Municipal Campaign Account

A Candidate and Registered Third Party, in the 2018 municipal election, is required under the Municipal Elections Act, 1996 to open an account in the name of their campaign (for example: “Campaign for John Doe” or “John Doe’s Campaign”) if funds will be expended or received.

The Act does not contain any prohibition against a municipal candidate being a signing officer on the campaign account, nor does it require the candidate to have a chief financial officer, as is the case with provincial and federal candidates.

Section 88.22(1) of the Municipal Elections Act, 1996 states:

A candidate shall ensure that, (a) no contributions of money are accepted or expenses are incurred unless one or more campaign accounts are first opened at a financial institution exclusively for the purposes of the election campaign; (b) all contributions of money are deposited into the campaign accounts; (c) all funds in the campaign accounts are used exclusively for the purposes of the election campaign; (d) all payments for expenses are made from the campaign accounts; (e) contributions of goods or services are valued; (f) receipts are issued for every contribution and obtained for every expense; (g) records are kept of, (i) the receipts issued for every contribution, (ii) the value of every contribution, (iii) whether a contribution is in the form of money, goods or services, and (iv) the contributor’s name and address; (h) records are kept of every expense including the receipts obtained for each expense; (i) records are kept of any claim for payment of an expense that the candidate disputes or refuses to pay; (j) records are kept of the gross income from a fund-raising function and the gross amount of money received at a fund-raising function by donations of $25 or less or by the sale of goods or services for $25 or less; (k) records are kept of any loan and its terms under section 88.17; (l) the records described in clauses (g), (h), (i), (j) and (k) are retained by the candidate for the term of office of the members of the council or local board and until their successors are elected and the newly elected council or local board is organized; (m) financial filings are made in accordance with sections 88.25 and 88.32; (n) proper direction is given to the persons who are authorized to incur expenses and accept or solicit contributions under the direction of the candidate; (o) a contribution of money made or received in contravention of this Act or a by-law passed under this Act is returned to the contributor as soon as possible after the candidate becomes aware of the contravention; (p) a contribution not returned to the contributor under clause (o) is paid to the clerk with whom the candidate’s nomination was filed; (q) an anonymous contribution is paid to the clerk with whom the candidate’s nomination was filed; and (r) each contributor is informed that a contributor shall not make contributions exceeding, (i) subject to subsection (2), a total of $1,200 to any one candidate in an election, and (ii) a total of $5,000 to two or more candidates for offices on the same council or local board.

TAKE NOTICE EVERY REGISTERED THIRD PARTY SHALL FILE by March 29, 2019, with the Clerk with whom their nomination was filed a financial statement and auditor's report in accordance with s.88.29 of the Municipal Elections Act, 1996.

88.29 (1) On or before 2 p.m. on the filing date, a registered third party shall file with the clerk of the municipality in which he, she or it registered a financial statement and auditor’s report, each in the prescribed form, reflecting the registered third party’s campaign finances in relation to third party advertisements,

(a) in the case of a regular election, as of December 31 in the year of the election; and (b) in the case of a by-election, as of the 45th day after voting day. Error in financial statement (2) If an error is identified in a filed financial statement, the registered third party may withdraw the statement and, at the same time, file a corrected financial statement and auditor’s report on or before the applicable filing date under section 88.30. Supplementary financial statement and auditor’s report (3) If the campaign period for the registered third party in relation to an election in the municipality continues during all or part of the supplementary reporting period, the registered third party shall, before 2 p.m. on the supplementary filing date, file a supplementary financial statement and auditor’s report for the supplementary reporting period. Supplementary report (4) A supplementary financial statement or auditor’s report shall include all the information contained in the initial statement or report filed under subsection (1), updated to reflect the changes to the registered third party’s campaign finances during the supplementary reporting period. Auditor (5) An auditor’s report shall be prepared by an auditor licensed under the Public Accounting Act, 2004. Exception re auditor’s report (6) No auditor’s report is required if the total contributions received and total expenses incurred in the registered third party’s campaign in relation to third party advertisements during an election in the municipality up to the end of the relevant period are each equal to or less than $10,000. Notice from clerk, before filing date (7) At least 30 days before the filing date, the clerk shall give notice of the filing requirements of this section and the penalties set out in subsections 88.27 (1) and 92 (4) to every registered third party that registered in the municipality. Same, before supplementary filing date (8) At least 30 days before the supplementary filing date, the clerk shall give notice of the filing requirements of this section and the penalties set out in subsections 88.27 (1) and 92 (4) to every registered third party that gave notice to the clerk under paragraph 4 of section 88.28. Electronic filing (9) The clerk may provide for electronic filing under this section and may establish conditions and limits with respect to electronic filing. Documents filed after filing date (10) If the documents required to be filed under this section are not filed by 2 p.m. on the day that is 30 days after the applicable day for filing the documents, the clerk shall accept the documents only for the purpose of making the documents available under subsection 88 (9.1). Report by clerk (11) As soon as possible after April 30 in the year following a regular election or 75 days after voting day in a by- election, the clerk shall make available to the public on a website or in another electronic format a list of all registered third parties for the election along with an indication of whether each has filed a financial statement and auditor’s report under subsection (1).

Effect of default by registered third party 88.27 (1) Subject to subsection (6) and in addition to any other penalty that may be imposed under this Act, an individual, corporation or trade union that is registered as a registered third party in relation to an election in a municipality is not entitled to register in relation to a subsequent election in the municipality until after the next regular election has taken place, (a) if the registered third party fails to file a document as required under section 88.29 or 88.32 by the relevant date; (b) if a document filed under section 88.29 shows on its face a surplus, as described in section 88.31, and the registered third party fails to pay the amount required by subsection 88.31 (4) to the clerk by the relevant date; (c) if a document filed under section 88.29 shows on its face that the registered third party has incurred expenses exceeding what is permitted under section 88.21; or (d) if a document filed under section 88.32 shows on its face a surplus and the registered third party fails to pay the amount required by that section by the relevant date. 2016, c. 15, s. 61. Notice of default (2) In the case of a default described in subsection (1), the clerk shall notify the registered third party in writing that the default has occurred and shall make available to the public the name of the registered third party and a description of the nature of the default. 2016, c. 15, s. 61. Application to court (3) The registered third party may, before the last day for filing a document under section 88.29 or 88.32, apply to the Superior Court of Justice to extend the time for filing the document under that section and, if the court is satisfied there are mitigating circumstances justifying a later date for filing the document, the court may grant an extension for the minimum period of time necessary to enable the registered third party to file the document but the court shall not grant an extension of more than 90 days. 2016, c. 15, s. 61. Notice to clerk (4) If a registered third party makes an application under subsection (3), the registered third party shall notify the clerk in writing before 2 p.m. on the last day for filing a document under section 88.29 or 88.32 that the application has been made. 2016, c. 15, s. 61. Effect of extension (5) If the court grants an extension under subsection (3), the penalty set out in subsection (1) applies only if the registered third party has not filed the document before the end of the extension. 2016, c. 15, s. 61. Cessation of penalty (6) The penalty set out in subsection (1) for a default described in clause (1) (a) does not take effect if, no later than 2 p.m. on the day that is 30 days after the applicable day for filing the document, the registered third party files the relevant document as required under section 88.29 or 88.32 and pays the clerk a late filing fee of $500. 2016, c. 15, s. 61. 1. INTRODUCTION The Town of Bracebridge is conducting the 2018 Municipal Election in accordance with the Municipal Elections Act, S.O. 1996, as amended, and has chosen to use an alternative voting method, being Internet/Telephone Voting only (By-law 2017-002).

The purpose of this document is to establish procedures for the use of Internet/Telephone voting, which are consistent with the principles of the Municipal Elections Act, 1996 (MEA).

The Clerk, if deemed necessary, at any time, up to and including Voting Day (October 22, 2018), may amend procedures, documents, etc. Amendments to the procedures will be posted on www.bracebridgevotes.ca.

With respect to matters of policy and procedures for alternative voting methods and all other municipal election matters, the decision of the Clerk is final.

The contents of this document are intended only as a guide to certain provisions of relevant legislation and do not purport to recite all applicable statutory references. Prospective candidates must satisfy themselves through their own determination that they have complied with the pertinent sections of the MEA and that they are in fact qualified by law to seek elected office.

2. IMPORTANT DATES The 2018 Municipal Election will be held on Monday, October 22, 2018 ending at 8:00 p.m. The Term of Office is four years, beginning on December 1, 2018, and ending November 14, 2022.

Unofficial results will be posted on www.bracebridgevotes.ca as soon as possible after the close of voting at 8:00 p.m. on Monday October 22, 2018. There will also be an announcement with unofficial results at the Municipal Office.

The nomination period for candidates is May 1, 2018 to July 27, 2018 at 2:00 p.m.

Third-Party Advertisers may register from May 1, 2018 to October 19, 2018 during office hours.

A comprehensive list of important election dates can be found attached hereto in Appendix “A”.

3. PRINCIPLES GUIDING MUNICIPAL ELECTIONS The following principles were considered during the development of the MEA, its amendments, and the planning and delivery of the 2018 Municipal Election:

• The secrecy and confidentiality of the individual vote is paramount. • The election should be fair and non-biased. • The election should be accessible to the voters. • The integrity of the process should be maintained throughout the election. • There be certainty that the results of the election reflect the votes cast. • Voters and candidates should be treated fairly and consistently within a municipality.

4. ELECTORS

4.1. Qualification of Electors for Municipal Election

A person is entitled to be an elector at an election held in a local municipality (unless prohibited by the MEA or any other Act) if, on Voting Day he or she:

• Is a Canadian citizen; and • Is at least eighteen (18) years of age; and • Resides in the Town of Bracebridge; or is the owner or tenant of land in the Town of Bracebridge, or a spouse or same-sex partner of such a person; and • Is not prohibited from voting because they are: • Serving a sentence of imprisonment in a penal or correctional institution; • A corporation; • Acting as an executor or trustee or in any other representative capacity; and • Was convicted of a corrupt practice described in Section 90(3) of the MEA, if voting day in the current election is less than five years after voting day in the election in respect of which he or she was convicted.

IT IS THE RESPONSIBILITY OF THE ELECTOR TO ENSURE THEY ARE QUALIFIED.

4.2. Fractional or Time Share Ownership / Trailer Owners in Campgrounds

A tenant or owner of property under a fractional or time share contract is not entitled to vote unless the person is entitled to use the land:

• On Voting Day; or • For a period of six weeks or more during the calendar year in which Voting Day of the election is held.

4.3. Students

A student may vote in the municipality where he or she is temporarily residing while attending school as well as at his or her permanent home in a different municipality, provided that he or she does not intend to change his or her permanent home.

4.4. Homeless Persons

If a person has no permanent residence, then the following rules determine residence:

• The place in which the person most frequently returned to sleep or eat during the five weeks preceding the determination. • If the person returns with equal frequency to one place to sleep and another to eat, the place in which he or she sleeps. • Multiple returns to the same place during a single day, to eat or sleep, are considered to be one return.

