Mayor Eisenberger called the meeting to order and called upon Pastor Michael Smith of the United Pentecostal Church to lead Council in prayer.

Mayor Eisenberger called on Councillor Whitehead to come forward to make a presentation. On behalf of the Gilkson Community Association, Councillor Whitehead presented Councillor Farr with 100 hockey jerseys for the Skate the Dream Project. Councillor Farr thanked Councillor Whitehead and the Gilkson Community Association for their donation.

GENERAL ISSUES COMMITTEE REPORT 15-011

(Eisenberger/Whitehead) That Item 13 of the General Issues Committee Report 15-011, respecting the Auchmar Non-Binding Request for Proposals, be amended by adding sub-section (f), to read as follows:

13. Auchmar Non-Binding Request for Proposals (PED15072) (Ward 8) (Item 8.11)

(a) That the Request for Proposals for The Use, Adaptive Re-Use, Conservation, and Management of the Auchmar Estate in the City of Hamilton (Contract Number C3-06-14) be terminated;

(b) That the Real Estate Section of the Economic Development Division of the Planning and Economic Development Department be authorized and directed to enter into negotiations for the sale of the land and buildings, legally described as Parts 2, 3, 4 and 5 on Plan 62R-15401, with a right of way over Part 1 on Plan 62R-15401, as shown in Appendix “A” attached to Report PED15072, in accordance with the “Procedural By-law for the Sale of Land”, being By-law No. 14-204 and substantially on terms and conditions outlined in Appendix “B” attached to Report PED15072, and any such other terms and conditions deemed appropriate by the General Manager, Planning and Economic Development Department;

(c) That the Manager of Real Estate be authorized to retain the services of an independent qualified appraiser, in good standing with the Appraisal Institute of Canada, to establish a fair market value of the subject property;

(d) That all costs, including legal, appraisal and real estate, be debited to 10005 – Revolving Fund-Historic Properties; and,

(e) That the Manager of Real Estate be directed to report back to the General Issues Committee with any potential purchasers that have (i) substantially met the terms and conditions outlined in Appendix “B” attached to Report PED15072, and any such other terms and conditions deemed appropriate Council Minutes 15-013 May 27, 2015 Page 5 of 18

by the General Manager, Planning and Economic Development Department, and (ii) entered into an offer to purchase agreement with the City.

(f) That, as part of the conditions for a potential Agreement of Purchase and Sale, staff be directed to include a clause that provides the City of Hamilton a first right of refusal, should the new property owner choose to subsequently re-sell the land and buildings, legally described as Parts 2, 3, 4 and 5 on Plan 62R-15401, with a right of way over Part 1 on Plan 62R-15401, currently known as the Auchmar Estate. CARRIED

(Farr/B. Johnson) That Item 16 (a) of the General Issues Committee Report 15-011, respecting Grants Sub-Committee Report 15-001, May 8, 2015, be amended by adding sub-section (viii) and (ix) to read as follows:

(viii) That the recommended 2015 City Enrichment Fund grant for the Factory Media Centre, Annual Operations, in the amount of $10,410, be approved.

(B. Johnson/Ferguson) That Item e(i) of the General Issues Committee Report 15-011 respecting Gord McNulty, 2015 Canadian Aviation Historical Society (CAHS) Convention Committee, respecting the CAHS’s 52nd National Convention and Annual General Meeting to be held June 17-21, 2015 in Hamilton (Item 6.1) be lifted from the Information Section and added as Item #21 to Report 15-011. 21. Financial Support for Transportation Costs of the Canadian Aviation Historical Society (CAHS) National Convention and Annual General Meeting (AGM)

(B. Johnson/Ferguson) Whereas, the City of Hamilton will be the host city for the Canadian Aviation Historical Society (CAHS) National Convention and Annual General Meeting (AGM) from June 17-21, 2015;

Whereas, the last Canadian Aviation Historical Society convention held in Hamilton was 1984; Council Minutes 15-013 May 27, 2015 Page 6 of 18

Whereas, there will be delegates from across Canada and the United States coming to Hamilton;

Whereas, there will be economic benefits to the City as a result of the convention; and

Whereas, convention organizers have been coordinating with the Canadian Warplane Heritage Museum;

Therefore be it resolved:

(a) That Council provide financial support towards the transportations costs of the convention and AGM in the amount of $520; and

(b) That the costs for supporting the CAHS be funded from Tax Stabilization Reserve (110046) CARRIED

MOTIONS

7.1 Hamilton East Food Bank

(Collins/Merulla) That Item 13 of the Audit, Finance & Administration Committee Report 14-008, which was approved by Council on September 24, 2014, be amended by deleting it in its entirety and replacing it with the following in lieu thereof:

13. Hamilton East Food Bank (Item 9.1)

That the request for funding, through the 2014 Community Partnership Program Reserves in the amount of $15,000, to offset a portion of the operating costs for a new Hamilton East Food Bank through the end of the 2014 calendar year, be approved; contingent upon the Ward 5 Councillor providing the required 2014 application and associated documents to the Coordinator of the Community Partnership Program for review/rating of a Community Partnership Program application.

