On behalf of the dedicated officers and staff of the Elgin OPP Detachment, it gives me great pleasure to present the 2017 Annual Report. This report will demonstrate the high level of commitment Elgin County OPP has brought to all municipalities of the Elgin Group. Elgin officers and staff have worked in partnership with many stakeholders including our partners in the Provincial and Ontario Courts, Family and Childrens Services, The Ministry of Natural Resources, neighboring OPP Detachments and Municipal Police Services, and the dedicated members of our Community Policing Committees, to deliver a “community first” policing service. Fishleigh In 2017 Elgin OPP continued to focus on service delivery using the Ontario Mobilization and Engagement Model of Community Policing. We have engaged our community partners and stakeholders to form

collaborative partnerships and develop strategies that will allow us to respond more effectively to social issues like mental illness, domestic violence, and issues involving youth.

With the continued support of the Police Services Board, Municipal Councils, and our Community Policing Committees, Elgin County OPP will continue to provide a service that is professional, transparent, and appropriate to the circumstances, respecting the individual dignity of all persons.

Elgin County OPP Detachment has undergone many changes in 2017. We have combined our Property Crimes officers and Drug officer to form a Street Crime Team that works in partnership with our neighbouring Middlesex Detachment. The Elgin County Auxiliary Unit also experienced numerous changes in 2017and is led by S/Sgt, Jeff Lister. Our Auxiliary unit is currently at 13 members and we continue to recruit for future openings. The unit continues to provide a great service to the community as you will see later in this report.

The Elgin Auxiliary unit had a net gain of 1 member in 2017 bringing the compliment to 14. Two auxiliaries were hired on as regular O.P.P. recruit constables. Our members participated in over 40 events ranging from food drives to tractor pulls and staffed 30 marine unit shifts. 2017-2019 Action Plan Our Annual Business Plan has been changed to a three year Action Plan to coincide with the new OPP three year Strategic Plan. Our 2017-2019 Action Plan priorities as identified with community and Police Service Board consultation are: Crime - Reducing victimization resulting from Domestic Violence and related occurrences - Reduction in property crimes including Break & Enters and theft from motor vehicles - Reducing victimization from cyber and /or technology-enabled crime Drugs - Continued emphasis on drug investigations focusing on trafficking and drugs in schools Traffic - Concentrating on The Big Four; impaired driving, speeding/aggressive driving, inattentive/ distracted driving, and seat belt use. - Motorcycle related collisions - Animal related collisions Other - Marine patrol and emergency response on - Response to persons with mental illness or crisis - Reducing 911 pocket dials - Reducing false alarms

Crime Management Plan Elgin County Detachment has a comprehensive Crime Management Plan that is administered through the leadership of Regional Detective Sergeant Tim Mason. The Crime Unit includes four detectives assigned to major case investigation and officers assigned to the new Street Crimes Unit investigating property crimes and drug investigation.The Domestic Violence Investigator position has been bundled with the Community Mobilization and Engagement Officer and is supervised by the Detachment Sergeant. The Crime Unit is responsible for oversight and investigation of all serious crimes that occur in our detachment area. The foundation of the plan supports the OPP Results Driven Policing methodology and focuses on public safety through crime prevention and investigative excellence.

Traffic Management Strategy Elgin County Detachment has developed a Traffic Management Strategy with a goal of reducing motor vehicle collisions, specifically those that result in injury and death. Our focus in 2017 continued to be enforcement and education around aggressive driving, impaired driving, seat belt use, and distracted driving. These four driving habits are within complete control of the driver and together can have the largest impact on road safety. Elgin County Detachment continues to employ a Traffic Team designated to traffic enforcement. Our Traffic Team is dedicated to be responsive to community identified traffic issues as well as issues identified through analysis by our Detachment Analyst. Using analytics provided by our Detachment Analyst and the Focused Patrol program the traffic team will continue to focus their efforts where they are most needed and can have the greatest impact on traffic safety. We continue to work with our community partners to address the high number of car/deer collisions in Elgin County.

Community Satisfaction Survey Year: 2017

1. 98.4% of respondents felt “very safe” or “safe” in their community.

2. Of the 98 respondents (or 25.9%) who said they had contacted the OPP in the past year, 89.9%

were “satisfied” or “very satisfied” with the ease of contacting the OPP.

3. Overall, 93.4% of respondents were “very satisfied” or “satisfied” with the quality of police service

provided by the OPP.

