Overview The development of the mission statement for the Office of Equity and Racial Justice included public participation from various communities. Based on the extensive public process and input regarding brining forward concerns as part of the mission statement development, the Commission decided to complete that process before commencing its strategic planning, so they could have the benefit of that community input. In addition, the Commission has just concluded a series of presentations related to extremist groups, hate incidents, hate crimes, reporting of hate incidents/crimes, protests, and violence prevention strategies. Accordingly, the Commission can being its strategic planning. Below please find options proposed by staff regarded to setting meetings for its strategic planning.

Today, staff asks the Commission how it would like to proceed. In addition, the Commission can begin discussions related to its strategic plan.

Options The Commission can undertake its strategic planning: 1) during its regularly scheduled meetings; 2) during additional special meetings over the next few months; and/or, 3) can form an ad hoc committee to develop a strategic plan for the Commission. To the extent the Commission prefers to undertake its strategic planning during its regularly scheduled meetings, staff suggests adding special meetings to assist in accomplishing the strategic plan over the next few months.

Additional Special Meetings – Tuesdays, 10:00 am – 12:00 pm June 15th July 6th August 10th

Possible Ad Hoc Committee Meetings – Mondays, 2:00 pm – 4:00 pm June 7th and 14th July 12th and 19th August 2nd and 16th

Subject: VACANCIES – DEMOGRAPHICS AND PROCESS FOR COMMISSION SEAT NOMINATIONS

Overview The Commission has two (2) open seats for nomination. The last update was provided on February 23, 2021 and the Commission directed staff to return at a future date when there have been more appointments made by the Board of Supervisors to fill the 10 vacant Board nominated seats. The Board of Supervisors have filled 7 of those seats. In addition, the Commission requested updated demographics once the new members were seated. Today, staff will present the updated demographics from which the Commission can identify communities currently underrepresented on the Commission. Staff will also review the process for the Commission nominated seats.

Action Item(s) Review the demographics information presented and identify communities currently underrepresented on the Commission.

Background The Leon L. Williams San Diego County Human Relations Commission (Commission) was established on May 19, 2020, to “promote positive human relations, respect, and the integrity of every individual regardless of gender, religion, culture, ethnicity, sexual orientation, age, or citizenship status.” (Resolution Number 20-054, Section 1.) The County of San Diego Board of Supervisors established the Commission as a “positive step to reduce sources of tension and conflict in San Diego County,” with the intention of making “recommendations to alleviate discrimination and intolerance and serve as a resource to the Board of Supervisors and County departments on issues related to human rights and relations. The Commissioners would serve as a liaison to community groups, provide feedback on effective outreach and engagement tactics and review progress made to lessen hate crimes, bias, human rights violations and other related matters.” (Board Letter, Agenda Item 26, May 19, 2020.)

The Commission is comprised of thirty-one (31) members. Of those thirty-one (31) members, the Commission nominates seven (7) for appointment by the Board. There are factors for the Commission to consider in making their nominations. Specifically, “[e]ach Commission nomination shall: . . . attempt to nominate members of the community to create a Commission that is reflective of:” a. “the demographics, diversity, and culture of San Diego County; b. including, comprehensive representation of age, gender, socioeconomic status, ethnic background, culture, religion, sexual orientation, and geographical distribution; c. consider the prospective Commissioner’s knowledge and awareness of the problems and causes of intergroup tension and conflict; and, d. demonstrated commitment to fostering better human relations.” (Resolution No 20-054, Section 3.)

The Commission adopted and Board approved Bylaws also reflect the above requirements. (Bylaws, Article II, Section A.) Nominations by the Commission require a majority vote for the nominees to be forwarded to the Board of Supervisors for confirmation.