A person’s affidavit regarding the places to which he or she returned to eat or sleep during a given time period is conclusive in the absence of evidence to the contrary. PROCEDURES 2018 Municipal Election Page 7 Last Revision Date: April 24, 2018

4.5. Qualification of Electors for School Board Election

A person is entitled to be an elector in an election held in a local municipality, or in territory without municipal organization within the area of jurisdiction of the district school board if, on Voting Day, he or she: • Is a Canadian citizen; and • Is at least eighteen (18) years of age; and • Has not already voted in the election for school trustees elsewhere in the school board’s area of jurisdiction; and • Resides in the local municipality or territory or is the owner or tenant of a residential property, or a spouse or same-sex partner of such owner or tenant; and • Is not otherwise prohibited from voting because they are: • Serving a sentence of imprisonment in a penal or correctional institution; • A corporation; • Acting as an executor or trustee or in any other representative capacity; and • Was convicted of a corrupt practice described in Section 90(3) of the MEA, if voting day in the current election is less than five years after voting day in the election in respect of which he or she was convicted. To vote in an English-Language Public District School Board, an elector, in addition to the above, must: • Be a supporter (or be the spouse of a supporter) of the English-language public district school board; or • Not be a supporter of any school board, nor have qualified him or herself as an elector for a separate or French-language school board in the election.

To vote in an English-Language Separate District School Board, an elector must be a Roman Catholic who must:

• Qualify as an elector for the English-language separate district school board; or • Be a supporter (or be the spouse of a supporter) of the English-language separate district school board.

To vote in a French-Language Public District School Board, the elector must be a French-language rights holder (see ss. 23(1) and (2) of the Canadian Charter of Rights and Freedoms for criteria) who must: • Qualify as an elector for the French-language public district school board; or • Be a supporter (or the spouse of a supporter) of the French-language public district school board. To vote in a French-Language Separate District School Board, an elector must be a Roman Catholic and a French-language rights holder (see ss. 23(1) and (2) of the Canadian Charter of Rights and Freedoms for criteria) who must: • Qualify as an elector for the French-language separate district school board; or • Be a supporter (or the spouse of a supporter) of the French-language separate district school board. 4.6. Electoral Status for School Boards

The electoral status for school purposes is shown on the Voters’ List. A voter may, during the revision period (Monday, September 3, 2018 up to, and including, Voting Day, Monday, October 22, 2018), make application for correction of the List. Therefore, a person may make application to change their school support up to and including Voting Day. Qualifications for and definitions of the categories of school electors are found in the Education Act, R.S.O.1990.

5. CANDIDATES To run for an office on Council or a School Board, a Candidate must be qualified on the day they file the Nomination Paper.

5.1 Council

To run for Council (Mayor, District Councillor, Ward Councillor, District Chair) the person must:

• Be a Canadian citizen; and • Be at least eighteen (18) years of age; and • Be a resident of The Town of Bracebridge or own or lease property (or be the spouse of the owner or lessee) in The Town of Bracebridge; and • Not be legally prohibited from voting; and • Not be disqualified by any legislation from holding municipal office; and • Obtain at signatures from at least 25 individuals eligible to vote in the Town of Bracebridge on the day they signed the endorsement.1

The following Council offices are to be elected in the 2018 Municipal Elections:

Mayor One (1) to be elected at large by all voters in the municipality

District and Town Councillors Three (3) to be elected at large by all voters in the municipality

Councillor (Oakley Ward) One (1) to be elected by all voters in Oakley Ward

District Chair One (1) to be elected by all voters in the District of Muskoka – Nominations for District Chair are to be filed with the District Clerk

5.2 School Board

To run for School Board Trustee the person must be:

• Be a Canadian citizen; and • Be at least 18 years of age; and • Be a resident in the area of jurisdiction of the board; and • Be eligible to be an Elector for the school board in which the person is a candidate; and • Not be legally prohibited from voting; and • Not disqualified by any legislation from holding office.

Note: Endorsement signatures are NOT REQUIRED for School Board Trustee Candidates.

To be a candidate in an English-Language Public District School Board, a Candidate must:

• Be a supporter (or be the spouse of a supporter) of the English-language public district school board; or • Not be a supporter of any board, nor have qualified himself or herself as an Elector for a separate or French-language school board in the election.

To be a Candidate in an English-Language Separate District School Board, a candidate must be a Roman Catholic who must:

• Qualify as an Elector for the English-language separate district school board; or • Be a supporter (or be the spouse of a supporter) of the English-language separate district school board.

To be a Candidate in a French-Language Public District School Board, the candidate must be a French-language rights holder (see ss. 23(1) and (2) of the Canadian Charter of Rights and Freedoms for criteria) who must: • Qualify as an Elector for the French-language public district school board; or • Be a supporter (or the spouse of a supporter) of the French-language public district school board.

To be a Candidate in a French-Language Separate District School Board, a candidate must be a Roman Catholic and a French-language rights holder (see ss. 23(1) and (2) of the Canadian Charter of Rights and Freedoms for criteria) who must:

• Qualify as an Elector for the French-language separate district school board; or • Be a supporter (or the spouse of a supporter) of the French-language separate district school board.

An elected member of council or a school board trustee must maintain their qualifications throughout the entire term of office or their seat will become vacant.

5.3 Nominations

A person can only become a candidate during the Nomination Period. The Nomination Period starts on Tuesday May 1, 2018 and ends on Friday July 27, 2018 at 2:00 p.m. The time for close of Nominations will be confirmed using the National Research Council Official time signal at (613) 745-1576. Nomination papers will not be accepted after the deadline.

Nomination papers must be signed by the Candidate and filed in person or by an agent (no fax or email), accompanied by at least 25 signatures from eligible electors. Potential Candidates are required to make an appointment with the Clerk to ensure availability to receive the nomination.

All nomination documentation MUST contain original signatures.

Nominations must be filed at the Municipal Office during the period:

• Tuesday May 1, 2018 through to Thursday July 26, 2018, Monday to Friday (statutory holidays excepted) between 8:30 a.m. and 4:30 p.m. • Friday July 27, 2018 (Nomination Day) between 8:30 a.m. and 2:00 p.m. On Nomination Day, candidates must make their presence known to the Clerk prior to 2:00 p.m. Nomination papers will not be accepted after the deadline. Nominations may be made by completing and filing, in the office of the Clerk, nomination form and accompanied by the Declaration of Qualification, acceptable identification (must be valid and contain the candidate’s name, qualifying address and signature), the prescribed nomination filing fee ($200 for the Office of Mayor, $100 for all other offices), and such other documentation as required for the filing process. The filing fee is payable by cash, debit, certified cheque, bank draft or money order payable to the Town of Bracebridge.

If, after having filed a nomination form, a Candidate wishes to file a nomination for a different office in the same election, the first nomination shall be deemed to have been withdrawn at the time the second nomination is filed. The 25 signatures endorsing the Candidate’s nomination may be transferred. The filing fee is deemed to have been paid with the latest filing if the two nominations are for the same council/board unless changing offices.

If a greater number of Candidates are certified than are required to fill the said office, there will be an election. If the number of nominations for an office is less than the number of Candidates to be elected an additional Notice of Nomination will be advertised on the website only and additional nominations may be filed between 9:00 a.m. and 2:00 p.m. on the Wednesday following Nomination Day (August 1, 2018).

5.4 Nomination Papers Filed (non-certified)

A list of non-certified nomination papers filed will be posted on www.bracebridgevotes.ca as soon as possible after filing. The list will be updated as new nominations are received.

5.5 Certify or Reject Nominations

It is the responsibility of the candidate to ensure they meet all of the qualifications and file proper nomination papers, prior to 2:00 p.m. on July 27, 2018.

Under the MEA, the Clerk is required to reject or certify nominations of candidates. On or before 4:00 p.m. on July 30, 2018, the Clerk will examine each nomination filed and, if satisfied the person is qualified to be nominated and that the nomination complies with the MEA, the Clerk shall certify the nomination form.

The Clerk may consider the following requirements in their decision to reject or certify individual nominations:

• The Candidate has refused or declined to provide proof of qualification or identification suitable to the Clerk; • The Candidate is not qualified to hold office, or is otherwise prohibited by law from being nominated; • The nomination form is not complete or the prescribed filing fee has not been paid; • The Candidate’s name does not appear on the Voters’ List; and • The mandatory financial statement from a previous election was not filed.

There may be other circumstances in which the Candidate is disqualified from being nominated or elected, other than those identified above. It is the responsibility of each Candidate to ensure that they are not disqualified from being nominated for the office.

If not satisfied, the Clerk will reject the nomination and, as soon as possible, give notice to the person who sought to be nominated and to all other Candidates for that office. The Clerk’s decision to certify or reject a nomination is final. Once the nomination is certified, the Candidate’s name will be placed on the ballot, unless the name is removed by a Court Order.

A list of certified Candidates will be posted on www.bracebridgevotes.ca as soon as possible after certification. Interested individuals should subscribe to the web page to receive updates.

5.6 Withdrawal of Candidate

A Candidate may withdraw their nomination by completing a Withdrawal of Nomination form and filing it in the Clerk’s Office on or before 2:00 p.m. on July 27, 2018. If the withdrawal is completed by an agent, a copy of the Candidate’s photo identification must accompany the written notice. The Clerk will contact the Candidate for confirmation.

If withdrawing, the Candidate is entitled to a refund of the nomination filing fee. The Candidate is still required to submit a financial statement covering the financial transactions made up to the point at which withdrawal is submitted, prior to receiving the refund of the nomination filing fee. In addition, the Candidate will be required to return any election material distributed to the candidate for election purposes.

5.7 Candidate’s Names

The following rules shall apply regarding Candidate’s names: • Only the names of certified Candidates shall appear on the ballot. • The Candidates’ names shall appear in the format of first name then last name (e.g. John Doe), in alphabetical order, based on their surnames and in the case of identical surnames, their forenames. Middle initials shall not be used unless it is deemed necessary by the Clerk. • If the Candidate wishes and the Clerk agrees, another name that the candidate also uses may be used instead of, or in addition to, his or her legal name (e.g. Bill instead of William). • No reference to a Candidate’s occupation, degree, title, honour or decoration shall appear on the ballot. • If the surnames of two or more Candidates for an office are identical, or in the Clerk’s opinion so similar to cause possible confusion, every Candidate’s qualifying address shall appear or heard under his or her name. 5.8 Acclamations

If the number of Candidates for the said office is the same or less than the number to be elected, the Candidates will be declared as acclaimed on July 30, 2018 after 4:00 p.m.

5.9 Death or Ineligibility of a Candidate

If a certified Candidate dies or becomes ineligible before the close of voting:

• Resulting in an acclamation for an office, the election to such office is void and a by-election for the office will be held; or • Resulting in one fewer Candidate but no acclamation, the Candidate’s name will be removed from the ballot if the voting period has not commenced. If the voting period has commenced, the Clerk shall cause notice of the Candidate’s death or ineligibility on www.bracebridgevotes.ca.