4. 91.9% of respondents were “satisfied” or “very satisfied” with the OPP’s ability to work with

communities to solve local problems.

5. 83.8% of respondents were “satisfied” or “very satisfied” with the OPP’s visibility in the community.

Community Policing Committees

Elgin County OPP is very blessed to have a strong network of Community Policing Committees to represent the municipalities we serve. We work in partnership with our committees to identify and resolve issues of crime and traffic that are identified by the community. In addition, our committees volunteer countless hours of their time to support many community initiatives, particularily those that assist children, the elderly and vulnerable groups. Elgin County has six Community Policing Committees located in West Elgin, Southwold, Port Stanley, Belmont, Malahide, and . Elgin County OPP is very appreciative of the hard work all of our committees do to support their community and the OPP. In 2017 we continued to work with our committees using the Ontario Mobilization & Engagement Model of Community Policing and all committees are now using the model as a guide to assist them in setting priorities and objectives.

7 Inspector Brad Fishleigh, Page 16 of 139 Elgin County OPP Community Safety Officer Constable Adam Crewdson continued in the role of Community Safety Officer (CSO) for the Elgin County Ontario Provincial Police (OPP) this year. This year we had great successes and strengthened partnerships with media outlets and other community partners. The schools were well served by the Knowledge Influences Decisions and Situations (KIDS) program throughout the County. This program is similar to the Values Influences and Peers programs that other police forces use with the grade 6 classes. Cst Crewdson was asked by the Thames Valley District School Board (TVDSB) and the London Catholic District School Board (LCDSB) to come and help with training of the new grade 6 teachers. This training showed what the program is about and how it is implemented by the OPP throughout the varying Counties the school board operates in. This was a great showing of how Adam continues to work together with other stakeholders.

Adam continues to spend a day a week at the West Elgin High School supporting the high school and students at West Elgin. He took part in the Advice from the Ocean event, which was student lead, that saw mental health services and emergency responders come together for a fun activity filled day at Miller Park in West Lorne. Adam continues to increase our Social media presence at the West Region level. He has continually advocated for an Elgin presence on social media platforms. He has been featured on Facebook live with My FM in St. Thomas on Marine Safety, the OPP recruitment page, and other community partner’s pages.

Elgin OPP was pleased to participate again this year in the Racing Against Drugs (RAD) event. This event provides knowledge to elementary school youth about the dangers of drugs in our society. It is a partnership with the TVDSB and the LCDSB. Youth from all schools in Elgin County, St. Thomas, and Aylmer attend this event. Cst. Crewdson played a key role in facilitating the overall groups in addition to the OPP pit stop. It was a very busy week, with lots of energy, well worth the impact it has on our community’s youth.

Constable Crewdson was highly involved throughout our communities in Elgin County. He partnered with the Ontario Early Years Center visiting the children and families that attended the drop in events throughout the County. These visits have Adam speaking with the young children, showing them his police cruiser, and reading the group a children’s book. Adam was able to visit groups in West Lorne, Straffordville, and Port Burwell. He is looking forward to connecting with all groups offered throughout the rest of our communities.

Constable Crewdson also dropped in on the Home Alone Programs. These programs are run by the YWCA and are for youth ages 9-12. They cover a variety of topics from kitchen safety to how to handle emergencies. Adam attends to answer the youth’s questions about how the police would react to certain situations and provide information on how the children can keep themselves safe. Public safety and community well-being is a strong passion for Adam. This is another example of how he has connected with community stakeholders in our community.

During the summer months when school was out, Cst. Crewdson continued to support detachment goals by being an active member of our Marine Operators out on Lake Erie within the water ways of the County. Again he brought his enthusiasm to the program by taking members of the media on the water and being active on social media.

Cst. Crewdson was also active with the Crime Stoppers of London-Elgin-Middlesex as one of their coordinators. Adam assisted the organization with tips, media events, and overall regional goals for the program. As you can see Cst. Traffic Safety

The safety of motorists on Elgin County roads has always been a priority for Elgin Detachment. Our Traffic Management Team is dedicated to enforcement and response to traffic complaints within the County. Officers conducted 196 static RIDE checks in 2017, in addition to other tactics used to identify and remove impaired drivers. Festive RIDE was in operation from Nov 20th to Jan 6th. During that time officers conducted 119 RIDE checks charging 8 impaired drivers and issuing 5 three day suspensions. As you can see from the Motor Vehicle Collision chart below, we have seen a slight increase in total crashes in 2017 with slightly more personal injury crashes. We will continue to use statistical analysis and focus on targeted enforcement of Impaired Driving, Aggressive Driving, Seat Belt Use, and Distracted Driving. These four factors can often be the difference between a minor crash with no injuries and a major crash resulting in injuries or death. Of the crashes we experienced in Elgin County in 2017:

