TAXI DRIVER’S LICENCE LICENCE - NEW APPLICATION

1. The Sub-Committee considered an application for a Taxi Driver’s Licence, and resolved as follows, viz:-

Applicant: Hugh Young Gailey, 544 Road,

Decided: that consideration be continued to allow the applicant an opportunity to appear before the Sub-Committee to speak in support of his application.

PRIVATE HIRE CAR DRIVER’S LICENCE - NEW APPLICATION

2. The Sub-Committee considered an application for a Private Hire Car Driver’s Licence, and resolved as follows, viz:-

Applicant: James Dickson, 61 Coldstream Crescent, Coltness,

Decided: that consideration be continued to allow the applicant an opportunity to appear before the Sub-Committee to speak in support of his application.

TAXI DRIVER’S LICENCE AND PRIVATE HIRE CAR LICENCE - COMPLAINT

3. The Head of Legal Services advised the Sub-Committee of a complaint received by the Chief Constable, Strathclyde Police relative to the behaviour of William Kenmuir, 15 Croftcot Avenue, Bellshill. GENERAL PURPOSES (LICENSING) SUB - 20 February 2003

Decided: that consideration be continued to allow William Kenmuir an opportunity to appear before the Sub-Committee to speak in relation to the complaint.

It was agreed in terms of Section 50A(4) of the Local Government () Act 1973, that the public be excluded from the meeting for the following items on the grounds that the business involved the likely disclosure of exempt information as defined in paragraphs 6 and 14 of Part 1 of Schedule 7A of the Act.

(a) JOHN HAMILTON, 4 HAMILTON PLACE,

4. With reference to paragraph 1 of the Minute of the meeting of this Sub-Committee held on 14 November 2002, the Head of Legal Services advised (1) that consideration of a complaint (tabled) relative to the behaviour of John Hamilton, 4 Hamilton Place, New Stevenston had been continued to allow John Hamilton an opportunity to appear before the Sub-Committee to speak in relation to the complaint, and (2) that John Hamilton was unable to be in attendance due to illness.

Decided: that consideration of the complaint relative to the behaviour of John Hamilton be continued to allow John Hamilton another opportunity to appear before the Sub-Committee to speak in relation to the complaint.

(b) ANTHONY KELLY, 35 GREENSIDE STREET,

5. With reference to paragraph 5 of the Minute of the special meeting of this Sub-Committee held on 7 November 2001, the Head of Legal Services (1) advised that consideration of a complaint (tabled) relative to the behaviour of Anthony Kelly, 35 Greenside Street, Coatbridge had been continued to allow Anthony Kelly another opportunity to appear before the Sub-Committee to speak in relation to the complaint, and (2) recommended that, for the reason detailed, consideration of the complaint be further continued.

Decided: that consideration of the complaint relative to the behaviour of Anthony Kelly be continued to allow Anthony Kelly another opportunity to appear before the Sub-Committee to speak in relation to the complaint.

(2) PRIVATE HIRE CAR LICENCE - RECALL OF SUSPENSION - JACQUELINE CALLAGHAN, 63 BELLSDYKE ROAD, AlRDRlE

6. With reference to paragraph 2 of the Minute of the meeting of this Committee held on 23 January 2003, the Head of Legal Services advised that consideration of a request (tabled) by Jacqueline Callaghan, 63 Bellsdyke Road, Airdrie seeking the recall of the suspension of her Private Hire Car Licence had been continued to allow Jacqueline Callaghan an opportunity to appear before the Sub-Committee to speak in support of her request.

The Sub-Committee then heard Mr. Laughran, Jacqueline Callaghan’s agent, speak in respect of the request.

Thereafter, Jacqueline Callaghan, Mr. Laughran and representatives of the Police withdrew from the meeting and the Sub-Committee resumed consideration of the matter. GENERAL PURPOSES (LICENSING) SUB - 20 February 2003

Jacqueline Callaghan, Mr. Laughran and representatives of the Police were then re-admitted to the meeting.

Decided: that the suspension of Jacqueline Callaghan’s Private Hire Car Licence be recalled

(3) TAXI DRIVER’S LICENCE AND PRIVATE HIRE CAR LICENCE - RENEWAL - DAVID IAN MCDONALD, 91 ARRAN DRIVE, RAVENSWOOD,

7. With reference to paragraph 1 of the Minute of the meeting of this Sub-Committee held on 23 January 2003, the Head of Legal Services advised (1) that consideration of an application by David lan McDonald, 91 Arran Drive, Ravenswood, Cumbernauld for the renewal of his Taxi Driver‘s Licence and Private Hire Car Licence had been continued to allow the applicant an opportunity to appear before the Sub-Committee to speak in support of his applications, and (2) that David lan McDonald was currently in hospital.

Decided: that consideration of the applications by David lan McDonald for the renewal of his Taxi Driver’s Licence and Private Hire Car Licence be continued to allow David lan McDonald another opportunity to appear before the Sub-Committee to speak in support of his applications.

(4) SECOND HAND DEALER’S LICENCE - NEW APPLICATION - WlLLlAM C. FALLON, 54 CORSEWALL STREET, COATBRIDGE

8. The Head of Legal Services advised (1) that an application (tabled) by William C. Fallon, 54 Corsewall Street, Coatbridge for a Second Hand Dealer’s Licence to enable him to trade from his Autobreakers premises at I0Cameron Street, Coatbridge had been received; (2) that an objection to the application (tabled) had been received from Mrs. G. Nisbet, local resident, and (3) that a late representation had been received from the Chief Constable, Strathclyde Police.

