To help inform the discussion, please find attached a copy of a recent Phoenix Center paper entitled A Retrospective Analysis of Vertical Mergers in Multichannel Video Programming Distribution Markets: The Comcast-NBCU Merger. In this paper, Phoenix Center Chief Economist Dr. George S. Ford presents a retrospective analysis of the price effects of the Comcast-NBCU merger. In particular, Dr. Ford conducts an econometric analysis of data on the prices paid for programming by multichannel video programing distributors (“MVPDs”) before and after the transaction and finds no evidence that Comcast’s programming prices rose after the merger. The analysis covers general interest programming, news channels, and national and regional sports networks. Given these results, Dr. Ford concludes that there is either a lack of a net positive effect on incentives to raise programming prices above competitive levels following the vertical merger or that the behavioral remedies placed on the Comcast-NBCU merger were effective. -

The hour-long special will incorporate behind-the-scenes and live performances from some of the most talented students in Northeast Florida starting at 8 p.m. on July 18. The Local Station has teamed with FSCJ to produce a documentary-style special showing how the cast and crew are preparing for the shows at the end of summer. The documentary includes exclusive footage of auditions, callbacks, rehearsals, set development, and a special look at the training behind one of the choreographed fight scenes. WGFL License Corporation, licensee of television broadcast station WGFL, High Springs, Florida (“WGFL”), filed the captioned petition seeking a waiver of the rules that preclude cable operators from deleting the duplicate programming of “significantly viewed” stations under the syndicated exclusivity rules (“exclusivity rules”).1 Specifically, WGFL seeks a waiver of the significantly viewed exception so that it may enforce its exclusivity rights against television broadcast stations WESH, Daytona Beach, Florida, and WTLV and WJXT, both Jacksonville, Florida.2 WESH, WTLV and WJXT are considered to be significantly viewed in Alachua County, Florida, where the community of Gainesville, Florida, served by Cox Cable-Gainesville/Ocala, Inc. is located.3 No opposition to this petition has been received. For the reasons discussed below, we grant WGFL’s waiver request. II. BACKGROUND 2.
