I. SMES

1 SME'S DEVELOPMENT AND MODERNIZATION

1. Title of the subsidy

The program for developing the commercialisation of market products and services (de minimis aid).

2. Period covered by the notification

2017-2018.

3. Policy objective and/or purpose of the subsidy

Supporting Romanian companies, co-operatives and economic operators, by facilitating access to financing, in order to improve their economic and technical performances and to comply with requirements arising from Romania's status as a member state of the EU, while also increasing competitiveness, creating and maintaining jobs, increasing consumer protection and food safety.

400 new jobs were created through this program, of which 200 for graduates, unemployed or disadvantaged persons.

4. Background and Authority for subsidy (including the identification of legislation through which they are granted)

The grantor of the subsidy is the Ministry of Business Environment, Commerce and Entrepreneurship.

Law N° 346/2004 regarding SMEs set-up and development.

Decision N° 147/04.05.2012 of the President of the Agency for Implementing Projects and Programmes for SMEs for approving the Program for developing the commercialisation of market products and services.

Order N° 473/2014 for approving procedures regarding the implementation of the Program for developing the commercialisation of market products and services, the Program for developing entrepreneurial skills among young people and facilitating their access to finance - START, the multiannual national Program for developing entrepreneurial culture among women managers in small and medium enterprises sector, the multiannual national Program for supporting arts and handicrafts and the multiannual national program for setting-up and developing technological and business incubators.

Law N° 6/2017 regarding the State Budget for year 2017.

The de minimis aid scheme was approved by Order N° 978/02.07.2018 of the minister for business environment, commerce and entrepreneurship.

6. Beneficiaries of the subsidy

Legal persons (companies/co-operatives), in accordance with Art. 2, Law N° 346/2004 regarding SMEs set-up and development, with subsequent amendments made by Government Ordinance N° 27/2006.

7. Total granted amount for the subsidy

2017 – 49.949.000 lei allocated for 216 signed contracts, with a maximum grant amount of 250.000 lei per beneficiary; total amount paid in 2017: 37.360.990 lei. G/SCM/N/343/EU/Add.23

2018 - 49.949.000 lei for 190 signed contracts, with a maximum grant amount of 250.000 lei per beneficiary; total amount paid in 2018: 0 lei.

2 DEVELOPMENT OF SMES

1. Title of the subsidy

The UNCTAD/EMPRETEC Romania Program for supporting SMEs development.

2. Period covered by the notification

2017-2018.

3. Policy objective and/or purpose of the subsidy

Supporting development of small and medium-sized enterprises, creation of jobs, increasing the number of small and medium-sized enterprises able to face competition and competitive forces stemming from the globalization of markets.

4. Background and Authority for subsidy (including the identification of legislation through which they are granted)

The grantor of the subsidy is the Ministry of Business Environment, Commerce and Entrepreneurship. Law N° 346/2004 regarding SMEs set-up and development. Law N° 6/2017 regarding the State Budget for year 2017. Law N° 2/2018 regarding the State Budget for year 2018.

The de minimis aid scheme for 2018 was approved by Order N° 956/26.06.2018 for approving the procedure for implementing the UNCTAD/EMPRETEC Program.

5. Form of the subsidy

Grant.

6. Beneficiaries of the subsidy

Individuals who, at the time of applying to the program, fulfil the following criteria:

a) Are Romanian citizens or foreigners speaking Romanian language; b) Have graduated secondary or tertiary educational cycle and hold a Diploma of Baccalaureate/Bachelor's or other proof of graduating; c) Fill in the forms for applying to the program; d) Take responsibility in participating to all workshop activities during the 9 days of training.

2017 – 504.000 lei. 2018 – 504.000 lei.

3 START-UP NATION ROMANIA

1. Title of the subsidy

The Start-Up Nation Romania Program (de minimis aid).

2. Period covered by the notification

2017-2018.

3. Policy objective and/or purpose of the subsidy

The main goal of this de minimis aid scheme is stimulating the establishment and development of small and medium sized enterprises and improving their economic performance, creation of jobs, inclusion of disadvantaged persons, unemployed and recent graduates on the labour market and expansion of investments in new and innovative technologies.

Through this program, over 17.000 new jobs have been created, of which 14.000 are specifically for disadvantaged persons, unemployed and graduates from 2012 onwards.

4. Background and Authority for subsidy (including the identification of legislation through which they are granted)

The grantor of the subsidy is the Ministry of Business Environment, Commerce and Entrepreneurship. Law N° 346/2004 regarding SMEs set-up and development. Law N° 6/2017 regarding the State Budget for year 2017.

