INFORMATION on the enforcement of the judgment of the European Court of Human Rights in. case no. 19664/07Velichko v. R ussia (judgment of 15 January 2013, final on 27 May 2 0 ß )

Violation

In its judgment in caseVelichko v. the European Court of Human Rights found a violation of Article 3 of the Convention for the Protection of Human Rights and Fundamental Freedoms on account of improper conditions of the applicant’s detention in the temporary detention facility; Article 5 §§ 1 and 3 of the Convention - on account of S. Velichko’s unlawful detention due to non-compliance with the principle of legal certainty and quashing by the way of supervisory review of the court decision ordering the applicant’s release on bail; excessively length of the applicant’s pre-trial detention under the court's orders which contained no sufficient grounds for imposing of the restrictive measure. The amount was fuly paid on 08.07.2013 in roubles according to the exchange rate ai the date of the payment (payment order no. 1246899 for RUB 517,144.80).

2. By the judgment of the Presidium of the Supreme Court of the Russian Federation of 16 April 2014 the criminal proceedings against S. Velichko were reopened in view of the new circumstances and the court decisions concerning restrictive measures, delivered in respect of the applicant earlier, were quashed. In relation with the violation, the European Court awarded to S. Velichko the compensation of non-pecuniary damage and legal costs and expenses, which, as it was mentioned above, was paid by the Russian authorities to the applicant in full. According to the Murmansk Regional Court, neither the applicant nor his representative filed any applications with the courts after the European Court's judgment became final. No other individual measures are required.

General Measures:

1. The European Court found a violation of Article 3 of the Convention on account of inadequate conditions of the applicant's detention in the temporary detention centre of the Department of the Interior of in the Murmansk Region (the cells of the temporary detention facility did not have a window, toilet and offered no access to natural light or air). • After the event in question, the Russian authorities took measures to ensure proper conditions of detention in the above temporary detention centre. In 2007 and 2011, the temporary detention centre of the Department of the Interior of Severomorsk in the Murmansk Region was completely overhauled. At the moment, all the cells of the above temporary detention centre are equipped with the toilets complying with all the necessary privacy requirements, basins with running water, radio speakers to broadcast the public state programme, tables for having meals, lockers for storing personal belongings and food, day and night lighting, individual sleeping places (in compliance with the sanitary space requirements of 4 sq m per person), windows providing natural lighting; the floor covering is replaced with new one and the induction ventilation system is refurbished. The suspects and accused held in the above temporary detention centre are provided with bedding that is regularly disinfected. The regime and conditions of detention of the suspects and accused in the temporary detention centre of the Department of the Interior of Severomorsk are daily monitored by the senior officials of intermunicipal division of the Ministry of Interior for Severomorsk and by the officers of the Prosecutor's Office of Severomorsk closed city. Following the inspection, no complaints from the detainees of the temporary detention centre were received and no violations were found. Moreover, at present the Department of the Ministry of Interior for the Murmansk Region is in the process of developing of design estimate documents for construction in 2014-2015 of a new temporary detention centre of the intermunicipal division of the Ministry of Interior for Severomorsk closed city that would accommodate 50 persons. 2. In view of the violations of Article 5 §§ 1 and 3 of the Convention found by the European Court, the Murmansk Regional Court (i.e. in the region where the violations had been committed) held the seminars for the judges of the Murmansk Region devoted to study of the European Court's judgmentVelichko in case v. Russia and the European Court's case law in similar cases.

Pursuant to the Regulations on Representative of the Russian Federation at the European Court of Humans Rights - the Deputy Minister of Justice of the Russian Federation approved by the Decree of the President of the Russian Federation of 29 March 1998 no. 310, the European Court’s judgmentVelichko in case v. Russia was forwarded to the Constitutional Court of the Russian Federation and competent state authorities (the Supreme Court of the Russian Federation, the Murmansk Regional Court, the General Prosecutor's Office of the Russian Federation, the Ministry of Interior of the Russian Federation, the Investigative Committee of the Russian Federation, the Federal Security Service of the Russian Federation, the Federal Drug Control Service of the Russian Federation) for practical consideration and application of general measures under their jurisdiction in order to prevent the violations found by the Court in future.
