23232_VM.book Page 136 Wednesday, April 29, 2009 9:03 AM 23232_VM.book Page 137 Wednesday, April 29, 2009 9:03 AM Federal Republic of Germany martin burgi Overall, and despite several difficulties, local authorities have a compara- tively strong legal and political standing within the German federal system due to their constitutionally enshrined right to self-government and to their significant administrative role.1 Nonetheless, they have no direct and constitutionally recognized role in respect of federal legislation, although they have to implement most of it. Moreover, the increasing extent of so- called “delegated duties” has left local authorities with little to no budget room for actual self-government.2 Recent reforms of the federal system have aimed at improving at least their financial situation. The constitutional order of the Federal Republic of Germany is defined by the Basic Law (bl), which came into force in 1949. The federation es- tablished after the German reunification in 1990 consists of sixteen states (Länder), each of which has its own constitution, parliament, and govern- ment. Local authorities are considered a constituent part of the Länder; thus, in legal terms, they are not a separate order of government in the fed- eral system.3 Local authorities and their right to self-government are constitutionally recognized in principle in Article 28(2) bl. However, local autonomy is granted only “within the laws”; therefore, it is subject to limitations by fed- eral and Land legislation. Furthermore, as local authorities are considered a constituent part of the Länder, they possess a hybrid character;4 they serve not only as self-governing units but also, depending on the issue at hand, as the most subsidiary unit of Land administration. -

German Law Journal (2020), 21, pp. 45–54 doi:10.1017/glj.2020.18 ARTICLE As Darkness Deepens: The Right to be Forgotten in the Context of Authoritarian Constitutionalism Matthias Goldmann* (Received 27 February 2020; accepted 28 February 2020) Abstract There is no point in denying the significance of the Right to be forgotten for the state of judicial dialogue in Europe. It vindicates the position of the BVerfG as a court deserving international recognition for advanc- ing the law in the crucial field of data protection. Nevertheless, restricting the scope of analysis to the narrow context of judicial dialogue misses the wider context of the rise of authoritarian constitutionalism in certain EU Member States. In this respect, it is of the highest significance that the decisions on the Right to be forgotten effectively eliminate the imagined normative hierarchy between domestic and EU law that provided the basis for the BVerfG’s jurisprudence ever since Solange I and Maastricht. Moreover, by reas- serting the primacy of EU law, the BVerfG strengthens the position of embattled judges in Poland facing disciplinary action for implementing the primacy of EU law. The concern shown by some members of the First Senate for the situation in Poland corroborates this reading. Introduction The double coup on the Right to be forgotten by the Bundesverfassungsgericht (BVerfG)1 prompted most commentators to focus on the significance of these decisions for the decade- old scuffle between Karlsruhe and Luxembourg. Assessments vacillate between hailing the deci- sions as stabilizing the relationship between the courts2 and rejecting them as yet another outburst of constitutional self-assertion.3 Common to these accounts is the dominance of institutional dynamics between Europe’s highest courts as an explanatory factor. -

Introduction Law and politics are closely intertwined. At Ludwig-Maximilians-University Munich this is demonstrated by the name of our Institute for Politics and Public Law. Furthermore, some professors of our law faculty acted or are acting as Federal Minister1), as Minister of a Federal State2), as judge of the Hague International Court of Justice3), as judges of the Federal Constitutional Court4) or even as President of the Karlsruhe Federal Constitutional Court5). Law is an instrument for politics to organize the society. But politicians are obliged to respect the legal provisions in force. Constitutional law is a mandatory standard for politics since Article 20 (3) Basic Law6) states that the legislature shall be bound by the constitutional order. The executive and the judiciary shall be bound by law and justice. In Germany, the Federal Constitutional Court (FCC) is the guardian that the constitutional order of the Basic Law is respected by all state authority. Therefore it bears the great responsibility of guaranteeing the compliance of legislative, executive and judicial bodies with this order. On one hand it acts as arbiter in interior affairs settling disputes between the supreme federal bodies concerning the extent of their rights and duties. It reviews statutes which were adopted by the Parliament and can declare them to be null and void. The Court has struck down more than 600 laws as unconstitutional. On the other hand, the Federal Constitutional Court’s competence also comprises external affairs. -