5.10 Campaigning

Prohibition of Canvassing/Advertising at Voting Locations (Election Help Centre)

The MEA provides that while an Elector is in a voting location (Election Help Centre), no one shall attempt, directly or indirectly, to influence how the Elector votes. No campaign material, literature or advertising of any nature whatsoever of any Candidate in the Election shall be displayed at, or within an election help centre or municipal facility, including parking lots.

The premises are deemed to include the entire building and the property on which it is located, including the parking lot. Campaign material or literature of any nature found in this location will be removed immediately and disposed of without notice.

Right of Entry for Campaigners

Campaigners shall have access to rented premises, condominiums and co-operative housing units:

“No landlord shall restrict reasonable access to a residential complex by candidates for election to any office at the federal, provincial or municipal level, or their authorized representatives, if they are seeking access for the purpose of canvassing or distributing election material.” Residential Tenancies Act, 2006, Section 28

“No corporation or employee or agent of a corporation shall restrict reasonable access to the property by candidates, or their authorized representatives, for election to the House of Commons, the Legislative Assembly or an office in a municipal government or school board if access is necessary for the purpose of canvassing or distributing election material.” Condominium Act, 1998, Section 118

“No non-profit housing co-operative or servant or agent of such a cooperative shall restrict reasonable access to the housing units of the cooperative by candidates, or their authorized representatives, for election to the House of Commons, the Legislative Assembly, any office in a municipal government or a school board for the purpose of canvassing or distributing election material.” Co- operative Corporations Act, 1990, Section 171.24

If campaigners are experiencing difficulty in gaining access to any of the above premises, they should contact the administrating body of the facilities. The Clerk is not responsible for securing access to any buildings for the purpose of canvassing or distributing election material.

5.12 Use of Corporate Resources for Election Purposes

The use of corporate resources for election campaign purposes is strictly prohibited.

Use of Corporate Resources During an Election Campaign Period Policy No. TOB-EP- 2018-01 provides that:

1. No municipally owned facilities, equipment, supplies, services or other resources of the Town, including Town staff, are used for any election campaign related activities;

2. No Town staff canvass or actively work in support of a candidate, party or question on the ballot during hours in which they receive any compensation from the Town;

3. No election campaign related activities take place on Town owned property.

5.13 National Do Not Call List

The Canadian Radio-television and Telecommunications Commission (CRTC) has established a National Do Not Call List (DNCL). The following is an excerpt of the Telecom Regulatory Policy CRTC 2009-200:

“In addition to the exemption set out in section 3(d), the National DNCL Rules do not apply to telemarketing telecommunication made by or on behalf of a candidate as defined in subsection 2(1) of the Canada Elections Act or a candidate under provincial law for the purposes of a provincial or municipal election, or by or on behalf of the official campaign of such a candidate”.

5.14 Candidates’ Election Campaign Advertisement

All Candidate election campaign advertisements must be in compliance with the MEA at all times. A Candidate must have filed their nomination paper before spending any money, and the amount they may spend on their campaign is regulated.

A Candidate shall not cause an election campaign advertisement to appear unless they provide the following information to the broadcaster or publisher in writing:

• The name of the Candidate; and • The name, business address and telephone number of the individual who deals with the broadcaster or publisher under the direction of the Candidate. 5.15 Rental Housing and Condominium Corporations

Landlords and condominium corporations cannot prohibit their tenants from displaying campaign signs in their own unit. The condominium corporation/landlord will have the right to establish reasonable conditions related to the size or type of sign. Landlords and condominium corporations may prohibit the display of signs in relation to common areas of the building.

5.16 Financial Reporting Requirements

Information regarding election finances such as financial responsibilities of Candidates, campaign contributions/fundraising, campaign expenses and financial reporting is available in the Ministry of Municipal Affairs 2018 Candidates’ Guide for Ontario Municipal and School Board Elections. This and other documentation can be found on the Ministry website at www.mah.gov.on.ca.

5.17 Candidate Access Portal

After September 1, 2018, Candidates will be provided access to the online Candidate Access Portal where Voters’ List information will be available to search, view or download. Access will not be granted until the Candidate’s Declaration for Proper Use of the Voters’ List is executed and filed with the Clerk. The Voters’ List may only be used for election purposes.

The Candidates will be able to see which electors have participated in the election. Candidates will not be able to see how an elector has voted.

No printed or digital copies of the Voters’ List will be provided.

5.18 Scrutineers

Each Candidate may appoint, in writing on the prescribed form, person(s) to act as scrutineers to represent him or her during the election process, including attendance in the Election Help Centre on Voting Day.

The appointment shall be made using the Appointment of Scrutineer by Candidate form as signed by the Candidate. A person appointed as a scrutineer prior to being admitted to observe these election processes shall produce and show their appointment form and valid acceptable identification. The scrutineer will be issued an identification badge, which must be returned to the Clerk before leaving. All scrutineers must take and subscribe to an Oath of Secrecy.

Not more than one Candidate or one scrutineer representing each candidate may be in the Election Help Centre at any time.

Scrutineers and Candidates are prohibited from the following:

• Attempting, directly or indirectly, to interfere with how an elector votes, and prohibited from attempting to campaign or persuade an elector to vote for a particular Candidate, • Displaying a Candidate's election campaign material of any nature whatsoever in the voting place, including the parking lot, • Compromising the secrecy of the voting, • Interfering or attempt to interfere with an elector who is marking a ballot, • Obtaining or attempt to obtain, in an Election Help Centre, any information about how an elector intends to vote or has voted; • Communicating any information obtained at an Election Help Centre about how an elector intends to vote or has voted; PROCEDURES 2018 Municipal Election Page 18 Last Revision Date: April 24, 2018

• Causing a disturbance in the Election Help Centre; and • Using cellular phones or other mobile devices in the Election Help Centre.

The Clerk is responsible for the conduct of the Election and no Candidate or scrutineer has the right to interfere with an Election Official in the discharge of their duties.

Any Candidate, scrutineer, Third Party Advertiser, agent or voter who by their actions creates a disturbance or interferes in any way with the proper conduct at the Election Help Centre or Vote Counting Location, may be expelled from the location for such actions. An agent, candidate or scrutineer who is dissatisfied with the actions of election personnel is invited to contact the Clerk to discuss the matter.

Candidates and/or scrutineers wishing to observe the final count must be at the Municipal Office prior to 8:00 p.m. on election night. No one will be admitted into the centre after 8:00 p.m.

As the role of scrutineers is different using Internet/Telephone Voting, staff will provide Candidates or their scrutineers the opportunity to participate during the logic and accuracy testing phases and a mock election. This process is intended to help electors and those involved in the election process to gain confidence in the alternative voting method.

6. THIRD PARTY ADVERTISERS Individuals, corporations and unions can register as Third Party Advertisers and can also make contributions to Third Party Advertisers. Third Party Advertisers are required to register with every municipality in which they wish to advertise. If a Third Party Advertiser is advertising related to a District Chair candidate, they are required to register within the lower-tier municipality.

Third Party Advertisers may register with the municipality from Tuesday, May 1, 2018 until Friday, October 19, 2018 at 4:30 p.m. Third party registrations will not be accepted after the deadline. Registration allows a Third Party Advertiser to promote or oppose any candidate that the electors in the municipality can vote for (Local Council, District Council, District Chair and School Board Trustee positions).

No individual, corporation or trade union shall incur expenses for a third party advertisement unless the individual, corporation or trade union is certified as a registered Third Party Advertiser with the Clerk of the municipality, when the expenses are incurred and the advertisement appears.

Third party advertising must be done independently of candidates. Candidates are not permitted to register as, or direct, a Third Party Advertiser.

6.1 Third Party Registrations (Certified)

A list of certified Third Party Registrations will be posted on www.bracebridgevotes.ca as soon as possible after filing. The list will be updated as new registrations are received.

6.2 Restricted Period

The restricted period for third party advertisements in relation to an election in a municipality begins on the earliest day that an individual, corporation or trade union is permitted to register (May 1, 2018) as a Third Party Advertiser in relation to the election, and ends at the close of voting on voting day.

6.3 Mandatory Information in Third Party Advertisements

No registered Third Party Advertiser shall cause a third party advertisement to appear during the restricted period unless the advertisement contains the following information:

• The name of the registered Third Party Advertiser; and • The municipality where the Third Party Advertiser is registered; and • A telephone number, mailing address or email address at which the registered Third Party Advertiser may be contacted regarding the advertisement.

6.4 Mandatory Information for Broadcaster

A registered Third Party Advertiser shall not cause a third party advertisement to appear during the restricted period unless they provide the following information to the broadcaster or publisher in writing: • The name of the registered Third Party Advertiser; and • The municipality where the Third Party Advertiser is registered; and • A telephone number, mailing address or email address at which the registered Third Party Advertiser may be contacted regarding the advertisement.

6.5 Prohibition, Broadcaster or Publisher

No broadcaster or publisher shall cause a third party advertisement to appear during the restricted period if the information set out in the paragraphs above have not been provided.

7. CAMPAIGN EXPENSES AND CONTRIBUTIONS 7.1 Duties of Candidates and Third Party Advertisers

Candidates and Third Party Advertisers should pay careful attention to campaign finance rules and may wish to seek professional advice.

The MEA assigns several duties to Candidates and registered Third Party Advertisers respecting contributions, receipts, records, financial filings, return of contributions, anonymous donations and other matters. Candidates and Third Party Advertisers should familiarize themselves with their duties and obtain professional assistance if required.

7.2 Campaign Period

Contributions cannot be accepted outside the campaign period (beginning upon nomination or registration and ending December 31, 2018). A campaign period may be extended as set out in subsection 88.24(4) of the MEA.

7.3 Maximum Campaign Expenses

Upon filing of Nomination papers or Registration, Candidates and Third Party Advertisers will receive an estimate of campaign spending limits using the number of electors for each respective office as it existed on nomination day of the previous election (September 12, 2014).

No later than September 25, 2018, the Clerk shall provide each Candidate and Third Party Advertiser, via email, with a Certificate of Maximum Campaign Spending Limits that can be incurred using the number of electors for each respective office as it exists on September 15, 2018.

7.4 Contributions

Contributions include money and the fair market value of goods and services accepted for an election campaign, but do not include:

• voluntary labour, • labour provided voluntarily from an employee acting under the direction of a Candidate or Third Party Advertiser without added compensation; • $25 or less donated or paid for goods or services at a fund-raiser; • a loan from a bank or recognized lending institution; and • no charge political advertising provided equally to all candidates for an office in accordance with the Broadcasting Act (Canada).

Contributions up to $25 may be made in cash. Contributions more than $25 must be contributed by the contributor or in a way that associates the contributor’s name and account with the payment. No one may contribute more than:

• $1,200 to one Candidate or Third Party Advertiser, other than the Candidate, the Third Party Advertiser or their spouse, or • a total of $5,000 to two or more Candidates or Third Party Advertisers nominated or registered in the Town. Candidates and Third Party Advertisers shall not take contributions more than the amount set out in the Certificate of Maximum Campaign Amount.