Government Emergency Ordinance N° 10/2017 for stimulating the establishment of new small and medium-sized enterprises, approved by Law N° 112/2017. The de minimis aid scheme was approved by Order N° 692/06.06.2017 of the minister for business environment, commerce and entrepreneurship.

5. Form of the subsidy

Grant.

6. Beneficiaries of the subsidy

Legal persons (companies/co-operatives) in accordance with Government Emergency Ordinance N° 10/2017 and certain eligibility criteria.

7. Total granted amount for the subsidy

The online application system was opened on 14.06.2017 and closed on 14.07.2017. 19.297 business plans were registered by the application, of which 10.000 business plans were verified and 1.469 SMEs were rejected. 8.531 applications were accepted. As a result, 8.444 contracts have been signed within the budget limits and the contracting phase was finalized on 15.11.2017. Between 15.11.2017 and 01.10.2018 (deadline for reimbursements), 493 applicants have given up funding for various reasons, so the final active contracts settled at 7.951. G/SCM/N/343/EU/Add.23

Of the total number of 7.591 applicants, 7.296 have submitted the reimbursement documentation within the limit of the procedural deadline (31.12.2018). Out of these, 7.159 were effectively paid and 137 were rejected due to non-compliance with the reimbursement procedures, or due to giving up funding.

Outputs of the Start-up Nation Romania Program 2017-2018:

- 3.296 of total start-ups have a woman as a legal representative (46%); - 3.972 of all the legal representatives of the paid beneficiaries are under 35 years old (55.5%); - 1.684 of the legal representatives of the paid beneficiaries are between 36 and 45 years old (23.5%); - 1.503 of the legal representatives of the paid beneficiaries are over 45 years old (21%); - 17.717 newly-created jobs by the paid beneficiaries, of which: o 14.365 are unemployed, graduates after 2012 or disadvantaged individuals.

Of the total of 7.159 granted reimbursements, credit institutions have managed and certified the reimbursements as follows:

o 1.441 by CEC Bank; o 2.011 by BCR (Romanian Commercial Bank); o 3.707 by BT (Bank Transilvania).

In 2017, a total of 3.397.670 lei were payed to beneficiaries from the national budget.

In 2018, a total of 1.175.646.480 lei were payed to beneficiaries from the national budget and 144.897.890 lei were paid from EU funds.

4 ART AND HANDICRAFTS SUPPORTING PROGRAM

1. Title of the subsidy

The national program for supporting arts and handicrafts.

2. Period covered by the notification

3. Policy objective and/or purpose of the subsidy

Stimulating the development of crafts and of small industries in Romania, consolidating the small and middle class of craftsmen, who carry out their activity as individuals or within specific associations or other organisations, especially in rural areas, preserving those crafts which involve lots of manual skills for their creation and reviving craftsmen' services and products, especially traditional ones, including folk arts and crafts.

Promoting arts and handicrafts on national and international markets.

4. Background and Authority for subsidy (including the identification of legislation through which they are granted)

The grantor of the subsidy is the Ministry of Business Environment, Commerce and Entrepreneurship. Law N° 6/2017 regarding the State Budget for year 2017. Law N° 2/2018 regarding the State Budget for year 2018. Law N° 346/2004 regarding SMEs set-up and development.

The de minimis aid scheme for 2018 was approved by Order N° 921/14.06.2018 of the minister of business environment, commerce and entrepreneurship.

5. Form of the subsidy

Financial allocations for organizing the National Crafts and Craftsmanship Fair in 2017 and 2018 (08-10.12.2017; 28-30.09.2018) with the participation of more than 100 craftsmen.

6. Beneficiaries of the subsidy

The beneficiaries are commercial companies, co-operatives and other legal persons such as associations, foundations.

7. Total granted amount for the subsidy

2017 – 890.000 lei were allocated and a total amount of 156.038 lei was payed to beneficiaries. 2018 – 890.000 lei were allocated and a total amount of 55.135 lei was payed to beneficiaries.

Transportation expenses for beneficiaries and their products were supported as well as accommodation expenses for the duration of event.

Also, costs of products transportation were supported, if separate transportation was required. The maximum amount of reimbursement for transportation costs, cumulatively for beneficiaries and their products, did not exceeded 2.000 lei for the entire event. Accommodation costs for the beneficiaries were supported, up to a limit of 1.600 lei per beneficiary for four nights of accommodation, but no more than 200 lei per night per person.

5 DEVELOPING ENTREPRENEURSHIP AMONG WOMEN FROM THE SME SECTOR

1. Title of the subsidy

The national multi-annual program for developing entrepreneurial culture among women from the SME sector.

2. Period covered by the notification

2017-2018.

