BACKGROUND WBA Champion Guillermo Jones 1. On September 27,2008, Guillermo Jones ("Jones") won the WBA Cruiserweight Title by defeating then Champion Firat Arslan ("Arslán"), by TKO in Altona, Germany. Because Jones was the Official Challenger for the division, his mandatory defense was due within nine (9) months (June 27,2009). 2. On October 2,2010, Jones successfully defended his Title against the then Official Challenger Valery Brudov ("Brudov") in Panama City, Panama. Because Brudov was the Official Challenger for the division, Jones' next mandatory defense was due within nine (9) months (July 2,2011). 3. On November 5, 2011, Jones successfully defended his Title defense against Michael Marrone ("Marrone"), the then #14 ranked fighter in the division. Lateef Kavode 4. On August 6,2010, Lateef Kayode ("Kayode") won the vacant WBO NABO Cruiserweight Title, but was not ranked by the WBA. 5. On October 15,2010, Kayode won the vacant NABF Cruiserweight Title, and was ranked #11 by the WBA. 6. On December 3, 2010, Kayode successfully defended the WBA NABO Cruiserweight Title and was ranked #3 by the WBA. 7. On February 4,2011, Kayode successfully defended the NABF and WBO NABO Cruiserweight Title and was ranked #3 by the WBA. 8. On June 10,2011, Kayode successfully defended the NABF Cruiserweight Title, won the vacant NABA Cruiserweight Title, and was ranked #1 by the WBA. 9. On September 9, 2011, Kayode successfully defended the NABA Cruiserweight Title and was ranked #I by the WBA. Interim Champions - Yoan Pablo Hernandez & Denis Lebedev 10. In September 2011, the WBA Interim Champion, Yoan Pablo Hemandez ("Hemandez") offrcially announced his relinquishment of the WBA Interim Cruiserweight Title, thus the title became vacant. 11. Instead of participating in a bout to determine the vacant WBA Cruiserweight Title, Kayode elected to wait to enforce Jones' mandatory obligations, which were past due at that time. ' 12. On November 4,2011, Denis Lebedev ("Lebedev"), ranked #3 by the WBA, and James Toney ("Toney"), ranked #4by the WBA, participated in a bout to determine the WBA Interim Champion, whereby Lebedev won by unanimous decision. B. CONCLUSION l. Jones' mandatory defense is now overdue by seven (7) months. The leading available contender for most of that period was Kayode and Kayode chose to enforce Jones' mandatory, instead of fighting for the Interim Title. Therefore, an immediate call for a purse bid will be issued for Jones to defend his title against Kayode. 2. The winner of that bout, or Jones if a draw, must defend the title within nine (9) months against Lebedev, or whoever holds the Interim Title at that time. In the meantime, Lebedev is free to participate in a voluntary defense of the Interim Title, so long as it does not conflict or otherwise hinder the defense due against the winner of Jones vs. Kayode in the periods referenced herein. 3. A call for purse bid shall be issued for a bout between Jones and Kayode if the parties have not signed bout contracts on or before March I,20I2. The purse bid shall be scheduled for March 14,2012, Panama City, Panama. The specific time and location for the purse be shall be identified in the call for purse bid. WOB alleges that King, by failing to produce a clean fighter, breached the Agreement.2 King makes two arguments in his defense. First, he argues that the Agreement only required him to “do everything within his control . to cause Jones’s participation”3 — because Jones’s use of furosemide was not within King’s control, it cannot be grounds for breach.
