PPinformed that initially 275 sand guts were proposed by the administration but GSDA rejected 87 and remaining 188 were proposed with Gramsabha Resolution. After due deliberations on all the aspects of environmental impact Committee decided to recommend 188 proposals for Environmental Clearance (EC) subject to compliance of the following conditions:

1. District Collector to ensure that conditions stipulated in the Government Resolution (G.R.) dated 12/03/2013 issued by Revenue and Forest Department, Government of (GoM) and Office Memorandum (O.M) of Ministry of Environment and Forest (MoEF), dated 24/12/2013 are implemented in letter and spirit.

2. Sand excavation is allowed only for the Reti Guts having sand deposition more than 2 m and excavation should be for layers above 2 m of sand deposit as recommended by GSDA. 3. District Collector to ensure that every receipt given is serially scanned and registration number so generated must be written on such receipt to avoid duplicction and unauthorized transportation of the sand. 4. Project Proponent and District Collector to ensure that vehicles transporting sand should not be overloaded beyond stated capacity. 5. It shall be ensured that there is no fauna dependant on the river bed or areas close to miningfor its nesting. 6. The depth of miningshall be restricted to the recommendations of GSDA. 7. The green belt development /tree plantation willbe made in an area of 20'Yo of the total leased area either on river bank or along road side. 8. Measures for prevention & control of soil erosion and management of silt shall be undertaken. Protection of dumps against erosion, if any, shall be carried-out with geo textile matting or other suitable material. 9. Project Proponent and District Collector to ensure that there is no violation of the Supreme Court order and orders of the National Green Tribunal given in the related matters. 10. District Collector and District Mining officer will be held individually responsible for non compliance of the conditions stipulated in the Environmental clearance and shall be liable for legal action under Environment (Protection) Act of 1986. 11. Transport of sand should be through vehicle which is properly covered with Tarpaulin and it should not be overloaded. 12. District Collector to ensure that the mining plan is approved by Director of Geology and Mining comprising study to show that annual replenishment of sand in the mining lease area is sufficient to sustain the mining operations at levels prescribed in the miningplan and that the transport infrastructure is adequate to transport the mined material. 13. Conditions as stipulated in "Annexure A' should be followed scrupulously.

PPinformed that all 62 sand guts are recommended through Gramsabha Resolution and that these were not located in any Reserved Forest or ESA and all excavations would be done beyond 300 m of river structures. Collector outlined steps to prevent unauthorized mining like coordinating of mining activity by issuing Transit Passes with specific duration, frequent inspection by Revenue and Mining officers etc. This will be verified by SEAC through site visits. After detailed deliberations on all the aspects of environmental impact Committee decided to recommend 62 proposals for Environmental Clearance (EC) subject to compliance of the following conditions:

1. District Collector to ensure that conditions stipulated in the Government Resolution (G.R.) dated 12/03/2013 issued by Revenue and Forest Department, Government of Maharashtra (GoM) and Office Memorandum (O.M) of Ministry of Environment and Forest (MoEF), dated 24/12/2013 is implemented in letter and spirit. 2. Sand excavation is allowed only for the Reti Guts having sand deposition more than 2 m and excavation should be for layers above 2 m of sand deposit as recommended by GSDA. 3. District Collector to ensure that every receipt given is serially scanned and registration number so generated must be written on such receipt to avoid duplication and unauthorized transportation of the sand. 4. Project Proponent and District Collector to ensure that vehicles transporting sand should not be overloaded beyond stated capacity. 5. It shall be ensured that there is no fauna dependant on the river bed or areas close to mining for its nesting. 6. The depth of mining shall be restricted to the recommendations of GSDA. 7. The green belt development Itree plantation will be made in an area of 20'10 of the total leased area either on river bank or along road side. 8. Measures for prevention & control of soil erosion and management of silt shall be undertaken. Protection of dumps against erosion, if any, shall be carried-out with geo textile matting or other suitable material. 9. Project Proponent and District Collector to ensure that there is no violation of the Supreme Court order and orders of the National Green Tribunal given in the related matters. 10. District Collector and District Mining officer will be held individually responsible for non compliance of the conditions stipulated in the Environmental clearance and shall be liable for legal action under Environment (Protection) Act of 1986. 11. Transport of sand should be through vehicle which is properly covered with Tarpaulin and it should not be overloaded. 12. District Collector to ensure that the mining plan is approved by Director of Geology and Mining comprising study to show that annual replenishment of sand in the mining lease area is sufficient to sustain the mining operations at levels prescribed in the mining plan and that the transport infrastructure is adequate to transport the mined material. 13. Conditions as stipulated in" Annexure A' should be followed scrupulously.

