Many of our states have taken the step of waiving co-payments for coronavirus- related testing and treatment through our Medicaid programs and have encouraged our private insurers to do the same. We all know that more needs to be done to increase access to affordable health care during this crisis, however. To that end, we would ask that you reconsider your decision and immediately open a special enrollment period of at least 30 days on the federal health care exchange. A special enrollment period would ensure individuals in the 38 states on the federal exchange, in addition to those who already qualify, can purchase the coverage they need during this challenging time. Too many of our constituents are uninsured or underinsured despite the steps we’ve taken at the state level. As a result, far too many of our residents are choosing to forgo coronavirus testing and treatment out of fear of the potential costs to themselves and their families at a time of increasing economic distress. Not only is this unacceptable, it’s also dangerous as it undermines our ability as a nation to stop the spread of COVID- 19.

The Partnership is composed of health systems, health IT vendors, innovators, chronic care specialists, and primary care stakeholders who are committed to ensuring patients who receive care via telehealth have access to the highest quality care. As a coalition representing leaders across the telehealth space, we appreciate the opportunity to provide comments on the RFI on Regulatory Relief to Support Economic Recovery. We applaud the broad and swift action taken by HHS and the Centers for Medicare and Medicaid Services (CMS) in response to the pandemic to make certain Medicare beneficiaries continue to have access to necessary care. During the pandemic numerous waivers and flexibilities were issued to ensure access to telehealth services as an alternative modality to in-person care. Prior to the pandemic, telehealth services were limited in scope and utilization. However, out of necessity, the pandemic forced the healthcare system to explore how care can be effectively provided through alternative modalities. The Partnership recognizes that outside of the current PHE, the agency’s authority to eliminate or waive certain telehealth requirements, such as originating and distant site requirements is limited by current statute.

    May 19, 2020 The Honorable Alex Azar Secretary Department of Health and Human Services 200 Independence Avenue, NW Washington, D.C. 20201 Dear Secretary Azar: On behalf of the American College of Physicians (ACP), I am writing to ask that the Department of Health and Human Services (HHS) make a targeted allocation out of the Provider Relief Fund (PRF) to support primary care physicians and their practices, sufficient to keep their doors open, by offsetting lost revenue from the COVID-19 pandemic, similar to the targeted allocation for rural hospitals. In addition, ACP urges HHS to create more options for primary care practices to transition away from pure fee-for-service (FFS) to per patient per month (PPPM) prospective payments, adjusted for patient characteristics, health status, and risk. These recommendations build upon, and add specificity to, our letter on April 28th where we recommended that a substantial and dedicated portion of the newly authorized $75 billion of the PHSSEF be rapidly and automatically disbursed to physicians and their practices based on lost revenue and increased costs. The American College of Physicians is the largest medical specialty organization and the second- largest physician membership society in the United States. ACP members include 159,000 internal medicine physicians (internists), related subspecialists, and medical students. Internal medicine physicians are specialists who apply scientific knowledge and clinical expertise to the diagnosis, treatment, and compassionate care of adults across the spectrum from health to complex illness. Internal medicine specialists treat many of the patients at greatest risk from COVID-19, including the elderly and patients with pre-existing conditions like diabetes, heart disease, and asthma.

In particular, the ASC community applauds the work by the Centers for Medicare & Medicaid Services (CMS) to create the Hospital Without Walls regulatory framework that will permit surgery centers to serve their communities in new ways and provide desperately needed capacity for patient care during this crisis. To that end, I seek your assistance in ensuring that the resources contained in the Coronavirus Aid, Relief, and Economic Security Act (CARES) Act, are made available immediately to ambulatory surgery center that are in severe economic distress due to the pandemic. Some of the $100 billion in funding for the Public Health and Social Services Emergency Fund in the CARES Act must be directed towards reimbursing eligible health care providers, such as ambulatory surgery centers and our physicians, for health care-related expenses or lost revenues that are attributable to COVID-19. ASCs were quick to follow guidance from CMS and state leaders to postpone most elective surgeries to increase social distancing and preserve medical supplies.

We appreciate the Administration’s collaboration with states in addressing this national challenge. State insurance regulators are also working to make sure insurance markets meet the immediate and long-term needs of consumers, insurers, and other stakeholders. On behalf of the membership of the National Association of Insurance Commissioners1, we write to request that you take a number of actions to strengthen health insurance markets, namely providing maximum flexibility on 2021 rate review deadlines; clarifying the financing of surveillance testing; and expediting access in the Federally- facilitated Marketplaces to the already-codified special enrollment period for consumers with declining income. State regulators will soon begin the process of reviewing insurers’ proposed rates for plan year 2021 and carriers are already developing them. As states set their deadlines for submission, posting, review and approval of rates they must balance the need for data and the availability of state resources, and they must comply with various Federal deadlines. We thank you for your recent announcement that the initial filing, posting, and final submission dates have been moved back. This will provide states the flexibility they need as they work closely with their carriers to ensure the most accurate rates for 2021.

    October 5, 2020 Introduction President Trump’s bout with COVID-19 has brought the pandemic back to the forefront of the news cycle and on the minds of everyone. Fatigue from being socially distanced from loved ones and the trappings of the “new normal” including wearing masks, washing hands per CDC guidelines, and all those Zoom meetings have led us to let our guard down somewhat. Some areas of the country are doing well, while others see the virus spreading at an alarming rate. A New York Times article on the spread of COVID-19 is linked here. For us, now that RHC cost reports have finally been filed with Medicare, it is time to turn our attention back to Provider Relief Funds and the rather onerous reporting requirements that HHS announced recently for General and Targeted Distributions, RHC COVID-19 Testing Reporting Requirements, and an additional $20 billion of Phase 3 Provider Relief Funding for certain providers. Under this Phase 3 General Distribution allocation, providers that have already received Provider Relief Fund payments will be invited to apply for additional funding that considers financial losses and changes in operating expenses caused by the coronavirus.

DeWine’s Press Conference During today’s press conference, Gov. DeWine announced that the Ohio Department of Health (ODH) will issue a new order requiring that children grades K-12 wear a mask while at school. The administration is working to distribute two million masks to schools and will use regional education service centers to distribute. The order will soon be available here. Lt. Gov. Husted clarified that the administration is still working on its plan for high school contact sports for the fall. An ODH order regarding contact sports from July 4th was extended this week. The administration stated that July 4th order is not the plan for high school contact sports and should not be viewed as such. The administration continues to work with the Ohio High School Athletic Association on this matter. Additionally, Lt. Gov. Husted noted the administration is working with professional sport organizations in Ohio on plans for their seasons.
