Washington, DC 20510 Dear Majority Leader McConnell: Thank you for your swift action to hold hearings and to make certain that each Senator has the opportunity to consider the President’s nomination to fill the open seat on the Supreme Court of the United States. It is of utmost importance that the Supreme Court has a full nine-member court before Election Day on November 3, 2020. Maintaining the integrity and credibility of our elections is of paramount significance to each of us as our state’s respective chief election official. Americans must be able to exercise their constitutional right to vote with confidence, knowing their ballot will be counted for the candidate of their choice. In the case an election issue is challenged in court, America cannot afford a tie vote. We must be able to report election results in a timely, secure, and efficient manner as we have done before. The Honorable Amy Coney Barrett is an outstanding nominee for consideration for a vacancy on the Supreme Court of the United States. She brings with her an unblemished record and extensive experience as a litigator and distinguished professor of law at the University of Notre Dame. Her philosophy and tried and true beliefs of upholding the constitution and the laws of our nation as written make her an excellent choice for our nation’s highest court. -

Kim Wyman (R-WA) WHEREAS, the 2020 election cycle was the most challenging in recent memory, with a global pandemic and multiple natural disasters affecting numerous states and their election infrastructure and processes; and WHEREAS, election workers across the country worked tirelessly under difficult conditions to ensure a fair, safe and accurate election for the more than 155 million voters in November; and WHEREAS, based upon unrelenting misinformation and disinformation from both domestic and foreign sources, extremists have taken to threatening and endangering election workers, from Secretaries of State, state election directors, local election officials and election workers; and WHEREAS, the cornerstone of our republic is the right of Americans to vote in a safe, secure and accurate election, and their exercising of that right; and WHEREAS, election workers are a vital part of ensuring the exercise of that right for all eligible Americans; and WHEREAS, violence and violent threats directed at Secretaries of State, their families, staff, and other election workers is abhorrent and the antithesis of what our nation stands for. -

The Reilly Center’s mission is to generate thoughtful programs, dialogue, and research about mass communication and its many faceted relationships with social, economic, and political issues. Evident in everything the Center does is its commitment to strengthen and advance the Manship School’s national leadership in media and politics. The Center’s agenda is diverse and fluid – from the annual John Breaux Symposium, which brings in national experts to discuss a topic that has received little or no attention, to conducting the annual Louisiana Survey, a vital resource for policymakers, which tracks advancements and regressions of citizen attitudes about state services. At minimum, we urge you to propose the extension of the Emergency Election Plan in effect for the spring 2021 elections.3 We also encourage you to incorporate the recommendations in this letter into any emergency plan for all future elections carried out during the evolving phases of this global pandemic. -

Barriers to Voting in Louisiana A Briefing Paper by the Louisiana Advisory Committee for the United States Commission on Civil Rights June 2018 Advisory Committees to the U.S. Commission on Civil Rights By law, the U.S. Commission on Civil Rights has established an advisory committee in each of the 50 states and the District of Columbia. The committees are composed of state citizens who serve without compensation. The committees advise the Commission of civil rights issues in their states that are within the Commission’s jurisdiction. More specifically, they are authorized to advise the Commission in writing of any knowledge or information they have of any alleged deprivation of voting rights and alleged discrimination based on race, color, religion, sex, age, disability, national origin, or in the administration of justice; advise the Commission on matters of their state’s concern in the preparation of Commission reports to the President and the Congress; receive reports, suggestions, and recommendations from individuals, public officials, and representatives of public and private organizations to committee inquiries; forward advice and recommendations to the Commission, as requested; and observe any open hearing or conference conducted by the Commission in their states. The Committee submits this report as part of its responsibility to study and report on civil rights issues in the state of Louisiana. Washington, D.C. 20549 Re: Shareholder Proposal to Pfizer Inc. Regarding congruency of political contributions on Behalf of Tara Health Foundation Ladies and Gentlemen: Tara Health Foundation (the “Proponent”) is beneficial owner of common stock of Pfizer Inc. (the “Company”) and has submitted a shareholder proposal (the “Proposal”) to the Company. I have been asked by the Proponent to respond to the supplemental letter dated January 25, 2021 ("Supplemental Letter") sent to the Securities and Exchange Commission by Margaret M. Madden. A copy of this response letter is being emailed concurrently to Margaret M. Madden. The Company continues to assert that the proposal is substantially implemented. In essence, the Company’s original and supplemental letters imply that under the substantial implementation doctrine as the company understands it, shareholders are not entitled to make the request of this proposal for an annual examination of congruency, but that a simple written acknowledgment that Pfizer contributions will sometimes conflict with company values is all on this topic that investors are entitled to request through a shareholder proposal. The Supplemental letter makes much of the claim that the proposal does not seek reporting on “instances of incongruency” but rather on how Pfizer’s political and electioneering expenditures aligned during the preceding year against publicly stated company values and policies.” While the company has provided a blanket disclaimer of why its contributions may sometimes be incongruent, the proposal calls for an annual assessment of congruency. -

