I. INTRODUCTION

1. The Jharkhand State Road Project (JSRP) is aimed to rehabilitate and improve Govindpur - Jamtara - - Barhet - section of existing single to intermediate lane road section to a two-lane standard. The project road takes off from Chainage 0.0 Km at Govindpur Junction at NH-2, which further traverses through Jamtara - Dumka - Barhet and ends at Sahebganj. The length of existing road is about 308 Km. However, designed length of project road including bypasses is 311 km. Upon project completion, this road will serve as backbone of north-eastern Jharkhand connecting to National Highway 2 (NH2) and to other national highway network.

2. Environmental monitoring is the lynchpin of environmental safeguard program. Through environmental monitoring, both Asian Development Bank (ADB) and Road Construction Department (RCD) can gather information to: i) evaluate the environmental management plan (EMP) progress by establishing compliance status, ii) detect and correct non-conformances, iii) identify unanticipated impacts and implement necessary mitigation measures, and iv) provide evidence to support enforcement of penalty provisions of the civil works contract to deter non- compliance.

3. Environmental monitoring and its annual disclosure is an ADB requirement for environmental category B projects like JSRP. Environmental monitoring is part of project implementation process to be complied by both ADB and RCD - preparation and submission of the annual monitoring report is the responsibility of the RDC while supervision to provide guidance is the role of ADB.

4. This annual environmental monitoring report describes the environmental management plan implementation status, compliance issues confronted, and corrective actions taken by the RCD, Government of Jharkhand from February 2011 to January 2012.

II. JSRP PROJECT IMPLEMENTATION PROGRESS

5. The Govindpur-Sahebganj road section is divided into 4 sections and also called construction packages, these are: i) Govindpur-Jamtara, 69.68 kms. including 6.2 kms. Govindpur by-pass; ii) Jamtara-Dumka, 75.5kms. including 5.98 kms. Dumka by-pass; iii) Dumka-Barhet, 98.14 kms.; and iv) Barhet-Sahebganj, 49.85 kms. The entire Govindpur- Sahebganj road section passes through 6 districts, namely: , Jamtara, Devghar, Dumka, and Sahebganj). Designed carriageway width is 7.0m and formation width in general is 12 meters which exceeds near bridge approaches and high embankment stretches.

A. Incorporation of Environmental Requirements into the Project Contractual Arrangements

6. The Environmental Management Plan (EMP) is integrated in the civil works contract particularly in the Bill of Quantities (BOQ) while the environmentally sound practices like good housekeeping, occupational health and safety, including waste minimization are as prescribed in the EMP. Specifically, Section 6 of the Contract for Civil Works contains the environmental management and monitoring plan. Its effective implementation is highlighted in Section 4.18 of the General and Particular Condition of Contract which requires “the contractor shall take all reasonable steps to protect the environment (both on and off site) and to limit damage and nuisance to people and property resulting from pollution, noise and other results of his operations. The Contractor shall ensure that emissions, surface discharges and effluent from the Contractor’s activities shall not exceed the values stated in the Specification or prescribed in applicable Laws.”

7. To ensure faithful and timely implementation of the EMP an Environmental Specialist (ES) is deployed as part of the construction supervision consultant (CSC) team. The ES-CSC is responsible for the EMP implementation supervision, conduct liaisons with relevant government agencies and affected communities to ensure that road stretches are handed over for civil works as scheduled, monitor unanticipated impacts during construction stage, immediately inform RCD, and recommend mitigation measures.

B. Key Mitigation Measures Implemented

1. Compliance Status with National/State /Local Statutory Environmental Requirements:

The loan agreement required the RCD, Jharkhand to implement the project and operate and maintain the project facilities in compliance with the Initial Environmental Examination (IEE), ADB Safeguards Policy Statement (2009), and Government of India (GoI) environmental laws and regulations applicable to the project.

9. An Environmental Clearance was required for the project from the Ministry of Environment and Forest (MoEF) according to the EIA Notification 2006. Accordingly EC was secured in 2009 as provided in appendix A. The road packages were also required to secure Forest Clearance (FC) for diversion of forest to non forest purpose and tree felling clearance from the State Forest Department and No Objection Clearances from the Jharkhand Environment Protection and Pollution Control Board (JEPPCB) for establishment and operation of HMPs. So far no permit has been required for using water from the Water Board.

10. A total of 32.645 kilometers of JSRP roads is inside protected forestland requiring the conversion of 68.010 hectares and at such scale clearance has to be secured from the MoEF, Delhi. Application for FC was first filed with the Jharkhand Forest and Environment Department (JFED) on 21-9-2011. In turn, the JFED has forwarded the proposal to MoEF for the granting of Forest Clearance on 17-01-2012. As of February 2012, the clearance is still being processed.

