Garden State Preservation Trust Fiscal Year 2013 Annual Report

This is the Annual Report of the Garden State Preservation Trust for Fiscal Year 2013 from July 1, 2012 to June 30, 2013. The core of the public-information mission of the Garden State Preservation Trust has been to document and illustrate achievements in conservation and preservation – with an emphasis on accomplishments at the municipal level. We measure this by acres preserved. But it is also importation to show grants for recreational development, historic site funding and the intact farms that have been protected. The bulk of the Annual Report focuses on all of this information. Of course, the statutory function of this Annual Report concerns GSPT financing, appropriations and agency operations. These are contained in the chapters which follow the Legislative District preservation tables. This is to be construed as the full annual report of the Garden State Preservation Trust for the 2013 Fiscal Year in compliance with P.L. 1999 C.152 section 8C-15. It is also intended to be a comprehensive summary of required financial reporting from FY2000 through FY2013, providing a full accounting of Garden State Preservation Trust activities since July 1999. The principal author is Executive Director Ralph Siegel. A special debt is owed to Bryan Lofberg of the State Agriculture Development Committee for years of patience, thorough assistance and faithful friendship. Recently retired, Bryan is irreplaceable and will be missed.

1. Preservation & Recreation

A second decade of achievement in parks & permanent preservation

The Garden State Preservation Trust (GSPT) component programs have preserved 390,000 acres since the year 2000. This represents a land mass larger than Atlantic County or, in the north, Sussex County. Measured against the state’s geographic size, this is an achievement that is unparalleled by any state conservation program anywhere in the United States. In addition, $438 million has been invested in the development of recreational facilities and in the preservation of historic sites in the same period. Each of New Jersey’s 21 counties has been affected by the conservation, farmland, recreation and historic preservation efforts funded through the GSPT. All residents benefit from the fact that a third of the dry land mass in New Jersey has been permanently preserved. Preserved lands protect quality of life even for those who do not live near the forests, wetlands, parks and farms that have been saved. Every community has a vision of what it intends for itself. Residents understand the character of their neighborhood, of their downtown, of their sports facilities and of their natural areas. Each city, town, suburb and village faces threats to this vision and character. In the majority of New Jersey cities and

towns, conservation and preservation have become important tools to address concerns over threats to the character of their community. It is important to underline the local accomplishments of the last 13 years undertaken by state, county, municipal and nonprofit agencies:

 Park development projects in 195 municipalities.  Land acquisitions in 354 municipalities.  117 communities preserving more than 1,000 acres in parks or farmland.  Counties and towns drawing 737 grants for 427 recreational projects totaling $355 million.

Land preservation, historic preservation and park development programs have reached an unprecedented pace under the Garden State Preservation Trust with the additional funding provided by the 2007 and 2009 bond referendums. Over this period, GSPT’s land preservation programs have been able to preserve open land that would otherwise have been lost to development. ______

The following pages provide single-page "handout" summaries of the historic preservation, recreational development and land conservation achievements in each of the 40 Legislative Districts. These summaries include acreage totals, development project appropriations and grants for historic sites, town by town, for Green Acres, Farmland Preservation and Historic Preservation in each Legislative District under the Garden State Preservation Trust from FY2000 through FY2013. Rural and suburban legislative districts with vast conservation resources have higher totals of land acquisitions. Cities and densely suburbanized areas show a focus on endangered historic sites and on the development of crucial neighborhood parks. 2. Refinancing & Tax Compliance

Responsible management of finances

The Garden State Preservation Trust in April 2012 (which was during the previous fiscal year) issued $281 million in refinancing bonds in order to reduce debt service payments owed on the GSPT’s $1.15 billion of debt. Savings from the refinancing benefitted the GPST in FY2013. During FY2013, GPST was tasked with providing documentation of written compliance with evolving IRS rules and regulations. The GSPT was one of the first agencies in State Government to draft and develop a “Tax Compliance Procedure.” This was done in partnership with the State Agriculture Development Committee and the Office of Green Acres, and was adopted by the full board of the GSPT early in FY2013 on July 31, 2012. The funds from the FY2012 bond issue are being used to replace older, costlier bonds. The lower cost is a savings to the taxpayers who every year pay off the GSPT debt on its land preservation bonds issued from 2003 and 2005. The refinancing reduced debt service payments on GSPT bonds by $8 million during FY2012 and by $18 million in FY2013. Because of this bond issue, evolving IRS regulations required for the first time that the GSPT – and all government issuers of tax-free bonds – file with the IRS a written Tax Compliance Procedure by which New Jersey’s conservation