Pursuant to the Resolution establishing the Commission, as well the Bylaws, there are thirty-one (31) seats, comprised as follows: the Board of Supervisors each nominate three individuals, one of which is a youth, for a total of fifteen (15); two (2) members are seated ex-officio; seven (7) seats are designated for named outside organizations to designate their nominee to the Board for confirmation; and, seven (7) seats are designated for the Commission to name individuals for Board confirmation. Currently, there are ten (10) Board nominated seats and two (2) Commission nominated seats vacant.

The seven (7) outside organization seats and their current designees are: 1) Jewish Family Service of San Diego (Kate Clark); 2) San Diego LGBT Community Center (Cara Dessert); 3) International Rescue Committee (Rashid Essa); 4) San Diego Rapid Response Network (Norma Chavez-Peterson); 5) Southern Tribal Chairmen’s Association (Angela Elliot Santos); 6) San Diego Chapter of the Black American Political Association of California (Ellen Nash); and, 7) Asian Pacific Islander representative who shall be appointed by the Union of Pan Asian Communities, Asian Business Association of San Diego, and San Diego API Coalition (Samuel Tsoi).

Terms of Commission Members Commission member terms are based on how they were nominated. Those members who were nominated by a Board of Supervisor serves for a term concurrently with the term of the nominating Supervisor’s term. Members nominated by the Commission serve a two-year term. Members nominated/designated by one of the seven (7) outside organizations listed in the Resolution establishing the Commission serve an indefinite period.

Demographics of the County and Commission The Commission asked for the demographics of the County and Commission as it reviews opportunities for representation on the Commission. We obtained the information about the County from the County of San Diego Health and Human Services Agency, the San Diego Association of Governments (SANDAG), the Pew Research Center, and the Williams Institute from UCLA School of Law. The Commission demographics were based on self-reported answers. Please see the attached demographics summary (Attachment A).

Nomination Process The Commission can nominate individuals who have submitted applications. The Commission makes its nominations in light of the factors listed in the Resolution and stated herein.

The nomination process established by the Commission is as follows:

1. Receive updated demographics and identify opportunities for representation on the Commission; 2. Members receive and review the applications; 3. Each Member creates a shortlist of up to 3 individuals for Commission consideration; 4. Members send staff their shortlist a week before the nominations meeting; 5. Staff compiles the list, noting names identified multiple times, and includes the information in the Agenda materials; 6. The Commission discusses and makes nominations from the names submitted at the designated nominations meeting;

Through May 20th, 57 applications have been received. This includes 31 applications submitted as part of the earlier nomination process. We are including the applications with this Agenda item so that you have sufficient time to review them and send in your respective shortlists (Attachment C). For ease of reference, we have made a list of all the applicant names (Attachment B). Lastly, we have attached a current roster of all members and by whom they were nominated (Attachment D).

Next Steps The Commission has two (2) seats for which to make nominations.

1. At today’s meeting, the Commission is asked to undertake Step 1: Receive the updated demographics and identify opportunities for representation on the Commission. 2. Review the applications and send staff your shortlist by June 15th. 3. Nominations will be on the June 22nd Agenda.

HRC Releases Cathedral Catholic Statement

The Leon L. Williams San Diego County Human Relations Commission works to promote positive human relations, respect, and the integrity of every individual regardless of gender, religion, culture, ethnicity, sexual orientation, age, or citizenship status. Appreciating and respecting one another is of utmost importance, and these lessons start at a young age. We urge our communities to join us and remain vigilant in teaching these lessons. High school students recently reminded us all how important these lessons remain.

We acknowledge Cathedral Catholic High School’s public apology after football players circulated and posed in offensive photos aimed at Lincoln High School, which Cathedral played in a football game the week before. One social media post created by a Cathedral Catholic player had a photo of somebody wearing a shirt that read “Catholics vs. Convicts III” with the caption “We run the city” typed onto the photo.

We also value the letter school leaders sent to families condemning the photos as racist and stating that the school unreservedly apologizes “for the poor judgment shown by the students who posed for and posted the racist photos.”

