It also touches on some related matters, such as the assessment of damages for defamation. The law frames the test for defamation not in terms of the reactions to a publication of its actual recipients, but rather the imagined responses of a hypothetical audience, whose members the law often describes as ‘ordinary reasonable people’. Through an analysis of case law, the thesis concludes that the legal test for defamation is ambiguous, not least as to whether it should always reflect mainstream opinion, even when it is anticipated that most people would respond to a publication irrationally. In light of such uncertainties, the thesis explores the law’s practical application, reporting on interviews with eight judges and 28 defamation lawyers, assessing how they understand and apply the law. It concludes that the majority of lawyers understand the test for defamation as intended to reflect how most people think, both in terms of their values as well as how they interpret communications. With that in mind, the thesis presents empirical findings on whether defamation law achieves that end.

SLANDER, METAPHOR, AND THE BODY POLITIC IN EARLY MODERN ENGLAND BY CARLA ROSELL DISSERTATION Submitted in partial fulfillment of the requirements for the degree of Doctor of Philosophy in English in the Graduate College of the University of Illinois at Urbana-Champaign, 2017 Urbana, Illinois Doctoral Committee: Associate Professor Lori Humphrey Newcomb, Chair Professor Curtis Perry Associate Professor Catharine Gray Associate Professor Andrea Stevens Abstract In sixteenth and seventeenth century England slander was increasingly understood as a distempering force that had the potential to spread from a subject’s body to the body politic, a fear that pervaded legal, religious, and medical discourses. My dissertation—the first sustained study of slander’s real and perceived ability to affect both individual and social bodies— examines the internal responses incited by slander and their effects on community bonds. Because slander was conceived as a domestic threat undermining unity at all levels of society in early modern England, writing of the period relies on metaphor to explain this verbal ill’s genesis and to illustrate its effects on individual and figurative bodies, including its ability to incite anger, wound, or kill. As my title suggests, slanderous speech could emerge from any social rank; commoners (the “feet” of the social body) and those of gentle status could and did use the language of critique (their “mouths”) to identify and attempt to ameliorate the ills of the body politic, even as the monarch and others in authority countered such charges by labeling them sedition. Each chapter of my project places literary texts from the period roughly spanning the 1560s to the 1630s alongside little-studied treatises about slander and sins of the tongue, all of which I consider within the developing legal framework of slander law.

    Hugh Stewart (Film Editor/Film Producer) 14/12/1910 - ? by admin — last modified Jul 27, 2008 02:44 PM BIOGRAPHY: Hugh Stewart was born in Falmouth on 14th December 1910. Educated at Claysmore and then at Cambridge under F.R. Leavis, he entered the film industry in the early 1930s at Gaumont-British under the apprenticeship scheme run by Ian Dalrymple. He trained as a film editor, initially cutting together out-takes from Marry Me (1932). He was assembly cutter on Basil Dean’s 1932 adaptation of The Constant Nymph, and his first film as Editor was Forbidden Territory (1934). He cut several important films for Gaumont, including Saville’s Evergreen (1934) and Hitchcock’s The Man Who Knew Too Much (1934) before moving to Beaconsfield to work on quota productions. He also gained experience with John Dighton writing comedy scripts for Naughton and Gold shorts. During the late 1930s he edited a series of films for Korda and Saville including Dark Journey (1937), Action for Slander (1937), and South Riding (1938), and for Eric Pommer in St Martin’s Lane (1938). Having worked for Michael Powell on The Spy in Black (1939) he was engaged for 49th Parrallel (1941) but was unable get a discharge from the Army before the unit sailed. Keen to go oversees, Stewart joined the Army film Unit, filming in Algeria and Tunisia and he helped Roy Boulting edit this footage into Africa Freed. After this film was shelved due to difficulties with the Americans he worked on Tunisian Victory (1944). After the War, Stewart became a film producer, beginning with Trottie True (1949) the novel of which he’d read while ill.
