Accord­ ing to the complaint, the plain­ tiffs’ injuries occurred as a result of an accident in which a vehicle driven by D’Avilar, in which Vassell was a passenger, was struck in the rear by a vehicle driven by Bao Lu and owned by Min Lu. Hon. Loren Baily­Schiff­ man denied the motion of the defendants. Bao and Min Lu ap­ pealed in the Appellate Division, Second Department, where the order of the Supreme Court was affirmed. In their decision, the appellate justices found that the defendants failed to establish that Bao Lu had a nonnegligent explanation for striking the rear of D’Avilar’s vehicle. The justices explained that, in support of their motion, the defendants submitted transcripts of the dep­ osition testimony of D’Avilar, Vassell and Bao Lu. They deter­ mined that the evidence presented failed to determine whether the accident involved two or three vehicles. —D'Avilar v. Lu, 2019‐11170, June 17, 2020 DAMAGES REDUCED IN APPEAL INVOLVING BREACH OF CONTRACT Appellate Division, Second Department In an effort to recover damages for breach of contract, Shirley Pinkney and others filed a complaint in Kings County Supreme Court, Civil Term against Paris Fields, among others. Pursuant to the contract, Pinkney hired Fields to perform renovation work on a residential building located in Brooklyn. Following a nonjury trial on the issue of damages, the Supreme Court rendered a de­ cision and judgment. Upon an appeal by the defendants, the jus­ tices of the Appellate Division, Second Department modified the judgment. The justices first noted that, in reviewing a determi­ nation made after a nonjury trial, their “power is as that of the trial court” and that they “may render a judgment warranted by the facts, taking into account that in a close case, the trial court had the advantage of seeing and hearing the witnesses. They concluded that in this case, with one exception, the Supreme Court’s determinations regarding damages were warranted by the facts. However, the justices found that, as the plaintiffs con­ cede, the determination to award consequential damages in the principal sum of $24,481.49 was not warranted by the facts. In­ stead, based on the trial evidence, a consequential damages award in the principal sum of $15,336.12 was warranted by the facts. Therefore, the justices reduced the award of consequential damages, reduced the total damages awarded from the principal sum of $31,741 to the principal sum of $22,595.63 and remitted the matter to the Kings County Supreme Court, Civil Term for a recalculation of interest on the damages award and for the entry of an appropriate amended judgment. —Pinkney v. The justices explained that the defendants met their burden of showing that An did not sustain a serious injury within the meaning of insurance law as a result of the accident. They noted that the defendants submitted competent medical evidence establishing that the alleged injury to An’s right knee did not constitute a serious injury under either the permanent consequential limitation of use or significant limitation of use categories.
