Iowa Department of Public Health IDPH Legislative Update April 10, 2017 In this issue: • Second Funnel • IDPH 2017 Policy Package • Public Health Bills of Interest That Survived the Second Funnel • Bills Sent to, Signed by Governor • Bills of Interest That Did Not Advance Second Funnel The second funnel deadline for this legislative session was Friday March 31. Bills must have reached a certain point in order to continue advancing or they are considered dead in their current format. For more information on funnel deadlines, please see the IDPH Legislative Update from March 8 2017, linked here. The Session Timetable is a helpful resource to know what bills are considered funnel-proof, as well as what bills may be considered during the coming weeks. IDPH 2017 Policy Package IDPH Omnibus Bill HF 393 (formerly HSB 25). The bill passed the House chamber, with an amendment, on March 13 by a vote of 95-0. The bill was referred to the Senate Human Resources Committee. A subcommittee of Senators Mark Costello, Pam Jochum, and Tom Shipley was assigned to the bill. UPDATE: The subcommittee recommended passage on March 21. The full Senate Human Resources Committee passed the bill out on March 29. It may now be considered by the full Senate chamber. IDPH and Iowa Workforce Development’s Plumbing/Contractors Bill SF 411 (formally SSB 1113). The bill passed the Senate chamber on March 14 by a vote of 49-0. It was then referred to the House State Government Committee. A subcommittee of Representatives Kevin Koester, Michael Bergan, and Bruce Hunter recommended passage of the bill. UPDATE: The bill was voted out of the full House State Government Committee on March 30. It may now be considered by the full House chamber. Public Health Bills of Interest Advancing Past Second Funnel Behavioral Health SF 415 (Formally SSB 1088): Good Samaritan Law – Alcohol Only. The bill passed the Senate chamber by a vote of 49-0 on March 15. The bill was then referred to the House Judiciary Committee. UPDATE: A subcommittee of Representatives Megan Jones, Lee Hein, and Mary Lynn Wolfe has been assigned to the bill. The subcommittee recommended passage on March 28. The bill passed the full House Judiciary Committee on March 30. It may now be considered by the full House chamber. SF 442 (Formally SSB 1103) Self Exclusion from Gambling Facilities. The bill passed the Senate chamber by a vote of 47- 2 on March 14. The bill was referred to the House State Government Committee. A subcommittee of Representatives Kevin Koester, Mary Mascher, and Ken Rizer was assigned to the bill. UPDATE: The subcommittee recommended passage with an amendment on March 23. The full House State Government Committee recommended passage with an amendment on March 29. The bill passed the full House chamber on April 6 by a vote of 75-20. Since the bill was amended by the House it will now “bounce” back to the Senate chamber for their concurrence with the change. HF 613 (Formally HSB 52) Fantasy Sports. UPDATE: The study bill was referred to the House Committee on Ways and Means. UPDATE: The subcommittee recommended passage with an amendment on March 23. The full House Ways and Means Committee passed out the bill with an amendment on March 23. The bill received a file number and was placed on the calendar as unfinished business. Four amendments were filed on April 3 and 4 that may be considered during House chamber discussion. Bills in this committee are considered funnel-proof. Bills on Opioid-Related Issues HF 523 Medical Examiner’s Bill. UPDATE: The bill passed the House chamber by a vote of 96-0 on March 15. It was referred to the Senate Judiciary Committee. A subcommittee of Senators Jeff Edler, Kevin Kinney, and Jason Schultz recommended passage of the bill on March 23. The full Senate Judiciary Committee passed out the bill on March 28. It may now be considered by the full Senate chamber. HF 524 (Formally HSB 89) PDMP Requirements/Naloxone Coverage. The bill passed the house with an amendment by a vote of 96-0 on March 21. It was referred to the Senate Judiciary Committee. A subcommittee of Senators Jeff Edler, Julian Garrett, and Rich Taylor was assigned to the bill. The bill passed out of subcommittee on March 29. The Senate Judiciary Committee passed out the bill with an amendment on March 30. It is now eligible for consideration by the full Senate chamber. HF 532 (Formerly HF 322) Required Prescriber Enrollment with PDMP. The bill was referred the House Human Resources Committee. It passed committee on March 2. UPDATE: The bill passed the House chamber by a vote of 95-1 