GOVERNMENT AND OUTER BUDGET SECTOR AGENCIES NOTICES MOYNE SHIRE COUNCIL Proposed Local Law No. 1 of 2006 General Amendment Local Law 2006 The Moyne Shire Council (“Council”) is proposing to amend its General Local Law 2005 (Local Law No. 3 of 2005). The following information is provided in accordance with section 119 of the Local Government Act 1989 (the “Act”). The purpose of the proposed amendment is to: ● provide for the safe use of the Port of Port Fairy facilities by all users; ● ensure the Port of Port Fairy meets the needs of both commercial operators and visitors; ● ensure the workings of the Port of Port Fairy are efficiently managed and conducted in an equitable manner; ● require that a person in control of a dog in a public place in a prescribed area shall have in his or her possession a dedicated scooper device or bag for the purpose of the collection and removal of any dog excrement from that dog; and ● provide controls over parked vehicles being used for advertising. The proposed amendment if adopted will: Port of Port Fairy ● control the area where vessels may be refuelled or unloaded; ● prohibit vessels from being tied up to handrails on the wharf or jetty; ● provide for the Port Controller to direct that a vessel be moved from a permanent berth; ● provide for the Port Controller to be able to alter the position of berthed vessels in the absence of the vessel master in certain circumstances; ● control the parking of vehicles between the wharf and the Co-operative building unless loading or unloading; ● provide that a vessel master who is unloading squid must ensure that the jetty surface is washed down and kept free from squid ink; ● make it an offence to use a vehicle to refuel unless such vehicle has a current authorization; ● require that vehicles used for refueling are fitted with fire fighting and oil spill equipment; ● make it an offence for any vessel to discharge liquid waste into the water of the Port; ● declare certain areas to be “Emergency Access Areas”; ● prohibit the storage of any container of oil on the wharf; ● provide for the Port Controller to close parts of the Port for particular activities; ● prohibit the: – riding of bicycles; – use of toy vehicles; – diving and swimming; – scuba diving and lighting of fires in certain circumstances; ● limit the speed of water traffic in the Port. Dogs ● require that any person who has the control of a dog in a public place within a Township area in Schedule 4 or any other area as prescribed by Council shall have in his or her possession a dedicated scooper device or bag for the purpose of collection and removal of any excrement from that dog. Fisheries Act 1995 MINISTERIAL DIRECTION SPECIFYING ELIGIBILITY CRITERIA FOR THE ISSUE, TRANSFER AND RENEWAL OF AQUACULTURE LICENCES I, Peter Harris, Secretary, Department of Primary Industries, under section 61 of the Fisheries Act 1995, make the following Direction specifying eligibility criteria that must be met before the approval of the issue, renewal or transfer of an aquaculture fishery licence. Objective The objective of this direction is to specify eligibility criteria that must be met before approval of the issue, renewal or transfer of an aquaculture fishery licence. 2. Authorising provision This direction is made under section 61 of the Fisheries Act 1995. 3. Eligibility criteria (1) This clause applies where an aquaculture licence for a specified area within an aquaculture fisheries reserve, declared under section 88(1) of the Act, is to be – (a) issued; (b) transferred; or (c) renewed, where the licence to be renewed – (i) was issued after the declaration of a management plan for the relevant aquaculture fisheries reserve made under section 28 of the Act; or (ii) has been renewed twice since the declaration of a management plan for the relevant aquaculture fisheries reserve made under section 28 of the Act. (2) An applicant for the transfer, issue or renewal of an aquaculture licence as described in sub-clause (1) must satisfy the eligibility criteria set out in sub-clause (3). (3) The applicant must – (a) have a lease of Crown land under section 134 of the Land Act 1958; or (b) have a sub-lease to a lease of Crown land under section 134 of the Land Act 1958; or (c) have the written consent of the holder of a lease of Crown land under section 134 of the Land Act 1958 and sign a deed poll that provides indemnity to the State Government of Victoria in a form required by the State consistent with the warranty and indemnity provisions specified in the Crown lease, for the specified area for which the licence is to be issued, transferred or renewed. 1410 G 27 6 July 2006 Victoria Government Gazette
