Gopal Baglay's Message on the occasion of 72nd Republic Day of India I extend warm greetings to the friendly people of Sri Lanka and all Indians residing in this beautiful country on the occasion of the 72nd Republic Day of India. It was on 26 January 1950 that the world’s largest written Constitution entered into force into a newly independent India and transformed the young nation into a Republic. As a fellow South Asian democracy and our closest maritime neighbour, Sri Lanka has been a consistent partner of the Indian people and society. Our common heritage, of which Buddhism is a core element, reflects our cultural similarities and millennia old people-to-people ties. Today, we are fortunate to have strong leaders guiding our destinies. As a result, I feel extremely positive about the prospects for our bilateral relationship. Ever since my arrival in Colombo on 8 May 2020, carrying 12.5 tonnes of medical supplies, I have worked with the Sri Lankan side including the Government and its people with a sense of purpose to take our bilateral engagement forward. I am happy to share with you that despite the challenges of the COVID 19, our two Governments have been able to maintain the momentum of high-level exchanges including through the Virtual Bilateral Summit between Prime Minister Modi and Prime Minister Mahinda Rajapaksa on 26 September 2020 and the numerous telephone conversations between Prime Minister Modi and President Gotabaya Rajapaksa. The National Security Adviser of India visited Colombo in November for the 4th Trilateral Meeting with his counterparts from Sri Lanka and Maldives.

Minister, Migrant Workers Stranded Overseas due to COVID – 19: Restrictions to Return to Sri Lanka We write with reference to numerous complaints the Human Rights Commission of Sri Lanka (“Commission”) received from Sri Lankan migrants (and their families) stranded overseas due to travel restrictions imposed by the Government to prevent the spread of COVID-19. The Commission commends all efforts made by the Government of Sri Lanka to curb the spread of COVID-19 and recognizes the special need to restrict certain rights in the interests of public health and public order during this health emergency. However, as stipulated under Section 10 of Act No. 21 of 1996, the Commission is duty bound to inquire into complaints and make recommendations to the Government to ensure that administrative practices are in accordance with our constitution and international human rights norms and standards. In this regard, the Commission wishes to emphasize that under Article 14 (1) (i) of the Constitution, every citizen has a right to return to Sri Lanka. This is similar to Sri Lanka’s treaty obligations. Article 8 of the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families recognises all migrant workers and family members have the right to enter and remain in their State of origin at any time. Article 67 requires State Parties to adopt measures for their orderly return when they decide to return or their residence or employment expires or when their stay is irregular.

    PARLIAMENT WATCH – SRI LANKA* 2009 REPORT _____________________________________________________________ * Conceptualised, implemented and funded by South Asians for Human Rights; Research carried out and assistance provided by Transparency International, Sri Lanka A Report on the proceedings of the Sixth Parliament of Sri Lanka Background The report covers the period from January to December 2009. The period under review was significant for Sri Lanka as it marked the end of the armed struggle that spanned over 26 years. The war was officially declared over by the Sri Lankan government on May 19, 2009 generating much hope at the end of a protracted war. Public expectations were high with regard to the restoration of civil liberties which were long compromised to enable the execution of the war to an end. However, Sri Lanka was also left to deal with grave issues such as the 300, 000 Internally Displaced Persons (IDP), a war-battered economy and the lack of investment and industrial development, in addition to dealing with allegations of war crimes and human rights abuses. This report looks at the conduct of the Sri Lankan Legislature during the year 2009 and how Parliament dealt with issues related to transparency, accountability, good governance and human rights during the last phase of Eelam War IV and its immediate conclusion. Significant attention is also paid to the area of human rights, given its extreme importance in times of war, and the immediate aftermath when countries tend to experience more violations of rights that are constitutionally guaranteed. In addition, the report covers a range of topics including the specific issue of IDPs and freedom of expression concerns in Sri Lanka.