The Town of Bracebridge does not issue contribution rebates.

7.5 Filing Requirements and Notice

The Clerk shall provide notice of all of the filing requirements at least 30 days before the filing date.

All Candidates and Third Party Advertisers are required to file a financial statement using the prescribed form. Electronic submissions will not be accepted. A Notice of Default will be given to any Candidate or Third Party Advertiser if the Financial Statement is not submitted by the deadline.

7.6 Financial Statements

By March 29, 2019, all Candidates and Third Party Advertisers are required to file a financial statement with the Clerk using the prescribed form. Electronic submissions will not be accepted.

There are penalty provisions in the MEA that are applicable to Candidates who fail to meet the disclosure and reporting requirements.

If a Candidate fails to pay over a surplus to the Clerk or exceeds their election spending limit, they forfeit any office they have been elected to and are ineligible to run for, or to be appointed to any office in Ontario until the next regular election. A Candidate will be permitted to resubmit a financial statement to correct an error, until the filing deadline. The nomination filing fee will only be refunded if a financial statement is filed on time. If a Candidate doesn’t file their financial statement on time and is willing to pay a $500 late filing fee, the Candidate will be provided an additional 30 day grace period to file the financial statement. A Candidate exercising this option will not be refunded their nomination filing fee.

In accordance with the MEA, the Clerk shall, before Voting Day, notify all candidates of the penalties under subsection 88.23 (2) and 92(1) related to election campaign finances.

8. ELECTION SIGNS AND OTHER ADVERTISEMENTS 8.1. Town of Bracebridge

By-law No. 2018-001 provides for the regulation of election signs in municipal, provincial and federal elections. Candidates, Third Party Advertisers and Electors should review the By-law to ensure compliance.

In accordance with the By-law, no election signs may be installed on private property prior to the close of nominations (2:00 p.m. on Friday July 27, 2018). No election signs may be installed on road allowances prior to Saturday September 22, 2018.

Any sign, or part thereof, that has been installed, affixed or otherwise displayed in contravention of any provision of the Election Signs By-law may be removed immediately without notice by an Officer or any other individual designated by the Clerk.

8.2. District Municipality of Muskoka (By-law #89-112)

Political campaign signs may be permitted within the limits of a District road allowance provided that the sign does not exceed 1 m2 (10 square feet). They may be erected without a permit provided that the person or organization erecting the sign shall remove it at his/her expense within two (2) weeks of the date of the election or conclusion of the campaign, whichever is sooner.

No person shall locate a sign in such a manner as to obstruct, impair or impede the view of any lane, street, highway intersection, regulatory sign, traffic signal or railway crossing. No person shall attach or paint a sign on a fence, post, rock, tree, utility pole, bridge or any structure visible from the District road.

Notwithstanding the foregoing, where an Area Municipality has enacted and enforces its own sign by-law which is more restrictive than the District sign by-law, the by-law of the Area Municipality shall govern (in the urban area only).

If in contravention with any of the above, the sign will be removed to a District facility where it can be retrieved by the owner or organization.

8.3. Ministry of Transportation

For convenience, below is information regarding placing election campaign signs on Provincial properties, including laneways. The responsibility for authorized placement of signs rests with the candidate. Please reference the Ministry of Transportation General Guidelines for Election Signs for more detailed information.

• An election sign must not be placed upon or adjacent to the right-of-way of a Class 1A Freeway, Class 1B Staged Freeway and Class 2A Principal Arterial Highway (i.e. Highway 400, Highway 11 and Highway 69). • Election signs may be erected on the right-of-way or adjacent to Class 2B Undivided Arterial Highway, a Class 3 Collector Highway or Class 4 Local Highway after an official election has been called (e.g. Highway 118). • Election signs up to 0.7 m2 in size must be placed at least 4m from edge of pavement. Signs over 0.7 m2 and up to 3.7 m2 must be placed at the outer limit of the right-of-way.

• Election signs must not be affixed to any permanent or official highway sign, a guide rail or other highway structure or facility. They must not be placed where they may interfere with visibility, official signs, traffic signals, or other safety devices. They must not be placed on a safety island at intersections. • Permits or Letters of Approval are not required for any election signs erected under the Ministry of Transportation’s Corridor Signing Policy. A Sign Permit will be required for any signs in excess of 3.7 m2 (40 sq. ft.) in size and they must be placed on private property. • Election signs must be removed from the Ministry right-of-way and adjacent properties within three (3) working days following Election Day. • Any signs contravening the Ministry Policy will be removed by the Ministry of Transportation.

8.4. Municipal Authority to Remove Advertisements

Where there has been a contravention of the third party advertising requirements in this section the Clerk may direct and require a person who is reasonably believed to cause or permit the contravention, or the owner or occupier of the land on which the contravention occurred, to remove the advertisement or discontinue the advertisement.

9. VOTERS’ LIST Prior to September 1, 2018, the Municipal Property Assessment Corporation (MPAC) will provide the Town of Bracebridge with the Preliminary List of Electors (PLE). The Clerk then corrects and amends the PLE using information held by the municipality and produces the Voters’ List by September 1, 2018.

Electors can check to see if they are on the Voters’ List by using the Online Voter Services (OVS) available at www.bracebridgevotes.ca. Electors are prompted to enter their name, property address, and optionally, their birthdate.

Using the information provided, a real-time lookup is performed against the list of eligible electors, and a single positive or negative response is returned. For negative responses, the elector will receive instructions on how to be added to the list and will be directed to an online, self-serve option.

9.1. Revisions to the Voters’ List

During the Revision Period, electors may make application to be added to, or amend, their information on the Voters’ List up to, and including, Voting Day.

Electors can complete and print an online Application to Amend the Voters’ List (Form EL-15) which will be electronically submitted to the Clerk. The elector will then be required to attend the office with the necessary identification to sign the application.

Electors may also make application to amend the Voters’ List by attending the Municipal Office during regular business hours (Monday to Friday from 8:30 a.m. to 4:30 p.m.) On Voting Day (October 22, 2018) electors may make application to amend the Voters’ List up to 8:00 p.m. The Clerk will require proof of identification. For individuals who cannot provide the required identification, a Declaration of Identity (Form 9) may be completed.

10. VOTING 10.1. Number of Votes

A voter is only entitled to vote once in a municipality and once in a school board, even if the voter has more than one qualifying property address within the municipality or school board. The place where they vote is where they reside. In a municipality with wards, if a voter resides in one ward but has other properties in different wards in the same municipality, he or she may only vote in the ward where he or she resides. A voter may only have one permanent residence.

10.2. Internet/Telephone Voting Method

Only Internet/Telephone Voting shall be used for the 2018 Municipal Election. Internet voting allows an elector to cast an electronic ballot from their personal computer, tablet or smartphone from anywhere there is an internet connection (cable, Wi-Fi or cellular). Alternatively, votes can also be cast by telephone within North America.

10.3. Internet/Telephone Voting Process

The voting period shall commence on Friday, October 12, 2018 at 10:00 a.m. through until 8:00 p.m. on Monday, October 22, 2018.

During the voting period, the Municipal Office will be designated as the Election Help Centre and will host access to the internet through voting kiosk stations with applicable voting equipment.

• Eligible electors, as identified on the Voters’ List, will receive through the mail, a sealed and personalized Voters Information Letter (VIL). This letter will direct electors to a designated website or telephone number, based on the selected method of voting. • At the designated website or through the identified telephone number, electors will enter their PIN as well other required validation criterion. Electors will then be entered into the voting system. • Based on the eligible options for the elector (ward, school board) the voting system will offer the options for the various election races for the elector to cast their vote(s). The voting system will permit the elector to abstain/skip from voting for an office(s) if desired. • Following the elector’s selection, the voting system response shall identify the voter’s choice and provide the voter with the option of changing or confirming their vote. • Once all races are confirmed by the elector, the elector submits (casts) their vote and the voting process is complete. The elector will be struck off the Voters’ List and identified as having participated in the election process. Once the voter PIN has been used to complete “all” races associated with the election, it cannot be used again and further access shall not be granted to the internet/telephone voting service. 10.4. System Integrity

The integrity of the voting process shall be the responsibility of the Clerk and shall be preserved by:

• Ensuring that every eligible elector on the Voters’ List, as amended, receives a sealed Voter Information Letter (VIL) containing the voter’s unique PIN; • Ensuring that no one except the Clerk, or designate, can access PINS that match each voter’s name and address; and • Providing an opportunity for eligible electors to be added to the Voters’ List or to make amendments to the list, up to and including Election Day (October 22, 2018 at 8:00 p.m.) • Engaging an independent third party to conduct a Web Application Penetration Test. 10.5. Voter Information Letter (VIL)

Voter information Letters (VILs) will be printed through the municipality’s contract with DataFix using the Voters’ List, as amended and delivered through Canada Post to the mailing address of all eligible voters in advance of the voting period. In the case of an emergency, or at the discretion of the Clerk, alternative delivery methods may be utilized.

The VIL may include, but is not limited to, the following information:

• The elector’s PIN and the telephone number to call and the designated internet address (URL) to access to cast his or her vote; • Instructions on how to vote; • Dates and hours of voting; • The location and telephone number of the Election Help Centre(s); • Voter eligibility criteria; and • Information on illegal and corrupt practices under the MEA.

A person cannot give their VIL to another eligible elector for the purpose of voting. Acceptance of another person’s VIL, including the actual voting thereof, will be considered an illegal and corrupt practice, and therefore, subject to the penalty provision under the MEA, specifically s.89 and 90.

Should an eligible voter receive more than one VIL, the eligible voter may only vote once and must return the other VIL to the Municipal Office. Electors who knowingly vote twice are committing an offence under the MEA and subject to an investigation and prosecution by the police and legal system. VILs returned to the Municipal Office shall have the PIN disabled. The VIL will be maintained in a secure fashion and destroyed in the same manner as all other municipal election material.

10.6. Replacement PINS

If an elector requires a new PIN, they can attend or contact the Election Help Centre to review options with an election official. New PINs shall not be provided through alternative methods without the approval of the Clerk.

Eligible electors are able to request a new or replacement VIL and PIN under certain circumstances:

• If an elector on the Voters’ List has lost/not received their VIL and the PIN has not been used, an authorized Election Official can provide a new VIL and PIN provided that satisfactory information has been provided and the elector completes the necessary forms. The authorized Election Official will proceed to disable the elector’s first assigned PIN and issue a new VIL and PIN. • Where a person on the Voters’ List has attempted to vote and their PIN has already been used, they can attend the Municipal Office and prove to the satisfaction of the Municipal Clerk that they did not vote the PIN and require a new PIN. Upon providing proof of identity and residence a new Voter Information Letter containing a new PIN may be issued provided the required statutory declaration has been executed. This process may require engagement of law enforcement. • Where an eligible voter has received an incorrect PIN in terms of ward and/or school support and has not voted, they can contact the Election Help Centre and may have the proper category applied to the existing PIN. The elector will be required to provide appropriate confirmation of eligibility.