Elgin County Detachment has 5 qualified marine operators conducting marine patrols, supported by a summer marine student and the Elgin Auxiliary Unit. The Marine Unit is out early for the May long weekend to ensure the boating public is ready for the boating season with properly equipped vessels and properly qualified captains. Officers are on the water patrolling every weekend and attend water related community events including Can-Fest, Harbourfest and Tall Ships in Port Stanley and Tub Daze in Port Burwell. The marine unit is responsible for approximately 450 square kilometers of Lake Erie and covers approximately 100 km of shoreline along the north shore of the Lake. A large component of this goal is the pro-active education provided through media outlets and presentations provided by our CSO. We continue to follow the principles of Intelligence Led Policing and are also committed to the Crime Abatement Program which centres on ensuring repeat offenders abide by the conditions placed on them by the courts upon their release. Elgin Detachment has shifted from a “Directed Patrol” program to a more specific “Focused Patrol” program. Using analytics from the Detachment Analyst we identify areas of concern and assign officers to specific focused patrols related to crime and traffic trends. This not only acts as a deterrent to crime but also helps to have a car at the right place at the right time to respond to crime and increase our odds of catching criminals in the act.

Break & Enter We experienced an increase in Break & Enters in the central and east end of the county in 2017 and an overall increase of 26 across the county.

Domestic Violence Our domestic violence occurrences in Elgin County have remained fairly consistent with the lower numbers experienced in previous years except for an increase in Central Elgin. In 2017 we have continued to work with our partner agencies, like Violence against Women Services Elgin County, to increase awareness and education and provide alternative services from the community. 80

This program has been very successful in 2017, handling 1826 tips that resulted in the clearance of 39 criminal cases, 71 criminal charges, over $43,000 in recovered property, 9 weapon seized, and over $83,000 in seized drugs.

R.I.D.E. Grant Each year Elgin County OPP completes an application for a RIDE Grant through Mothers Against Drinking and Driving. In 2017 Elgin OPP received $13,618.00 and all of that grant money has been spent to provide officers at RIDE checks throughout the County, with the bulk of those checks occurring during the Festive RIDE Season. We are very proud and appreciative to be partners with Mothers Against Drinking and Driving in the fight to keep impaired drivers off our roadways.

BACKGROUND: At its June 2013 Planning meeting, Council received a deputation from Tom Marks regarding the possible severance of the valley lands on his property at 44382 Ferguson Line. The purpose of the proposed severance was to donate the lands to the Kettle Creek Conservation Authority ( KCCA) for their long term management and protection as natural open space. The lands offer an opportunity for the KCCA to extend the ownership of the Kettle Creek valley system from St. Thomas northerly to its current limits at the Dan Patterson Conservation area. Council directed staff to meet with Mr. Marks and staff from the KCCA to determine if a scenario could be reached that met with the policies of the Official Plan.

REPORT: After much discussion and meetings with Mr. Marks and KCCA/Municipal staff, a scenario has been negotiated that works in terms of Official Plan policy and Mr. Mark' s desire' s for the future of his family' s property. Attached is an aerial photo showing approximate boundaries with approximate parcel areas and frontages ( all on Ferguson Line).

This scenario involves the severing of a parcel, approximately 42 acres (outlined in green) with 128m of frontage on Ferguson Line, which includes the bulk of the ravine lands and a connecting link or ` bridge just to the north of the home farm to connect the two principle natural heritage areas. It is proposed that the " bridge" would form a wildlife corridor link between the two, to be planted by the KCCA. Mr. Marks and staff discussed the possibility of an agreement

Staff have asked the KCCA to confirm that the width of the " bridge" ( currently shown as approximately 30m) would be adequate for a wildlife corridor purpose.

The severance would leave two retained parcels:

The first, shown in burgundy, includes the bulk of the agricultural lands, which are proposed to remain in agricultural production. This parcel is approximately 69 acres in size with 235m of frontage on Ferguson Line.

The second, shown in yellow, includes the home farm and surrounding lands down to Ferguson Line. This parcel is approximately 9 acres in size with 99m of frontage of Ferguson Line.