DMOpresented 51 proposals before the Committee. However the PPfailed to submit individualGSDAcertificates indicating actual depth of sand available and excavable depth pertaining to proposals. The proposals were, therefore deferred.

DMO presented 99 proposals before the Committee. The Committee observed that GSDA Certificate does not mention anything about the actual depth of sand available on the river bed. The proposals were, therefore deferred.

District Collector gave a detailed presentation of 154 proposals of sand mining in District. He informed that out of 154 sand guts only 94 were recommended by Gramsabha Resolution. Therefore the Committee decided to consider only 94 proposals. Taluka wise presentation was made by the Collector. The Committee noted that in a recently published news miningof sand next to pillars of railwaybridgein Daund Taluka was reported. This is a matter of concern. The Collector promised that necessary action would be taken against the negligent officers whose lack of concern has put the safety of bridge in jeopardy. Colector also promised a thorough review of sand mining in nearby vicinity of bridges, dams, KT weirs etc. to ensure safety of the structures. He reiteratedthe seriousness with which the District Administration has persued unauthorized sand miningand ensured the Committee that such clandestine activities will be controlled with all seriousness.

After due deliberations on all the aspects of environmental impact Committee decided to recommend 53proposals for Environmental Clearance (EC)subject to compliance of the following conditions:

1. District Collector to ensure that conditions stipulated in the Government Resolution (G.R.)dated 12/03/2013 issued by Revenue and Forest Department, Government of Maharashtra (GoM)and Office Memorandum (D.M) of Ministry of Environment and Forest (MoEF),dated 24/12/2013 is implemented in letter and spirit. 2. Sand excavation is allowed only for the Reti Guts having sand deposition more than 2 m and excavation should be for layers above 2 m of sand deposit as recommended by GSDA. 3. District Collector to ensure that every receipt given is serially scanned and registration number so generated must be written on such receipt to avoid duplication and unauthorized transportation of the sand. 4. Project Proponent and District Collector to ensure that vehicles transporting sand should not be overloaded beyond stated capacity. 5. It shall be ensured that there is no fauna dependant on the river bed or areas close to mining for its nesting. 6. The depth of miningshall be restricted to the recommendations of GSDA. 7. The green belt development Itree plantation will be made in an area of 20,},o of the total leased area either on river bank or along road side. 8. Measures for prevention & control of soil erosion and management of silt shall be undertaken. Protection of dumps against erosion. if any, shall be carried-out with geo textile matting or other suitable material.

9. Project Proponent and District Collector to ensure that there is no violation of the Supreme Court order and orders of the National Green Tribunal given in the related matters. 10. District Collector and District Mining officer will be held individually responsible for non compliance of the conditions stipulated in the Environmental clearance and shall be liable for legal action under Environment (Protection) Act of 1986. 11. Transport of sand should be through vehicle which is properly covered with Tarpaulin and it should not be overloaded. 12. District Collector to ensure that the mining plan is approved by Director of Geology and Mining comprising study to show that annual replenishment of sand in the mining lease area is sufficient to sustain the mining operations at levels prescribed in the mining plan and that the transport infrastructure is adequate to transport the mined material. 13. Conditions as stipulated in "Annexure A' should be followed scrupulously.

Additional Collector and DMO presented 20 proposals before the Committee. Committee observed that GSDA had given unambiguous certificate regarding depth of sand available in 17 cases.