11. In compliance, the JSRP has not undertaken any construction inside these forestlands and not a single tree has been cleared. To ensure that no confusion on the boundaries of forestlands, RCD and JFED have installed signboards indicating the name, start and endpoints of forestland traversed by the road section and trees are properly marked and numbered using visible paints.

12. Tree felling clearances have been issued by the JFED for trees located on privately owned lands along the road right of way (ROW). Tree inventory indicated that 11,043 trees that need to be cleared are located in privately owned lands. Packages 2 and 3 have totally cleared all trees along its ROW that are located on private lands, numbering 1,876 and 6,867 trees, respectively. Packages 1 and 4, have cleared almost 70% of the 1,199 and 1,101 trees along its ROW outside forestland.

13. NOCs and Consent to Establish (CtE) are required for the establishment and operations of hot mix, wet mix, stone crushers plants, and diesel generators in different contract packages. As of the reporting period, all Contractors excluding package IV have submitted applications to the JEPPCB but only Packages I and III were able to secure NOCs and CtEs. .

14. All Contractors failed to conduct air and water quality monitoring as prescribed in the approved Monitoring Plan (MoP) and provided in the IEE.

2. Status of Environmental Management Plan Implementation

15. The JSPR has registered a good overall performance in implementing EMP across all road packages. Out of the 14 EMP activities, Packages II and III achieved 71% (10 out of 14) compliance, 21% (3 out of 14) partial compliance, and 7% non-compliance rates. Packages I and IV performed slightly lower at 64%, 28%, 7%, full, partial, and non-compliance rates.

16. These quantitative compliance performance indicators should be tempered by crucial delays in the issuance of government clearances for tree cutting and NOC for the establishment

of construction related plants and diesel generator sets in spite of the Contractors having submitted all necessary requirements.

III. SUMMARY OF ENVIRONMENTAL MONITORING

A. Compliance Inspections

1. Summary of Inspection Activities

17. Monthly reviews of monitoring reports submitted by the Contractors were conducted by the ES-CSC to ensure continuous compliance and allow expedient identification on non- compliances and their mitigation.

18. On-site facility inspections were conducted by the ES-CSC to validate monthly reports submitted by the contractor, assess the adequacy of the mitigation measures being carried out, and emphasize enforcement presence. During the reporting period, on-site inspection only started on February 2012 due to delays in mobilizing the ES-CSC. Two rounds of camp and road on-site inspections were made using a checklist developed for the Project. This checklist covered the aspects of regulatory compliance, mitigation measure implementation, and ambient quality as prescribed in the IEE. The inspections were led by ES-CSC supported by contractors. These on-site inspections focus on active construction fronts and construction camp. Roadside interviews with the site engineers and workers were conducted in addition to visual inspection, while a facility walkthrough around the campsite, generally following the flow of construction materials were conducted. Contractor records were also reviewed to confirm site findings.

B. Key Environmental Issues

19. Need to Update the IEE Report to cover the Govindpur By-Pass. Under Package 1 of the Jharkhand State Roads Project (40005-IND), only the Jamtara village will be by-passed but updated estimates on the scale of involuntary resettlement required along the first 6 kilometers in Govindpur section necessitates bypassing this village. This bypass is not covered in the IEE reviewed and approved by the Bank. The Road Construction Department (RCD) needs to screen the potential environmental impacts along the new bypass to confirm if the environmental categorization remains valid and the necessary mitigation measures are reflected in the revise IEE Report for subsequent disclosure consistent with the ADB policy.

20. Identification of an Elephant Corridor along Package 4 Sahebganj Forest. The Ministry of Environment and Forest (MoEF) – Forest Clearance Division processing of RCD’s application for FC to divert 68.010 hectares of forestland revealed the presence of an elephant crossing between chainage 45+000 to 45+500 coinciding with the Moorum Road. RCD has submitted a countermeasure proposal on 28-01-2011 for MoEF’s consideration in granting the clearance to channel the elephant movement within the Moorum Road by constructing a 150m x 1.6m barrier on all sides of the intersection along the project road, installation of speed brakes, and posting of regulatory speed limit signages. To date, RCD still awaits the acceptance of the proposed countermeasure and the issuance of the FC by the MoEF. The potential conflict puts

the Asian Elephant, an endangered species, to greater risk of collision from the proposed wider road carriage, and the resulting increase in traffic and travel speed due to the road upgrading. These conditions may result to injury or death to elephants. This conflict was unanticipated during preparation of the IEE. It is recommended that in parallel to the processing of the FC application, the RCD through the CSC, will assess the significance of the conflict, evaluate alternative measures, describe the mitigation measure, estimate needed resources, and update the IEE report.