10.7. Assistance for Electors

If an elector requires assistance to vote, an Election Official may assist as requested, provided the elector takes the Oral Oath to vote with assistance.

In lieu of an Election Official providing assistance, the elector may request that a friend assist the elector at the Election Help Centre. The friend assisting the elector shall be required to take the Oral Oath to vote with assistance. No person shall be allowed to act as a friend of more than one voter at the Election Help Centre.

Where an elector requires an interpreter (provided by the elector), the interpreter shall take the Oral Oath to vote with assistance and shall translate the oaths as well as any lawful questions put to the voter.

Candidates or their scrutineers are not permitted to interpret for or assist any electors in the voting process.

10.8. Election Process Public Information Sessions

The municipality will be hosting a public information session in the summer of 2018 to assist with questions related to the election and will be conducting a “mock election” to better familiarize the electors, candidates and scrutineers with the internet/telephone voting process.

A logic and accuracy testing session will also be held in the fall of 2018.

Confirmed dates for the above events will be communicated in advance of the sessions on www.bracebridgevotes.ca.

11. ELECTION ADMINISTRATION 11.1. Clerk’s Authority

The Clerk is responsible for facilitating the 2018 Municipal Election through the establishment of rules and procedures. The Clerk may appoint, in writing, Election Officials to assist in the administration of the election process with duties including but not limited to:

• Receive Nomination Papers; • Administer Oaths; • Issue a Replacement Voter Information Letter (VIL); • Authority to approve or deny applications for revision to the Voters’ List; • Assist in the revision of the Voters’ List to add an Elector, remove an Elector’s own name and/or correct erroneous information; • Authority to require a person to furnish proof of identity, qualifications or any other matter; • Assist in the conduct, supervision and management of the Internet and Telephone Voting Procedures; • Maintain peace and order at the Election Help Centre by removing anyone who is causing a disturbance; and • Assist the Clerk and other Election Officials as required.

The Clerk may provide for any matter or procedure that is not otherwise provided for in an Act or regulation and, in the Clerk’s opinion, is necessary or desirable for conducting the election.

The Clerk at any time has the right to amend this document to facilitate the voting process and security. The Clerk’s ruling on any interpretation of this document is final.

11.2. Public Notices

The official election website www.bracebridgevotes.ca will be the main place for election information and updates for the media, candidates, third party advertisers, voters and the public.

Notice of Nominations will be provided prior to Nomination Day. The Notice of Nomination for Office for School Board Trustees shall also be available in French. In the event of the need for an additional notice after the close of nominations, this public notice will be published electronically only.

The Clerk shall give notice of the election (if one is required) as soon after Nomination Day as possible which will include a list those candidates with certified nominations for each office.

The Clerk shall also provide notice that describes the method and timelines for the internet and telephone voting process.

11.3. Secrecy

All Election Officials shall take an oath of secrecy and be appointed by the Clerk as per the Appointment and Oath of Election Official. Complaints regarding any and/or all breaches of secrecy shall be documented by the Election Official as well as questions and answers of the complainant and, if deemed appropriate, the Clerk shall submit same to the Police for further investigation and prosecution.

11.4. Language

Procedures and forms will be provided in English only.

11.5. Clerk’s Responsibility to Review Financial Statements Post Election

The Clerk will be required to review all of the financial statements received and identify whether any contributor appears to have exceeded any of the contribution limits. The Clerk will be required to report to the Compliance Audit Committee as soon as possible after the filing deadline regarding contributions made to candidates and third party advertisers in excess of the established limits. Within 30 days of receiving the report, the Compliance Audit Committee must consider the report and decide whether to commence a legal proceeding against a contributor for an apparent contravention.

11.6. Clerk’s Report on Financial Statements Post Election

As soon as possible after April 30, 2019, the Clerk is required to provide a report and make it available on the Town website setting out all candidates in an election and indicate whether each candidate complied with the financial reporting requirements.

11.7. Disposition of Records Post Election

After one-hundred and twenty (120) days from declaring the results of the election (subject to a Judge’s order or recount proceedings), the Clerk shall authorize the destruction of the applicable election records and be provided with written confirmation. The Clerk may also destroy all other documents and materials related to the election, except those specified under the Act (e.g. financial statements filed by candidates).

All materials destroyed will be listed, and a declaration stating their destruction will be taken and retained on file.

12. ACCESSIBILITY The Town of Bracebridge is committed to ensuring that all qualified electors have the opportunity to vote. The use of Internet and Telephone Voting provides the most accessible access to the electoral process, as it eliminates the need for electors to attend a polling station and provides for an extended period of time to participate in the election process. Any questions or comments regarding accessibility should be directed to the Clerk.

The Clerk shall ensure that the Election Help Centre is accessible to electors with disabilities. At the discretion of the Clerk (during regular business hours up to and including October 18, 2018), special requests will be considered for an Election Official to travel to a location with a mobile voting kiosk (i.e. laptop, tablet) to assist electors who require accommodations.

The Clerk is required to prepare a plan regarding the identification, removal and prevention of barriers that affect electors and candidates with disabilities, and make the plan available to the public in advance of the voting period. The Clerk is also required to provide a follow-up report to the public within 90 days after the election.

13. VOTING DAY Prior to the activation of the system on Friday, October 12, 2018 at 10:00 a.m., the Clerk and those candidates/scrutineers in attendance shall confirm that all Candidates’ names are listed and that no votes have been cast.

13.1. Results of Election

The Clerk, at 8:00 p.m. on October 22, 2018 shall arrange for the close and deactivation of the voting system. The Clerk shall then produce the results report. The Clerk and another Election Official shall sign the report, indicating the unofficial results and votes cast.

As soon as possible after Voting Day, the Clerk shall declare the Candidates elected as a result of the election, and certify the results of the election. The official results will be posted on www.bracebridgevotes.ca as soon as possible after October 22, 2018.

13.2. Recount

The MEA requires a recount to be conducted within 15 days:

• Where the counting of ballots resulted in a tie vote and one Candidate will not be elected; • Where a municipality, local board or Minister of Municipal Affairs has passed a resolution to order a recount; or • Where an electors’ request have been granted by the Superior Court of Justice.

In accordance with the MEA, a recount shall be conducted in the same manner as the original count. Only a judge may provide that a recount be held in a different manner than the original count.

13.3. Emergencies

In the event of any condition of an emergency or any circumstance that will undermine the integrity of the election, the Clerk has the discretion to declare an emergency and make any arrangements deemed necessary for the conduct of the election.

In the event of a postal strike, the Clerk shall determine how VILs will be distributed.

When declaring an emergency, the Clerk shall make such arrangements the Clerk considers advisable for the conduct of the election. If the arrangements are consistent with the principles of the Act, they prevail over anything in the Act and the Regulations made under it. The emergency continues until the Clerk declares that it has ended.

TAKE NOTICE EVERY CANDIDATE SHALL FILE by March 29, 2019, with the Clerk with whom their nomination was filed a financial statement and auditor's report in accordance with s.88.25 of the Municipal Elections Act, 1996.

Candidates’ financial statements, etc. 88.25 (1) On or before 2 p.m. on the filing date, a candidate shall file with the clerk with whom the nomination was filed a financial statement and auditor’s report, each in the prescribed form, reflecting the candidate’s election campaign finances, (a) in the case of a regular election, as of December 31 in the year of the election; and (b) in the case of a by-election, as of the 45th day after voting day. 2016, c. 15, s. 60. 88.23(2) Subject to subsection (7), in the case of a default described in subsection (1),

(a) the candidate forfeits any office to which he or she was elected and the office is deemed to be vacant, and

(b) until the next regular election has taken place, the candidate is ineligible to be elected or appointed to any office to which this Act applies.

92(1) A candidate is guilty of an offence and, on conviction, in addition to any other penalty that may be imposed under this Act, is subject to the penalties described in subsection 88.23(2),

(a) if the candidate incurs expenses that exceed the amount determined for the office under section 88.20; or

(b) if the candidate files a document under section 88.25 or 88.32 that is incorrect or otherwise does not comply with that section.

NOTICE TO REGISTERED THIRD PARTY OF FILING REQUIREMENTS

Same, before supplementary filing date (8) At least 30 days before the supplementary filing date, the clerk shall give notice of the filing requirements of this section and the penalties set out in subsections 88.27 (1) and 92 (4) to every registered third party that gave notice to the clerk under paragraph 4 of section 88.28. Electronic filing (9) The clerk may provide for electronic filing under this section and may establish conditions and limits with respect to electronic filing. 88.27(1) Subject to subsection (6) and in addition to any other penalty that may be imposed under this Act, an individual, corporation or trade union that is registered as a registered third party in relation to an election in a municipality is not entitled to register in relation to a subsequent election in the municipality until after the next regular election has taken place,

(a) if the registered third party fails to file a document as required under section 88.29 or 88.32 by the relevant date;

(b) if a document filed under section 88.29 shows on its face a surplus, as described in section 88.31, and the registered third party fails to pay the amount required by subsection 88.31(4) to the clerk by the relevant date;

(c) if a document filed under section 88.29 shows on its face that the registered third party has incurred expenses exceeding what is permitted under section 88.21; or

(d) if a document filed under section 88.32 shows on its face a surplus and the registered third party fails to pay the amount required by that section by the relevant date.

92(4) A registered third party is guilty of an offence and, on conviction, in addition to any other penalty that may be imposed under this Act, is subject to the penalty described in subsection 88.27(1),

Notice of Penalties

Sections 91, 92 and 94 of the Municipal Elections Act, 1996 set out penalties with respect to violations under the Act as follows:

Corrupt practice and ineligibility for office 91.(1) If a person is convicted of a corrupt practice under this Act, or of an offence under the Criminal Code (Canada) in connection with an act or omission that relates to an election to which this Act applies, then, in addition to any other penalty provided for in this Act, (a) any office to which the person was elected is forfeited and becomes vacant, and (b) the person is ineligible to be nominated for, or elected or appointed to, any office until the next two regular elections have taken place after the election to which the offence relates.

Exception 91.(2) However, if the presiding judge finds that the person committed the corrupt practice or offence under the Criminal Code (Canada) without any intent of causing or contributing to a false outcome of the election, clause (1)(b) does not apply.

Offences by candidate 92.(1) A candidate is guilty of an offence and, on conviction, in additional to any other penalty that may be imposed under this Act, is subject to the penalties described in subsection 88.23(2), (a) if the candidate incurs expenses that exceed the amount determined for the office under section 88.20; or (b) if the candidate files a document under section 88.25 or 88.32 that is incorrect or otherwise does not comply with that section.

