PETITION FOR RULEMAKING

Ben W. Walker ("Walker"), a prospective applicant for a new FM broadcast station at Cut and Shoot, Texas, hereby requests the Commission to institute a rulemaking proceeding for the amendment ofSection 73.202(b) ofthe Rules to make the following changes:

The attached FM Spacing Study (Attachment A) establishes that Channel 235A can be assigned to Cut and Shoot under the Commission's rules. The assignment would present no siting

The proposed assignment would provide Cut and Shoot, a community of90S persons (1990

US Census), its first broadcast transmission service.

Walkerwill expeditiously apply for operation onChannel 235A, ifallocated to Cut and Shoot, and ifgranted, will promptly build the proposed PM broadcast station.

IThe study notes that the proposed allocation is short-spaced to the licensed Class C facilities of Station KYKR, Beaumont, Texas but not to the Class Cl KYKR facilities authorized by Construction Permit BPH-9S0101IC. A license application for the Class CI facilities was filed on February 25, 1999 (File No. BLH-990225KB) and KYKR presently is operating with these facilities. Accordingly, the KYKR authorized facilities are those specified in the license application.