Also shown on the photo, in blue, is a potential lot addition to Mr. Mark' s sister's property. This is approximately 1 acre in size and would add about 44m of frontage to her lot.

The lands to be severed are designated Natural Heritage in the Municipality of Central Elgin Official Plan. Council may use its flexibility provisions to interpret the plan relative to the bridge" feature should it support the concept. The policies of the OP for Natural Heritage support efforts towards the long term protection and enhancement of significant woodlands and valleylands. In this regard I believe that this latest scenario is worthy of Council' s consideration and reflects Mr. Mark' s desire' s for the future stewardship olthe valley lands_

1. Official Plan The subject lands are located within the Agricultural designation in accordance with Schedule " A"— Land Use Plan to the Municipality of Central Elgin Official Plan. The Agricultural designation permits small scale agriculture-related commercial or industrial uses which are directly related to the farm operation and are required in close proximity to the farm operation( e.g. grain drying operations). To avoid conflicts with agricultural operations, applications for new agricultural-related uses permitted within the Agricultural designation shall be subject to the following: 1. The proposed use shall be small scale, directly related to the farm operation and required in Gose proximity to the farm operation; 2. There is no suitable alternative site within a Settlement Area or Employment Area identified on the Land Use Schedules; 3. There is no suitable alternative site which avoid Class 1 to 4 lands as defined by the Canada Land Inventory Soil Capability for Agriculture; 4. The site is of a size necessary only to accommodate the proposed use and its servicing requirements; 5. The potential Impacts from any new agriculture related uses on an adjacent agricultural operations shall be mitigated; 6. The regulations of the Open Space Zone 1 ( OS1) permit farm use, rural-residential use, institutional use, home occupations and accessory uses. The minimum lot area required for farm use is 10.11 hectares and the minimum lot frontage required Is 30.48m.

3. County of Elgin Official Plan: The subject lands are located within the Agricultural Area designation in accordance with Schedule" A"- Land Use, to the County of Elgin Official Plan. New lots for agriculture- related uses may be permitted if the local Official Plan supports their creation and provided the new lot is limited to a minimum size needed to accommodate the use and appropriate sewage and water services. Agriculture- related uses for the purposes of the County Official Plan includes small scale farm- related commercial and farm- related industrial uses which are directly related to agriculture and primarily serve the agricultural operation by adding value to, or retaining the value of, an agricultural commodity produced by that operation are deemed to be agriculture- related uses. Such uses may also provide direct service to other agricultural operations in close proximity on a secondary basis. Examples of such uses include, but are not limited to: agricultural storage and processing facilities involving the storage and processing of crops and/ or livestock and/ or related Items( such as cheese and milk) from a local farm operation in the area.

The County OP states that secondary uses such as home occupations are permitted in the Agricultural Area, subject to the policies of the Plan. c) Official Plan Policies: The subject lands are located within the" Agricultural" designation in accordance with Schedule A"— Land Use Plan, to the Municipality of Central Elgin Official Plan. The Agricultural Policies of the Plan permit secondary uses, including rural home occupations, subject to the policies of the Plan. Those policies include:

The special provisions of the 051- 77 zone recognize the existing second house on the subject lands. The standard home occupation regulations of the By-law place significant restrictions on the amount of floor area that can be used for the home occupation, and do not permit any employees. RECOMMENDATION: THAT Report No. CAO- 11- 18 entitled" Compliance Audit Committee— 2018-2022° be received;

AND THAT the attached terms of reference for the Elgin Election Joint Compliance Audit Committee for the 2018 Municipal Election be approved;

AND THAT staff be directed to prepare the necessary by- law to adopt the terms of reference for the 2018 Elgin Election Joint Compliance Audit Committee for the 2018 Municipal Election, as required by the Municipal Elections Act, 2006;

AND THAT Council direct that the annual operating costs of the Elgin Election Joint Compliance Audit Committee be financed through the Elections Reserve.

REPORT The Municipal Elections Act, 1996 ( MEA), as amended, requires that every municipality appoint a Compliance Audit Committee prior to October 1st in the year of a Municipal Election. The following summarizes the requirements for a Compliance Audit Committee as set out in sections 81 and 81. 1 of the MEA:

a Compliance Audit Page 79 of 139 4 Committee - 2018 - 2022 & AL v., Nothing in the legislation precludes municipalities from sharing services of a Compliance Audit Committee. The Elgin municipalities approved a joint Committee for the 2010 and 2014 Municipal Elections. Requests for Compliance Audits are usually not significant in number. To date, there has only been one request received in Elgin County which was related to the 2010 Municipal Election. Based on this information, staff believe there is merit in continuing this joint arrangement. Elgin County Clerks and Deputy Clerks have discussed the benefits and agreed to recommend the establishment of a Joint Compliance Audit Committee again for the 2018 Municipal Election.