3. Policy objective and/or purpose of the subsidy

• stimulating and supporting establishment and development of private economic structures set up by women; • promoting an information and training system for women entrepreneurs.

4. Background and Authority for subsidy (including the identification of legislation through which they are granted)

The grantor of the subsidy is the Ministry of Business Environment, Commerce and Entrepreneurship.

Financial allocations for organizing events for women entrepreneurs as follows:

Step 1: 1 national conference for raising awareness on state support for women entrepreneurs. Step 2: 4 national workshops – training modules. Step 3: 4 international events – establishing networks and partnerships.

6. Beneficiaries of the subsidy

Legal persons (companies/co-operatives), as Art. 2, Law N° 346/2004 regarding SMEs set-up and development, with subsequent amendments made by Government Ordinance N° 27/2006.

2018 – 1.000.000 lei were allocated and a total amount of 236.460 lei was payed to beneficiaries.

6 PROGRAM FOR MICRO INDUSTRIALISATION

1. Title of the subsidy

The multi-annual national program for micro-industrialisation.

2. Period covered by the notification

2017-2018.

3. Policy objective and/or purpose of the subsidy

Supporting investments in priority economic sectors identified in the implementation procedure, increasing the activity volume and the competitiveness of SMEs operating in these sectors.

Through this program 400 new jobs were created, of which 200 for graduates, unemployed and disadvantaged persons.

4. Background and Authority for subsidy (including the identification of legislation through which they are granted)

The grantor of the subsidy is the Ministry of Business Environment, Commerce and Entrepreneurship.

2018 – 74.359.000 lei total budget and 134 signed contracts, with a maximum grant amount of 450.000 lei/beneficiary; total amount paid in 2018: 0 lei.

II. COAL AND MINING

7 COAL AND MINING ACTIVITIES

1. Title of the subsidy programme

State aid to facilitate the closure of uncompetitive coal mines, in the period 2011 – 2024.

2. Period covered by the notification

2017-2018.

3. Policy objective and/or purpose of the subsidy

The objective of the scheme is the granting of state aid to facilitate the closure of Petrila, Paroseni and Uricani production units (National Society of Mine Closings ) and Lonea and Lupeni (Energy Complex Hunedoara). For each of these production units to be closed, Plans for the Ceasing of Activity have been elaborated, containing the precise dates for ceasing the exploitation activity.

Respectively, the permanent ceasing of coal production is:

a) Production Unit – Petrila Coal Mine: 31st of December 2015. b) Production Unit – Uricani Coal Mine: 31st of December 2017. c) Production Unit – Paroseni Coal Mine: 31st of December 2017. d) Production Unit – Lonea Coal Mine: 31st of December 2018. e) Production Unit – Lupeni Coal Mine: 31st of December 2018.

4. Background and authority for subsidy

National Society of Mine Closings Jiu Valley

The state aid is compatible with the internal market for the period from the 1st of January 2011 until the 31st of December 2021 pursuant to Council Decision 2010/787/E.U. of 10 December 2010 on State aid to facilitate the closure of competitive coal mines. State aid authorised by the European Commission Decision C(2012) 1020 final of February 2012, i.e. State Aid 33033 – Romania; Response letter from the European Commission of 14th of December 2012 regarding the authorisation of State Aid 33033 – Romania; State Aid 42800 - Prolongation of aid for exceptional costs for mine closure in Romania; Response letter from the European Commission of 20th of December 2016 N°COMP/CD/MD/jbl*2016/125983 and Decision C(2018) 1001 final/ 16.02.2018 Amendment of aid measures for mine closure in Romania.

Energy Complex Hunedoara

The state aid is compatible with the internal market for the period from the 1st of April 2017 until the 31st of December 2024 pursuant to Council Decision 2010/787/E.U. of 10 December 2010 on State aid to facilitate the closure of competitive coal mines. State aid authorised by the European Commission Decision C (2016/7719) and Decision C(2018) 1001 final/ 16.02.2018 Amendment of aid measures for mine closure in Romania.

b) The national legislation on the basis of which the subsidy is provided as follows:

The total amount paid for the measure is:

Energy Complex Hunedoara

8. Duration the subsidy and/or any other time limit attached to it

The time limit of the subsidy to cover production losses for the National Society of Mine Closings Jiu Valley SA is the 31st of December 2017 and for the Energy Complex Hunedoara is year 2018 inclusively. The last payment of aid for exceptional costs related to the cessation of mining activities is the 31st of December 2021 (National Society of Mine Closings Jiu Valley SA) and the 31st of December 2024, for the Energy Complex Hunedoara, according to the EC Decision C (2018)1001 final.

