Drug & Alcohol Testing Program
Illinois Propane Gas Association offers a drug testing program for current members.
1. Option 1 On Site Testing at your Location: When you receive a Random Drug and/or Alcohol Test Notice email from the Illinois Propone Gas Association, a collector will contact you to set up and com- plete the required tests prior to the end of the month in which the driver was selected.
2. Option 2—Clinic Based Testing: When you receive a Random Drug and/or Alcohol Test Notice email from the Illinois Propone Gas Association, it is the company’s responsibility to make sure the driver goes to the clinic you have chosen to have the test completed before the date given on the notice.
Call the IPGA at (800) 727-6207 and request the informational packet to get you started in the consortium program.

Illinois Propane Gas Association 53 IPGA Committees Committees are the driving force of the Illinois Propane Gas Association. Every program that the IPGA submits for IPERC funding is conceived and designed by one or more of its standing committees. It is this structure that gives every member a voice in the decision making process that determines the direction of the Association. This “Committee Driven” approach to program development is what makes the Illinois Propane Gas Association a leader in the Industry.
Executive Committee The Executive Committee consists of the current IPGA officers and the NPGA State of Illinois Director, which is an ex officio member of this committee. The Committee provides general supervision of ILPGA affairs and staff.

Education & District Directors Committee The main focus of this committee is to focus on how to keep members up to date with new regulations, methodologies and general Association news. Equally important is news received back from the field. This input is used to measure the effectiveness of current programs and to shape the development of future programs.

This Committee is responsible for keeping the IPGA on track with the goals of the Strategic Plan and ensures that the committees are following the directives and goals in the Strategic Plan. This also allows the opportunity for committee’s to compare their progress with other committees and update the Strategic Plan to keep up with building future goals for the IPGA to meet.

Illinois Propane Gas Association 55 Liquefied Petroleum Gas Container Act (430 ILCS 10/0.01) Short title. This Act may be cited as the Liquefied Petroleum Gas Container Act. (Source: P.A., 86-1324.)
(430 ILCS 10/1) Sec. 1. It is the intent of the Illinois Legislature to protect the pub- lic welfare and promote safety in the filling and use of pressure vessels containing lique- fied petroleum gases through implementing both the Interstate Commerce Commission regulations, within the State of Illinois, and the national standards of safety on the fill- ing of these containers. It is deemed necessary to insure that containers properly con- structed and tested be used and that a liquefied petroleum gas of suitable and safe va- por pressure be placed in these containers. To attain this end the filling and refilling of liquefied petroleum gas containers by other than the owner or authorized person must be controlled and specific authority to prevent violation and encourage enforcement be established. (430 ILCS 10/2) Sec. 2. The term “person” shall mean and include any person, per- sons, firm, firms, corporation or corporations. The term “owner” shall mean and in- clude (a) any person who holds a written bill of sale or other instrument under which ti- tle to the container was transferred to such person, (b) any person who holds a paid or receipted invoice showing purchase and payment of such container, (c) any person whose name, initials, mark, or other identifying device has been plainly and legibly stamped or otherwise shown upon the surface of such container for a period of not less than one year prior to the final enactment and approval of this act, or (d) any manufac- turer of a container who has not sold or transferred ownership thereof by written bill of sale of otherwise; the term “liquefied petroleum gas” as used in this Act shall mean and include any material which is composed predominately of any of the following hydrocarbons of hydrocarbons or mixtures of the same: propane, propylene, butanes (normal butane and iso-butane), and butylenes. (430 ILCS 10/2.5) Sec. 2.5. This Act does not apply to any liquefied petroleum gas con- tainer designed to hold 20 pounds or less of liquefied petroleum gas. (Source: Laws 1955, p.626.)
(430 ILCS 10/3) Sec. 3. If a liquefied petroleum gas container shall bear upon the surface thereof in plainly legible characters the name, mark, initials or other identifying device of the owner thereof, it shall be unlawful for any person except such owner or a person authorized in writing by him: (a) To fill such container with, or withdraw from such container, liquefied petroleum gas or any other gas or compound; (b) to buy, sell, offer for sale, give, take, loan, deliver or permit to be delivered, or otherwise use, dis- pose of, or traffic in any such container; or (c) to deface, erase, obliterate, cover up or otherwise remove or conceal or change any such name, mark, initials or other identify- ing device of the owner or to place the name, mark, initials or other identifying device of any person other than the owner on such container. (430 ILCS 10/4) Sec. 4. The use of a liquefied petroleum gas container or containers by any person other than the person whose name, mark, initial or device shall be or shall have been upon such liquefied petroleum gas container or containers, without written consent or purchase of such marked and distinguished liquefied petroleum gas container, for the sale of liquefied petroleum gas, filling with liquefied petroleum gas, or the with- drawal of liquefied petroleum gas, or the possession of such liquefied petroleum gas containers by any person other than the person having his name, mark, initial or other device thereon, without the written consent of such owner, shall and is hereby declared to be presumptive evidence of the unlawful use, filling or refilling, transition of, or trafficking in of such liquefied petroleum gas containers. Illinois Propane Gas Association 56 (430 ILCS 10/5) Sec.5. Whenever any person, or the president, secretary, treasurer, or other officer of any corporation mentioned in Section 2 of this Act, or his, or her, its or their duly authorized agent who has personal knowledge of the facts, shall make oath in writing before any judge or associate judge, that the party so making such an affidavit has reason to believe and does believe that any of his, her, its or their liq- uefied petroleum gas containers marked with the name, initials, mark or other device of said owner, are in the possession of or being used by or being filled or transferred by, or that liquefied petroleum gas is being withdrawn from the container by, any person whose name, initials, mark or other device does not appear on said containers, and who is in the possession of, filling or refilling, or using such containers without the writ- ten consent of the owner of such name, initials or trade mark, the judge or associate judge may, when satisfied that there is reasonable cause, issue a search warrant and cause the premises designated to be searched for the purpose of discovering and obtain- ing the same, and may also cause to be brought before him the person in whose posses- sion such containers may be found, and shall then inquire into the circumstances of such possession; and if such judge or associate judge finds that such person has been guilty of violation of this Act, he shall impose the punishment herein prescribed, and he shall also award the possession of property taken upon such search warrant to the owner thereof. (430 ILCS 10/6) Sec. 6. Violations. Any person who shall fail to comply with any of the foregoing provisions of this Act shall be deemed guilty of a Class B misdemeanor, for which the fine shall be not less than $1,000 and not more than $1,500 for each offense. (Source: P.A. 91-816, eff. 6-13-00. )