The powers and functions of a Compliance Audit Committee are as follows: consider a compliance audit application received by an elector and decide whether it should be granted or rejected if the application is granted, appoint an auditor to conduct a compliance audit receive the auditor' s report consider the auditor's report and if the report concludes that the candidate appears to have contravened a provision of the MEA relating to election campaign finances, the committee may commence legal proceedings against the candidate for the apparent contravention if the report indicates that there was no apparent contravention and the committee finds that there were no reasonable grounds for the application, the council is entitled to recover the auditor' s costs from the applicant consider reports of the Clerk identifying each contributor to a candidate for office on a Council or a registered third party who appears to have contravened any of the contribution limits under the MEA, the committee may commence legal proceedings against the candidate for the apparent contravention.

PROCESS All election candidates are required to file provincially- prescribed financial statements with the Clerk detailing their campaign financing activities. An eligible elector who believes, on reasonable grounds, that a candidate has contravened the MEA, relating to campaign finances, may apply for a compliance audit of the candidate' s election campaign finances.

The application must be made in writing to the Clerk, including the reasons for the elector' s belief that the candidate has contravened the MEA and must be made within 90 days after the latest of: a) the filing date; b) the candidate' s supplementary filing date, if any; c) the filing date for the final financial statement; or d) the date on which the candidate' s extension, if any, expires.

COMMITTEE The proposed terms of reference for the Committee are attached to this Report and provides for an Election Joint Compliance Audit Committee composed of at least three( 3) and no more than seven ( 7) members of the public.

It is important that the Election Joint Compliance Audit Committee members possess an in-depth knowledge of the campaign finance rules of the MEA so that they can make independent decisions on the merits of the applications. As the Committee will operate as a quasi- judicial committee, prior experience on a committee, task force or tribunal would be an asset. A Committee composed of professionals such as auditors, accountants, lawyers, academics and other individuals having a familiarity with municipal election campaign financing rules is recommended.

FINANCIAL IMPLICATIONS TO BUDGET The municipality is responsible for any costs resulting from the review of applications submitted to the Election Joint Compliance Audit Committee. These costs include: Committee members' honorarium, which is being recommended to be$ 100. 00 per member, per meeting, plus mileage costs auditor' s costs to perform an audit costs related to the Committee' s operations and activities legal costs related to an appeal to the Ontario Court of Justice with respect to a decision of the Committee legal costs to undertake legal action against the candidate for violations of the elections finance provisions of the MEA.

Compliance Audit Page 80 of 139 Committee - 2018 - 2022 & Factors involved in determining Election Joint Compliance Audit Committee costs include the number of compliance audit applications that are received, the number of meetings that are required to be held, and the complexity of the audits that need to be conducted. It is therefore difficult to pre-determine the costs that will result from the establishment of the Election Joint Compliance Audit Committee process, as the number of applications to be submitted are unknown in advance.

It is recommended that the Elections Reserve be identified as the s. rce of financing for the operational expenses of the Election Joint Compliance Audit Committee.

1. DEFINITIONS

a. Act - means the Municipal Elections Act, 1996, S. O. 1996, c. 32, as amended from time to time.

b. Applicant— means an elector as defined under Section 88. 33( 1) or 88. 35( 1) of the Act who applies for a compliance audit of a candidate' s or third party advertiser' s election campaign finances.

c. Application — means an application for a compliance audit accepted by the Clerk pursuant to Section 88. 33( 2) of the Act.

d. Auditor- means a person appointed by the Elgin Election Joint Compliance Audit Committee to conduct a compliance audit of the election campaign finances of candidates and registered third parties pursuant to Section 88. 33 of the Act.

e. Auditor' s Report - means a report prepared by an auditor regarding the findings of an audit into the election campaign finances of a candidate or registered third party advertiser.

f. Candidate - means the candidate whose election campaign finances are the subject of an application for a compliance audit.

g. Clerk— means the Clerk of a lower tier municipality in Elgin County, or his or her designate.

h. Committee - means the Elgin Election Joint Compliance Audit Committee established pursuant to Section 88. 37 of the Act.

