Scripture tells us that praying for our Gleaders is one of the best ways we can do this. “Therefore I exhort first of all that supplications, prayers, intercessions, and giving of thanks be made for all men, for kings and all who are in authority, that we may lead a quiet and peaceable life in all godliness and reverence” (1 Timothy 2:1-2 NKJV). It is better to pray for governmental leaders — local, state, and national — than to criticize them. This doesn’t mean we always agree with their every action or condone legislative decisions contrary to biblical principles.

  • What's New in Appeals? Appellate Law in Arizona 2020
2/24/2020 What’s New in Appeals? Appellate Law in Arizona 2020 ALICE JONES BROENING OBERG WOODS & WILSON P.C. 1 Overview of Presentation Recent opinions from the Arizona Court of Appeals and Arizona Supreme Court Rule changes from 2019-2020 Changes on the appellate courts 2 1 2/24/2020 Shepherd v. Costco Wholesale Corp. 246 Ariz. 470 (App. April 30, 2019) Division One – Judges Perkins (author), Winthrop, and Thompson (dissent in part and concur in part) Negligence claim can be brought even if duty of care did not arise under HIPAA and allegations that Costco had failed to cancel an erectile dysfunction prescription despite multiple requests and opportunities to do so and an employee joked with Plaintiff’s ex- wife about the prescription were sufficient to withstand a Motion to Dismiss. Trial court correctly dismissed breach of fiduciary duty, fraud, negligent misrepresentations, intentional infliction of emotional distress, intrusion upon seclusion, and false light claims. 3 Shepherd v. Costco Wholesale Corp. cont. Court also held the Complaint alleged sufficient facts to avoid dismissal based on A.R.S. § 12-2296 immunity because may be able to prove Costco did not act in good faith. Court holds that HIPAA does not pre-empt state-law negligence claims for wrongful disclosure of medical information and it may inform the standard of care. Court also allowed punitive damages claim to move forward because Plaintiff alleged Costco “rewards its pharmacy employees through a system of incentives for pharmacy sales, which system contributed to the failure of [Costco] to cancel the prescription as requested twice by Plaintiff.” Judge Thompson dissented re: punitive damages, stating Plaintiff had failed to sufficiently allege Costco acted with evil intent.

There’s so much left unanswered and so many people killed and irreparability harmed from this cowardice attack on the United States. We now have to contend with the TSA and their illusion of safety at airports (honestly, more of an inconvenience and an invasion of privacy than anything else) as well as the 100-mile “reduced constitution zone ” where as an American Citizen, you can be stopped and asked for identification for no reason at all and then there’s all the data-mining and surveillance on American Citizens. It’s all quite problematic and an invasion of our privacy. The buildings in the financial district are replaced and even bigger ones are being built, but what was really lost in this was our right to privacy.

The 2021-2022 Guide to State Court Judicial Clerkship Procedures The Vermont Public Interest Action Project Office of Career Services Vermont Law School Copyright © 2021 Vermont Law School Acknowledgement The 2021-2022 Guide to State Court Judicial Clerkship Procedures represents the contributions of several individuals and we would like to take this opportunity to thank them for their ideas and energy. We would like to acknowledge and thank the state court administrators, clerks, and other personnel for continuing to provide the information necessary to compile this volume. Likewise, the assistance of career services offices in several jurisdictions is also very much appreciated. Lastly, thank you to Elijah Gleason in our office for gathering and updating the information in this year’s Guide. Quite simply, the 2021-2022 Guide exists because of their efforts, and we are very appreciative of their work on this project. We have made every effort to verify the information that is contained herein, but judges and courts can, and do, alter application deadlines and materials. As a result, if you have any questions about the information listed, please confirm it directly with the individual court involved. It is likely that additional changes will occur in the coming months, which we will monitor and update in the Guide accordingly. We believe The 2021-2022 Guide represents a necessary tool for both career services professionals and law students considering judicial clerkships. We hope that it will prove useful and encourage other efforts to share information of use to all of us in the law school career services community.

I couldn’t believe that I had already been the Presiding Judge for nearly six months. Now here I sit half-way through my three year term wondering how can 2017 be just 15 days away? Seems like just yesterday we were wishing everyone Happy New Year and getting used to writing “2016” on the date line. In addition to reflecting on how quickly the years go by (and how old we are becoming), this is also the time of year when people reflect on what they are grateful for. With respect to this great Judicial Branch, here 3 From the Presiding Judge are some of the items on my list.