agencies are able to verify that every dollar of the GSPT’s tax-exempt bond funds is used in a proper and legal manner. In addition, the Tax Compliance Procedure includes provisions to ensure systems are in place at those agencies to monitor their preserved lands in order to detect and prevent violations. None of this was in any way new. It has always been understood and expected that public conservation funds would be used in a responsible and legally correct manner. It has been an obligation these agencies already have to the taxpayers and to the Legislature, and the conservation agencies have demonstrated their understanding of these obligations for decades. The written Tax Compliance Procedure gave the IRS the evidence it required that New Jersey is and has been in compliance. It also provides clear documentation to the taxpayers and to the Legislature that effective, active systems are in place to ensure all funds to preserve parks, forests and farms are being invested properly. Refinancing and tax compliance were only the most recent activity in the GSPT’s history of public financing. It began when voters on Nov. 3, 1998, approved Public Question #1 to amend the New Jersey Constitution to dedicate $98 million a year from the Sales and Use Tax for land preservation, historic preservation and park development. Under the authority of the constitution, these dedicated funds, plus any bonds issued against these funds, in addition to any interest earned on the balances of these funds, could be used for no other purpose. The annual dedication of $98 million began in Fiscal Year 2000 and it continues until 2029. It does not expire before then and cannot be changed without another voter referendum. Phase One of the dedication ran from 1999 to 2009. The objective during Phase One was to use this annual dedication totaling $980 million to fund a 10- year preservation program. This included the issuance of $1 billion in bonds. The record shows the Legislature in 1999 expected the referendum to yield annual funding of about $144 million a year for conservation and recreation projects plus $6 million a year for historic preservation. Phase Two of the dedication runs from 2010 to 2029. During this final 20 years, the constitutionally dedicated funds can only be used for the payment of the debt service on the original bonds. The constitution caps the debt service at $98 million annually. The constitution also stipulated that if less than $98 million was needed in any given year, then only the required sum was to be dedicated. The Trust moved quickly in FY2003 to sell $500 million in bonds in March to provide the cash to cover Appropriations Acts that had already been garden state preservation trust annual report FY2013 You Are Viewing an Archived Report from the New Jersey State Library 57

enacted from FY2000 to FY2002. It also became apparent in 2003 that the dedication of the $98 million per year through 2029 could support more than just $1 billion in bonds. The voters in November 2003 approved Public Question #1 to increase the GSPT’s borrowing capacity by an additional $150 million. These additional bonds could be issued without any increase in the $98 million annual dedication. The Trust issued the remaining $650 million in bonds in FY2005. Because the bonds were structured with favorable rates for institutional investors, the GSPT also was paid a “premium” of $70 million. This increased the total available for conservation to $1.22 billion. The bond proceeds, the bond premium, the annual dedication of $98 million plus the interest earned brought the grand total to more than $2 billion for conservation during the first 10 years of the GSPT program. This was an average of $200 million a year – much better than the $144 million the Legislature and Governor had first envisioned in 1999. When the Garden State Preservation Trust issued its bonds, great effort was made to keep debt-service payments to a minimum during the first 10 years so maximum funds were available for conservation appropriations. A refinancing bond issue of $210 million was structured in FY2006 to reduce debt service payments by $4.5 million over the next three years. This savings meant that $4.5 million became available for more conservation projects. In FY2010, a new funding source came into play with the proceeds of General Obligation bonds authorized by the voters in two ballot referendums totaling $600 million. Combined with prior GSPT funding, these ballot referendums meant the taxpayers had committed $2.7 billion for conservation and historic preservation from FY2000 to FY2013. The Legislature extended the GSPT’s fiscal responsibilities to include the management and monitoring of the funds from the $200 million bond referendum approved in November 2007 and the $400 million bond referendum approved in November 2009. The Green Acres program’s recommendations totaling $123 million were unanimously approved by the GSPT board on Sept. 18, 2013, the Farmland Preservation Program recommendations totaling $79.5 million were unanimously approved by the GSPT on Nov. 21, 2013. The Legislature approved these recommendations totaling $203 million, which were signed into law on Jan. 25. Fiscal Year 2013 closed on June 30 with unexpended balances of $175 million in the three Garden State Preservation Trust funds plus $43 million in the