Compliance Audit - means an audit conducted by an auditor, appointed by the Elgin Election Joint Compliance Audit Committee, of a candidate' s election campaign finances; contributions to candidates; registered third parties campaign finances, and contributions to registered third parties.

j. Council — means the Council of a lower tier municipality in Elgin County, including the Council of the Town of Aylmer, Municipality of Bayham, Municipality of Central Elgin, Municipality of Dutton Dunwich, Township of Malahide, Township of Southwold, and Municipality of West Elgin.

k. Municipality— means a lower tier municipality in the County of Elgin, including The Corporation of the Town of Aylmer, The Corporation of the Municipality of Bayham, The Corporation of the Municipality of Central

Compliance Audit Page 82 of 139 Committee - 2018 - 2022 & Elgin, The Corporation of the Municipality of Dutton Dunwich, The Corporation of the Township of Malahide, The Corporation of the Township of Southwold, and The Corporation of the Municipality of West Elgin.

Registered Third Party - means the individual, corporation or trade union whose notice of registration has been certified by the Clerk and whose campaign finances are the subject of an application for a compliance

audit.

2. ENABLING LEGISLATION

Section 88. 37 of the Act requires that before October 1st in an election year, Council establish a Compliance Audit Committee for the purposes of Sections 88. 33, 88. 34, 88.35 and 88.36 of the said Act relative to a possible contravention of the Act's election campaign finance provisions.

3. TERM

The term of office of the Committee is the same as the term of office of Council, being December 1, 2018 to November 14, 2022, and shall serve in the instance of any by-election that may take place during that time.

4. MEETINGS

The Committee will meet as needed, with meetings to be scheduled by the Clerk of the municipality where a compliance audit application is received, in accordance with the MEA requirements. The Clerk of the host municipality shall ensure and verify the validity of the meeting. The Clerk will contact all members to ensure that a quorum of members is able to attend the said meeting. Meetings will be held at the location determined by the Clerk of the host municipality.

The Committee members will select a Chair from amongst its members at its first meeting.

In accordance with the Act, the meetings of the Committee shall be open to the public, but the Committee may deliberate in private.

5. MANDATE

The Committee is required to act in accordance with the powers and obligations set out in the Municipal Elections Act, 1996, as amended ( MEA). The Committee will be required to:

a. consider a compliance audit application received from an elector that a candidate or a registered third party has contravened provisions of the MEA relating to election campaign finances and determine whether it should be granted or rejected;

Compliance Audit Page 83 of 139 Committee - 2018 - 2022 & b. if the application is granted, the Committee shall appoint an auditor to conduct a compliance audit;

c. receive the auditor's report;

d. consider the auditor' s report and if the report concludes that the candidate or registered third party appear to have contravened a provision of the MEA relating to election campaign finances, the Committee may commence legal proceedings against the candidate or registered third party for the apparent contravention; and

e. consider the report(s) of the Clerk identifying each contributor to a candidate for office on a Council or a registered third party who appears to have contravened any of the contribution limits under section 88. 9 or 88. 13 of the MEA and decide whether to commence a legal proceeding against a contributor for an apparent contravention.

6. COMPOSITION

The Committee will be composed of at least three ( 3) and no more than seven 7) members of the public.

Members must possess an in- depth knowledge of the campaign financing rules of the MEA and therefore membership drawn from the following stakeholder groups:

a. accounting and audit— accountants or auditors with experience in preparing or auditing the financial statements of municipal candidates;

b. academic— college or university professors with expertise in political science or local government administration;

c. legal profession with experience in municipal law, municipal election law or administrative law;

d. professionals who in the course of their duties are required to adhere to codes or standards of their profession which may be enforced by disciplinary tribunals; and

e. other individuals with knowledge of the campaign financing rules of the Municipal Elections Act, 1996, as amended.

Pursuant to subsection 88. 37( 2) of the Act, the Committee shall not include:

a. Members of Council or local board;

b. Employees or officers of the Municipality or local board;

d. Any persons who are registered third parties in the Municipality in the election for which the committee is established.

Further, an individual shall be deemed ineligible to be a member of the Committee if they prepare the financial statements of:

a. any candidate running for office on Municipal Council or local board during the term for which the Committee has been established; or

b. any registered third party.

In addition, a Committee Member may not be a contributor or provider of any election- related services to a registered candidate or third party advertiser in the 2018 Municipal Election or any subsequent by-election including but not limited to accounting, legal, auditing, marketing or campaign services.

