergency preparedness manual. A copy of the current manual shatl be kept at an off- site location designated hy the operator. The manual shall be updated at le-asf once a year and upon changes in operations at the site. The manual shall contain the following elements:

1. A list of names and numbers of persons to be contacted in the event of a fire, flood, or other emergency; 2. A list of the emergency response eqtuipment at the site, ifs Iocation, and how it shoutd be used in the event of a fire or other emergency; and 3. A description of the procedures that should be followed in the event of a fire, including procedures to contain and dispose of the oily material generated by the combustion of large iumbers of waste ti res (62-T 1 1.540(1 )(e)(1 -3).

o Please find attached an Emergency Preparedness Manual that addresses the requirements listed above. Please note that a copy of this manual will be kept on file at the office of the then-current Waste Management Technical Staff. At the time of the submittal of this application, the copy of the Emergency Preparedness Manual will be kept by Mike Knox at the Waste Management lnc. of Florida located at612,0 213t. Street Bradenton Florida 34203. This is subject to future change based upon changes in staff, staff responsibilities, office locations, etc. Furthermore, the plin will be reviewed at least annually and updated in accordance with the requirements listed above.

The operator of fhe sife shall immediately notify the Department in the event of a fire or other emergency, which poses in unanticipated threat to the public health or the environment. Within two weeks of any emergency, the operator of the site shalt submit to the Department a written report on the emergency. This report shalt describe the origins of the emergency, the actions that were taken to deal with the emergency, the resu/fs of tie actions that were taken, and an analysis of the success or failure of the actions (62-71 1.540 (1 )(f)). WM will comply ' with this requirement should a fire or emergency occur that poses an unanticipated threat to the pubtic neamn;1 th;;;"ironment. The operator of the site shalt maintain records of the quantity of waste tires received at the sife, sfore d at the site, and shippea from the 711.5a00@D. site (62-

WM will accumulate ' waste tires until a sufficient quantity is available for hauling to an FDEP authorized storage andlor disposal flcility. Tires will be removed from the site a minimum 6f on.e per month. Records of waste tires accepted from the public will be kept that will satisfy the requirement to record both the number of waste tires received and stored at the site. When the accumulated waste tires are taken to an FDEP authorized storage and/or disposal facility, the weight of the waste tires will be obtained and placed in facility records to document the quantity of tires shipped from the site.

WM maintains ' telephone service at the site that satisfies this requirement. Furthermore, numerous site management personnel have cellular phones that can arso be used to satisfy thiJrequirement. A person may a waste tire sife within the 200-fo;;- ""tn"ix"i'i" upon demonstration to the Department, as part of a permit apptication or modification, that permanent controt methods for residuals will result in compliance with water quality standards in Chapters 62-J02, and 62-520, F-A'C. Stormwater control methods shatl meet siormwater requirements of chapters 62-25 and G2-330, F.A.c., as appticabte. The site shalt be managed in such a way as fo divert stormwater or floodwaters around and away from the storage piles. Ihrb secfio n shall not apply to artificial reefs construction pursuant to Department permit (62-71 1.s4o4)@).

o There is a storm water retention pond within 200 feet of this site. The pond is located directly west of the site, approximately 30 feet from the storage location. WM has reviewed the requirements of Chapte rs 62-25, and 62- 330 F.A.C. Due to the limited number of tires and the containment of the tires within a sealed metal container, WM believes that the proposed WTCC is compliant with the requirements listed above.

An outdoor waste tire pite shalt have no greater than the foilowing maximum dimensions:

1. Width: 50 feet; 2. Area: 10,000 square feet; and 3. Height: 1 5 feet (62-71 1.s40(3)(b)(1 -3)).

WM will accumulate and store the waste tires in containers with a capacity of 40 cubic yards or less and ensure that all tires are removed from the site at least once each month. These voluntary operating limits will ensure that no single accumulation of tires exceeds the maximum limits described above.

A S0-foot wide fire lane shatt be placed around the perimeter of each outdoor wasfe tire pile. Access to the fire lane for emergency vehicles must be unobstructed at all fi'mes (62-711.540(3)(c)).

' WM will maintain a 50-foot clear area around most of the area where containers used to accumulate and store the waste tires. WM requests an exception to this requirement, as described in 62-711.540 (6) as the 50- foot clear area may not be SO-foot in all directions. lt should be noted that the waste tire storage location is for the most part compliant with this rule. The only anticipated exception is that at times empty metal containers may be within the S0-foot proximity.

' To meet the requirements of this exemption, WM will comply with 62- 711.540 (6) (a) and (b). This is described in that section of this narrative. o Access to the sife sha/t be controlted through the use of fences, gates, natural harriers or other means (62-711.s40(3)(d)).

o The perimeter of the property owned by WM is fenced and gated. These features will limit access to the site as required.

The site shall he b_ermed or given other adequate protection ffnecess ary to keep liquid runo! !1om a potential waste tire fire from entering water bodres (62-7 1 1 .540(3) (e)).

