Post. The payment should be made in Cash / Bank Draft / Postal Order in favour of Sr.A.O./S&W UHBVN Dhulkote payable at Ambala.

The last date of issue of tender documents is 24.10.2013 upto 1 PM. Tender will be received upto 3:00 PM on 24.10.2013 & opened on the same day in the office of XEN/TRW UHBVN Dhulkote at 3:30 PM in the presence of the tenderers or their representative who may like to be present at the time of opening. In case last date of sale / submission / opening happens to be a holiday, the tender can be purchased / submitted / opened on next working day.

Earnest money of Rs. 50,000/- should be deposited in the shape of DD in favour of Sr.A.O./S&W UHBVN Dhulkote payable at Ambala.

Terms & Condition:

1. The payment shall be made to the Workers by the contractor timely and any dispute with the labour shall be the responsibility of the Contractor.

2. The payment shall be made to the Contractor by A/C Payee’s Cheque through Escrow Account in the following month after receipt of bill from the contractor& proof of disbursement of wages to each worker and after due verification by the Nigam representative.

3. The order is valid up to 08-02-2014, but the department reserves the right of extend the period or curtailing the Workers at any time fully & partially for which no compensation shall be paid to contractor.

4. The officer in-charge of the work shall be authorized to dispense with the services of the Workers supplied by him, if any one or all of them do not work according to his satisfaction or non availability of raw material.

5. The contractor shall be responsible for payment of compensation to the Workers employed through him, if some any mis-happening occurs with them during the working hours. Also accessories which are required for performing of duties such as torch, dress, leather bags etc. is to be provided by the contractor.

6. All formalities e.g. insurance of Workers, payment of EPF, maintaining of record of payment to Workers or any other statuary requirement of state/Central Govt. under Labour Act shall be fulfilled by the contractor.

7. No Claim of absorption of Workers in the Nigam shall be entertained at any stage & Workers shall remain as employees of contractor for all the times.

8. The disbursement of wages to each Workers will be made by the Contractor to the individual employee through Escrow Account under XEN/TRW UHBVN Dhulkote of the Nigam up to 7th of every month and payment certificate along with a copy of the pay bill deposit receipt of EPF employees share, ESI & Service Tax shall be furnished by the Contractor by the 10th of every month. Without operating of Escrow Account, no payment will be released to contractor.

9. The contractor has to furnish an affidavit duly attested by notary public that the payment to the Workers engaged by him will be made on DC rates applicable for revenue Distt. in full and no deduction from this will be made.

10. Income tax and surcharge on income tax will be deducted as applicable from bill.

11. The D.C. rate for the Workers supplied by the Contractor shall be applicable for the month for which the Workers are engaged.

12. Contactor will submit an Affidavit by 10th of every month that he has deposit all dues to the concerned department i.e. EPF Contribution along with employer share, ESI and Service Tax. EPF employer share ESI & Service Tax as applicable which will be reimbursed on the production of original deposit receipts.

13. The Workers below the age 18 years shall not be employed & the contractor shall allow weekly rest as per labour Act without extra charges to the Nigam on this account.

14. The contractor will be fully responsible for giving the compensation in the case of any accident (fatal/not-fatal) happened to the Workers while doing the job and in no case liability will be on the Nigam.

15. The scope of work for the contract labour in various offices /TRWs / THWs under XEN/TRW Dhulkote of the UHBVN be according to their nature of work.

16. In every case in which by virtue of the provision of section 12 sub-section (i) of the time will be followed strictly. Form-10 & 14 will be maintained by the contractor.

17. In every case in which by virtue of the provision of section (i) of the Workmen’s compensation Act, 1923, UHBVN is obliged to pay compensation to a workman employed by the contractor for execution works. UHBVN will recover from the contractor the amount of compensation so paid & without prejudice to the right of the UHBVNL under section 12 of sub-section (2) of the said Act UHBVN shall recover such amount & have right there by to deduct it from the security deposit or from any sum due to UHBVNL by the contractor whether under this contract or otherwise or any other contractor under any other Nigam.

18. Any dispute arising out of contract shall be limited to Ambala Jurisdiction only.

19. The services of the Workers employed can be utilized in any of offices /TRWs under XEN/TRW UHBVN Dhulkote without any extra cost. The DC rate as mentioned in work order will be applicable.

20. The holiday in the offices /TRW workshops shall be observed by the contract Workers as notified in the list of holidays circulated by the Haryana Govt. & adopted by the Nigam. However, in case of emergency, the services of contract Workers can be requisitioned by the officer in charge of work to meet any contingency even on Sunday & Holidays.

21. Only service charge/premium allowed to the contractor shall count to the contractor’s commission.

22. The contractor shall comply with all relevant labour acts, Rules Regulation of the central Govt./UHBVNL and he will prepare the record & submit the required statement/return periodically to the concerned competent authority.

23. The EPF regulation as per miscellaneous Act 1952, ESI & any other State/Central Govt. Taxes shall be complied with by contractor.

24. A Valid license should be available with labour contractor all the times as per labour (Regulation & Abolition) Act 1970 Labour (Regulation & Abolition) Rule 1975 and he will supply necessary document/information to the UHBVNL/Labour Department regarding Workers Engaged.

25. The first aid facilities will be provided by the contractor if any worker is injured during his stay at the place of work.

26. All the terms and condition as specified in the tender enquiry for the said work shall be applicable.

27. If an injury is such that permanent disability is caused to the Workers, the necessary compensation will be provided by the Contractor as per applicable laws.

28. The contractor will abide by all labour acts & rules & legalization as framed by the Govt./Nigam amended from time such as contract labour (R&A) Act, 1970 payment of wages Act 1936, payment of minimum wages Act, 1948 & State rules/regulation made there under. The contractor will maintain necessary records as required under labour regulation & make available the same for inspection by the competent authority of the Nigam/State/Labour Act. The labour regulation & Conditions/guidelines/instruction issued by the State/Nigam from time to time will be followed strictly by the contractor.

29. The Contractor labour is required for the period as mentioned in aforesaid column.

30. Contractor will sign all service agreement as per policy of the Nigam for outsourcing of service/activities supplied vide memo no. Ch-88/UH/GA-438 Dt. 10.6.2009 & instructions issued time to time.

31. The performance of the Contractor will be reviewed time to time and if his working is not found satisfactory, work order will be cancelled and issued to the second lowest.

32. This office reserves the right to cancel the work order at any time without assigning any reason to the contractor.

33. The work order will be cancelled without prior information in case of violation of any rules/terms and condition of the work order.
