*4016 T-CARD TRIAL—Mrs Hopwood to Minister for Transport—

(1) What are of the results ofhe recent T-Card trial for school students in the Hornsby electorate? (2) Have there been problems with the project with some students reporting inability of the card to be used on some journeys?

Answer—

The Ministry of Transport advises: (1) and (2) The T-card trial conducted in the Hornsby electorate was one component of a series of field trials. The trial was considered successful and well received by those students involved. The field trials were undertaken to identify and resolve any problems before the technology was introduced to all school travel on private buses in the greater metropolitan area. 1.17 per cent of T-cards distributed in the Shorelink trial were returned as a faulty card and 0.05 per sent were returned as a damaged card.

*4017 ALLOTMENT SIZE—Mrs Hopwood to Minister for Infrastructure and Planning, and Minister for Natural Resources—

When will the Minister make a decision about the Mount Errington (Hornsby electorate) minimum allotment size?

Answer—

I am advised that the Department of Infrastructure, Planning and Natural Resources is currently reviewing a draft local environmental plan prepared by Hornsby Council for land at Mount Errington that would alter the minimum allotment size. The Minister Assisting the Minister for Infrastructure and Planning (Planning Administration), the Hon Diane Beamer MP, will make a decision regarding the draft plan after she has considered the Department’s recommendation.

*4023 NEWCASTLE SYNAGOGUE—Mr Debnam to Minister for Police—

In relation to attacks on the Newcastle synagogue: (1) Was the Newcastle synagogue vandalised on the night of 20 April 2005? (2) Have police investigated the attack? (3) Did the attack include graffiti (including swastikas and the words ‘Jews must die’) anti-semitic stickers being applied to the walls and were windows smashed? (4) Did police identify any fingerprints at the scene? (5) Did the police investigation confirm that witnesses heard smashing of windows and saw two males running down the street? (6) Do police have information that the racist groups White Pride and/or the Patriotic Youth league may have been involved? (7) What is the status of the police investigation and have any charges been laid? (8) Have there been any convictions for attacks on synagogues in NSW in the last ten years?

NSW Police has advised me : (1) to (8) An incident occurred at the Newcastle Synagogue on 20-21 April 2005. Investigations are continuing.

*4024 TRANSPORT SAFETY AND RELIABILITY REGULATOR (ITSRR)—Mr Debnam to Minister for Transport—

In relation to the Independent Transport Safety and Reliability Regulator (ITSRR): (1) Given Minister Costa told Parliament on 29 October 2003 during the second reading of the Transport Legislation Amendment (Safety and Reliability) Bill ‘This bill establishes an Independent Transport Safety and Reliability Regulator. The regulator will be independent of the Ministry of Transport and transport operators’, what statutory or legislative provisions guarantee the independence of the organisation, its personnel, management, reporting, funding or media policy? (2) Are the statutory or legislative provisions for ITSRR different to the statutory and legislative provisions guaranteeing independence for the Auditor General?

Answer—

The Independent Transport Safety and Reliability Regulator (ITSRR) advises: (1) and (2) The Transport Administration Act 1988 states that the principal objective of ITSRR is to facilitate the safe operation of transport services in the State. ITSRR’s independence from the Ministry of Transport and transport operators is outlined in various sections of the Act. Section 42P specifies the limits of Ministerial control or direction of ITSRR in areas such as accreditations, enforcement action, safety inquiries, reliability monitoring and auditing and the content of any report or recommendation. These are the critical functions undertaken by ITSRR to meet its principal objective. The Minister for Transport has ultimate responsibility for transport safety in NSW and for this reason ITSRR will continue to remain within the transport portfolio. Following the findings and recommendations of the Waterfall Special Commission of Inquiry the Government has introduced legislation that further enhances both ITSRR’s independence and the accountability and responsibility of its CEO.

In relation to ticket prices as at 1 September in each of the years 1995, 1996, 1997, 1998, 1999, 2000, 2001, 2002, 2003, 2004: (1) What was the ticket price of a return train fare from Concord West to Central Station? (2) What was the price of a return train fare from Penrith to Central Station? (3) What was the price of a return train fare from Sutherland to Central Station? (4) What was the price of a return train fare from Parramatta to Central Station? (5) What was the price of a return train fare from Denistone to Central Station?

Answer—

Railcorp advises: (1) to (5) Ticket Price is determined by the time of day the ticket is purchase and whether the purchaser is entitled to a concession.

*4028 COUNTRY PASSENGER RAIL SERVICES—Mr Aplin to Minister for Transport—

Following the Premier’s recent commitment to the retention of the Countrylink XPT service from to Albury will you confirm that passenger services will continue to be offered at Henty and Culcairn stations?