7. APPOINTMENT PROCESS

All applicants will be required to submit a summary outlining their qualifications and experience.

A Nominating Committee consisting of the Clerks from each of the lower tier municipalities in Elgin County will review and consider all applicants/ applications, and will prepare a proposed Joint Committee membership list for consideration by each of the respective Municipal Councils.

Members will be selected on the basis of the following:

a. demonstrated knowledge and understanding of municipal election campaign financing rules and knowledge of the MEA and related regulations;

b. proven analytical and decision- making skills;

c. experience working on a committee, administrative tribunal, task force or similar setting;

d. demonstrated knowledge of quasi-judicial proceedings;

e. availability and willingness to attend meetings; and

f. excellent oral and written communication skills.

The Members will be appointed by each of the respective Municipal Councils.

Members of the Committee shall be paid an honorarium of$ 100 per meeting, plus mileage at the current mileage rate established by the host municipality. The host municipality shall pay all costs relative to the respective application.

9. STAFF SUPPORT

The Clerk or designate of the host municipality shall act as the Secretary to the Committee and provide support where required.

The Clerk shall establish administrative practices and procedures for the Committee and shall carry out any other duties required under this Act to implement the Committee' s decisions.

10. APPLICATION BY ELECTOR

a. Financial Statements of Candidates

All candidates are required to file provincially prescribed financial statements with the Clerk detailing their election campaign financing activities.

An eligible elector who believes on reasonable grounds that a candidate has contravened a provision of the Act, as amended, relating to election campaign finances, may apply for a compliance audit of the candidate' s election campaign finances, even if the candidate has not filed a financial statement.

The application must be made in writing to the Clerk and include the reasons for the elector' s belief that the candidate has contravened the Act. The application must be made within 90 days after the latest of the following dates:

The filing date ( last Friday in March following the election);

ii. The date the candidate filed a financial statement, if the statement was filed within 30 days after the applicable filing date;

iii. The candidate' s supplementary filing date, if any, ( last Friday in September in the year following the election); or

iv. The date on which the candidate' s extension, if any, expires.

b. Registered Third Parties Financial Statements

All registered third parties are required to file provincially prescribe financial

Compliance Audit Page 86 of 139 Committee - 2018 - 2022 & statements with the Clerk reflecting the registered third party' s campaign finances in relation to third party advertisements.

An eligible elector who believes on reasonable grounds that a registered third party who is registered in relation to the election in the Municipality has contravened a provision of the Act, relating to campaign finances, may apply for a compliance audit of the campaign finances of the registered third party in relation to third party advertisements, even if the registered third party has not filed a financial statement.

The application must be made in writing to the Clerk and include the reasons for the elector's belief that the registered third party has contravened the Act. The application must be made within 90 days after the latest of the following dates:

The filing date ( last Friday in March following the election);

ii. The date the registered third party filed a financial statement, if the statement was filed within thirty ( 30) days after the applicable filing date;

iii. The supplementary filing date, if any, for the registered third party last Friday in September in the year following the election); or

iv. The date on which the registered third party's extension, if any, expires.

11. ROLES AND RESPONSIBILITIES

Sections 88.33, 88. 34, 88. 35 and 88.36 of the Municipal Elections Act outlines the process for Compliance Audits.

a. Compliance Audit of Candidates' Election Campaign Finances

The Compliance Audit Committee will be required to:

within thirty ( 30) days after the committee has received a compliance audit application, consider the application submitted by an elector and received by the Clerk and decide whether it should be granted or rejected;

give notice of its decision to grant or reject the application, and brief written reasons for the decision, to the candidate, the clerk with whom the candidate filed his or her nomination, the secretary of the local board, if applicable, and the applicant;

iv. within thirty ( 30) days after receiving the Auditor' s Report, consider the report and, if the report concludes that the candidate appears to have contravened a provision of the Act relating to election campaign finances, the committee shall decide whether to commence a legal proceeding against the candidate for the apparent contravention; and

v. give notice of the committee' s decision, and brief written reasons for the decision, to the candidate, the clerk with whom the candidate filed his or her nomination, the secretary of the local board, if applicable, and the applicant.

