    Acknowledgements The two editors of this book are best described as ‘hands-on’ academics. We have both maintained our credentials as lawyers after moving into the academy from legal practice. A co-founder (in 1989) of Melbourne’s first community legal centre specializing in immigration and refugee law (known now as Refugee Legal), Mary has taken a particular interest in the plight of migrant children over many years. In 2006, Lenni began holding trainings for pro bono attorneys at New York Law School to expand the pool of attorneys prepared to represent child migrants. In 2012, as the numbers of unaccompanied minors arriving at the south west border of the United States grew exponentially, she founded the Safe Passage Project, a law school clinic combined with a non-profit representing hundreds of children via direct and mentored pro bono services. This book has involved considerable work and commitment on the part of many people. We are deeply grateful to each of our contributors and for their patience in reviewing and revising their work so as to give a sense of unity and fluency to what would otherwise be a very diverse collection. Research for this book was made possible through the support of private donor, Ms Judy Harris; research funding by New York Law School and private donor, Sheila Wellington; and before that, the Australian Research Council, Linkage Project LP100200596 ‘Small Mercies, Big Futures: Enhancing Law, Policy and Practice in the Selection, Protection and Settlement of Refugee Children and Youth’.     About the authors Mary Crock (BA (Hons) LLB (Hons) PhD (Melbourne)) has worked in the area of immigration and refugee law since 1985. She is Professor of Public Law at Sydney University Law School. An Accredited Specialist in Immigration Law since 1994, she has been listed in the peer reviewed publication Best Lawyers in Australia (for immigration law) since 2008 and has served on a variety of national, state and NGO bodies relating to immigration, refugees, disability and child protection. Professor Crock has written extensively on issues related to immigration and refugee law, authoring 11 books, and over 70 book chapters and refereed articles. She has had a research focus on the laws, policies and practices involving persons with disabilities in forced migration since 2010, building on a long-standing interest in children and other vulnerable migrants. Together with her husband Professor Emeritus Ron McCallum AO, her work with refugees with disabilities was recognized in December 2015 with the award of the inaugural NEDA Medal by Australia’s National Ethnic Disability Alliance. Laura Smith-Khan (BA (Languages) LLB (Hons) (Sydney), GradDip Legal Practice (ANU), M App Ling (Monash)) is a Doctoral Candidate in Linguistics at Macquarie University. Her doctoral research focuses on linguistic diversity, communication and social justice within Australia’s refugee policy and procedures. She was lead research associate on the Protection of Refugees with Disabilities project, coordinating and con- ducting research across all six fieldwork locations. Along with the Chief Investigators, she has presented project findings at various international conferences and seminars. Since completing her undergraduate education in 2011, Ms Smith-Khan has authored 12 peer-reviewed publications across multiple disciplines.

John is Head of the Discipline of Clinical Ophthalmology and Eye Health at The University of Sydney. He also consults at Sydney Eye Hospital and The Children’s Hospital at Westmead. In 1974 he completed a Master of Laws Degree at Queen’s University, Canada. It was at this point that Ron developed his interest and expertise in labour and employment law. After teaching at Monash for 18 years, he moved to Sydney in 1993 where he was appointed to a full professorship at the University of Sydney. Blind since his birth, this appointment made Ron the first totally blind person to be appointed to a full professorship at any Australian or New Zealand university. He served as Dean of the University of Sydney Law School between 2002 and 2007.

Introduction Good afternoon ladies and gentlemen. It is indeed a huge honour for me to deliver this annual human rights lecture named for Ron Castan QC. I met Ron on several occasions, but we never conversed at any length. I was a young admirer from afar for he was an example to us all on how law could be utilised to enhance and to protect the human rights of all persons, especially Indigenous Australians. Sadly, Ron passed away just a few days shy of his sixtieth birthday, but his work lives on in the Castan centre which focuses upon human rights law, practice and scholarship. 2. The CRPD Committee I well remember Monday morning 23 February 2009. It was very cold, for my wife, Professor Mary Crock, and I found ourselves in Geneva. We alighted from the tram and walked under the flags at the Palais des Nations, one of the major United Nations buildings. I was excited yet nervous, for this was my first day as an inaugural member of the United Nations Committee on the Rights of Persons with Disabilities, the CRPD Committee. The primary purpose of the CRPD Committee is to monitor the implementation on a world-wide basis of the United Nations Convention on the Rights of Persons with Disabilities2 which I shall call the CRPD.

    A Forgotten Cohort: Citizenship Through Work and Persons with Disabilities Ron McCallum* & Hannah Martin" Though the UnitedNations has recognized that access to work is afundamentalhuman right, access to this right is commonly denied to persons with disabilities throughout the world. Their exclusion from full participationin the labourforce has generated,and continues to generate, both economic andsocial disadvantageswhile also preventing them from accessinga key feature of citizenship: the right to work. The authors argue that improving persons with disabilities' access to, andparticipationin, employment will allow them to take-and also to give back-the full benefits of industrial citizenship. An examination of various internationalinstruments, including the Convention on the Rights of Persons with Disabilities, provides an overview of the commitments made to persons with disabilities regardingfair and equal employment. The authors use the case studies ofAustralia and Canada as a means to examine the effectiveness of two very different strategiesfor increasing employment for persons with disabilities-anti- discriminationlegislation and sheltered workshops. The authors ultimately conclude that only policies that increasepersons with disabilities' access to the open labour market, such as anti- discriminationlegislation and the imposition of duties of reasonableaccommodation, have the potential to allow persons with disabilitiesto accessfull citizenship at and through work.