Answer—

RailCorp advises: There are no plans to alter existing CountryLink service levels at Henty and Culcairn.

*4030 RURAL FIRE SERVICE STAFFING—Mr Humpherson to Minister for Police, representing the Minister for Rural Affairs, Minister for Local Government, Minister for Emergency Services and Minister for Lands—

(1) Of the 96 separations from the Rural Fire Service in the past three years how many were due to (a) retirement (b) resignation (c) dismissal? (2) Of those who resigned, how many alternatively faced the possibility or the likelihood of dismissal?

Answer—

(1) Of the 96 separations advised in response to Question 3844, 19 were due to retirement, 76 to resignation and there was one dismissal. (2) Nil.

*4032 WINDSOR ROAD WIDENING—Mr Pringle to Deputy Premier, Treasurer, Minister for State Development, and Minister for Aboriginal Affairs, representing the Minister for Roads, Minister for Economic Reform, Minister for Ports and Minister for the Hunter—

In view of the federally/privately funded M7 Westlink construction being ahead of schedule, will the Minister ensure that the upgrading of Windsor Road is completed at the same time as the M7 Westlink is opened?

Answer—

I’m advised: As announced by the Premier in April 2005, the Westlink M7 Motorway is expected to open four months ahead of the scheduled completion date of August 2006. The widening of Windsor Road is continuing and expected to be completed to McGraths Hill during 2006 as scheduled.

*4034 CLASSROOM TECHNOLOGY SUPPORT—Mr Pringle to Minister for Transport, representing the Minister for Education and Training—

(1) How many of the promised 129 technical support staff for classroom technology have currently been employed? (2) How many have been appointed to schools in the Hawkesbury electorate?

Answer—

(1) The 129 technical support positions are being filled progressively. Recruitment has commenced in all regions. (2) Schools in the Hawkesbury electorate are located in the Department’s Northern Sydney Region and Western Sydney Region. Interviews have been held to fill the five technical support positions located in Western Sydney Region. Offers of appointment will be made, subject to the completion of pre- employment checks. Advertisements have closed and interviews are being scheduled for four technical support positions located in Northern Sydney Region.

*4036 PUBLIC HOSPITAL ROSTERS—Mr Stoner to Minister for Health—

In relation to public hospital rosters for medical practitioners on the Mid North Coast: (1) Are you aware of the grievances of GP’s who support public hospitals by participating on rosters? (2) Are you aware that Accident and Emergency rosters require GPs to block out a large part, if not all of their day, adversely affecting their private practices? (3) Why is there no monetary compensation to rostered GPs for: the working up, admission and organisation of care for accident and emergency patients; the discharging of patients; the dispensing of medications for accident and emergency patients; and attending medical staff council meetings? (4) Why is the rate of remuneration to rostered practitioners for doing ward rounds the same for public holidays as for weekdays? (5) Are you aware that rostered practitioners are concerned that the appointment of nurse practitioners will result in less complex cases being done “in house” while only more complex cases will be directed towards rostered doctors? (6) Given that these issues have the potential to result in fewer practitioners available to work in hospitals on the Mid North Coast, what are your plans to resolve the doctors’ grievances?

Answer—

(1) I understand there are certain issues of concern to some Visiting Medical Officer-General Practitioners in rural areas with regard to participation on public hospital rosters. (2) The level of disruption to a GP’s private practice would depend on the number of patients attending the local hospital Emergency Department requiring immediate treatment. (3) (a) VMO GPs who work in those hospitals covered by the Rural Doctors Settlement Package (generally small rural hospitals) are remunerated for these services in accordance with the rates provided for under the Package.

(b) Discharge of patients usually occurs during a “consultation” visit by the GP, for which Rural Doctors Settlement Package fees would be payable. (4) Dispensing of medication is considered part of the patient “consultation” or “procedure” for which the VMO GP would be paid at Rural Doctors Settlement Package rates. VMO GPs are remunerated for attendance at a range of meetings where their clinical input assists the functioning of the hospital. Remuneration for attendance does not extend to attendance at the Medical Staff Council. The rate of payment is set by the Rural Doctors Settlement Package. The rates payable under the Package have been agreed between the Rural Doctors Association and the Department of Health. (5) Nurse practitioners are likely to support GPs with high caseloads and to reduce demands on their time to provide “out of hours” services. (6) Rates payable under the Rural Doctors Settlement Package are adjusted annually. The Rural Doctors Liaison Committee is available for rural VMO GPs to raise specific remuneration issues with NSW Health. The Rural Doctors Association has requested a review of some items in the Rural Doctors Settlement Package, and the Department has agreed to a review.