Exception 92.(2) However, if the presiding judge finds that the candidate, acting in good faith, committed the offence inadvertently or because of an error in judgement, the penalties described in subsection 88.23(2) do not apply.

Additional Penalty, Candidates 92.(3) if the expenses incurred by or under the direction of a candidate exceed the amount determined for the office under section 88.20, the candidate is liable to a fine equal to the excess, in addition to any other penalty provided for in the Act.

Additional Penalty, Registered Third Party 92.(3) if the expenses incurred by or under the direction of a registered third party exceed the amount determined for the office under section 88.21, the registered third party is liable to a fine equal to the excess, in addition to any other penalty provided for in the Act.

Pursuant to Section 33.1 of the Municipal Elections Act, S.O. 1996, the clerk shall, before voting day, give to each person nominated for an office notice of the penalties under subsections 88.23(2) and 92(1) related to election campaign finances and the requirements under which the nomination filing fee will be refunded (all of sections 88 and 92 have been included to provide the necessary context): Effect of default by candidate 88.23 (1) A candidate is subject to the penalties listed in subsection (2), in addition to any other penalty that may be imposed under this Act, (a) if the candidate fails to file a document as required under section 88.25 or 88.32 by the relevant date; (b) if a document filed under section 88.25 shows on its face a surplus, as described in section 88.31, and the candidate fails to pay the amount required by subsection 88.31 (4) to the clerk by the relevant date; (c) if a document filed under section 88.25 shows on its face that the candidate has incurred expenses exceeding what is permitted under section 88.20; or (d) if a document filed under section 88.32 shows on its face a surplus and the candidate fails to pay the amount required by that section by the relevant date. 2016, c. 15, s. 60. Penalties (2) Subject to subsection (7), in the case of a default described in subsection (1), (a) the candidate forfeits any office to which he or she was elected and the office is deemed to be vacant; and (b) until the next regular election has taken place, the candidate is ineligible to be elected or appointed to any office to which this Act applies. 2016, c. 15, s. 60. Notice of default (3) In the case of a default described in subsection (1), the clerk shall, (a) notify the candidate in writing that the default has occurred; (b) if the candidate was elected, notify the council or board to which he or she was elected in writing that the default has occurred; and (c) make available to the public the name of the candidate and a description of the nature of the default. 2016, c. 15, s. 60. Clerk’s report re filing requirements (4) The clerk shall make available to the public a report setting out all candidates in an election and indicating whether each candidate complied with section 88.25. 2016, c. 15, s. 60. Same (5) The report mentioned in subsection (4) shall be made available on a website or in another electronic format as soon as possible after, (a) April 30 in the year following a regular election; and (b) 90 days after voting day in a by-election. 2016, c. 15, s. 60. Application to court (6) The candidate may, before the last day for filing a document under section 88.25 or 88.32, apply to the Superior Court of Justice to extend the time for filing the document under that section and, if the court is satisfied there are mitigating circumstances justifying a later date for filing the document, the court may grant an extension for the minimum period of time necessary to enable the candidate to file the document but the court shall not grant an extension of more than 90 days. 2016, c. 15, s. 60. Notice to clerk (7) If a candidate makes an application under subsection (6), the candidate shall notify the clerk in writing before 2 p.m. on the last day for filing a document under section 88.25 or 88.32 that the application has been made. 2016, c. 15, s. 60. This guide provides information to those wishing to register as third party advertisers for the 2018 municipal council and school board elections. The information also applies to any by-elections that may be held during the 2018-2022 council and school board term.

Prior to 2018, third party advertising was not regulated for municipal council and school board elections. Those who wanted to advertise or distribute materials supporting or opposing a candidate did not have to identify themselves, were able to spend unlimited amounts of money, and did not have to report their advertising or financial activities to anyone.

Recent changes to the Municipal Elections Act, 1996 created a framework of rules for third party advertising. This guide provides information about who can register to be a third party advertiser, what registration allows them to do, and the rules that third party advertisers must follow.

The municipal clerk

Every municipality has a municipal clerk who is in charge of running the election.

The municipal clerk is the main contact for registered third party advertisers and those who are interested in becoming registered.

The clerk’s office is where forms such as the registration form and campaign financial statements must be filed. The clerk is also responsible for providing information about spending limits and filing deadlines to third party advertisers.

If your municipality does not have a website, you could visit or contact the town hall for more information.

A municipality may have specific rules regarding issues such as where and when election signs may be displayed and whether third party advertising activities may occur on municipal property.

What is third party advertising?

Third party advertising refers to advertisements or other materials that support, promote or oppose a candidate, or support, promote or oppose a “yes” or “no” answer to a question on the ballot. Third party in this context is a person or entity who is not a candidate.

Third party advertising is separate from any candidate’s campaign, and must be done independently from a candidate. Any advertisements or materials that are made and distributed by a candidate, or under a candidate’s direction, are part of the candidate’s campaign.

2018 Guide for third party advertisers – Ontario municipal council and school board elections 2 Third party advertising is a way for those outside of the candidate’s campaign to express support of or opposition to candidates (or a “yes” or “no” answer to a question on the ballot) and to try to persuade voters to vote a certain way.

A third party advertisement is an advertisement in any broadcast, print, electronic or other medium that promotes, supports or opposes a candidate, or a “yes” or “no” answer to a question on the ballot. Advertisement includes traditional ads as well as materials such as brochures or signs. What is not a third party advertisement?

Activities that do not involve spending money, such as discussions or expressing an opinion about a candidate (or an answer to a question on the ballot) are not considered to be third party advertising. Examples include: . speaking to friends and neighbours . posting on social media, such as Twitter, Facebook or Instagram . sending an email to a group or mailing list.

Internal communications from an employer to their employees, a corporation to its shareholders, directors, members or employees or by a trade union to its members or employees are not considered to be third party advertising.

Advertising about an issue, rather than a candidate or a “yes” or “no” answer to a question on the ballot is not considered third party advertising. For example, signs saying “Support local businesses” or “Keep the waterfront green” would not be third party advertising, even if a candidate has made those issues part of their campaign. When do the rules apply?

The Municipal Elections Act,1996 sets out a restricted period for third party advertising. This restricted period runs from May 1 in the year of the election to the close of voting on voting day. For the 2018 election, the restricted period is May 1, 2018 to the close of voting on October 22, 2018.

Candidates can begin filing their nominations on May 1. If any individual or group wanted to spend money before May 1 on signs or advertisements supporting someone who intended to become a candidate, or someone who they hoped would become a candidate, the third party advertising rules would not apply. However, once the restricted period begins on May 1, any signs or other advertisements would have to be taken down or discontinued.

Who can be a third party advertiser

Only those who have registered can spend money on third party advertising. The following are eligible to register as a third party advertiser: . any person who is a resident in Ontario

2018 Guide for third party advertisers – Ontario municipal council and school board elections 3 . a corporation carrying on business in Ontario . a trade union that holds bargaining rights for employees in Ontario.

If two or more corporations are owned or controlled by the same person or people, or if one corporation controls another, they are considered to be a single corporation. If the same person or people own or control multiple corporations, only one of those corporations may register to be a third party in a municipality.

There is no restriction against family members or campaign staff of candidates registering to be third party advertisers. However, third party advertising must be done independently of the candidate. If a person with close ties to a candidate wishes to register they should consider how these activities may look to the public and how they would be able to demonstrate that they were not working in co-ordination with the candidate. Who cannot be a third party advertiser

A candidate running for any municipal council or school board office cannot register to be a third party advertiser in any municipality.

Groups, associations or businesses that are not corporations are not eligible to register and may not spend money on third party advertising in municipal elections. For example, neighbourhood associations, clubs or professional associations cannot register and cannot make contributions to third party advertisers. Members may register as individual third party advertisers and may contribute individually.

Candidates in the provincial election cannot register. They may register after the provincial election, when they are no longer candidates.

Federal and provincial political parties cannot register to be third party advertisers. Political parties are not permitted to be financially involved in municipal elections. Registration

An individual, corporation or trade union must register with the municipal clerk to be a third party advertiser in a municipality. Third parties can register in any lower-tier or single-tier municipality (city, town, township, etc.). Third parties cannot register in an upper-tier municipality (a region or county).

Being registered in a municipality allows the third party to advertise to the voters in that municipality. A third party advertiser can support or oppose any candidate or candidates who will be voted on by the people in that municipality. This includes candidates running for local council, school trustee and candidates running for offices on an upper tier council.

2018 Guide for third party advertisers – Ontario municipal council and school board elections 4 Third party advertisers do not need to decide before they register which candidate or candidates they want to support or oppose, and they do not have to tell the clerk what their intentions are.

A third party can only advertise to voters in the municipality where they are registered. There is no limit on the number of municipalities where a third party can register. If a third party wants to advertise to voters in more than one municipality they must register in each municipality where they wish to advertise.

For example, if a third party wanted to advertise for or against a candidate running for an office that is voted on by people in more than one municipality, such as a school trustee or regional chair, they would need to register in each municipality.

Deadline to register

An individual, corporation or trade union can register to be a third party advertiser beginning on May 1, 2018, and can file a registration until the close of business on Friday, October 19, 2018.

Where to register

An individual or a representative of a corporation or trade union must file a Notice of Registration (Form 7) with the municipal clerk in person or by an agent. It must have an original signature – the form may not be a copy, and may not be scanned and submitted electronically. There is no registration fee.

The municipal clerk must be satisfied that that the individual, corporation or trade union is eligible in order to certify the registration, and may require that identification or additional documents be provided.

A person who is filing as the representative of a corporation or a trade union should make sure that they can provide proof that they are authorized to act on the corporation or trade union’s behalf.

Registering in more than one municipality

If a third party advertiser registers in more than one municipality, each of those registrations is considered to be a separate advertising campaign. Once they register, they must keep each advertising campaign separate, and ensure that they follow the rules in each municipality where they are registered:

. The identification required on signs, advertisements and other materials must indicate that the third party is registered in that municipality. . There must be a separate bank account for each campaign . Contributions may not be shared between the advertising campaigns – if a contributor has given money to the advertising campaign in municipality A, that money cannot be used to fund expenses in municipality B.

If the third party wants to use the same signs or the same advertisement in more than one municipality, the separate advertising campaigns can produce a “joint” advertisement. The advertisement would indicate that the third party is registered in both municipality A and municipality B, and each advertising campaign would pay for its share of the expense for the advertisement. . The third party must file a separate financial statement in each municipality where they were registered. The financial statement must reflect the financial activities relating to advertising in that municipality.

Responsibilities of registered third parties

Third party advertisers are required to follow many of the same financial and reporting rules as candidates.

Unlike candidates, third party advertisers cannot appoint scrutineers to observe the voting, or to be present when votes are counted.

Identification on advertising

A third party advertiser must provide the following information on all of its advertisements, signs and other materials:

. the legal name of the registered third party (if the third party is a corporation or trade union, the name of the corporation or trade union must appear, not the name of the representative who filed the registration) . the municipality where the third party is registered . a telephone number, mailing address or email address where the third party can be contacted.

