Gutierrez Posse is Professor of Public International Law, University of Buenos Aires Abstract International humanitarian law is the branch of customary and treaty-based international positive law whose purposes are to limit the methods and means of warfare and to protect the victims of armed conflicts. Grave breaches of its rules constitute war crimes for which individuals may be held directly accountable and which it is up to sovereign states to prosecute. However, should a state not wish to, or not be in a position to, prosecute, the crimes can be tried by international criminal tribunals instituted by treaty or by binding decision of the United Nations Security Council. This brief description of the current legal and political situation reflects the state of the law at the dawn of the twenty-first century. It does not, however, describe the work of a single day or the fruit of a single endeavour. Quite the contrary, it is the outcome of the international community’s growing awareness, in the face of the horrors of war and the indescribable suffering inflicted on humanity throughout the ages, that there must be limits to violence and that those limits must be established by the law and those responsible punished so as to discourage future perpetrators from exceeding them. Volume 91 Number 875 September 2009 REPORTS AND DOCUMENTS The Geneva Conventions and Public International Law British Foreign and Commonwealth Office Conference commemorating the 60th Anniversary of the 1949 Geneva Conventions, London, 9 July 2009 Address by Theodor Meron, Judge and former President of the International Criminal Tribunal for the former Yugoslavia, Professor of International Law and holder of the Charles L. Denison Chair at New York University Law School With sixty years of hindsight, it seems particularly appropriate to reflect on the trajectory of international humanitarian law (IHL) as shaped by the 1949 Geneva Conventions. The near universal acceptance of the Conventions and their secure integration into the international system can sometimes lead us to underestimate the significance of their impact. It is this transformative impact on public inter- national law which will be the focus of this note. To start, I will briefly review the historical context from which the 1949 Conventions materialized. Calamitous events and atrocities have always driven the development of IHL. In 1863, the American Civil War gave rise to the Lieber Code. This ultimately gave birth to the branch of IHL commonly known as the Hague Law, which governs the conduct of hostilities. One hundred and fifty years ago, the battle of Solferino – immortalized in Henry Dunant’s moving memoir of suffering and bloodshed – inspired the Red Cross Movement. Thence began the other branch of IHL, the Geneva Law, which – starting with the first Geneva Convention in 1864 – has provided for the protection of victims of war, the sick, the wounded, prisoners and civilians. -

In the wake of the transition to a democratic state, the country and region economy has prospered and its institutions have grown more complex. As institutional capacity has grown, so too has the need for a robust rule of law. An established rule of law can provide assurances to investors and businesses, while keeping checks on government and private powers and protecting citizens’ fundamental rights. Institutions of higher learning, such as universities and professional training centers, can and should play a key role in stimulating and sustaining this dynamic. Indeed, education is foundational. This paper is part of the Introduction to the Laws of Iraq and Iraqi Kurdistan, a series of working papers produced by the Iraqi Legal Education Initiative (ILEI) of Stanford Law School. This series seeks to engage Iraqi students and practitioners in thinking critically about the laws and legal institutions of Iraq and Iraqi Kurdistan. Founded in 2012, ILEI is a partnership between the American University of Iraq in Sulaimani (AUIS) and Stanford Law School (SLS). The Commission, at its sixty-fifth session (2013), decided to include the topic “Crimes against humanity” in its long-term programme of work,77 on the basis of the proposal prepared by Mr. Sean D. Murphy and reproduced in annex B to the report of the Commission on the work of that session.78 The General Assembly, in paragraph 8 of its resolution 68/112 of 16 December 2013, took note of the inclusion of this topic in the Commission’s long-term programme of work. 109. At its sixty-sixth session (2014), the Commission decided to include the topic in its programme of work and appointed Mr. Sean D. Murphy as Special Rapporteur for the topic. 79 The General Assembly subsequently, in paragraph 7 of its resolution 69/118 of 10 December 2014, took note of the decision of the Commission to include the topic in its programme of work. B. Consideration of the topic at the present session 110. At the present session, the Commission had before it the first report of the Special Rapporteur (A/CN.4/680), which was considered at its 3254th to 3258th meetings, from 21 to 28 May 2015.80 111. In his first report, the Special Rapporteur, after assessing the potential benefits of developing a convention on crimes against humanity (section II), provided a general background synopsis with respect to crimes against humanity (section III) and addressed some aspects of the existing multilateral conventions that promote prevention, criminalization and inter-State cooperation with respect to crimes (section IV). -

Four factors are identified that point to the churches’ complicity in creating and sustaining the conditions in which the 1994 genocide could occur, leaving up to one million people dead. These factors include the close relationship between church and state, the churches’ endorsement of ethnic policies, power struggles within the churches, and a problematic theology emphasizing obedience instead of responsibility. Nevertheless, the portrayal of all Christian churches as collaborators of the genocide appears too simplistic and one-sided. Various church-led initiatives for peace and reconciliation prior to the genocide indicate a more complex picture of church involvement. Turning away from a “Theology of Genocide” that endorsed ethnic violence, numerous Christian churches in Rwanda now propagate a “Theology of Reconciliation.” A modest empirical case study of the Presbyterian Church (EPR) reveals how their “Theology of Reconciliation” embraces the four dimensions of theology, institutions, relationships, and remembrance. Based on their own confession of guilt in the Detmold Confession of 1996, the EPR’s engagement for reconciliation demonstrates religion’s constructive contribution in Rwanda’s on-going quest for sustainable peace and development. -