That the request for funding, through the 2014 Community Partnership Program Reserves in the amount of $15,000, to offset a portion of the operating costs for a new Hamilton East Food Bank, facilitated by St. Matthews House, through the end of the 2014 calendar year, be approved; contingent upon:

(i) The Ward 5 Councillor providing the required 2014 application and associated documents to the Coordinator of the Community Partnership Program for review/rating of a Community Partnership Program application; and,

7.2 Exemption Request from By-law 10-142, being a by-law to Regulate Fences – 18 Hillsdale Court, Dundas, Ontario

(VanderBeek/Pasuta) Whereas, the City of Hamilton has passed By-law 10-142 being a by-law to regulate fences;

And whereas, By-law 10-142 restricts the height of a fence to 0.9m within 3.0m of a front lot line, but the height may be increased to 2.0m if the fence is more than 3.0m from the front lot line;

And whereas, the property at 18 Hillsdale Court, Dundas, Ontario is a triangular shaped lot with the outdoor amenity area located in the front and side yard;

And whereas, the owner of the property wishes to erect‎ a 2.0m high fence along their front lot line for privacy and safety considerations;

And whereas, the proposed 2.0m high fence will not have any negative effects on adjoining properties or affect safe vehicular access to and from the property or adjoining property;

And whereas, exemptions to the Fence By-law are permitted where approval under the Planning Act has been granted but a fence for a single family dwelling is not subject to Planning Act approval;

Therefore be it resolved:

That‎ the requested exemption from By-law 10-142, being a by-law to regulate fences, to permit a 2.0m high fence along the front lot line for the property at 18 Hillsdale Court, Dundas, Ontario, be approved. CARRIED

7.3 Wentworth Adult Mixed Slo-Pitch League June Tournament – Special Occasion Permit Liquor Licence

(Duvall/Whitehead) Whereas, Hamilton City Council has received Notice (attached hereto as Appendix “A”) from Mr. Joe Seroski on behalf of the Wentworth Adult Mixed Slo- Pitch League, that they wish to obtain approval for a Special Occasion Permit Liquor Licence to sell alcohol on June 19, 2015 between the hours of 5:00 p.m. and 11:00 p.m.; June 20, 2015 between the hours of 11:00 a.m. and 11:00 p.m. and June 21, 2015 between the hours of 11:00 a.m. and 7:00 p.m. at Turner Council Minutes 15-013 May 27, 2015 Page 9 of 18

Field located at 344 Rymal Road East, Hamilton, Ontario, during the Wentworth Adult Mixed Slo-Pitch League June Tournament taking place in Hamilton, Ontario;

Whereas, the Alcohol and Gaming Commission of Ontario requires that if a permit holder is not a registered charity or non-profit organization, that a resolution of the Council is required to designate the event as one of municipal significance; and

Whereas, the City of Hamilton does not have an objection to the Liquor Licence Serving Time Extension for the following establishment;

Therefore be it resolved:

(a) That the City of Hamilton hereby deems the Wentworth Adult Mixed Slo- Pitch League June Tournament, being held in the City of Hamilton, Ontario on June 19, 20 and 21, 2015, as municipally significant; and,

(b) That the following applicant be provided a copy of this resolution for inclusion with their application to the Alcohol and Gaming Commission of Ontario:

(Conley/Pearson) Whereas, Hamilton City Council has received Notice (attached hereto as Appendix “A”) from Mr. Justin Brown on behalf of the Fourword Thinking, that they wish to obtain approval for a Special Occasion Permit Liquor Licence to sell alcohol on June 5, 2015 between the hours of 4:00 p.m. and 11:00 p.m.; June 6, 2015 between the hours of 11:00 a.m. and 11:00 p.m. and June 7, 2015 between the hours of 11:00 a.m. and 7:00 p.m. at Valley Park located at 970 Paramount Drive, Stoney Creek, Ontario, during the Hamilton Rib Fest taking place in Hamilton, Ontario;

Whereas, the Alcohol and Gaming Commission of Ontario requires that if a permit holder is not a registered charity or non-profit organization, that a resolution of the Council is required to designate the event as one of municipal significance; and

Whereas, the City of Hamilton does not have an objection to the Liquor Licence Serving Time Extension for the following establishment;

Therefore be it resolved:

(i) Fourword Thinking c/o Mr. Justin Brown, Toronto, Ontario.