A registered individual cannot act on behalf of a group or organization that is not eligible to register as a third party advertiser. For example, if Chris Smith is the president of a business improvement association (BIA), the signs and materials must identify Chris Smith as the person responsible for the advertising, not the BIA.

If ads are going to be broadcast or published (e.g. on a radio station or in a newspaper), the ad must contain the information required above, and the third party advertiser must also provide the broadcaster or publisher with the following:

. the name of the registered third party . the name, business address and telephone number of the individual who deals with the broadcaster or publisher under the direction of the registered third party . the municipality where the third party is registered.

Any additional content of signs is not regulated under the act.

A municipality may have rules in place about when signs can be put up, and how signs may be displayed on public property.

The third party is responsible for removing their signs after voting day. The municipality may require a sign deposit or have penalties for failing to remove signs. Contact the municipal clerk for more information.

Advertising on voting day

The Municipal Elections Act, 1996 does not prohibit campaigning or advertising on voting day. While there are restrictions on advertising for federal and provincial elections on voting day, these “blackouts” do not exist for municipal council and school board elections.

The act prohibits campaign material in a voting place. The voting place could include the entire property of a building that has a voting place inside it, including the parking lot. A third party is not allowed to have brochures, buttons, signs or any other advertising material in the voting place.

Wrapping up the advertising campaign

After voting day, the third party advertiser must remove any signs or other advertisements that have been put up, including online ads.

The advertising campaign must end on December 31, 2018, unless it has a deficit and the third party informs the clerk in writing that they are going to extend their campaign. Once the campaign has ended, the third party should close the designated bank account and prepare the financial statement.

Financial statements must be filed with the clerk by 2 p.m. on Friday, March 29, 2019.

This guide refers to activities related to third party advertising as the “advertising campaign”.

Record keeping

Every third party is responsible for keeping financial records related to their advertising campaign. The Municipal Elections Act, 1996 does not require that third parties use any specific accounting system. A third party may want to consult with an auditor or an accountant to make sure that they are using a bookkeeping and accounting system that will suit their needs.

The third party should also look through the financial statement (Form 8) that they will be required to file to make sure that they are keeping records of all the information that must be included on the statement.

Every third party is required to keep all of their advertising campaign financial records until November 15, 2022 when the next council or school board takes office.

A third party must keep the following campaign records:

. the receipts issued for every contribution including when the contribution was accepted and the date the receipt was issued (receipts must also be issued to the third party for any contributions made to their own advertising campaign) . the value of every contribution, whether it is money, goods or services, and the contributor’s name and address . all expenses, including the receipts for each expense . any claim for payment of an expense that the third party disputes or refuses to pay . the funds raised and expenses incurred from each separate fundraising event or activity . the terms of any loan received from a bank or other recognized lending institution.

Advertising campaign period

A registered third party can only accept contributions or incur campaign expenses during their advertising campaign period.

The advertising campaign begins on the day the individual, corporation or trade union is registered as a third party advertiser. Third parties can register beginning on May 1, 2018 until the close of business on Friday October 19, 2018.

2018 Guide for third party advertisers – Ontario municipal council and school board elections 8 As the advertising is meant to influence voters, there is little point in continuing to advertise after voting day. However, the advertising campaign period runs until December 31, 2018. This extra time can be used to accept contributions if the campaign has not paid for all of its expenses.

If a third party is certain that they will not have any more financial activity after voting day, they can end their advertising campaign at any time between voting day and December 31, 2018.

Extended campaigns

If the advertising campaign has a deficit, the third party can extend their campaign in order to do some additional fundraising. A third party can extend their campaign by notifying the clerk using the Notice of Extension of Campaign Period (Form 6) on or before Monday, December 31, 2018. The end date for the extended period will be the earliest of:

. the day the third party notifies the clerk in writing that they will be ending their advertising campaign and not accepting any more contributions . June 30, 2019

Bank account

Every third party must open a bank account exclusively for the advertising campaign.

An individual cannot use an existing personal bank account for campaign finances, even if they are planning a very small advertising campaign. A corporation or trade union may not use an existing account.

All contributions – including contributions that the third party makes to itself – must be deposited into the third party advertising campaign bank account. All expenses must be paid for from the campaign account.

Contributions

Contributions are any money, goods or services that are given to a third party for use in the campaign, including money and goods that the third party contributes to their own campaign.

If a third party sells tickets to a fundraising event, the cost of the ticket is considered a contribution.

If a third party obtains a loan from a bank or other recognized lending institution and guarantees the loan, and the advertising campaign is unable to repay the full amount, any unpaid balance is considered to be a contribution by the guarantor. If the third party is an individual, either they or their spouse may guarantee a loan.

The value of volunteer labour (for example, if a team of volunteers helps to put up signs) is not considered to be a contribution.

A cash donation of $25 or less received at a fundraising event is not considered to be a contribution, and the third party may accept such donations without keeping track of who gave them. The total amount of money received from these donations must be reported on the financial statement.

If the third party obtains a campaign loan from a bank or a recognized lending institution, the amount of the loan is not considered to be a contribution.

Who can contribute

A third party can accept contributions from:

. any person who is a resident of Ontario . corporations carrying on business in Ontario . trade unions that hold bargaining rights for employees in Ontario.

If the registered third party is an individual, and their spouse is not normally resident in Ontario, the spouse can still make contributions to the third party’s advertising campaign. They may not make contributions to any other registered third party, or to any candidates.

Groups such as clubs, associations or ratepayer’s groups are not eligible to make contributions. The members of these groups may make individual contributions from their personal funds, as long as they are residents of Ontario.

Who cannot contribute

The following are not allowed to make contributions to third party advertising campaigns:

. a federal political party, constituency association, or a registered candidate in a federal election . a provincial political party, constituency association, or a registered candidate or leadership contestant . a federal or provincial government, a municipality or a school board.

A third party can only accept contributions once they have registered as a third party advertiser, and cannot accept contributions after the advertising campaign period has finished.

Any contributions received outside the advertising campaign period must be returned to the contributor. If the contribution cannot be returned to the contributor, it must be turned over to the clerk.

Contribution limits

There is no limit on how much a registered third party (and, if the third party is an individual, their spouse) can contribute to their own advertising campaign.

There is a $1,200 limit that applies to all other contributions. This amount includes the value of any goods or services donated to the third party advertiser. If an individual, corporation or trade union makes more than one contribution (e.g. contributes money, contributes goods, and purchases a ticket to a fundraising event), the total value of all the contributions cannot exceed $1,200.

The maximum total amount that a contributor can give to third parties registered in the same municipality is $5,000.

A contribution must come directly from the contributor – pooling contributions from others and giving them to a third party advertiser is not allowed. If a contribution is made from a joint account, it must be clear which person is making the contribution.

Only a contribution that is $25 or less can be made in cash. All contributions above $25 must be made by cheque, money order, or by a method that clearly shows where the funds came from (e.g. certain debit, credit or electronic transfer transactions).

Third party advertisers are required to inform every contributor of the contribution limits. Contributors should keep track of their donations to ensure they don’t end up giving more than is permitted.

Contribution receipts

Third party advertisers must issue a receipt for every contribution they receive. The receipt should show who made the contribution, the date, and the value. If the contribution was in goods or services, the third party must determine the value of the goods or services and issue a receipt for the full value.

If a third party receives a cheque from a joint personal account, the receipt must be issued only to the person who signed the cheque. The contribution can only come from one person.

2018 Guide for third party advertisers – Ontario municipal council and school board elections 11 Third party advertisers are required to list the names and addresses of every contributor who gives more than $100 total to the advertising campaign in their financial statement. The financial statement is a public document.

A third party should keep a record of the names and addresses of every contributor, regardless of the value of their contribution, because the same contributor may make multiple contributions that end up totalling more than $100.

Contribution receipts are not tax receipts. Contributions to third party advertising campaigns cannot be credited against provincial or federal income taxes.

An easy way for third party advertisers to inform contributors of the contribution limits is to include the contribution limits on the receipt that is given for each contribution.

Review of contributions

The contributions that are reported on third party advertisers’ financial statements will be reviewed by the municipal clerk to see if any contributors have given too much.

If the contributions reported on the financial statements show that a contributor gave more than $1,200 to an individual third party advertiser, or if they show that a contributor gave more than $5,000 to third party advertisers registered in the same municipality, the clerk will report this to the compliance audit committee. The compliance audit committee will hold a meeting and determine whether the municipality will begin court proceedings against the contributor.

Returning ineligible contributions

Third party advertisers are required to return any contribution that was made or accepted in contravention of the act as soon as they learn that it was an ineligible contribution. If the contribution cannot be returned, it must be turned over to the clerk.

Contributions should be returned or paid to the clerk if the contribution is: . made outside the campaign period . from an anonymous source (except for donations of $25 or less at a fundraising event) . from an ineligible source (e.g. someone who doesn’t live in Ontario, a business that is not a corporation, etc.) . greater than the $1,200 individual limit or the $5,000 total limit . a cash contribution greater than $25 . from funds that do not belong to the contributor who gave them

Refunding unused contributions

If the advertising campaign ends with a surplus, the third party can withdraw the value of contributions that they made to their own campaign. If the third party is an individual, they can also withdraw the value of contributions made by their spouse. If there is still a

A third party advertiser cannot refund any other unused contributions.

Contribution rebates

Some municipalities have established programs to provide rebates to those who make contributions to candidates. These programs only apply to candidates, and do not apply to contributions made to third party advertising campaigns.

Fundraising

Fundraising functions are events or activities held for the primary purpose of raising money for a third party’s advertising campaign.

If a third party has created brochures or other advertising materials that include a sentence asking people to make a contribution or providing information about how to contribute, this would not be a fundraising brochure since its primary purpose is to persuade voters to vote a certain way, not to raise money.

Fundraisers can only be held during the advertising campaign period. Third party advertisers must record the gross income, including ticket revenue and other revenue, and the expenses related to each event and activity on their campaign financial statement.

If tickets are sold to the event, the ticket price is considered to be a contribution to the campaign and a receipt must be issued to each person who purchases tickets. If the ticket price is higher than $25, tickets cannot be paid for in cash.

If the ticket price is more than $100, these contributions must be included in Table 1 on the campaign financial statement (Form 8). If the ticket price is less than $100 and a person who buys a ticket makes other contributions, making their total contribution more than $100, these contributions – including the cost of the ticket – must be recorded in Table 1.

If funds are raised by selling goods or services for more than fair market value, the difference between the fair market value and the amount paid is considered to be a contribution. If the good or service is sold for $25 or less, the amount paid is considered campaign income, and not a contribution.

Examples: The campaign has 20 framed prints to sell at a fundraising function. The cost to the campaign is $20 per print, and they are sold for $50 each. Each person who purchases a print is making a $30 contribution to the campaign.

The campaign has 100 t-shirts printed to sell at a fundraiser. The cost to the campaign is $10 per shirt, and they are sold for $25 each. Each person who purchases a shirt is not making a contribution. The $2,500 that was raised by selling the shirts must be recorded as campaign income on the financial statement.

