Business Bulletin: Wednesday 4 September 2013 Section F – Motions and Amendments

Motions and amendments are normally printed the day after they are lodged. If an amendment is lodged to a motion then the original motion will appear alongside the amendment, along with any support lodged that day, in this section.

Each Monday, this section also contains all motions and amendments lodged the previous week that are still live and any motions and amendments that have been lodged for debate in the coming week. A motion or amendment is live if it has not been debated, withdrawn or otherwise deleted from the list.

Where a motion or amendment has been withdrawn, it is indicated in this section the day after it has been withdrawn. Support for motions and amendments received after they are lodged is shown at the end of this section the day after such support is received.

Motions and amendments can be published with various symbols:

 Asterisks before the motion or amendment number indicate a motion or amendment published for the first time;

 Asterisks also identify alterations to the text of a motion or amendment made since it was first published;

 A hash symbol identifies motions eligible for debate at Members’ Business;

 A diamond symbol identifies motions lodged for Members’ Business that have not yet attracted the required cross-party support;

 An "R", identifies motions or amendments in which the Member who lodged it has a registrable interest.

The Parliamentary Bureau periodically deletes motions or amendments not scheduled for debate and which are over six weeks old.

A search facility is also available on the Scottish Parliament web site at http://www.scottish.parliament.uk/parliamentarybusiness/28877.aspx.

Any questions in relation to this section should be directed to the Chamber Desk, for which contact details are provided at the end of the Bulletin.

New and altered motions and amendments

*S4M-07578 James Dornan: Congratulations to Castlemilk Boy Called up to the Scotland Squad—That the Parliament congratulates Ikechi Anya on being selected for the Scotland football squad to face Belgium on 6 September 2013; recognises what it sees as this tremendous achievement by a boy from Castlemilk who had to go through a number of setbacks in his career before playing in La Liga for Sevilla and now in the Championship with Watford; considers his success a fine example of how determination and belief in a person’s own ability can pay off, and wishes Ikechi and the team every success as Gordon Strachan builds his team for the future.

Supported by: Joan McAlpine*, Stuart McMillan*, *, *, *, *, Kevin Stewart*

*S4M-07577 Kevin Stewart: Offshore Europe—That the Parliament welcomes the tens of thousands of delegates and over 1,500 exhibitors who, it understands, are attending the 2013 Offshore Europe (OE) Conference and Exhibition in Aberdeen; believes that the event is held in high regard by the global energy industry, members of which will converge on the city to participate in the four-day event; hopes that OE will generate lots of new business for Scotland’s oil and gas companies from across all sectors of the industry, and wishes all of the participants and the organisers the very best in their endeavours.

Supported by: Nanette Milne*, Dennis Robertson*, Kenneth Gibson*, Chic Brodie*, Roderick Campbell*, Joan McAlpine*, George Adam*, Richard Lyle*, Angus MacDonald*, Stuart McMillan*, Liam McArthur*, Nigel Don*

*S4M-07576 Christine Grahame on behalf of the Justice Committee: European Commission Proposal for a Council Regulation on the Establishment of the European Public Prosecutor’s Office—That the Parliament agrees that the European Commission Proposal for a Council Regulation on the establishment of the European Public Prosecutor’s Office (COM(2013) 534 final) does not comply with the principle of subsidiarity as laid down in Article 5 of the Treaty on European Union.

*S4M-07575 Christine Grahame: Hmmm...Chocolate—That the Parliament congratulates Ruth Hinks of Cocoa Black in Peebles on becoming the first woman to progress to the World Chocolate Masters to be held in France in October 2013 after becoming the first female winner of the UK World Chocolate Masters in 2012; further congratulates her on becoming the first person to win both UK World Chocolate Master and UK Confectioner of the Year titles; notes that her chocolate-making expertise has been showcased on national television and at various international demonstrations, and wishes her luck for the competition, which is to be held at the Salon du Chocolat Professionnel in Versailles and will showcase professional pastry chefs and chocolate masters from around the world.