on March 28. The bill was referred to the Senate Human Resources Committee. A subcommittee of Senators Tom Shipley, Thomas Greene, and Herman Quirmbach was assigned to the bill. It passed out of the full Senate Human Resources Committee on March 30. It is now eligible for debate by the full Senate chamber. HF 543 (Formerly HF 276) Child Abuse Cases Involving Drugs. The bill was referred to the House Human Resources Committee. It passed committee on February 28. The bill passed out of the House chamber by a vote of 93-0 on March 14. It was then referred to the Senate Human Resources Committee. A subcommittee of Senators Jake Chapman, Joe Bolkcom, and Craig Johnson was assigned to the bill. UPDATE: The bill passed out of subcommittee on March 22. It passed the full Senate Human Resources committee on March 29. It may now be considered by the full Senate chamber. Chronic Disease and Infectious Disease Prevention SF 475 (Formerly SSB 1137) Children’s Health Screenings. UPDATE: The bill passed the full Senate chamber with amendments by a vote of 33-15 on March 21. The bill was referred to the House Education Committee. A subcommittee of Representatives Skyler Wheeler, Mary Ann Hanusa, Tom Moore, Amy Nielsen, and Sharon Steckman recommended passage on March 27. The full House Education Committee passed out the bill out on March 29. NOTE: Division III of this bill directs IDPH to convene a workgroup of specified stakeholders to make recommendations on reducing the administrative burden to schools for ensuring compliance with dental, vision, and lead screenings, and immunizations. Injury Prevention HF 513 (Formally HSB 130) Safe Operation of Bicycles. The bill was referred to the House Transportation Committee. A subcommittee of Representatives John Wills, Gary Mohr, and Lisa Heddens was assigned to the bill. The bill passed out of committee on March 2. It may now be considered by the full House chamber. Two amendments were filed on March 15 that may be considered during floor debate. UPDATE: The bill was placed on the House calendar as unfinished business. Safe Driving Bills 2 Iowa Department of Public Health IDPH Legislative Update April 10, 2017 HF 590 (Formally HSB 139) Ban on Hand-Held Phones while Driving. The bill was referred the House Transportation Committee. The bill passed out of the House Transportation on March 2 and may now be considered by the full House chamber. It was placed on the House calendar under unfinished business on March 30. SF 444/HF 519 (Formerly SSB 1101/HSB 109) Governor’s Bill on Traffic Safety including a 24/7 Sobriety Program. Each bill was referred to each chamber’s Judiciary Committees. SF 444 passed the full Senate chamber on March 9 by a vote of 48-0. It was referred to the House Ways and Means Committee. A subcommittee of Representatives Zach Nunn, Mary Gaskill, and Guy Vander Linden was assigned to the bill. The bill passed out of subcommittee on March 20. UPDATE: The full House Ways and Means Committee passed SF 444 out on March 30. The bill passed the House on April 6, with an amendment, by a vote of 90-3. It will now “bounce” back to the Senate chamber for their concurrence with the change. HF 519 was withdrawn. Water Quality HF 538 (Formerly HSB 135) House Water Quality Bill. The bill was referred to the House Agriculture Committee. It passed out of committee on March 1. It was then referred to the House Ways and Means Committee for consideration of the language relating to taxes and fees. The subcommittee recommended passage on March 14. UPDATE: The House Ways and Means committee passed the bill out on March 23. It may now be considered by the full House chamber. SF 482 (Formerly SSB 1034) Governor’s Water Quality Bill. This bill was referred to the Senate Committee on Natural Resources and Environment. It passed the committee on March 1 and was referred to the Senate Ways and Means Committee for consideration of the taxes and fees including in the bill. The bill passed out of Ways and Means on March 7, and was referred to the Senate Appropriations Committee. A subcommittee of Senators Tom Shipley, Rick Bertrand, and Joe Bolkcom has been assigned to the bill. UPDATE: The subcommittee recommended passage on April 5. It may now be considered by the full Senate Appropriations Committee. Other Bills of Public Health Interest HF 520/SF 470 (Formerly HSB 164/SF 282) Epidiolex Affirmative Defense (CBD Investigational Product). UPDATE: HF 520 was referred to the House Public Safety Committee. It passed out of committee on March 1 and may now be considered by the full House chamber.
