No. 17760—GAD-SER2-ID-0001/2018-SCS.—Whereas, the case of Shri Gunanidhi Nayak, O.A.S. Gr.A (JB) was considered along with other eligible O.A.S. Gr.A. (JB) Officers by the Selection Board on the 2nd May 2018 for promotion to the rank of O.A.S. Gr.A. (SB) on basis of the information on proceeding status, vigilance status and assessment of CCRs received from different quarters.

(2) Whereas on recommendation of the Selection Board Meeting, dated the 2nd May 2018, Shri Gunanidhi Nayak, O.A.S. Gr.A. (JB) was promoted on ad hoc basis to O.A.S. Gr.A (SB) vide G.A. & P.G. Department Notification No.14770-SCS., dated the 24th May 2018.

(3) Whereas subsequently it was detected that, Revenue & Disaster Management Department had issued a Memorandum of charges bearing No. 2282-R(CS), dated the 3rd December 2013, against Shri Gunanidhi Nayak, under Rule 15 of O.C.S. (4) Whereas in pursuance of G.A. Department O.M. No. 3928-Gen., dated the 18th February 1994, read with its clarification issued vide letter No.1598-Gen., dated the 18th January 1999, to deny the promotional benefit, it must be shown that at the relevant time, the disciplinary/criminal case is pending at the stage when charge sheet has already been issued to the employee.

(5) Whereas it is clear that, the Memorandum of charges under Rule 15 of O.C.S. (CC & A) Rules, 1962, as on the 2nd May 2018 i.e. the date of holding the Selection Board, is pending against Shri Gunanidhi Nayak.

(6)Therefore, considering the above aspects since the proceeding was pending as on the date of Selection Board i.e. on the 2nd May 2018, the Government have been pleased to revert Shri Gunanidhi Nayak, B.D.O., Nabarangpur UoT as B.D.O., Malkangiri from the rank of O.A.S. Gr.A. (SB) to O.A.S. Gr.A. (SB) with immediate effect and allow him to continue as such until further orders.

Whereas, .it was observed that, the functioning of the Committee of Management of the Berhampur Cotton and Silk WCS Ltd. which was constituted on the 19th January 2015 is in stalemate position due to resignation of its all 07 Nos. of Board of Directors including vice-president and except the President and such resignation without discharging their duties and responsibilities, is detrimental to the interest of the society in general and its weaver members in particular; Whereas, the members of the committee of aforesaid WCS were served on notice vide this Office Letter No. 173, dated the 24th May 2018 to show cause as to why the Committee of Management will not be superseded under Section 32(1) of OCS Act 1962 due to such resignation; Whereas, 06 Nos. of Board of Directors have submitted their written statement on the 11th June 2018 wherein, they described very in-genuine matter like distribution of profit earned by the RMB. The RMB is set up during the year 2007-08 in a view to get quality raw materials on standard price fixed by the N.H.D.C and timely availability of Raw Material to weavers at door step. Though the RMB is a separate unit functioning with the funds received from Government and no investment from the society; such demand stands no merit. Secondly, they demand for removal of Secretary from society. As the staff management is the duty of management of the society and at present all the Board of Directors (except President) have tendered their resignation; the management has no right to take any policy decision without quorum. Thirdly, they requested for fresh election to constitute new Committee of Management of the society; Whereas, the financing bank of the society, i.e. The Berhampur Central Co-operative Bank Ltd., Berhampur was requested for his views vide this Office Memo No. 177, dated the 24th May 2018 for proposed supersession of the Committee of Management of the said society, but no such consent/ reply has been received within specified time or till date. The Government Nominees representing to the Committee of Management have not given any view on the matter within specified time or till date; Whereas, after careful consideration of all above facts, the undersigned is of opinion that, the activities of existing Committee of Management is detrimental to the interest of the society.As such the Committee of the Berhampur Cotton and Silk WCS Ltd. ought to be removed from the office forthwith; Therefore, I, Shri Prasan Kumar Singh, Deputy Director of Textiles-cum-Deputy Registrar of Co-operative Societies, Southern Division, Berhampur in exercise of power conferred on me under Section 32 (1) of OCS Act, 1962 (Act 2 of 1963) read with Notification No. 20127-Co-op., dated the 23rd September 1999 of Co-operation Department, do hereby supersede the Committee by this order and appoint Shri Durga Prasad Panigrahi, Inspector of Textiles, office of the Asst. 4. Bids must be accompanied by Earnest Money Deposit/Bid security of the amount specified for the work in the table Column (5) above, pledged in favour of Executive Engineer, Fishery Engineering Division, Bhubaneswar and will have to be in any one of the forms as specified in the bidding document. Bidders desirous to hire machineries or equipments from outside the State or owned but deployed outside the State are required to furnish 2% of the amount put to tender as bid security.

5. Additional Performance Security shall be obtained from the bidder when the bid amount is less than the estimated cost put to tender. In such an event, only the successful bidder who has quoted less bid price/ rates than the estimated cost, i.e. estimated cost put to tender shall have to furnish the exact amount of differential, i.e. estimated cost put to tender minus the quoted amount as Additional Performance Security (APS) in shape of Post Office Savings Bank Account/National Savings Certificate Post Office Time Deposit Account/Fixed Deposit Receipt of Scheduled Bank duly pledged in favour of the Executive Engineer, Fishery Engineering Division, Bhubaneswar within seven days, otherwise the bid shall be cancelled and the E.M.D. shall be forfeited. Further proceeding for blacklisting shall be initiated against bidder.

6. If the rate quoted by the bidder is less than 15% of the tendered amount, then such a bid shall be rejected and the tender shall be finalized basing on merits of rest bids. But if more than one bid is quoted at 14.99% (Decimals up to two numbers will be taken for all practical purposes) less than the estimated cost, the tender accepting authority will finalize the tender through transparent lottery system, where all bidder/their authorized representatives, the concerned Executive Engineer and DAO will remain present as per Memorandum No.12366, dated the 8th November 2013 of Works Department, Government of Odisha.

7. The Online bidding process shall be Governed by e-procurement guidelines of Government of Odisha vide Works Department No. 1027—F.A.R.- 3/08-W., dated the 24th January 2009 & relevant clauses of the OPWD Codes in force.

8. Guidelines laid down in Office Memorandum No. 7885, dated the 23rd July 2013 and No. 12366, dated the 8th November 2013 of Government of Odisha, Works Department to be followed scrupulously for Online bidding system.

10. The bidder must possess compatible Digital Signature Certificate (DSC) of Class II or Class-Ill.

Bidders who participated in the bid can witness the opening of bids after logging onto the site through their DSC. If the office happens to be closed on the date of opening of bids as specified, the bids will be opened on the next working day.

13. Original bid security & Demand Draft towards cost of bid document shall be submitted in the office of the undersigned 3 (three) days before opening of bid, i.e. from the 18th July 2018 to the 20th July 2018 during working hour failing which the bid will be rejected.

14. The intending bidders are required to produce documents viz. Original Registration, valid GSTIN Clearance Certificate, PAN Card after opening of bid for verification purpose in the latter stage along with the original documents relating to ownership and hiring of plants and machineries mentioned at Annexure-I, preferably within three working days after opening of the Technical Bid i.e. from the 23rd July 2018 to the 25th July 2018.
