ParliamentaryRAJYA SABHA Bulletin PART-II No.59123-59126] MONDAY, SEPTEMBER 2, 2019 No.59123 Table Office Information/Documents to be furnished by Members and Leaders of Legislature parties in Rajya Sabha under the Anti-Defection Rules Under sub-rule (1) of Rule 3 of the Members of Rajya Sabha (Disqualification on Ground of Defection) Rules, 1985 made under paragraph 8 of the Tenth Schedule to the Constitution, Leader of each legislature party (other than a legislature party consisting of only one member) is required to furnish within thirty days from the date of commencement of these rules or, where such legislature party is formed after such date, within thirty days from the date of its formation, or, in either case, within such further period as the Chairman may for sufficient cause allow, the following to the Chairman, namely:— (a) a statement (in writing) containing the names of members of such legislature party together with other particulars regarding such members as in Form-I and the names and designations of the members of such party who have been authorized by it for communicating with the Chairman for purposes of these rules; (b) a copy of the rules and regulations (whether known as such or as constitution or by any other name) of the political party concerned; and (c) where such legislature party has any separate set of rules and regulations (whether known as such or as constitution or by any other name), also a copy of such rules and regulations. 2. Sub-rule (4) of rule 3 of the said rules provides that whenever any change takes place in the information furnished by the Leader of a legislature party, he/she is required to furnish in writing to the Chairman, information with respect to such change as soon as may be thereafter and in any case within thirty days from the date on which such change has taken place or within such further period as the Chairman may for sufficient cause allow. 2 3. Leaders of legislature parties in Rajya Sabha are requested to furnish the requisite information/documents at the earliest, if not already furnished, to the Chairman, Rajya Sabha in Form-I which can be obtained from the Table Office i.e. Room No. 33, Parliament House, New Delhi. 4. Sub-rule (2) of rule 3 of the said Rules, provides that if a legislature party consists of only one member, such member shall furnish a copy of the rules and regulations mentioned in clause (b) of sub-rule (1) of rule 3 to the Chairman within thirty days from the date of commencement of these rules or, where he has become a member of the Council after such date, within thirty days from the date on which he has taken his seat in the Council or, in either case, within such further period as the Chairman may for sufficient cause allow. 5. Sub-rule (3) of rule 3 of the said Rules provides that in the event of any increase in the strength of a legislature party consisting of only one member, the provisions of sub-rule (1) of rule 3 shall apply in relation to such legislature party as if such legislature party had been formed on the first date on which its strength increased. Sub-rule (4) of rule 3 further provides that any change in the information furnished by a member under sub-rule (2) has to be intimated in writing to the Chairman as soon as may be thereafter and in any case within 30 days from the date on which such change has taken place or within such further period as the Chairman may for sufficient cause allow. 6. Members of legislature parties in Rajya Sabha consisting of only one member are accordingly requested to furnish the requisite information/document, as indicated in para 4 above, at the earliest, if not already furnished, to the Chairman, Rajya Sabha. 7. Attention of Leaders of Legislature Parties and Members is drawn to sub-para (3) of Para 8 of the Tenth Schedule to the Constitution which provides that any wilful contravention by any person of the above mentioned rules may be dealt with by the Chairman in the same manner as a breach of privilege of the House. ––––––––––– 3 No.59124 Legislative Section Arrest of Shri P. Chidambaram, Member, Rajya Sabha The following Communication No. 6759/RC No. 2202017 E 0011, CBI EOU-IV EO-II New Delhi dated 27.08.2019 addressed to the Hon'ble Chairman, Rajya Sabha has been received from Superintendent of Police, EO- II, CBI, New Delhi: "This is to inform that in pursuance to the Non-Bailable Warrant of Arrest dated 21.08.2019 issued by the Court of Hon'ble Special Judge (PC Act) CBI-09, Rouse Avenue Court, New Delhi in RC no. 2202017E0011, CBI EOU-IV New Delhi u/s 120-B R/W 420 IPC and 8 and 13(1)(d) of PC Act 1988 (CBI vs. INX Media (P) Ltd. and Ors.), Sh.
