CIEL-2 SATELLITE NOW OPERATIONAL Satellite Completes all Testing and Begins Commercial Service at 129 Degrees West February 5th, 2009 – Ottawa, Canada – The Ciel Satellite Group today announced that its first communications satellite, Ciel-2, has completed all in-orbit testing and has now entered commercial service at the 129 degrees West Longitude orbital position. The new satellite was launched last December 10 from the Baikonur Cosmodrome in Kazakhstan, and will be providing high-definition (HD) television services to the North American market, primarily for anchor customer DISH Network Corporation. “We are very pleased that Ciel-2 has successfully completed all of its initial testing, and are excited about its entry into commercial operations,” said Brian Neill, Executive Chairman of Ciel. “The support of many parties, particularly our shareholders and Industry Canada, has been central to our success, and we look forward to a bright future of serving customers for many years to come throughout North America.” About Ciel-2 Built by Thales Alenia Space, Ciel-2 is the largest Spacebus class spacecraft ever built, weighing 5,592 kg at launch; Ciel-2 is expected to operate for at least 15 years. The new BSS spacecraft is capable of serving all regions of Canada visible from 129 degrees West, as well as the larger North American market. The Ciel Satellite Group was awarded the license for 129 degrees West by Industry Canada in October 2004. Ciel-2 will be operated from the new Satellite Operations Centre at SED Systems located in Saskatoon, Saskatchewan, Canada. The Ciel-2 satellite is designed to provide 10.6 kilowatts of power to the communications payload at end of life, which consists of 32 Ku-band transponders.

Polka issued the following statement on Jan. 30 commending the Federal Communications Commission on adoption of the Rural Digital Opportunity Fund (RDOF): “Over the past decade, the FCC has made great progress in evolving its high-cost universal service programs so that existing providers are not overbuilt and funds are awarded more cost-effectively to providers offering higher- performance broadband service. Today’s adoption of the Rural Digital Opportunity Fund by the FCC is a significant step in that evolution. “By adopting a challenge process to ensure eligible areas are unserved and by using the ‘budget clearing round’ approach to awarding funds in the auction, the FCC will further ensure that residents and businesses at millions of unserved locations receive broadband service that is reasonably comparable to the service urban consumers receive. United States Government Accountability Office Washington, DC 20548 March 23, 2012 Congressional Committees Subject: To Date, DISH Network Is Cooperating with the Court-Appointed Special Master’s Examination of Its Compliance with the Section 119 Statutory License This report responds to the requirement, enacted in the Satellite Television Extension and Localism Act of 2010 (STELA),1 mandating that the Comptroller General monitor and periodically report on the degree to which DISH Network (DISH)2 is complying with the Special Master’s3 examination of its compliance with the royalty payment and household eligibility requirements of the Section 119 statutory license.4 To respond to this mandate, we interviewed the Special Master and representatives of DISH, the National Association of Broadcasters (NAB), and the U.S. Copyright Office, and analyzed documents provided by these individuals. We found that, to date, DISH is complying with the Special Master’s examination. In particular, DISH provided the Special Master with information on its subscribers and royalty payments, and is cooperating with NAB on a survey of all major network-affiliated television stations nationwide. Background The television broadcast industry provides free over-the-air programming to the public through local television stations; this is known as the primary transmission of the programming. However, more than 30 million U.S. households have access to broadcast programming through subscriptions to direct broadcast satellite (DBS) service.5 When a DBS operator provides its subscribers with access to broadcast programming, it is providing a secondary transmission of the programming. Because the broadcast programming is copyright protected, a license is required to secure the public performance rights for the secondary transmission of these works.6 Under existing law, two statutory licenses permit DBS operators, such as DISH or 1Public L.

By this Notice, we remind MVPDs of this recurring obligation—the deadline for which falls on Thursday, September 30, this year—and identify in the following pages those employment units that must complete the Supplemental Investigation Sheet (SIS). The Form 396-C also designates those filers required to submit the SIS with a check mark in Section I labeled “Supplemental Investigation Sheet attached”.