The Administrative Officer then indicated that Mrs. Nisbet was not in attendance.

The Sub-Committee heard Superintendent Docherty explain the reasons for the Chief Constable’s representation being submitted late and the applicant‘s agent, Mr. Cooke, McKenzie Solicitors, advise that his client had no objection to the representation being considered.

The Sub-Committee then heard Mr. Cook speak in support of the application and Superintendent Docherty speak in respect of the representation (tabled).

Thereafter, the applicant, Mr. Cooke and representatives of the Police withdrew from the meeting and the Sub-Committee resumed consideration of the matter.

(2) LATE HOURS CATERING LICENCE - NEW APPLICATION - AHMED JANI, 102 ALBERT ROAD, CROSSHILL, GLASGOW

5. The Chief Solicitor (Licensing) advised (1) that an application (tabled) by Ahmed Jani, 102Albert Road, Crosshill, Glasgow for a Late Hours Catering Licence in respect of the Real Spice Tandori, 103 Cumbernauld Road, had been received, and (2) that objections (tabled) to the application had been received from a number of local residents and Councillor Wallace, local Member.

The Sub-Committee then heard Councillor Wallace outline his and the local residents’ objections to the application, Chief Superintendent Buchan outline the Chief Constable’s observations on the application, and Mr. Mahmood, the applicant‘s brother, speak in support of the application.

Thereafter, Mr. Mahmood, Councillor Wallace and representatives of the Police, withdrew from the meeting and the Sub-Committee resumed consideration of the matter.

(3) STREET TRADER'S LICENCE - NEW APPLICATIONS

(a) ELIZABETH MITCHELL MEECHAN, 9 GOLSPEY AVENUE, AlRDRlE

6. The Chief Solicitor (Licensing) advised (1) that an application (tabled) by Elizabeth Mitchell Meechan, 9 Golspey Avenue, Airdrie for a Street Trader's Licence to enable her to trade from her static snack van at South Caldeen Road, Coatbridge had been received; (2) that objections (tabled) to the application had been received from the Chief Constable, Strathclyde Police and Christie, Bakers, and (3) that the objection by the Chief Constable had been submitted late.

The Administrative Officer indicated that the applicant and a representative from Christie, Bakers were not in attendance.

Thereafter, the Sub-Committee resumed consideration of the matter in the applicant's and objector's absence.

The Sub-Committee then heard Chief Superintendent Buchan (1) explain the reason for the Chief Constable's objection being submitted late and outline the objection to the application, and (2) Mr. McAlpine, Department of Planning and Environment outline the Director of Planning and Environment's observations on the application.

Decided: that consideration be continued to allow the applicant another opportunity to appear before the Sub-Committee to speak in support of the application.

(b) TAHIR ALI, 23 HALBERT STREET, GLASGOW

7. The Chief Solicitor (Licensing) advised (1) that an application by Tahir Ali, 23 Halbert Street, Glasgow for a Street Trader's Licence to enable him to trade from an ice cream van in the areas of Harthill and Eastfield had been received, and (2) that Tahir Ali had failed to submit a Food Safety Certificate.

The Administrative Officer then indicated that Tahir Ali was not in attendance.

Thereafter, the Sub-Committee resumed consideration of the matter in the applicant's absence.

2. The Head of Legal Services advised (1) that an application (tabled) by Maria Theresa Brodie, 32 Aitkenhead Avenue, Coatbridge for a Private Hire Car Driver’s Licence had been received, and (2) that a late representation in respect of the application had been received from the Chief Constable, Strathclyde Police.

The Sub-Committee then heard Superintendent Docherty explain the reason for the Chief Constable’s representation being submitted late and Maria Theresa Brodie advise that she had no objection to the Chief Constable’s representation being considered.

The Sub-Committee then heard Superintendent Docherty outline the Chief Constable’s representation (tabled) to the application and Maria Theresa Brodie speak in support of her application.

Thereafter, the applicant and representatives of the Police withdrew from the meeting and the Sub-Committee resumed consideration of the matter.

With reference to paragraph 2 of the Minute of the meeting of this Sub-Committee held on 20 February 2003, the Head of Legal Services advised (1) that consideration of an application (tabled) by James Dickson, 61 Coldstream Crescent, Coltness, Wishaw for a Private Hire Car Driver’s Licence had been continued to allow the applicant an opportunity to appear before the Sub-Committee to speak in support of his application, and (2) that James Dickson had spent convictions.

The Sub-Committee, having enquired as to the age and general nature of the spent convictions, were provided, in broad terms, with such information by James Dickson.

The Sub-Committee then heard the applicant and Superintendent Docherty speak in respect of the application.

Thereafter, the applicant and representatives of the Police withdrew from the meeting and the Sub- Committee resumed consideration of the matter.

With reference to paragraph 3 of the Minute of the meeting of this Sub-Committee held on 20 February 2003, the Head of Legal Services advised that consideration of a complaint by the Chief Constable and Rosemary Wilson, 13 Croftcot Avenue, Bellshill relative to the behaviour of William Kenmuir, 15 Croftcot Avenue, Bellshill had been continued to allow William Kenmuir an opportunity to appear before the Sub-Committee to speak in relation to the complaint.

The Administrative Officer then indicated that Rosemary Wilson was not in attendance.

The Sub-Committee then heard Superintendent Docherty outline the Chief Constable’s complaint and William Kenmuir’s agent, Mr. Bell, Leonards, Solicitors speak in respect of the complaint.