As a result of the 2019 elections, Mississippi will move up 4 spots in our state rankings, from 49th to 45th, and Louisiana will move up from 47th to 44th. Both states remain in the bottom 10 states for women’s representation in state legislatures. Virginia, which saw a modest gain in women’s representation, will move from the 31st to the 25th spot, and New Jersey, which saw no change in the number of women in its legislature, will return to the 21st spot in CAWP’s rankings after briefly being 17th due to a woman filling a vacancy by appointment at the end of 2019. KENTUCKY RESULTS Elections were held for Kentucky’s statewide executive offices, and women candidates competed in the general election races for lieutenant governor, secretary of state, auditor, and treasurer. Of these, Jacqueline Coleman, running on a joint ticket with gubernatorial candidate Andy Beshear, won her election for lieutenant governor, and Republican incumbent State Treasurer Allison Ball won re- election. -

Louisiana State Background Brief Introduction Louisiana has been on the front lines of climate change for decades. The state is vulnerable to sea-level rise and hurricanes and faces increasing risk from inland flooding and extreme heat. Despite ranking fifth in carbon dioxide emissions per capita, Louisiana has not committed to reducing emissions from its industrial sector (EIA 2019). The state’s signature climate change document, its Coastal Master Plan, is an ambitious adaptation plan that enjoys widespread popularity. The state’s economy is heavily reliant on fossil fuels, though the sector is less dominant than at any point in the past 80 years. Moreover, the state’s low wages, high unemployment rate, and shrinking fossil fuel sector mean that many workers would likely benefit from Just transition policies. Political demand for climate action is growing in some areas of the state. Recent alliances of previously unaffiliated progressive groups demanding a Green New Deal for the Gulf South signify this growing constituency. Policy Landscape Despite its climate vulnerabilities, Louisiana has almost no statewide policies to address climate change. The state has not set targets for renewable energy generation or use, and lawmakers actively oppose any attempts to regulate greenhouse gas emissions at the state or federal level. Foundational Policy: Comprehensive Master Plan for a Sustainable Coast Louisiana’s only climate change-focused policy is its Coastal Master Plan. The Plan calls for $50 billion to be spent over the next $50 years to rebuild the state’s wetland buffer to protect against flooding from sea-level rise and storm surges (CPRA 2017c). -

PLAINTIFFS’ JOINT MEMORANDUM IN OPPOSITION TO JURISDICTIONAL ARGUMENTS IN STATE’S AND PARISH REGISTRARS OF VOTERS’ MOTIONS TO DISMISS Plaintiffs in these consolidated cases1 hereby present their joint memorandum in opposition to jurisdictional arguments raised by the State of Louisiana’s (“State”) and Parish Registrars of Voters’ (collectively, “Defendants”) Motions to Dismiss, ECF Nos. 29, 31, as they pertain to the claims in Plaintiffs’ pending motions for preliminary injunction.2 Accordingly, 1 Plaintiffs in the Clark v. Edwards case are Telisa Clark, Lakeshia Barnett, Martha Christian Green, Crescent City Media Group (“CCMG”), and League of Women Voters Louisiana (“LWVLA”) (collectively, “Clark Plaintiffs”). Plaintiffs in the Power Coalition for Equity & Justice v. Edwards case are Power Coalition for Equity and Justice (“PCEJ”), Louisiana State Conference of the NAACP (“Louisiana NAACP”), Jane Chandler, Jennifer Harding, Edith Gee Jones, and Jasmine Pogue (collectively “Power Coalition Plaintiffs”). 2 Plaintiffs will respond to the non-jurisdictional arguments raised in these motions in accord with the schedule set forth under the Local Rules. Case 3:20-cv-00308-SDD-RLB Document 36 06/11/20 Page 2 of 29 Plaintiffs respond to Defendants’ contentions that the Court lacks subject matter jurisdiction to adjudicate the pending motions for preliminary injunction because: (1) Plaintiffs lack standing due to a lack of (a) injury in fact, (b) traceability, and/or (c) redressability; and (2) that the case is barred by the Political Question Doctrine.