After due deliberations on all the aspects of environmental impact Committee decided to recommend these 13 proposals for Environmental Clearance (EC) subject to compliance of the following conditions:

1. District Collector to ensure that conditions stipulated in the Government Resolution (G,RI)dated 12/03/2013 issued by Revenue and Forest Department, Government of Maharashtra (GoM) and Office Memorandum (OIM) of Ministry of Environment and Forest Mdated 24/12/2013 is implemented in letter and spirit. ~

2. Sand excavation is allowed only for the Reti Guts having sand deposition more than 2 m and excavation should be for layers above 2 m of sand deposit as recommended by GSDA. 3. District Collector to ensure that every receipt given is serially scanned and registration number so generated must be written on such receipt to avoid duplication and unauthorized transportation of the sand. 4. Project Proponent and District Collector to ensure that vehicles transporting sand should not be overloaded beyond stated capacity. 5. It shall be ensured that there is no fauna dependant on the river bed or areas close to miningfor its nesting. 6. The depth of miningshall be restricted to the recommendations of GSDA. 7. The green belt development /tree plantation will be made in an area of 201'0 of the total leased area either on river bank or along road side. 8. Measures for prevention & control of soil erosion and management of silt shall be undertaken. Protection of dumps against erosion, if any, shall be carried-out with geo textile matting or other suitable material. 9. Project Proponent and District Collector to ensure that there is no violation of the Supreme Court order and orders of the National Green Tribunal given in the related matters. 10. District Collector and District Miningofficer will be held individually responsible for non compliance of the conditions stipulated in the Environmental clearance and shall be liable for legal action under Environment (Protection) Act of 1986. 11. Transport of sand should be -through vehicle which is properly covered with Tarpaulin and it should not be overloaded. 12. District Collector to ensure that the mining plan is approved by Director of Geology and Mining comprising study to show that annual replenishment of sand in the mining lease area is sufficient to sustain the mining operations at levels prescribed in the miningplan and that the transport infrastructure is adequate to transport the mined material. 13. The Committee observed that the locations were beyond the prescribed distance of 300 m from habitation and that the quarries would not affect surface / ground water regime. The Committee again deliberated environmental impact of quarries with reference to baseline and incremental ground level concentrations of air quality and observed that these would not exceed the prescribed limits and that the impacts due to quarrying would be minimal. After due deliberations on all the aspects of environmental impact Committee decided to recommend 13 proposals for Environmental Clearance (EC)subject to compliance of the following conditions:

1. The approved mining plans shall be submitted to the Committee at the earliest. 2. No stone crushing shall be allowed in any of the quarries approved. 3. Existing quarries have not maintainedanybenches.The approved quarries shall maintain benches with the configurations: 60 degrees slope in the cut, 6 mt depth for cut and 6 mt width for the bench. 4. No dumpingof material shall be allowed in water sources or nallas. 5. DMO mentioned that there were no abandoned quarries. The Committee is oftheopinion that there may be abandoned quarries. DMO shall verify this from Tahshildars and wherever the abandoned quarries arefound,restoratioin plan for the same should be prepared. The future applications for environmental clearance for quarries will not be considered unless restoration plan for the abondoned quarries are submitted. 6. General Conditions as stipulated in "Annexure H' should be followed scrupulously. ******

Committee noted that the project was considered as 8(a)• B2 category of EIA Notification, 2006. All issues related to environment, including air, water, land, soil, ecology and biodiversity and social aspects were discussed. During discussion and deliberations on the matter following points emerged: 1. PP to submit details regarding use of paint and exact nature of chemicals used. PPto carry out QRA and mitigation measures thereof. 2. PPto submit details of treatment of coolant. 3. Onsite and Off-site hazard managent plan of flammable material stored within premises. 4. After discussion, ToR presented by the PPwas approved with the following additional ToR:

1. A maximumof about 20 'Yo saving in energy shall be targetted while planning the industtrial construction.

A monitoing station shall be placed at Hariharishewar Temple. 3. Approved Miningplan shall be submitted alongwith EIA report. PPshall carry out public consultation and approach SEACwith EIA report incorporating minutes of the same.

The Committee noted that the new CETP was necessiciated by the unprecidental industrial growth in Tarapur MIDC post 2000 when a large number of textile processing, pharma and chemical industries got established there. In 2003, MoEF declared Tarapur MIDC as "Critically Polluted Industrial Area". A Monitoring Committee constituted by Hon'ble Supreme Court visited Tarapur MIDC along with representatives of MIDC, MPCB,TIMA and local NGOs. The abstract of this visit was to set up new CETP for which purpose a society under Companies Act named as "Tarapur Environment Protection Society (TEPS)" was established. The TEPS is the PP in the present case.