*S4M-07574 Kenneth Gibson: No UK Tax Liability for Vodafone—That the Parliament notes Vodafone’s recent sale of its 45% stake in Verizon Wireless to the US telecoms group, Verizon Communications, for £84 billion; understands that this represents one of the biggest corporate deals in history; believes that, while Vodafone was founded and is headquartered in the UK, due to complex tax arrangements, the company does not believe that it is liable to pay UK tax and that, following the conclusion of the recent deal, HM Revenue and Customs (HMRC) is expected to receive little or, indeed, nothing; believes that, because Vodaphone’s stake in Verizon Wireless was held by a Dutch subsidiary, using Dutch legislation, it will benefit from a tax exemption on disposals in the Netherlands; considers with alarm that, even if Vodafone’s UK-based parent company sold the stake in Verizon Wireless, it is still highly unlikely that it would have had to pay any UK tax because of the Finance Act 2002, which was introduced by the last Labour administration and allowed for an exemption from capital gains tax on so-called substantial shareholdings held by companies; understands that, following previous tax avoidance controversies, including what it considers the infamous sweetheart deals struck between companies and HMRC, which reportedly allowed Vodafone to forego £6.75 billion in tax, this latest action illustrates that Vodafone does not feel that it has any moral duty to pay its fair share of tax to the country in which it operates and where 41% of its shares are held; considers that, despite rhetoric to the contrary, the Labour Party, as evidenced by its time in government, does not take the issue of tax avoidance seriously; further believes that the Labour Party has created a tax environment suited to multinational corporations wanting to take advantage of tax loopholes and that the party is primarily concerned with rewarding large and powerful companies, and believes that, in the process, the Labour Party has let down the UK public, who, it considers, expected it to tackle such practices when it was in power.

Supported by: Richard Lyle*, Jamie Hepburn*, Christina McKelvie*, Joan McAlpine*, *, *, Adam Ingram*, Mike MacKenzie*, John Mason*, Stuart McMillan*, Chic Brodie*, John Wilson*, Nigel Don*

*S4M-07573 Nicola Sturgeon: High Speed Rail (Preparation) Bill - UK Legislation—That the Parliament agrees that the relevant provisions of the High Speed Rail (Preparation) Bill, introduced in the House of Commons on 13 May 2013, relating to preliminary investment in preparatory works for the construction of a high speed rail network, in so far as these matters fall within the legislative competence of the Scottish Parliament, should be considered by the UK Parliament.

*S4M-07572 John Finnie: The Case for an Independent Socialist Scotland—That the Parliament welcomes the publication of The Case for an Independent Socialist Scotland, which was written by Colin Fox, as a contribution to what it considers the important debate on the country’s future.

Supported by: *, David Torrance*, Jean Urquhart*

Business Bulletin: Wednesday 4 September 2013 Section J – Progress of Legislation

For further information on the progress of Bills and subordinate legislation, contact either the relevant clerk or webpage (see end of Bulletin for details).

Bills in Progress A list of all Bills in progress can be accessed via the Scottish Parliament website at: http://www.scottish.parliament.uk/parliamentarybusiness/Bills/576.aspx

For each Bill, the date of the next (or most recent) event in the Bill’s passage is given. Other relevant information, e.g. about lodging amendments, is given in italics.

As soon as a Public Bill (i.e. a Government, Committee or Member’s Bill) has completed Stage 1, amendments for consideration at Stage 2 may be lodged; and as soon as Stage 2 is completed, amendments for Stage 3 consideration may be lodged. The last lodging day for amendments at Stage 2 is three sitting days before the meeting at which those amendments will be considered (e.g. Thursday for a meeting on Tuesday); at Stage 3 it is four days before. Amendments may be lodged until 4.30 pm on any sitting day, except on the last lodging day for Stage 2, when the deadline is 12 noon.

A Hybrid Bill is subject to the same rules except in the case of Stage 2 where amendments for consideration may be lodged no earlier than the completion of any consideration of evidence at Stage 2.

Amendments to Private Bills are subject to different deadlines. These are set out in Rule 9A.12 of Standing Orders.

Members are advised to lodge amendments in good time before the beginning of a Stage and as early as possible during the day.

(G) = Government Bill; (M) = Member’s Bill; (C) = Committee Bill; (P) = Private Bill; (H) = Hybrid Bill.
