The Coouact will be awarded to the Participating Service Provider whose price quotation is the most advantageous and responsive to MTRCB in accordance with the MTRCB's iudgment and discretion. MTRCB shall oot be bound to accept the lovsest or any price quoation, which, in its iudgment is, in the ultimate analysis, not advantageous to the govemment.

Furthermore, the MTRCB-BAC reserves the right to accept or reiect any price quotatiofl, waive any formality in the RFQ, annul the procurement process, reiect any or all price quotatioos at any time prior to contract awatd, declare the procutement process as failure, without thereby incurring any liability to the affected Participating Service Provider of any person.