If goods (such as food and drink) are sold at market value, the revenue is not considered to be a contribution, but must still be recorded on the campaign financial statement as campaign income.

Expenses

Campaign expenses are the costs that are incurred during the campaign. These include costs directly related to producing, distributing or publishing advertisements, as well as indirect costs such as hiring someone to keep track of contributions and issue receipts.

Goods and services that are contributed to the campaign are also expenses. They should be treated as if the contributor gave the third party money and the third party went out and purchased the goods and services at fair market value – both the contribution and the expense must be recorded.

Example: An individual spends $120 on stakes for putting up signs and donates them to a third party’s advertising campaign. The third party should record a contribution of $120 in goods or services from the individual, and record an expense of $120.

Expenses must be paid from the campaign bank account. If a credit card is used to pay for purchases, the third party should keep clear records showing that the expense on the credit card was reimbursed from the campaign account.

Any taxes such as HST paid on purchases should be included in the amount of the expense.

Third party advertisers can only incur expenses during their advertising campaign period, except for expenses related to the preparation of an auditor’s report. If a third party advertiser is required to include an auditor’s report with their financial statement,

2018 Guide for third party advertisers – Ontario municipal council and school board elections 14 they may incur these expenses after the advertising campaign period has ended. These expenses must also be reported on the financial statement.

Spending limits

The general spending limit for a third party’s advertising campaign is calculated based on the number of electors who are eligible to vote in the municipality where the third party is registered. The formula to calculate the limit is $5,000 plus $0.05 per eligible elector, to a maximum of $25,000.

Examples: A third party advertiser registered in a municipality with 50,000 electors would have a spending limit of $7,500.

A third party advertiser registered in a municipality with 500,000 electors would have a spending limit of $25,000. $5000 plus $0.05 per elector is $30,000, so the maximum $25,000 applies.

There is a separate spending limit for expenses related to holding parties and other expressions of appreciation after the close of voting. This spending limit is calculated as ten percent of the amount of the general spending limit.

Example: A third party’s general spending limit is $20,000. The spending limit for throwing a party on voting night and making expressions of appreciation such as giving gifts to the members of the advertising campaign team would be $2,000. These expenses do not count toward the $20,000 general spending limit.

When a third party registers in a municipality, the clerk will give them an estimate of their general spending limit. This estimate will be based on the number of electors in the last election.

On or before September 25, 2018 the clerk must give a final general spending limit that is based on the number of electors on the voters’ list for the current election.

If the initial spending limit estimate is different than the final spending limit received in September, the higher of the two becomes the official spending limit. The clerk will also provide the spending limit for expenses related to parties and other expressions of appreciation.

Types of expenses

Most expenses will be subject to the general spending limit.

Expenses are not subject to the spending limit if they are:

. related to holding a fundraising event or activity

2018 Guide for third party advertisers – Ontario municipal council and school board elections 15 . related to a compliance audit . incurred by a registered third party who is an individual with a disability, and the expenses are directly related to the disability and would not have been incurred if not for the election . audit and accounting fees

Any materials, events or activities must have fundraising as the primary purpose in order to be exempt from the spending limit. An incidental mention of contributions is not enough to qualify as fundraising.

When the spending limit applies

The spending limit covers expenses that are incurred between the beginning of the advertising campaign (the day the third party is registered) and voting day. Expenses incurred between the day after voting day and the end of the advertising campaign period are not subject to the spending limit.

If a third party incurs an expense before voting day, but doesn’t get around to paying for it until after voting day, it would still be subject to the spending limit.

Expenses related to parties and expressions of appreciation after voting are subject to the specific spending limit regardless of whether they are incurred before or after voting day.

Advertising campaign financial statement

Every registered third party advertiser must file a complete and accurate financial statement on time.

The filing deadline is 2 p.m. on March 29, 2019.

Third party advertisers must use Form 8. (Do not use Form 4, as that is the financial statement for candidates.)

If a bookkeeper or accountant completes the financial statement, the third party is still responsible for ensuring that it is complete, accurate and filed on time.

Financial statements do not require original signatures. Contact the clerk for information about whether a financial statement can be filed by a method such as fax or email.

If an individual, corporation or trade union registered in more than one municipality, they must file a separate campaign financial statement with each municipal clerk.

If a third party did not receive any contributions or incur any expenses, they are only required to fill out the first page of the financial statement and sign it.

2018 Guide for third party advertisers – Ontario municipal council and school board elections 16 If a third party received contributions or incurred any expenses, they must complete the relevant parts of the financial statement.

If the advertising campaign contributions or campaign expenses are greater than $10,000, the financial statement must be audited and the auditor’s report included when the financial statement is submitted to the clerk.

Filing early

A third party can file their campaign financial statement after they have ended their advertising campaign. If a third party files a statement early and then discovers that there is an error in it, they can submit a corrected statement at any time before the filing deadline on March 29, 2019. The original statement is deemed to be withdrawn when the corrected statement is filed. A third party cannot withdraw a financial statement without submitting a corrected one at the same time.

Applying for an extension

If a third party will be unable to file the financial statement by the deadline, they may apply for an extension to the Superior Court of Justice before March 29, 2019.

Grace period for filing

If a third party has not filed a financial statement by the deadline, they may file the financial statement within 30 days after the deadline if they pay the municipality a $500 late filing fee. This 30-day grace period ends at 2 p.m. on Monday, April 29, 2019.

Penalty for filing late

If a third party has not filed a financial statement by the end of the 30-day grace period and did not apply to the court for an extension prior to the March 29th deadline, the individual, corporation or trade union will not be eligible to register as a third party advertiser in the municipality until after the 2022 election.

If a third party did not file a financial statement by the end of the 30-day grace period, they may still file it for the purposes of having their finances on the record. The clerk will accept the financial statement and make it available to the public. The penalty will still apply.

Extended campaigns

If a third party extends their campaign they must file two financial statements:

. a financial statement reflecting the advertising campaign until December 31, 2018 (due March 29, 2019) . a supplementary financial statement that includes the information from the primary statement and adds financial information from the extended campaign.

The supplementary financial statement must be filed with the clerk by 2 p.m. on Friday, September 27, 2019. There is also a 30-day grace period for this deadline in which the statement can be filed late provided the $500 fee is paid.

Surplus and deficit

If the campaign has a surplus after the third party has refunded contributions made by the third party (and, if the third party is an individual, their spouse), the remaining surplus must be paid over to the clerk when the financial statement is filed. The surplus will be held in trust, and the third party can use it if they incur expenses related to a compliance audit. If the surplus is not needed for these expenses, it becomes the property of the municipality.

If the third party’s campaign expenses are greater than the campaign income, the campaign will be in deficit.

Note: If the financial statement reports that the advertising campaign ended with a deficit, this is a deficit on paper only. The third party is still obligated to pay any vendors they owe money to. Ending the campaign with a deficit may result in questions being raised about how those vendors were paid.

Auditor’s report

A third party must have an auditor review the financial statement and provide a report if:

. the advertising campaign expenses exceed $10,000, or . the contributions received exceed a total of $10,000, or . both the expenses and contributions exceed $10,000 each.

The auditor’s report must be prepared by an auditor licensed under the Public Accounting Act, 2004. Before a third party hires someone to prepare the report, they should ensure that the person is properly qualified.

A third party can incur expenses relating to the auditor’s report after December 31, 2018. These expenses do not count toward the spending limit. These expenses should be included on the financial statement that will be filed.

Under the Municipal Elections Act, 1996, a penalty applies automatically if:

. a third party fails to file a financial statement by the end of the 30-day grace period or fails to apply to the court for an extension by the filing deadline . the financial statement shows that the third party has exceeded a spending limit . a third party fails to turn over their surplus to the clerk when they file their financial statement.

The penalty is that the individual, corporation or trade union will not be eligible to register as a third party advertiser in the municipality until after the 2022 election.

Compliance audits

Each municipality and school board must appoint a compliance audit committee.

If an eligible elector believes that a third party has not followed the election finance rules, the elector may apply for a compliance audit of the third party’s advertising campaign finances. The application must be in writing, and must set out the reasons why they believe the third party did not follow the rules.

An application for a compliance audit must be submitted to the clerk of the municipality where the third party is registered within 90 days of the deadline to file the advertising campaign financial statement.

The compliance audit committee will consider the application and decide whether to grant or reject the application. The committee’s decision may be appealed to the Superior Court of Justice within 15 days after the decision is made.

If the committee grants the application, it will appoint an auditor to conduct a compliance audit of the third party’s advertising campaign finances. The auditor is entitled to have access to all of the financial records related to the advertising campaign. The auditor will produce a report, which the third party is entitled to receive.

The compliance audit committee will meet to consider the auditor’s report. If the report concludes that there is an apparent contravention of the act, the committee will decide whether to commence legal action.

The compliance audit committee does not have any authority to set penalties. Only the court can decide if a third party contravened the act and, if so, which penalties should apply.

2018 Guide for third party advertisers – Ontario municipal council and school board elections 19 A person who does not want to or who is not able to apply for a compliance audit may decide to commence legal action on their own. A prosecution related to the 2018 election must be commenced before November 15, 2022.

Penalties

If a person is convicted of committing an offence, they may be subject to the following penalties:

. a fine of up to $25,000 . up to six months in prison . ineligibility to register to be a third party advertiser until after the next regular election . ineligibility to vote or run in the next regular election (in the case of conviction for bribery or other corrupt practices).

If a corporation or trade union is convicted of committing an offence, they may be subject to a fine of up to $50,000, and ineligibility to register to be a third party advertiser until after the next regular election.

If any third party advertiser is convicted of exceeding a spending limit, they may also be fined the amount by which they exceeded the limit.

Third party advertisers must use Form 8.

All registered third party advertisers must complete Box A: Name of Registrant and Box B: Declaration. If the third party did not receive any contributions or incur any expenses, check the box indicating this, and complete the Declaration in Box B. No further information is required.

If the third party did receive contributions or incur any expenses, fill in the information in Box C, Box D, Schedule 1, and Schedule 2 as appropriate. It may be easier to fill out the form by starting with the more detailed sections such as the tables in Schedule 1 before filling in the Statement of Campaign Income and Expenses.

Any contributors that give more than $100 in total must be identified and recorded in the tables in Schedule 1. There are separate tables for contributions of money or goods and services, contributed by individuals or corporations and trade unions. Record each contribution in the appropriate table.

Contributors that give $100 or less in total do not have to be individually identified. The total amount contributed from these contributors will be recorded as a lump sum.

If the third party received contributions or incurred expenses in excess of $10,000, an auditor’s report must be included with the financial statement.

The completed financial statement must be submitted to the clerk by 2 p.m. on the last Friday in March (March 29, 2019).

Supplementary financial statements must be submitted to the clerk by 2 p.m. on the last Friday in September (September 27, 2019).