2007 and 2009 Trust Funds. The conservation and preservation agencies are in the process of expending these funds on hundreds of the projects. In addition, projects and grants from old appropriations are cancelled on a regular basis. A grant cancellation makes these funds available for “reallocation” to a new project or grant. These reallocations require the same approval from the GSPT board as a new appropriation. These reallocations are then incorporated into appropriations bills that again require the approval of the Legislature and the signature of the Governor. The board of the Garden State Preservation Trust in September 2012 adopted Resolution #12-011 to require specific listing of projects and grants that have been cancelled or withdrawn before requesting the reallocation of these funds to new projects. This new policy will enable the GSPT to keep accurate track of the reallocation process allowing for funding of new projects, which will become increasingly important now that the initial appropriations capacities of the conservation and historic preservation trust funds have been exhausted.

3. Office Budget

Limited spending to execute and manage the historic mission

The Garden State Preservation Trust during Fiscal Year 2013 received its traditional legislative appropriation of $476,000 for its operating budget to fund payroll, office facilities, supplies and agency operations. Much of this funding was in place to enable the GSPT to engage professionals to expedite real estate closings in the event that conservation expenditures fall behind. Since no problem in timely expenditure has been experienced, most of this money is not used. Funds were also in place in the event that the Trust engaged in a marketing campaign or revived its program of procuring and distributing “Preserved Farmland” signs. These programs were not necessary in FY2013. As a result, $307,000 of the GSPT’s total budgeted funds – 64 percent – was not used. A sum of $169,086 was expended during FY2013. The Trust’s office funding is an “off-budget” item that comes directly from the GSPT trust funds, not from general State revenue. The $476,000 appropriation for the GSPT is actually drawn in proportionate parts from the larger administrative budgets of the three funded programs: Green Acres program, which totaled $5,228,000 in FY2013; part of the New Jersey Historic Trust, which totaled $630,000; and the Farmland Preservation Program, which totaled $1,921,000. The GSPT office budget is a subset of these totals, and is drawn proportionately from each of them. All of the administrative funds for the conservation and preservation programs are drawn from GSPT trust funds at the end of the fiscal year. of $7.8 million, were approved as part of the State’s FY2013 Appropriations Act enacted by the Legislature and signed by the Governor in June 29, 2012. When the fiscal year ended June 30, 2013, the actual expenditures and payable accounts were totaled and the precise cash sum was drawn from each of the GSPT trust funds. The entire legislative appropriation is not drawn down, only the actual money expended. Any appropriated dollars that were not expended are simply not drawn down. The unused dollars do not revert to the general treasury or become available in a surplus account. Instead, these unused dollars remain in the GSPT’s trust funds for future conservation appropriations.

4. Mission Statement

The voters of New Jersey from 1998 to 2009 committed an unprecedented $2.7 billion to permanent land preservation, development of recreational resources and the preservation of crucial historic sites in every community for years to come. The Garden State Preservation Trust is the independent gatekeeper of those funds. In the realm of conservation and historic preservation, the GSPT board has the specific task of . setting financial strategies . measuring balances . monitoring expenditures . reviewing project recommendations . approving appropriations . advocating policies for the efficient use of funds . training preservation agencies on cost reductions The Garden State Preservation Trust is formed as an independent authority managed by a 9-member board. The five public members are citizen volunteers who are appointed on a bipartisan basis by the Governor, the Senate President and the Assembly Speaker. The four other members are State officials representing major officers of the Governor’s cabinet. New Jersey voters have approved referenda in 1998, 2003, 2007 and 2009 to maintain and expand the funds they want to see invested in land conservation and historic preservation. These taxpayers have stoutly maintained their generosity during times of high taxes, economic turbulence and political upheaval. The Garden State Preservation Trust mission is premised on maintaining the taxpayers’ confidence that the funds they have approved are used in a manner that is . responsible . objective . balanced . efficient The GSPT pursues its mission in close alliance with the Department of Treasury, with State conservation and preservation agencies, and with New Jersey’s diverse universe of nonprofit land trusts, conservation organizations, county and local land preservation agencies. New Jersey has been a national leader in land preservation for a half-century. This effort reached unprecedented levels under the Garden State Preservation Trust. Today, one third of New Jersey’s dry land mass is permanently preserved as open space – a total acreage that exceeds the size of Grand Canyon National Park – and more land is preserved every year at a rate that outstrips the pace of development.