III. ENVIRONMENT

8 ENVIRONMENTAL PROTECTION

1. Title of subsidy programme

Allocation for environmental protection:

a) The RO – LA type transport Program to stimulate freight transport from road to rail in order to reduce greenhouse gas emissions from the road transport sector- state aid scheme (legal persons).

b) The Program on stimulating the renewal of the national car park - de minimis Scheme (legal persons).

c) The Program on reducing greenhouse gas emissions in transport by promoting energy – efficient road transport vehicles - de minimis Scheme (legal persons).

2. Period covered by the notification

2017–2018.

3. Policy objective and/or purpose of the subsidy

Environment protection.

4. Background and authority for the subsidy

The grantor of the subsidy is the Environment Fund Administration.

The legislation on the basis of which the subsidy is provided is as follows: the decision of the Decisional Board of the Environment Fund Administration N° 11/04.11.2014 for the approval of the scheme and N° 14/14.12.2017 for the renewal of the state aid scheme.

The legislation on the basis of which the subsidy is provided is as follows: the Disposals of the President of the Environmental Fund N° 241/22.05.2017 and N° 242.22.05.2017 (based on Regulation (EC) N°1407/2013 on the application of art.107 and 108 of the Treaty to de minimis aid).

5. Form of the subsidy

The subsidy is provided as a grant.

6. To whom and how the subsidy is provided

The total amount of the subsidies granted per each program is as follows:

a) The RO-LA type transport Program to stimulate freight transport from road to rail in order to reduce greenhouse gas emissions from the road transport sector - state aid scheme (legal persons)

The budget for the year 2018 was 20.000.000 lei, out of which the amount of 14.000.000 lei represents the grant.

b) The Program on stimulating the renewal of the National Car Park (2017-2018) – de minimis Scheme (legal persons)

The budget for the year 2017 was 39.200.000 lei. The budget for the year 2018 was 45.000.000 lei.

c) The Program on reducing greenhouse gas emissions in transport by promoting energy- efficient road transport vehicles (2017-2018) - de minimis Scheme (legal persons)

The budget for the year 2017 was 35.000.000 lei. The budget for the year 2018 was 55.000.000 lei.

The eligible costs shall be the investment costs. The Romanian Film Centre represents the public authority with responsibility for implementing and managing the above-mentioned aid schemes in the field of cinematography (the subsidies are granted through the Film Found). The Romanian Film Centre is a public institution of national interest with legal personality, under the authority of the Ministry of Culture and National Identity.

The legal base under which the subsidies are granted is Law N° 328/2006 on the approval of Government Order 39/2005 regarding cinematography, including subsequent amendments and additions.

The above-mentioned legal framework shall be supplemented with the applicable national legislation. G/SCM/N/343/EU/Add.23

Beneficiaries of the minimal aid are the companies submitting the financing dossier and fulfilling the following conditions:

Moreover, according to public policy documents, what is important in the cultural field is the intrinsic and perennial value of cultural diversity and creativity, and caution is recommended in the mechanical application of strictly economic logic to the cultural field.

Fully in agreement with the response of the Committee on Petitions of the European Parliament received on 29 March 2011 stating that "national aid is essential to contribute to the emergence of G/SCM/N/343/EU/Add.23

- 38 - a strong European cultural market. From this point of view, public funding granted by Member States plays a key role in preserving cultural diversity in Europe. In fact, the cultural sector has traditionally suffered from structural weaknesses, including sub-capitalization of companies, fragmentation of national markets and poor transnational circulation of European works of art. National aid allows Member States to develop their capacity to define and implement cultural policies to preserve cultural diversity in Europe", it can be argued that the main effect of state/minimis aid schemes is cultural identity preservation and the promotion of cultural diversity, the economic effect being a secondary one.

The total estimated budget of the scheme is 479.229.091 EUR (equivalent in lei), of which 359.421.814 EUR (equivalent in lei) represent European non-reimbursable funds provided through the European Regional Development Fund and 119.807.277 EUR (equivalent in lei) represent public co-financing funds provided by the state budget.

For the same beneficiary and the same eligible expenditure, the aid granted under this scheme cannot be cumulated with any other State aid, including de minimis aid.

8. Duration of the subsidy

Non-reimbursable financing subject to State aid will be granted to investment aid for airports under State aid rules as provided in Regulation (EU) 2017/1084 of 14 June 2017 amending Regulation (EU) N° 651/2014 on aid for port and airport infrastructure and in accordance with the provisions of the State Aid Scheme relating to Applicant's Guide for Specific Objective 2.3. The state aid is granted by signing the financing contract.
