MINUTES OF THE HOUSE CORRECTIONS AND JUVENILE JUSTICE COMMITTEE

The meeting was called to order by Chairperson at 1:30pm on Thursday, February 13, 2014, 152-S of the Capitol.

Hearing on: HB2540 — Juvenile offenders; youth residential center III; cost study; services and programming; establishment of performance measures and payment methodologies. Natalie Scott gave an overview of HB 2540.

Representative Jim Howell supported HB 2540. It provides a long-term solution for juvenile offender YRCII group homes. This bill addresses accountability and makes sure the program actually works. (Attachment 1) Representative Howell submitted two memorandums written by Dr. Delores Craig- Moreland of Wichita State University. (Attachment 2) (Attachment 3) Representative Rubin asked a question of Representative Howell.

Richard Ranzau supported HB 2540 that provides for a new level of youth residential center, called a YRC III. (Attachment 4)

Representative Peter DeGraaf provided written testimony in support of HB 2540. (Attachment 5)

Secretary Ray Roberts stated the Department of Corrections was concerned that HB 2540 establishes statutory mandates prior to an analysis of the data regarding the programing and effectiveness of various programs and residential centers operations. The department was neutral in support of this bill. (Attachment 6)

Representatives Moxley, Jennings, and Rubin had questions for Secretary Roberts.

Chairman David Unruh on behalf of the Board of County Commissioners of Sedgwick County (the Board), was supportive of the concept of creating a long-term funding solution for youth residential centers for medium to high risk youth that have proven results. Regarding HB 2540, the Board was neutral at this time. (Attachment 7)

Chairman Rubin called for final questions from the Committee and then closed the hearing.

Chairman Rubin stated that late testimony on HB 2496 was submitted to the Committee and the hearing was now closed.

Final action on bills previously heard HB 2479-Removing 2015 sunset provision from law requiring ignition interlock device after first test failure or alcohol or drug-related conviction. Natalie Scott gave an overview of HB 2479.

Representative Tom Moxley moved HB 2479 favorably for passage, seconded by Representative Ramon Gonzalez.

Representatives Moxley, Rubin, and Pauls commented on HB 2479.

The motion passed HB 2479 unanimously with Representatives Anthimides and Becker "Absent and not voting".

HB 2493-Relating to surety regulation, appearance bonds and unlawful sexual relations. Natialie Scott gave an overview of HB 2493.

Representative John Rubin moved HB 2493 favorably for passage, seconded by Representative Larry Campbell.

Representative Rubin proposed a balloon amendment and gave an overview (Attachment 8) . Chairman Rubin called Kevin Barone up to comment on this amendment. Representative Pauls commented. Representative Finney had a question, discussion followed.

Representative John Rubin moved to amend HB 2493 , seconded by Representative Janice Pauls.

Representative Moxley had a question.

The motion passed on the balloon amendment unanimously with Representatives Anthimides and Becker "Absent and not voting".

Representatives Finney and Pauls discussed amending HB 2493.

Representative moved to amend HB 2493 on page nine, subsection C, section 7 that provisions do not apply to any surety acting as a surety or agent of a surety prior to the effective date of the act , seconded by Representative Tom Moxley.

Discussion followed with comments by Representative Finch, Kevin Barone, Representative Rubin, and Representative Meier.

The motion to amend failed. The vote count was as follows: Ayes: Representatives Brett Hildabrand; Gail Finney; Tom Moxley Nays: Representatives J. Russell Jennings; Larry Campbell; Ramon Gonzalez; John Rubin; Janice Pauls; ; ; and Blaine Finch. Absent and Not Voting: Representatives Steven Anthimides and Steven Becker.

Representative John Rubin moved HB 2493 for favorable passage as amended by the Rubin balloon, seconded by Representative Campbell.

The motion to pass HB 2493 as amended was unanimous except for Representatives Steven Anthimides and Steven Becker "Absent and not voting".

HB 2433-Relating to the Kansas uniform securities act. Natalie Scott gave an overview of HB 2433.

Representative Blaine Finch moved to report HB 2433 for favorable passage, seconded by Representative Ramon Gonzalez.

The motion to pass HB 2433 was unanimous except for Representatives Steven Anthimides and Steven Becker "Absent and not voting".

HB 2427-Relating to the alcohol or other drug addiction treatment act.

Chairman Rubin said he would not be participating in the discussion or voting on HB 2427 because he was not present the day of the hearing. He was attending Representative Kleeb's wife's funeral.

Kathryn McBride gave an overview of HB 2497.

Representative Ramon Gonzalez motioned to table HB 2427 , seconded by Representative Blaine Finch.

HB 2497-Transfer of supervision of person paroled, on probation, assigned to community corrections or under suspended sentence. Natalie Scott gave an overview of HB 2497.

Representative Larry Campbell move to approve HB 2497 , seconded by Representative Janice Pauls.

Representatives Campbell stated he only heard one reservation about whether another court would have to transfer a defendant. Representative Finch wanted to draw attention to the Committee that there was opposition from Johnson County district attorney, Steve Howe and KCDAA. It was the desire of the Kansas Sentencing Commission to tweak this bill if it was voted on.

Representative Larry Campbell withdrew his motion, seconded by Representative Janice Pauls.

Representatives Moxley, Pauls, Rubin and Finch entered into a discussion. Representative Janice Pauls suggested a formal request to the Kansas Sentencing Commission whether they had been contacted by the Kansas Counties and District Attorneys Association. Scott Shulz from KSC said they had not been contacted. Chairman Rubin asked Patrick Vogelsberg representing KCDAA if they could get together with KSC to work out an agreement to HB 2497.

Chairman Rubin said HB 2497 will remain in committee.

Chairman Rubin discussed the bills to be heard and the bills to be worked. Then he called the meeting adjourned.