21. Delays in Securing Environmental Permits and Clearances. As noted in the previous Section, the MoEF has not issued its FC to allow the clearing of trees inside a forestland despite the submission of a revised proposal by the JFED. This impasse, if continued to persist, will cause delays in project construction as the forestland are not in a contiguous road sections but in numerous patches. Delays in issuance of the JEPPCB NOC has compelled the Contractors of Packages II and IV to proceed with the operation of the hot and wet mix plants, crushers, and diesel generators without securing the respective NOCs.

22. Failure of both Contractors and CSC to Implement Emission and Ambient Quality Monitoring. To date, monitoring of ambient air, noise, and surface water for all four Packages has not been carried out and in non-conformance with the approved Monitoring Plan.

23. Unsatisfactory Housekeeping Practices Inside Labor Camps and Occupational Health and Safety. During the site visits, solid and liquid wastes are being disposed on nearby vacant lots and not all workers are provided with personal protective equipment.

C. Corrective Actions Taken

24. Updating the ADB IEE Report. RCD has issued instructions to the CSC to conduct rapid environmental assessment of the Govindpur bypass, provide advice on the environmental categorization base on ADB SPS, 2009, and update the IEE Report accordingly. The result of the rapid environmental assessment will be communicated to ADB.

25. Compliance to EC Conditions: According to the EC, the project proponent is required to submit half yearly compliance report to regional office of MoEF for specific and general conditions stipulated. Preparation of the compliance reports have just been initiated during this reporting period but not submitted yet.

26. Intensify Coordination with the MoEF and JFEPPCB. The CSC and RCD are actively coordinating with the MoEF and JFEPPCB to expedite the process of approving the proposed elephant corridor countermeasure, processing of Forest Clearance, and issuance of the NOC. No forestland conversion, cutting of trees inside forestland, or mobilization of materials and manpower near the elephant crossing will be undertaken until prior approvals are secured.

27. Immediate Conduction of Ambient Monitoring by the CSC and Contractor. Instructions were issued by RCD for the ES-CSC and Contractors to conduct air and water quality monitoring through a nationally accredited laboratory. The result of the ambient monitoring will be made to assess the effectiveness of mitigation measures and will form part of the 2nd annual environmental monitoring report to the ADB.

28. Promoting Good Housekeeping and Occupational Health and Safety. The CSC has issued instructions to Contractors to implement pertinent provisions of the EMP and informed that incursions will be sanctioned according to civil works contract provision. 13

Various meetings with the Contractors both on- and off-site facilitated the formulation of the following agreements: • Practicing and maintaining Traffic and Safety management in each of the CD structures under construction as well as road works. • Providing First aid facility in each active construction sites beside the campsites. • Monthly/quarterly reporting to the CSC in the prescribed formats of checklists. • Waste oil and lubricants containment, storage/ handling. • Water testing to judge the suitability of water source for drinking purpose. • Environmental Pollution Monitoring. • To improve upon the House keeping at each of the campsites. • Waste handling and their disposal and in case of suitability, their reuse. • Organization EMP implementation training programme in July to September 2012 quarter. • Organization of AIDS- awareness & health check-ups camps in different contracts packages. • Formal instructions to Resident Engineers (Supervision Consultants)/PMs (Contractors) to assign appropriate significance to Environmental Compliance issues and regular monitoring of checklist and in-time submission of same. • Regular Site visits by CSC • Public Consultations in villages around construction camps/activities as it has been advised /requested informally by Environmental Specialist, PMU. • Preparation of redevelopment/ closure plan for borrow area, once flooded water gets dried, for execution of the project keeping in view the terms and condition as agreed with landlord/owners and submit it to us with copy of agreement with land owners. IV. CONCLUSION

30. Overall, the JSRP accomplished substantial compliance to the EMP particularly. All road packages fully complied with the requirements on removal of vegetation, establishment of office and material storage, establishment of construction camp, extraction or materials, transportation of materials, preparation of embankment, construction of bridges/culverts, tree clearing, and mobilization of equipment. Partial compliances on temporary traffic diversion cut and fill operation, and occupational health and safety. Non-compliance was noted only on camp cleanliness.

31. The RCD and JSRP Contractors are still struggling to secure Forest Clearance from MoEF and NOC to establish construction plants. The prolonged administrative procedures in securing Forest Clearance from the MoEF if remained unresolved will cause further delays in the overall project construction which is counterproductive to all stakeholders.

32. The delays in mobilization of the Contractors particularly in Packages II and IV and the mobilization of the Environmental Specialist affected the timely implementation of the EMP particularly in securing clearances, good housekeeping, occupational health and safety, and ambient monitoring. Even with these non-conformances no significant adverse impacts have resulted as the project construction is still in its nascent stage, ranging from 2% for Package II to 29% for Package I.

33. With the mobilization of the Environmental Specialist-CSC, appropriate measures are being taken to correct non-conformances and environmental compliance is expected to further improve.