This incident reminds us of the work that must continue in our communities. We encourage our school communities take the following actions:

• Ensure that words and actions meet high standards, and that racists behavior and acts are not tolerated. • Ensure that every student, family member, guest or employee feels valued, safe, and welcomed. • Create a plan to address racial bias and restorative practices.

The Human Relations Commission works to foster mutual respect and understanding among all communities within the county. We look forwarding to working with the County of San Diego’s Office of Equity and Racial Justice to develop solutions that create safe and welcoming culturally competent spaces for our youth in San Diego.

HRC Releases Chauvin Case Verdict Statement

The conviction of former police officer Derek Chauvin is being seen as a watershed moment for police accountability. Yet, since the verdict more Black lives around the country have been taken by police officers.

It is a reminder that the journey to dismantle racial injustices in policing and our criminal justice system requires resilience, vigilance, and unwavering commitment.

The Leon L. Williams San Diego County Human Relations Commission has formed a public safety subcommittee to engage with law enforcement so that every community can receive fair and unbiased police services. The subcommittee will discuss the diversity, accountability, policy, outreach, and culture of the Sheriff’s Department. This public safety subcommittee is part of the Human Relations Commission’s work of promoting a culture of positive human relations and fostering mutual respect and understanding within the County.

The work before us is clear. We must continue to reimagine policing across this county. We must continue to promote positive human relations. We must continue to rebuild trust with the San Diego community.

We realize it will take long hard work, courageous and difficult conversation, and strategic and purposeful planning. However, we embrace the challenges that brought individuals from all walks of life together as the Human Relations Commission to ensure that every resident realizes the American dream of life, liberty, and justice for all.

We extend our heartfelt prayers and sympathies to George Floyd’s family and want them to know that Mr. Floyd has forever changed the nation, particularly San Diego County for the better.

6. Board action declaring racism as a public health crisis

Update by Claudia G. Silva, Director, Office of Ethics and Compliance. Board of Supervisor’s meeting on January 12 adopted resolution declaring racism is a public health crisis and has directed CAO to report back to BOS within 90 days with an action plan.

7. Request for diversity information regarding staff of San Diego County Suicide Prevention Council based on public comment received on January 7, 2021.

Update by Claudia G. Silva, Director, Office of Ethics and Compliance. County of San Diego Behavioral Services has a contract with Community Health Improvement Partners (CHIP) by facilitating advisory council and other related subcommittees. Staffing level breakdown provided.

4. Discussion of community raised matters relating to the Commission promoting positive human relations. Discussion is limited to 15 minutes which may include the Commission placing the matter on a future agenda for possible action.

A discussion occurred to address and resolve the complaint received by former Commission Member Enrique Morones of Gente Unida against the County of San Diego Sheriff’s Department. Sheriff’s Department provided a response referring the complainant can file a complaint with Citizens Law Enforcement Review Board (CLERB). The Leon L. Williams Human Relations Commission does not have authority over Sheriff matters. A letter from the commission will be sent to complainant with option to file a complaint with CLERB. The commission will inquire with CLERB if such complaints have been filed and report back to the commission.

5. Update and discussion of development of mission statement for the Office of Equity and Racial Justice

Presented by Guadalupe Velasquez, Targeted Universalism, Othering and Belonging Institute.

6. Presentation on extremist/hate groups by Anti Defamation League (ADL)

Presentation by Matthew Brown, Associate Director, Anti-Defamation League-San Diego.

7. Update on vacancies

Updated provided by Claudia G. Silva, Director, Office of Ethics and Compliance. Demographic information to be shared with the commission on the next agenda. The Board of Supervisors currently has ten open seats for which nominations will be made.

8. Future Agenda Items The office of the District Attorney will be presenting in the upcoming March meeting. A request will be made to take a vote on the next meeting to provide the commission with monthly status reports on hate crimes filed with the District Attorneys’ Office.

Mission Statement development update: Survey link will be distributed by email March 8th. Outreach mechanisms will be used. Survey feedback to be provided at the next Ad Hoc Committee on March 23rd.
