§ 1. Scope of regulation and application of Act

(1) This Act governs principal aspects of entry to and residence in of citizens of the European Union and their family members.

(2) This Act applies to citizens of the member states of the European Union and of the European Economic Area who are not Estonian citizens, and to citizens of the Swiss Confederation (hereinafter, “citizens of the European Union”) and to their family members. (EU+EEA citizens)

(3) This Act does not apply to citizens of the European Union whose stay in Estonia is based on the International Military Co-operation Act, or to their family members ….

§ 13. Temporary right of residence of a citizen of the European Union

(1) A citizen of the European Union acquires a temporary right of residence in Estonia for five years when he or she registers his or her residence pursuant to the procedure provided in the Population Register Act.

(2) After five years, the term of temporary right of residence is extended for another five years if the residence of the citizen of the European Union continues to be registered in Estonia and the right of residence of the citizen of the European Union has not expired or has not been terminated.

(3) Upon registration of the residence, a corresponding certificate shall be issued to the citizen of the European Union if he or she so desires.

§ 14. Application for an

(1) A citizen of the European Union who has acquired a temporary right of residence in Estonia must apply for an Estonian identity card within one month after registration of his or her residence in Estonia pursuant to the procedure specified in the Identity Documents Act.

(2) An Estonian identity card constitutes evidence of the temporary right of residence of a citizen of the European Union.

§ 15. Expiration of the temporary right of residence of a citizen of the European Union

(1) The temporary right of residence of a citizen of the European Union expires: 1) when he or she has no registered residence in Estonia; 2) upon acquisition of a permanent right of residence; 3) upon the grant of Estonian citizenship to the citizen or upon restoration of his or her Estonian citizenship; 4) upon the citizen losing his or her European Union citizenship, or 5) upon the death of the citizen or upon a declaration of his or her death in absentia.

(2) Upon expiration of the temporary right of residence of a citizen of the European Union, the Police and Border Guard Board shall revoke the Estonian identity card issued to him or her. Notice of residence (1) For the address of a residence to be entered in the population register, a person shall submit a notice of residence in writing to a competent local government agency of his or her residence. An Estonian citizen permanently residing in a foreign state and an alien provided for in the Consular Act shall submit the data on their residence to a consular agent of Estonia pursuant to the procedure provided for in the Consular Act. (2) Persons who wish to simultaneously enter the address of the same residence in the population register may submit a joint notice of residence. ……….. (5) The space the address details of which a person indicates in a notice of residence shall be a residential building or apartment which is used as permanent residence (hereinafter dwelling), except in the following cases: 1) if the person applies for entry in the population register of the address of a building under construction belonging to him or her, or the address of another space belonging to him or her as the address of residence of him or her and persons living together with him or her; 2) if the person proves the use of a space which is not a dwelling, as a residence. (6) If a person is not the owner of the dwelling indicated in the notice of residence, the person shall annex to the notice of residence a copy of the document certifying his or her right to use the residence or permission of the owner of the dwelling to enter the data specified in the notice of residence in the population register. If a person submits the notice of residence by post, he or she shall annex to the notice of residence a copy of the page containing personal data of his or her . If the notice of residence is submitted with a , a copy of the page containing personal data of an identity document shall not be annexed to the notice.

Personal identification Have an identity document with you. If there are minor children living with you or wards then a document confirming the right to represent them ( e.g. the birth certificate that is legal in Estonia)

What to do with the form

Give the filled out forms with necessary additional materials to our official.

Result: a) A personal identification code will be created for you. b) By adding the address of the place of residence to the Population Register you will obtain a temporary residence permit in Estonia for five years. c) After the registration of the place of residence you have to go to the Police and Border Guard d) office within one month where you will be issued a document-identity card (the ID-card) that verifies your right for temporary residence.