CARRIED 7.5 Fostering the Light Rail Transit (LRT) Project

(Merulla/Farr) Whereas, the Province of Ontario has just announced that the City of Hamilton will receive Light Rail Transit (LRT) funding that will see the B-Line run from McMaster University through downtown Hamilton to Queenston Circle (Ward 4, East Hamilton);

Whereas, the LRT will connect directly to the new West Harbour GO Station, which is now under construction, and protect for a future, high-order pedestrian connection to the Hamilton Centre GO Station;

Whereas, procurement for the LRT will start in 2017, with construction starting in 2019;

Whereas, the Province will extend GO rail service on the Lakeshore West line from the West Harbour GO Station at James Street North to a new GO station at in eastern Hamilton, with construction is expected to begin in 2017, with completion in 2019;

Whereas, this undertaking equates to up to $1B in investment in Hamilton to build a new Light Rail Transit (LRT) line, including construction and;

Whereas, this announcement and scope of work will affect significant regions of the entire City of Hamilton, specifically around the B-Line, and GO station(s);

Therefore be it resolved:

(a) That the City Manager be directed to report back on creating an office to facilitate the Light Rail Transit (LRT) project, working closely with Metrolinx;

(b) That a Light Rail Transit (LRT) Sub-Committee of Council be struck; and

(c) That the affected Councillors along the B-Line corridor be asked to participate on the Light Rail Transit (LRT) Sub-Committee. CARRIED Council Minutes 15-013 May 27, 2015 Page 11 of 18

7.6 Safer City Initiative – Gun Amnesty and Buyback Program for Unwanted and Illegal Firearms

(Green/Eisenberger) Whereas, reducing violent crime and enhancing community safety is a priority for the City of Hamilton;

Whereas, there has been a spate of recent brazen violent crimes including but not limited to a midday shooting on Sunday May 17, 2015;

Whereas, a 2014 gun amnesty program organized by the saw 374 guns and almost 20,000 rounds of ammunition turned in to police; and

Whereas, in the year 2000, a gun buyback program in Toronto turned in 2,000 illegal and unwanted firearms to police;

Therefore be it resolved:

That the Hamilton Police Service consider and advise Council on the feasibility of an extended gun amnesty and buyback program for unwanted and illegal firearms, owned by residents living in the City of Hamilton; and,

That a source of funding be identified for the program.

8.4 Maintain Hydro One as a Wholly Owned Public Asset for the Benefit of all Ontarians

Councillor Merulla introduced the following Notice of Motion:

Whereas, the public electricity system in Ontario is a critical asset to the economy;

Whereas, the public electricity system generates significant revenue for municipal and provincial governments and gives Ontario a competitive advantage;

Whereas, local control and decision making is important to meet the needs of our communities and residents;

Whereas, local electricity distribution companies provide a source of stable and predictable revenue to our communities;

Whereas, some Ontario municipalities have examined possible sales or mergers of their local distribution companies, and have decided not to sell to Hydro One or the private sector; and

Whereas, the privatization, partial or whole, of electricity has led to higher rates and less control;

Therefore be it resolved:

(a) That the City of Hamilton call on the provincial government to:

(i) Stop the sale of any part of Hydro One, and maintain Hydro One as a wholly owned public asset for the benefit of all Ontarians;

(ii) Strengthen Hydro One by investing in the next generation of workers and upgrading aging infrastructure; and

(iii) Respect the autonomy and local decision-making powers of local distribution companies by not forcing these companies into mergers or sales;

8.5 Fostering the Light Rail Transit (LRT) Project

Councillor Merulla introduced the following Notice of Motion:

Whereas, the Province of Ontario has just announced that the City of Hamilton will receive Light Rail Transit (LRT) funding that will see the B-Line run from McMaster University through downtown Hamilton to Queenston Circle (Ward 4, East Hamilton);

Whereas, the LRT will connect directly to the new West Harbour GO Station, which is now under construction, and protect for a future, high-order pedestrian connection to the Hamilton Centre GO Station;

Whereas, procurement for the LRT will start in 2017, with construction starting in 2019;

Whereas, the Province will extend GO rail service on the Lakeshore West line from the West Harbour GO Station at James Street North to a new GO station at Centennial Parkway in eastern Hamilton, with construction is expected to begin in 2017, with completion in 2019;

Whereas, this undertaking equates to up to $1B in investment in Hamilton to build a new Light Rail Transit (LRT) line, including construction and;

Whereas, this announcement and scope of work will affect significant regions of the entire City of Hamilton, specifically around the B-Line, and GO station(s);

Therefore be it resolved:

(a) That the City Manager be directed to report back on creating an office to facilitate the Light Rail Transit (LRT) project, working closely with Metrolinx;

(b) That a Light Rail Transit (LRT) Sub-Committee of Council be struck; and

(c) That the affected Councillors along the B-Line corridor be asked to participate on the Light Rail Transit (LRT) Sub-Committee.

8.6 Safer City Initiative – Gun Amnesty and Buyback Program for Unwanted and Illegal Firearms

Councillor Green introduced the following Notice of Motion:

Whereas, reducing violent crime and enhancing community safety is a priority for the City of Hamilton;

Whereas, there has been a spate of recent brazen violent crimes including but not limited to a midday shooting on Sunday May 17, 2015;

Whereas, a 2014 gun amnesty program organized by the Hamilton Police Service saw 374 guns and almost 20,000 rounds of ammunition turned in to police; and

Whereas, in the year 2000, a gun buyback program in Toronto turned in 2,000 illegal and unwanted firearms to police;

Therefore be it resolved:

That the Hamilton Police Service consider and advise Council on the feasibility of an extended gun amnesty and buyback program for unwanted and illegal firearms, owned by residents living in the City of Hamilton; and,

That a source of funding be identified for the program.