Potential hazard and mitigation measures Conclusionof the EIA study

Public Hearing Report (if Public Hearing was conducted on 29-11-2014 at 11am in TIMA public hearing conducted then hall, Tarapur in accordance with the procedure laid in EIA submit the salient features) 2006 notification. Issues were raised on treated effluent standards of existing 25MLD CETP operated by TEPS. Accordingly, TEPS has emphasized the need of additional CETP of 50MLD so that the treated effluent standards can be met for both the plants. The participants have positively reacted accordingly with the suggestion that the proposed CETP also should run continuously and shall meet the stipulated standards. A detailed presentation of EIA report was made by the Environmental Consultant. All issues related to environment, including air, water, land, soil, ecology and biodiversity and social aspects were discussed. After discussion and deliberations on the matter following points emerged:

1. Profiling of industrial effluents has not been carri~d out and the Committee fears that in the absence of proper monitoring of shock loads, the system may suffer major failure. Profiling needs to be completed by end of February, 2015. 2. The PPstated that he was not responsible for disposing off the effluent post the MIDC sump. The Committee expressed concern that the management of the project unless entrusted with a single authority will be rendered infructuous. It is absolutely necessary to coordinate the efforts of TEPS and MIDC so that the CETPas well as the outfall pipe are completed Simultaneously. 3. The Committee feels that a suitable agency should coordinate the efforts of TEPS and MIDC for the effective and timely completion of the project as a whole. An Expert Committee needs to be authorized for this purpose.

After deliberation, Committee decided to recommend the proposal for Environmental Clearance to SEIAA, subject to compliance of above mentioned points.

The proposal was previously considered in 87th SEAC meeting. SEAC received Minutes of Meeting of rr» SEIAA. All issues related to environment, including air, water, land, soil, ecology and biodiversity and social aspects were once again discussed in detail.

During discussion and deliberations PPwas asked to comply with following points: 1. Exhaustive list of raw material alongwith MSDS. 2. Toposheet showing details of 25 km radius.

These details should be submitted by 3rd Jan, 2015. The Specific and General conditions applicable for Mining of Sand

Specific conditions: 1. Proposals are recommended for Environmental Clearancefor period 2014- 2015 only. 2. Provisions stipulated in Maharashtra Minor Minerals Extraction (development and Regulation) Rules 2013 and Government Resolution of Revenueand Forest Department dated 12/03/2013. 3. District Collector and District Mining officer will be held responsible individually for non compliance of the conditions stipulated in the Environmental clearance and shall be liable for legal action under Environment (Protection) Act of 1986. 4. District Collector will take bank guarantee upto 2'Yoof the total auction cost for the given auction period from project proponent to ensure the compliance of the conditions stipulated. In case of violation of stipulated conditions by project proponent bank guarantee so obtained shall be forfeited and legal action under the law should be initiated against such project proponent. 5. The depth of sand layer to be mined, after retaining 2 m minimum layer below, should not be more than 2 meters as per Government Resolution of RevenueDepartment dated 12th March 2013 e.g. if the total depth of sand is 3 m, only up to one metre of sand shall be mined. 6. It shall be ensured that excavation of minor mineral does not disturb or change the underlying soil characteristics of the river bed /basin, where mining is carried out. 7. It shall be ensured that mining does not in any way disturb the turbidity, velocity and flow pattern of the river water. 8. A siltation study should be carried out before commencement of the mining activity or within a period of one year through some expert Agency like NIO/CWPRS to determine the siltation load so that there is no over exploitation of the material at any point of time. The mineral to be removed shall be determined based on siltation load. This study shall be steered by competent authority while granting further mining lease and or renewing of the license. A copy of siltation study shall be submitted to the Environment Department, the District Mining Officer and respective Regional Office of the State Pollution Control Board. 9. It shall be ensured that there is no fauna dependant on the river bed or areas close to mining for its nesting. 10. Turtle nesting units' conservation is very important. Therefore sand mining in such areas is to be prohibited. 11. The green belt development/tree plantation will be made in an area of 20'Yoof the total leased area either on river bank or along road side. 12. Measure for prevention & control of soil erosion and management of silt shall be undertaken. Protection of dumps against erosion, if any, shall be carried-out with geo textile matting or other suitable material. 13. District Collector and Project proponent to ensure that there is no violation of the Supreme Court order and orders of the National Green Tribunal given in the related matters.