' As previously described, WM will accumulate and store less than 1,500 waste tires in containers rather than outside and/or in large pile(s). The containers will have a floor; walls and a door that witt contain any liquid runoff from a potential waste tire fire. In consideration of this information, the use of containers for accumulating and storing the waste tires will provide the required protection from liquid runoff from a potential waste tire fire.

The waste tire site shail be kept free of grass, underbrush, and other potentially flammable vegetation at att times (62-711,s40(g)0.

' The WTCC will be located in a central location within the property currently owned by WM. This property is used for a variety of refuse collection activities and, as such, does not have any large areas with grass, underbrush or other potentially flammable vegetation. To fully comply with this requirement, the WTCC will be located in an area that is at least 50 feet away from any grass, underbrush or potentially flammable vegetation.

For all waste tire sites, collection centers, processrng facitities, and disposa/ facilities which sfore processe d waste tires, th6 temperature of any above'ground piles of compacted, processe d tires over ten feet high shall be monitored and may not exceed 300 degrees Fahrenheit. Temperature control measures shall be institufed so that pile temperatures do not exceed 300 degrees Fahrenheit. ' WM will receive unprocessed waste tires from third party customers and does not anticipate receiving processed waste tires. WM acknowledges this requirement in the event that processed waste tires are received at the WTCC in the future. The Department shalt approve exceptions regues ted by an appticant as part of a waste fi're process ing facility permit apptication- or modification to the preceding technical and operationdt standa'rds if:

' As stated previously WM requests an exemption for the S0-foot clear area around the containers used to accumulate and store the waste tires. Because this entire area may not be clear at all times, WM requests an exception to this requirement. Please note that the storage area witl remain substantially clear (>2S-feet) and will maintain clear iccess. WM will comply with the requirements below to allow for this exemption to be approved.

(a) No waste tires are sfored on that site for more than one month; and

o All waste tires will be removed from the site on a monthly basis. Records of waste Tire removar wiil be maintained at the site.

WM has included a tjle survey performed by the locat fire authority that shows compliance with this requirement. The survey is provided is an attachment to the permit application. ltems noted in the Oct 2, 2003 letter from the charlotte county Fire and Emergency services Department have been addressed.

There is only one gate in and out of the facility. This gate was identified as "ENTRY GATE" on the site drawing. The Access and Approach Road leading to and from this gate is refereed to for use in evacuation in Section 3 of the previously submitted Emergency Preparedness Information Manual. This same road is shown on the previously submitted site drawing, labeled as the "APPROACH ROAD', "ACCESS ROAD". A highlighted arrow labeled "EVACUATION ROUTE" was also included on the site drawing. As requested the narrative has been revised to indicate that the site has one gate for ingress (entry) and egress (evacuation/ exit). The bottom of page 4, and top of page 5 to the narrative now includes this information. Waste Management Response:

In the Departments December 29, 2003 letter, page 2, item c), requested the minimum distance in feet to the stormwater retention pond "from the waste tire storage area closer to the pond." Our response to that comment stated that that distance was approximately 30 feet.

The distance from the waste tire storage area closest to the stormwater pond, to the pond, is approximately 30 feet. The site map note indicating this information has been revised to define this distance more clearly.

Per our discussion, the permit currently has the city incorrectly listed as Englewood. A review of the remainder of the permit (nearing the end of its five (5) year life) shows documents that use both names. Recent inspections performed by the department also reference both Placida and Englewood.

As you know the permit is be renewed within the next few months. At that time, all references to this facility will be changed to use the correct city name of Placida. Item 3 - The narrative description of the gate did not include the width of the existing gate, or the proposed replacement gate. These dimensions are provided below per your request.

The approach and access road runs through the center of the property as shown on the Waste Tire Storage Location drawing. This ingress and egress road has been further highlighted to make it more apparent in the drawing.

v.) The storm water pond is directly west of the property. The Waste Tire Storage Location drawing shows the pond at the bottom of the drawing. vi.) There is only one (1) access gate to the facility, located at the south end of the property (toward Harborview Rd.). This remainder of the property perimeter is an uninterrupted chain link fence. Both of these features are shown on the revised Waste Tire Storage Location drawing. vii.) The second paragraph of the Oct. 2, 2003 letter from the Charlotte County Fire and Emergency Services Department addresses the only requirements noted by the Fire Department. The water supply, located directly across Harborview Road can be reached, and requires no further action. Additionally, WM has made a key for the locked gate. The key has been labeled, and placed in the Knox box attached to the front of the office building. viii.) The permit application is for a "Waste Tire Collection Center" not a "Waste Tire Site". 62-701.200 (139) defines a Waste Tire Site as a site with 1,500 or more tires. A closure plan and closure cost estimate is not required for a Waste Tire Collection Center with fewer than 1,500 tires removed on a monthly basis.

RE: Inspection Letter of Acceptance

Dear Mr. Cosby:

On October 2,2003,I met with you for a request to inspect your tire storage area.

As per our conversation, the facility is acceptable; two areas of concem which we spoke about, and found a solution to, were 1) a water supply being far from the storage area, and2) it being behind a locked gate.

The water supply can be reached. It's within 1200 feet and you will make a key to the locked gate, keep it labeled, and put in the knox box attached to front of building.
