LEILÃO VIRTUAL GP SÃO PAULO GERAÇÃO 2019 NORMAS ESPECIFICAS I - CONDIÇÕES GERAIS ART. 1º- O Leilão de Produtos da Geração 2019, será realizado de forma virtual nos dias 19 e 20 de Maio de 2021, 4ª e 5ªFeira, as 20 horas. ART. 2º - A arrematação far-se-á pelo maior lance. ART. 3º - É facultado aos interessados fazer examinar por técnicos de sua confiança os produtos a serem licitados, antes do Leilão. Portanto, serão INACEITÁVEIS quaisquer reclamações posteriores. ART. 4º - Os vendedores e a APPS (Agência Paulista do Puro Sangue) não se responsa- bilizarão por quaisquer alterações ocorridas no estado dos animais após a arrematação, tampouco acidente de transporte. Parágrafo único - Lembramos aos interessados que procedam com antece- dência a devida revisão dos animais, em seus respectivos locais de alojamento. ART. 5º - Os animais deverão ser retirados no prazo de 4 (quatro) dias a contar da data da arrematação. ART. 6º - Os lances corresponderão ao valor da parcela mensal, que serão multiplicados por 15 (quinze), e resultará no valor total da arrematação. ART. 7º - Foram dispensados os necessários cuidados para que o catálogo esteja corre- to, mas a APPS (Agência Paulista do Puro Sangue), os vendedores e o leiloeiro não respondem por erros ou omissões do mesmo. Eventuais correções feitas durante o leilão prevalecerão sobre o catálogo. II - DOS COMPRADORES ART. 8º - Os compradores poderão optar pelas seguintes condições de pagamento: - 15 parcelas mensais iguais e sucessivas, sem juros e sem correção. - à vista com desconto de 6% (seis por cento), sobre o valor do arremate. Todos os animais arrematados por valor de parcela inferior ou igual a R$400,00 (quatrocentos reais) deverão ser pagos à vista. ART 9º - Os interessados em obter financiamento deverão apresentar, à APPS, cadas- tro para apreciação, até 10 dias antes do leilão. Parágrafo único - Os compradores que não estiverem cadastrados ou aqueles cujos cadastros não forem aprovados terão que efetuar o pagamento à vista, gozando do desconto estipulado para o certame. ART. 10º - Para os compradores se beneficiarem dos desconto para pagamento a vista, deverão regularizar a compra até o dia 24/05/2021. ART. 11º - Os compradores deverão pagar as seguintes taxas: a. 8,0% (oito por cento) sobre o valor do arremate, para qualquer opção de pagamento. b. Transferência de propriedade, de acordo com a tabela de emolumentos do Stud Book Brasileiro. ART. 12º - Aos compradores compete ainda: a.Assinar, no ato da compra, quando o leilão for presencial, nota promissória no valor correspondente ao preço da aquisição, acrescida das taxas devidas, com vencimento contra apresentação, e que deverá ser substituída quando da regularização da compra. NORMAS ESPECIFICAS b.Imprimir, quando o leilão for virtual, as notas promissórias e contrato de financiamento , que serão enviados por e-mail, e devolver a documentação acima, assinada pelo adquirente, para o endereço da APPS, localizado na Rua Pero Leão, 157 – Pinheiros - CEP 05423-060 – São Paulo. ART. 13º - Ficam cientes os compradores que em caso de inadimplência, mediante comunica- ção do vendedor à ABCPCC, esta poderá bloquear as transações e registros even- tualmente solicitados pelo comprador junto ao SBB, após ouvido o comprador no prazo de 5 (cinco) dias. Concordam os compradores que a inadimplência, por prazo superior a 15 (quinze) dias, gera autorização para a ABCPCC bloquear qualquer transações e registro de quais quer animais de propriedade do comprador, até a comprovação do efetivo paga- mento a vendedor e independentemente de inexistir restrição na transferência dos animais. ART. 14º - O ICMS é de responsabilidade do vendedor na forma do decreto 34.448. Os produtos com idade inferior a 36 meses estão isentos de ICMS. Entretanto para as vendas interes- taduais o imposto é devido e seu recolhimento será de responsabilidade do comprador. III - DOS VENDEDORES Compete aos vendedores: ART. 15º - Pagar a importância de R$ 1.200,00 (um mil e duzentos reais) referente a inscrição do leilão. ART. 16º - No caso da não apresentação do animal inscrito,seu responsável também deverá pagar a importância mencionada acima. ART. 17º - No ato da retirada por parte do comprador o animal deverá possuir, carteira de identidade, exame negativo de AIE e MORMO, além de vacinas obrigatórias dentro do prazo de validade, exigidos pelo serviço de Veterinária do Jockey Club. ART. 18º - No caso de defesa ou forfait, o vendedor terá 5 (cinco) dias úteis para efetuar o pagamento, após este prazo,incidirão juros sobre o débito. a) na defesa, o vendedor ficará responsável pelo pagamento das taxas de comprador, além das despesas previstas no art. 15°. III - CONDIÇÕES FINAIS ART. 19º - O animal arrematado será entregue pelo vendedor, com toda documentação exigida pelas autoridades sanitárias e Jockeys Clubs (anemia, mormo, vaci- nas, GTA), mediante autorização, por escrito, da APPS, a qual será dada imediatamente após a regularização da compra, correspondendo ao vendedor a responsabilidade de manutenção do animal até, no máximo 4 (quatro) dias subsequentes à arrematação. A partir do 5° (quinto) dia, as despesas de manutenção ficarão por conta do comprador, pagas diretamente ao vendedor no dia da retirada do animal no valor de R$ 80,00 (oitenta reais) a diária. Parágrafo único - Eventuais problemas decorrentes da não retirada do animal são de exclusiva responsabilidade do comprador. ART. 20º - A palavra do leiloeiro, no decorrer do Leilão: 1) Está credenciada a alterar ou complementar estas normas, bem como as demais informações do catálogo. 2) O leiloeiro reserva-se o direito de não aceitar lances de pessoas que, a seuexclusivo critério, julgar não responsáveis, sendo seu julgamento soberano. 3) Compete ainda ao leiloeiro estabelecer a seu critério exclusivo o lance de abertura e a variação do montante de cada lance, cabendo ao mesmo esclare cer eventuais dúvidas e estabelecer normas para os casos omissos. 4) Poderá o leiloeiro retomar a licitação, sempre ao seu exclusivo critério, mesmoapós a batida do martelo, para dirimir dúvida quanto à identidade do licitante ganhador em caso de disputa e lances simultâneos. Nesse caso, participarão da reabertura da licitação apenas os licitantes que se envolveram na questão.