*4037 POINT PLOMER ROAD—Mr Stoner to Minister for Infrastructure and Planning, and Minister for Natural Resources—

In relation to Kempsey Shire Council’s proposal to seal Point Plomer Road: (1) What role does your Department have in relation to approving this development in a sensitive coastal area? (2) What role does your Department have in relation to approving the associated Local Environmental Plan? (3) Did the Department of Environment and Conservation provide advice on 23 November 2004 that “the DEC considers the conservation values of the area are sufficiently great to justify a full environmental study and the consequent extension of environmental protection zones where appropriate”? (4) What is your response to this departmental advice?

Answer—

The development application was referred by the Kempsey Shire Council to the Department of Infrastructure, Planning and Natural Resources (DIPNR) requesting concurrence in accordance with clause 7(3) of State Environmental Planning Policy (SEPP) No 26 – Littoral Rainforests, for the reason that work was proposed within the 100 metre buffer zone to designated littoral rainforest. Concurrence was granted. The Department also issued concurrence under clause 20 of the Kempsey Local Environmental Plan as development on land zoned 7(f1) Coastal Lands Protection and 7(f2) Coastal Lands Acquisition was proposed. Concurrence was subject to conditions intended to mitigate against environmental and scenic impact. The Department’s role in the LEP process has been to decide, in accordance with the Environmental Planning and Assessment Act, whether an environmental study was required to support the draft plan. A decision not to require such a study was made on 23 September 2004. Kempsey Council has recently exhibited the draft plan for public comment. Council will now consider submissions received and decide whether any changes are necessary or whether to continue with the draft plan. The draft plan will be forwarded to the Department to provide a report to the Minister. The Minister will then decide whether to make the draft plan. The Department of Environment and Conservation (DEC) did indeed provide the advice referred to. I am informed that DEC’s advice did not change DIPNR’s earlier decision not to require an environmental study. The Environmental Planning and Assessment Act does not mandate such studies for amending local environmental plans such as this. Studies are often required for large-scale urban release areas or LGA-wide planning exercises. However they are not usually required when a situation is likely to occur which would limit environmental impacts when compared to the existing situation.

*4038 ASBESTOS ON SCHOOL SITES—Mrs Skinner to Minister for Transport, representing the Minister for Education and Training—

(1) How many of the State’s schools have asbestos on site? (2) Where is this mostly occurring e.g. in roofs, walls, in playground fill etc? (3) What programs are in place to deal with containment or removal of asbestos? (4) How many schools are involved in asbestos containment projects? (5) How many schools are involved in asbestos removal projects?

Answer—

(1) All NSW Government schools were surveyed and cleared of fibrous asbestos products as part of a whole-of-Government program in the 1980s and early 1990s. I am advised that bonded asbestos, such as fibro sheeting, may be present in schools with facilities built between 1920 and 1980. All existing fibro sheeting is maintained and encapsulated in accordance with WorkCover requirements and national standards. (2) I am advised that most of the recent occurrences of asbestos material in schools have related to the presence of fibro sheet fragments in school grounds. Most of these occurrences have been limited to topsoil contamination relating to the demolition of previous structures. Clearance processes range from surface pickups and application of turf to significant works to remove contaminated fill and seal exposed earth. (3) Asbestos related issues in Department of Education and Training schools are required to be reported to the Department of Commerce by the School Facilities Maintenance Contractor, and are oversighted by the Department of Commerce, in accordance with WorkCover procedures and national standards. (4) to (5) Since 2003 193 schools have been cleared of surface fragments of fibro sheeting and 86 schools have been the subject of fibrous containment and removal works in built assets. Work will continue to be undertaken wherever necessary.

*4039 PACIFIC HIGHWAY AND KARUAH BYPASS UPGRADE—Mr J.H. Turner to Deputy Premier, Treasurer, Minister for State Development, and Minister for Aboriginal Affairs, representing the Minister for Roads, Minister for Economic Reform, Minister for Ports and Minister for the Hunter—

(1) Is it the intention of the Roads and Traffic Authority to provide a direct access for the residents of North Arm Cove, Carrington and from their villages to Karuah without having to access the new upgraded Pacific Highway and Karuah Bypass? (2) If so, when will that access be completed? (3) If it is not the intention to provide the access is this a change in decision? (4) If so, when was the change made? (5) If so, who made the change? (6) If so, why was the change made? (7) If so, how will people from those villages mentioned in (1) above access Karuah? (8) If the access involves entering and leaving the upgrade of the Pacific Highway and Karuah Bypass, will this not present additional dangers to the communities of North Arm Cove, Carrington and Tahlee and the general travelling public? (9) If so, why would this decision be taken?

Answer—

(1) to (7) I am advised: The NSW Government is contributing $1.6 billion over ten years to the $2.2 billion Pacific Highway Upgrade Program. The Government’s priority to improve safety on the Pacific Highway is delivering dual carriageway from Hexham to the Queenland border.