1. Precise mining area will be jointly demarcated at site by officials of Mining/Revenue department prior to mining operations for all proposals under consideration. Such site plan, duly verified by competent authority shall be submitted to Environment Department. 2. All necessary statutory clearances shall be obtained before start of mining operations. 3. Depth of mining shall be restricted to 3 m or water level whichever is less. 4. No mining shall be carried out in the streams. 5. Mining shall be limited to day hours time only. The loading shall not be done during night hours. 6. No mining shall be carried out in the safety zone of any bridge and/or embankment. 7. No mining shall be carried out in the vicinity of natural/ manmadearchaeological sites. 8. The lease holder shall obtain necessary prior permission of the competent authorities for drawal of requisite quantity of water (surface water and groundwater), if required for the project. 9. Waste water, if any, shall be properly collected and treated so as to conform to the standards prescribed by MoEF/CPCB. 10. No wildlife habitat will be infringed. 11. Environmental clearance is subject to obtaining clearance under the Wildlife (Protection) Act, 1972 from the competent authority, if applicable to this project. 12. Green belt development shall be carried out considering CPCBguidelines including selection of plant species and in consultation with the local DFO/Horticulture Officer. 13. Parking of vehicles should not be made on public places. 14. Transportation of materials shall be done by covering the trucks / tractors with tarpaulin or other suitable mechanismso that no spillage of mineral/dust takes place. 15. Appropriate mitigation measures shall be taken to prevent any kind of pollution in consultation with the Maharashtra Pollution Control Board. It shall be ensured that there is no leakage of oil and grease from the vehicles used for transportation. 16. Vehicular emissions shall be kept under control and regularly monitored. The mineral transportation shall be carried out through the covered trucks only and the vehicles carrying the mineral shall not be overloaded. 17. Special Measures shall be adopted to prevent the nearby settlements from the impacts of mining activities. Maintenance of roads through which transportation of minor minerals is to be undertaken, shall be carried-out regularly. 18. Dispensary facilities for first-aid shall be provided at site. 19. Occupational health surveillance program of the workers should be undertaken periodically. 20. Provision shall be made for housing the workers at site, if required, with all necessary infrastructure and facilities such as fuel for cooking, safe drinking water, medical health care and sanitation etc. 21. Ambient air quality will be monitored at the site and the nearest habitation in the months of January, April and November. Ambient air quality at the boundary of the precise mining area shall conform to the norms prescribed by MoEF, GOI. 22. Measures shall be taken for control of noise level to the limits prescribed by CPCB 23. An Environmental Audit shall be annually carried out during the operational phase and t1s1eIlatl:submitted to the Environment Department.

24. Year wise expenditure shall be reported to the Regional Office, Ministry of Environment and Forests, Bhopal. 25. Revenue Authorities shall submit within 3 months their policy towards address (i) Standard operating process/ procedure to bring into focus any infringement/deviation /violation of environmental norms /conditions, (ii) Hierarchical system or Administrative order to deal with environmental issues and ensuring compliance of EC conditions and (iii) System of reporting of non compliance/violation of environmental norms to the District collector. 26. The Mining officer shall submit six monthly reports in hard and soft copy on the status of compliance of the stipulated environmental clearance conditions including results of monitored data (both in hard & soft copies) to the Environment department and the District Collector, the respective Regional Office of the Maharashtra Pollution Control Board. 27. Any change in mining area, khasra /Gat numbers, entailing capacity addition with change in process and or mining technology, modernization and scope of working shall again require prior Environmental Clearance as per provisions of EIA Notification, 2006 (as amended). 28. SEAC appraised the proposals on the basis of information submitted by concerned District Mining Officer. Mining Officer shall submit the list of blocks satisfying conditions stipulated above to Revenue & Environment dept. The list of blocks and conditions stipulated above shall be made available in public domain. It should be published in two local language newspapers and display at each block where mining operation is proposed. District Collector shall prepare closure plan and get it approved by the competent authority for all abandoned mines in the District.