b. Compliance Audit of Contributions to Candidates

The Compliance Audit Committee will be required to:

within thirty ( 30) days after receiving the Clerk' s Report that identifies each contributor to a candidate for office on Council who appears to have contravened contribution limits, consider the report and decide whether to commence a legal proceeding against the candidate for the apparent contravention; and

ii. give notice of the committee' s decision, and give brief written reasons for the decision, to the contributor and to the Clerk of the Municipality or secretary of the local board as the case may be.

c. Compliance Audit of Registered Third Parties' Campaign Finances

The Compliance Audit Committee will be required to:

within thirty ( 30) days after the committee has received a compliance audit application, consider the application submitted by an elector and received by the Clerk and decide whether it should be granted or rejected;

ii. give notice of its decision to grant or reject the application, and brief written reasons for the decision, to the registered third party, the clerk with whom the registered third party is registered, the secretary of the local board, if applicable, and the applicant;

iii. Appoint an auditor, if the compliance audit application is granted, to conduct a compliance audit of the campaign finances of the registered third party in relation to third party advertisements that appear during an election in the Municipality;

iv. within thirty ( 30) days after receiving the Auditor's Report, consider the report and, if the report concludes that the registered third party appears to have contravened a provision of the Act relating to campaign finances of the registered third party in relation to third party advertisements that appear during an election in the municipality, the committee shall decide whether to commence a legal proceeding against the candidate for the apparent contravention; and

v. give notice of the committee' s decision, and brief written reasons for the decision, to the candidate, the clerk with whom the candidate filed his or her nomination, the secretary of the local board, if applicable, and the applicant.

d. Compliance Audit of Contributions to Registered Third Parties

The Compliance Audit Committee will be required to:

i. within 30 days after receiving the Clerk' s Report that identifies each contributor to the registered third party who appears to have contravened contributions limits, consider the report and decide whether to commence a legal proceeding against a contributor for an apparent contravention; and

ii. give notice of the committee' s decision, and brief written reasons for the decision, to the contributor and to the Clerk of the Municipality.

12. APPEAL

The decision of the Compliance Audit Committee may be appealed to the Superior Court of Justice within 15 days after the decision is made and the Court may make any decision the Committee could have made.

SUBJECT: Lake Road Diversion Drain— Urban Assessments

TO COUNCIL: March 26, 2018

RECOMMENDATION. THAT Council of the Municipality provide direction on how urban assessments will be dealt with in regards to the Lake Road Diversion Drain Maintenance Project.

REPORT The Municipality of Central Elgin appointed Jeff Dickson of RJ Burnside to prepare a report under Section 78 of the Ontario Drainage Act for maintenance of the Lake Road Diversion Drain. The Lake Road Diversion Drain is an open ditch drain that starts out near the intersection of George Street & River Road and drains north east outlettting to the Marr Drain at the entrance to Kettle Creek Golf& Country Club. Part of the Section 78 report will include a new assessment schedule to dictate how the drain construction and report will be paid for as well as for future maintenance.

The watershed plan is attached to this report and identifies all the properties included in the Lake Road Diversion Drain watershed. It includes urban residential properties on George Street as well as agricultural and commercial lands to the north. Some residential drainage enters storm sewers which outlet into the natural watercourse north of George Street that eventually enters the Lake Road Diversion Drain. The remainder of the drainage is overland and tile drainage that enters the natural watercourse and drain directly.

In recent years, the Municipality has replaced and repaired Municipal Drains in urban areas including Eastwood and Lyndale and not assessed or billed the urban residents for the work. Typically, municipal drain maintenance and construction is assessed to all landowners in the watershed and they are billed for their assessed portion of the work. Many municipalities in Ontario are now " block" assessing urban landowners in municipal drain watersheds which

Lake Road Diversion Drain - Page 90 of 139 AL Urban Assessments means that all these lands are block assessed to the Municipality and funded through the general taxes rather than individually billed to landowners. Agricultural lands are still assessed and billed as they normally would be. It can be noted that agricultural lands receive a 1/ 3 grant from the Ontario Ministry of Agriculture, Food and Rural Affiars ( OMAFRA) and residential lands pay full price.

RJ Burnside is moving along on the report and it can be filed early in the summer. However, direction on how the Lake Road Diversion Drain will be is assessed is required before the report can be completed. There are two options that council may wish to consider:

Option 1 — Assess and invoice all landowners in the watershed as has traditionally been done, all work is paid for by landowners and nothing hits the general taxes.

Option 2 — Assess urban residential and commercial properties as block assessment to the Municipality which is paid through general taxes, the agricultural properties will be assessed the traditional way and invoiced for the work.