I am advised that approval for the $114 million Karuah to Buladelah section of the Pacific Highway upgrade, which was the subject of a detailed environmental impact assessment, involves significant improvements to a number of intersections that will allow traffic to safety enter, exit and cross the highway. (2) What was the full-time equivalent number of agency nurses employed in NSW public hospitals at 1 December 2004, 1 January 2005, 1 February 2005, 1 March 2005, 1 April 2005 and 1 May 2005? (3) What was the total cost of overtime paid to nurses for each of the months from December 2004 to April 2005? (4) What was the total cost of payments for agency nurses for each of the months from December 2004 to April 2005?

Answer—

(1) The number of Full Time Equivalent (FTE) nursing staff employed in the NSW Public Health System is reported annually in the Department’s Annual Report. Figures for 2003/04 are in Appendix 22 of the 2003/04 Annual Report. These figures are an aggregate of all categories of nurses, for example registered nurses, midwives, nurse managers, clinical nurse consultants, clinical nurse specialists, and educators, enrolled nurses, mothercraft nurses, nurse practitioners, residential care nurses and nurse educators. From December 2004 to April 2005 Area Health Services advised the Department that the following number of nurses and midwives were employed in permanent positions:

^NSW Health information systems capture and record employee details for a whole month, not by a specific day in the month. I am advised that figures for May 2005 are not yet available. (2) The FTE number of agency nurses is recorded on a monthly basis. Area Health Services have advised that from December 2004 to April 2005 the following Agency Nurse FTE had been utilised:

* FTE is the total number of paid hours worked, divided by the award hours (38) I am advised that figures for May 2005 are not yet available. (3) I am advised that NSW Department of Health does not centrally collect figures on overtime paid to nurses for each month. (4) Prior to the amalgamation of the Area Health Services on 1 January 2005, the method of paying for agency nurses differed across NSW Area Health Services. Area Health Services paid agency nurses through their payroll; direct to agencies; or used both methods of payment in situations where a variety of agencies were being used.

Given the various payment methods used over the period, consolidated payment data is not readily available in the format sought. From 1 February 2005, all private nursing agency nurses working in the public health system are required to be paid through Area Health Service payrolls. The introduction of the agency nurse payroll policy will provide consistency and equity in pay for all nurses working in the public health system.

*4043 DENTIST NUMBERS—Mr O'Farrell to Minister for Health—

What was the number of full-time equivalent: dentists; dental technicians; dental prosthetists; and other dental therapists employed by NSW Health and its Area Health Services at 30 June for each of the years from 1995 to 2004?

Answer—

I am advised that the Department of Health employment of dentists and dental auxiliaries has been limited to the Oral Health Branch. The number of Oral Health Branch staff with a dental qualification has varied over the past 10 years but has usually consisted of the Chief Dental Officer, a dentist in the role of Principal Adviser and a Dental Therapist in the role of project officer. None of these staff provide clinical services to patients. Answer—

The contract between Belmont Golf Club and Kalayla Pty Ltd, a subsidiary of Terrace Towers Group, is a private contract. I am advised that there is an Aboriginal land claim on part of the land involved in this contract, Aboriginal Land Claim 6577. I am advised processing of this claim has occurred in due order. All Aboriginal land claims are treated in the same manner and are based on their merits. I am advised the Ministers for Energy and Utilities, Local Government and Roads are not aware of any Memorandums of Understanding existing between either Hunter Water, Lake Macquarie City Council or the RTA and Terrace Tower Group in respect of this matter. The local member, Mr Milton Orkopoulos, Member for Swansea, has been kept appraised of the situation by the Premier’s Department Regional Coordinator, Mr B Chard.

(1) to (3) I am advised that: The Lawson Street community health centre was proposed in response to previous community concerns about the mobile needle and syringe service and evidence provided at the Upper House inquiry into Redfern and Waterloo. Consideration by the City of Sydney Council of the development application for the health centre has been deferred until a community consultation has taken place. This will commence in June 2005. An education campaign concerning the principles of harm minimisation and public health risks will be incorporated in the community consultation.

Answer—

(1) to (3) inclusive: The Department of Health does not budget on the basis of electorate. The initial cash budget for the Greater Southern Area Health Service, which includes Albury, is $447 million, an increase of $37.7 million on last year. For the purpose of allocating budgets to Area Health Services, the Department of Health does not make a direct link between the receipt of gaming machines taxation revenues and funding for specific Area Health Service enhancements. The increase in this revenue to funding for specific Area Health Service enhancements. The increase in this revenue to NSW Health however, is reflected in the 2005-06 Health Budget of $10.0 billion.
