FINAL REPORT REPUBLIC OF KENYA General Elections 2017 REPUBLIC OF KENYA European Union Election Observation Mission FINAL REPORT General Elections 2017 January 2018 This report contains the findings of the EU Election Observation Mission (EOM) on the general elections 2017 in Kenya. The EU EOM is independent from the European Union’s institutions, and therefore this report is not an official position of the European Union. KEY CONCLUSIONS OF THE EU EOM KENYA 2017 1. The Kenyan people, including five million young people able to vote for the first time, showed eagerness to participate in shaping the future of their country. However, the electoral process was damaged by political leaders attacking independent institutions and by a lack of dialogue between the two sides, with escalating disputes and violence. Eventually the opposition withdrew its presidential candidate and refused to accept the legitimacy of the electoral process. Structural problems and specific electoral issues both need to be addressed meaningfully to prevent problems arising during future elections. 2. Electoral reform needs to be carried out well in advance of any election, and to be based on broad consensus. The very late legal amendments and appointment of the leadership of the Independent Electoral and Boundaries Commission (IEBC) before the 2017 elections put excessive pressure on the new election administration. 3. Despite efforts to improve the situation, there was a persistent lack of trust in the IEBC by the opposition and other stakeholders, demonstrating the need for greater independence and accountability as well as for sustained communication and more meaningful stakeholder consultation. There was improved use of technology, but insufficient capacity or security testing. -

Expected Model & Process of Inclusive Democracy in Nepal Krishna B. Bhattachan, Ph.D. Central Department of Sociology and Anthropology Tribhuvan University Kirtipur, Kathmandu Nepal e-mail: [email protected] Paper presented in an international seminar on The Agenda of Transformation: Inclusion in Nepali democracy organized by the Social Science Baha at Birendra International Convention Centre in Kathmandu, Nepal 24-26 April, 2003 ii Abstract This paper gives a picture of the forest of inclusive democracy in Nepal, which is in the preliminary process of making. The paper begins with an overview of what went wrong in the past and the present in a multi-caste/ethnic, multi-lingual, multi-religious and multi-cultural country, Nepal, as perceived by excluded groups/communities. It identifies that the main socio-cultural-political fault line in the past and the present, irrespective of political systems, is the ideology, policy and practice of Bahunbad (Brahmanism). The main playing fields of Bahunbad discussed in the paper include caste/ethnicity, language, religion, culture, gender and region. This paper analyzes demands made by different excluded groups/communities, including indigenous nationalities, Dalit, Madhesi Hindus and Muslims, women, mother tongue speakers and non-Hindu religious groups, to create a just, equitable and democratic Nepalese society and also to bring positive peace in Nepal. This paper analyzes in detail mechanisms to include excluded groups/communities with focus on interconnection of federalism, proportional representation, autonomy based on caste/ethnicity, language and region and special measures or affirmative action or positive discrimination—remedial and preferential. Grassroots democracy as practiced by some indigenous nationalities is also discussed. -

Based on the research results of the State-level scientific and technological project “Urbanization and the management of the urbanization process in sustainable development in the Central Highlands” (Code TN3/X15), the article will focus on introducing some basic views of the Party and the State of Vietnam on grassroots democracy; then will analyze the participation of urban people in Central Highlands in the process of urban construction, planning and development. The research shows that in the process of urbanization in the Central Highlands;the participation level of the majority of the people is just at the level of the people know, the people discuss; and gradually decreased at the level of the people do and the people check. There exists a difference between the provinces in the Central Highlands about the level of the people’s participation in exercising grassroots democracy. -

But changes in the “exercise of power” have not kept up with changes in the “access to power.” In many communities, township authorities, Party branches, and social forces (such as clans, religious groups, and underworld elements) continue to impede democratic rule. This suggests that a purely procedural definition of democracy is problematic and that democratization depends on the power configuration in which elected bodies are embedded. Putting grassroots democracy into place goes well beyond getting the procedures right, and “high quality” democracy rests on much more than convening good village elections every three years. 2 Path to Democracy? Alila ABSTRACT This analysis traces the historical origins of Luo ethnic factor to lay the basis for a discussion in a separate paper of the role it plays in modern politics. The ethnic factor is seen to siei^e fron social trans formation starting from the precolonial period. And this took place differently in the two research areas Bondo and Gem. Gem evolved as a centralised entity having a common hereditary leadership in which clanisn has all along played a determining role, Bondo comprised of Sakvra, Asembo, Uyoma and Yimbo which evolved as separate entities has had marked hetero- geneity without a common clan system.
